Pursuant to Section 62 of the Town Law, I hereby call a Special Meeting of the Town Board, to be held in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, at 8:15 P.M. , Wednesday, July 16th, 1975, for the purpose of calling public hearings in relation to certain proposed street lighting improvements in and for street lighting district No. 1 of the Town of Mamaroneck, and in relation to the reconstruction of certain existing sanitary sewer laterals in and for sewer district No. 1 of the Town of Mamaroneck and also considering such other business as may come before the Board. ". 64f> 'l ir- ,rounci men) III Dated: July the 16th 1 9 7 5 99 7-16-75 MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD JULY 16, 1975 IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK, AT 8:15 P.M. CALL TO ORDER The Supervisor called the meeting to order at 8:15 P.M. in accordance with the Notice of Meeting and Waiver thereof as herewith presented and ordered received and filed as part of the record of this meeting. Set Date for Public Hearings : a) Sewer Improvements Following the explanation of the Engineer's memorandum of July 11, 1975 and pursuant to letter addressed to Carmine A. DeLuca, Comp- troller, by Sykes, Galloway and Dikeman under date of July 14,1975, herewith presented and ordered received and filed, the following resolution was offered by Deputy Supervisor Vandernoot, who moved its adoption, seconded by Councilman White, to-wit: RESOLUTION DATED JULY 16, 1975 A RESOLUTION CALLING A PUBLIC HEARING IN RELATION TO THE RECONSTRUCTION OF CERTAIN EXISTING SANITARY SEWER LATERALS IN AND FOR SEWER DISTRICT NO. 1 OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK. WHEREAS, the Town Engineer, by a Report dated July 11, 1975, has recommended the reconstruction of sanitary sewer laterals at various locations in and for Sewer District No. 1 of the Town of Mamaroneck, Westchester County, New York, as hereinafter more fully described; Ill and WHEREAS, the estimated cost of the aforesaid improve- . ments is $210,000; -1- 100 7-16-75 WHEREAS, it is now desired to call a public hearing on said proposed improvements in accordance with the pro- visions of Chapter 630 of the Laws of 1939, as amended by Chapter 710 of the Laws of 1943; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York, as follows: Section 1. A meeting of the Town Board of the Town of Mamaroneck, Westchester County, New York, will be held at the Weaver Street Firehouse, Weaver Street, in said Town, at 8:15 o'clock P.M., Eastern Daylight Saving Time, on the 6th day of August, 1975, for the purpose of considering the aforesaid improvements, at which time and place said Town Board will hear all persons interested in the subject matter thereof. Section 2. The Town Clerk is hereby authorized and directed to cause a notice of said public hearing to be published once in The Daily Times, the official newspaper, and posted in the manner provided by law. Section 3. This resolution shall take effect immediately. The question of the adoption of the foregoing resolution was duly put to a vote on roll call, which resulted as follows : Supervisor Helwig VOTING Aye Deputy Supervisor Vandernoot VOTING Aye Councilman Bloom VOTING Aye Councilman White VOTING Aye Councilman McMillan VOTING Aye The resolution was thereupon declared duly adopted. b) Sodium Vapor Lights Pursuant to letter addressed to Carmine A. DeLuca, Comptroller, by Sykes, Galloway and Dikeman under date of July 11, 1975, here- with presented and ordered received and filed, the following resolution was offered by Deputy Supervisor Vandernoot, who moved its adoption, seconded by Councilman Bloom, to-wit: RESOLUTION DATED JULY 16, 1975 A RESOLUTION CALLING A PUBLIC HEARING IN RELATION TO CERTAIN PROPOSED STREET LIGHTING IMPROVEMENTS IN AND FOR STREET LIGHTING DISTRICT NO. 1 OF THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK. -2- L 101 7-16-75 WHEREAS, the Town Engineer by a Report dated April 28, 1975 has recommended an improvement of the street lighting facilities of Street Lighting District No. 1 of the Town of Mamaroneck, Westchester County, New York, consisting of the conversion of 996 existing street lighting fixtures and bulbs to sodium vapor fixtures an d bulbs; III and WHEREAS, the maximum amount proposed to be expended therefor, including installation and other incidental expenses, is $150,000; and WHEREAS, it is now desired to call a public hearing in accordance with the provisions of Section 202-b of the Town Law to consider the aforesaid improvements; NOW, THEREFORE, BE IT RESOLVED, by the Town Board of the Town of Mamaroneck, Westchester County, New York as follows : Section 1. A meeting of the Town Board of the Town of Mamaroneck, Westchester County, New York, will be held at the Weaver Street Firehouse, Weaver Street, in said Town, at 8:15 o'clock P.M., Eastern Daylight Saving Time, on the 6th day of August, 1975, for the purpose of con- sidering the aforesaid improvements, at