TOWN OF MAMARONECK
held, April 6th, 1921.
The meeting was called to order by Supervisor Barton
at 10.40 P.M.
PRESENT: Supervisor Byrton
Justice Boyd, Collins, Dudley and Shafer,
Deputy Clerk Sherman,
Counsellor Gamble.
Upon motion, it was voted to dispense with the reading
of minutes not yet approved.
The Building Commissio n consisting of Henry J. G. Har-
lach, Chairman, Harry T. Brewer and Supervisor Geogrge W .Burton,
presented to the Town Board an ordinance to be known as the
"Building Code of 1921 of the Town of Mamaroneck to regulate
the eviction, construction, alteration, repairs and inspaction
of building or structures of any kind within the limits of the
unincorporated portion of the Town of Mamaroneck, and providing
also for the enforcement of same and the penalties prescribed
for any violation of its provisions."
The Committee reported that they had prepared and approved the
ordinance after much care and study, and believed that the sub-
ject matter contained therein protected the rights of the Town
of Mamaroneck in every detail.
After discussion, the following resolution was presented by
Justice Dudley and seconded by Justice Boyd.
RESOLVED, that the Town of Mamaroneck adopt
an ordinance to be known as "The Building
Code of 1921, of the Town of Mamaroneck, to
regulate the erection, construction, alter-
ation, repairs and inspection of buildings
or structures of any kind within the limits
of the unincorporated portion of the Town
of Mamaroneck, and providing also for the
enforcemant of same and the penalties pre-
scribed for any violation of its provisions,
said ordinance being in the following form
to read as follows.

and be it
FURTHER RESOLVED, that the Supervisor be,
and he hereby is authorized, directed, emp-
owered to have the said ordinance published
in a newspaper published in the Town of Mam-
aroneck and posted in at least three public
places in the said Town of Mamaroneck; and
be it
FURTHER RESOLVED, that this ordinance shall
take effect ten days after the date of its
publication and posting, in the manner pre-
scribed in Section 142A of the Town Law of
the State of New York and the certificate
of the Town Clerk shall be prima facie evi-
dence of the adoption and publication of
the aforeaid ordinance.
The question being taken upon the foregoing resilution
same was dcolared adopted by the following vote.
AYES: Messrs; Burton, Boyd, Collins, Dudley, Shafer and Sherman.
NAYS: None.
Justice Shafer presented a communication from Mr. Geo
P. Forbes stating that the rent of his office commencing May 1st,
1921, will be increased to $50.00 per month.
Upon the recommendation of Justice Shafer it was
VOTED, that the increase in rent of
Justice Shafer's offica be granted
and it was
FURTHER RESOLVED, that Justice Shafer
be authorized and emowered to procure
a lease for said rental, terminating
December 31st, 1921.
The question being taken upon the foregoing resolution,
same was upon ROLL CALL adopted.
A communication from John Ryan, resigning as Constable
of the Town of Mamaroneck, was received, road, ordered placed on
file and it was
VOTED, that the resignation of John Ryan
be and the same hereby is accepted as of
March 20th, 1921. Carried.
The following resolution was offered by Justice Boyd,
and seconded by Justice Collins:
WHEREAS, it has been brought to the
attention of this Board that the prop-
erty of Mrs. Margaret C. Borden in Sec-
tion 2 Block 1 of the Town of Mamaroneck
heretofore assessed for School taxes
for the year 1920 in School District 1
and the tax amounting to $82.66 paid
on September 20th, 1920, and
WHEREAS, if said property had been prop-
erly assessed for School taxes for the
year 1920 in School District No. 2, the
tax thereon would have been $28.40
THEREFORE BE IT RESOLVED, that the Sup-
ervisor be and he hereby is authorized
and empowered to take the necessary ac-
tion to correct the assessment for
school taxes for the year 1920 on the
property of Mrs. Margaret C . Borden in
Section 2 Block 1 of the Town of Mamaro-
neck from School District No.1 to School
District No. 2 where said property should
be properly assessed, and it is
FUTHER RESOLVED, that the Supervisor be
and he hereby is authorized and empower-
ed to refund to Mrs. Margaret C. Borden or
her proper representative the sum of
$54.26 being the difference in the amount
of school taxes that would have been
payable if said property had been prop-
erIy assessed in in School District No. 2
The question being taken upon the foregoing resolution,
same was UPON ROLL CALL, unanimously carried
The following resolution was offered by Justice Boyd
and seconded by Justice Dudley.
RESOLVED, that the Receiver of Taxes be
and he hereby is authorized and direct-
ed to notify the County Treasurer that
there is nothing appearing on record in
his office against lot 4 and part of lot
3 on map of Andrew Coles owner, and that
he be authorized and empowered to direct
tha cancellation of certificate.
Ths question being taken upon the foregoing resolution,
same was upon ROLL CALL , unanimously carried.