which time and place said Town Board will hear all persons interested III in the subject matter thereof. Resolution for Publication of Notice of Public Hearing set by County Board of Legislators Upon the Supervisor's presentation of two letters to the Town Clerk - one by Elmer J. Maloney, Clerk of the County Board of Legislators under date of July 14, 1975 and the other by Robert Funicello, Village - -3- 102 7-16-75 Attorney, Village of Mamaroneck under date of July 15, 1975, both herewith ordered received and filed as part of the record of this meeting, on motion by Councilman Bloom, seconded by Councilman McMillan, it was unanimously RESOLVED, that in accordance with Section 73, Sub 2 of the Town Law, the Town Clerk be and she hereby is author- "' and directed to cause a Notice of Public Hearing to be published in the official newspaper of the Town of Mamaroneck, "The Daily Times", once a week for four successive weeks preceding the hearing and shall also cause a copy to be posted in the manner provided by law. and be it further RESOLVED, that pursuant to the request of the Village of Mamaroneck, the cost of aforesaid publication, normally a town charge, be paid by the said Village of Mamaroneck. Subsequent to the Board's action, a discussion followed in which the Supervisor pointed out that Thomas Keane of the County Board of Legislators had informed her that the County Board would not consider the merits of the proposed 'division:., of the Town, but only whether the proposal should be submitted to a referendum in order to allow all the voters of the Town to vote upon this proposition. Mrs. Helwig said that since things were moving along quickly, she felt there was a need for citizens of the Town to work on a fact finding committee to determine the effects of the proposed divi- sion on the Town. Councilman White said the group should be appointed as quickly as possible and felt the committee would III have a difficult task because a minimum of time has been given to gather facts for presentation at the hearing and in offering guidance to the electorate. Whereupon, Councilman Bloom echoed his remarks made at the last meeting, and on his motion, which was seconded by Councilman White, it was unanimously RESOLVED, that this Board hereby authorizes Super- visor Christine K. Helwig to appoint members to serve on a fact finding committee to study the impact of the proposed division of the Town of Mamaroneck. 3. Provisional Appointment of Mrs. Diane Renta as Inter- mediate Account Clerk and Stenographer in the Town Clerk's Office. Pursuant to memorandum addressed to the Board by the Town Clerk under date of July 16, 1975, herewith presented and ordered re- ceived and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the pro- visional appointment of Mrs. Diane B. Renta as an Intermediate Account Clerk and Stenographer in the Town Clerk's Office, effective as of August 4, 1975 and to be compensated at the rate of $8540.00 per annum. -4- I_ 103 7-16-75 4. Accept Resignation of Mr. Herbert Bijur from C.A.C. A letter addressed to Thomas R. Amlicke by Herbert Bijur of 502 Orienta Avenue, Mamaroneck, tendering his resignation as a member of the Conservation Advisory Commission because of mov- ing away from the community was herewith presented and ordered received and filed. The Supervisor and members of the Board expressed their regret and paid tribute to Mr. Bijur for his contributions to the Commission especially the furtherance of good working relations between the C.A.C. and Village of Mamaroneck, and on motion by Councilman Bloom, seconded by Councilman McMillan, it was unani- mously RESOLVED, that this Board with regret accepts the resignation of Mr. Herbert Bijur from the Town of Mamaroneck Conservation Advisory Commission, and expresses to him its thanks and appreciation for the contribution he rendered to the community dur- ing his association with this Commission; and be it further RESOLVED, that a letter be directed to Mr. Bijur. 5. Salary Authorization - Recreation Pursuant to memorandum addressed to the Board by the Superin- tendent of Recreation under date of July 10, 1975, herewith presented and ordered received and filed, on motion by Councilman White and seconded by Deputy Supervisor Vandernoot, it was unanimously RESOLVED, that this Board hereby authorizes that John Quigley, Lifeguard at the Hommocks Pool, be compensated at the rate of $2.25 per hour, effec- tive June 23, 1975. 6. Request for Block Party - Mrs. Frank Meeske (Locust Terrace, Parkland Avenue, and Edgewater Place) A letter addressed to the Town Board by Mrs. Frank Meeske of 3 Locust Terrace, Town, requesting permission to hold a block party on Parkland Avenue, Locust Terrace and Edgewater Place on Saturday, August 9, 1975, together with the Chief of Police, V.A.C. and Fire Chief's reports approving said request, were herewith presented and ordered received and filed. Thereupon, on motion by Councilman White, seconded by Council- man Bloom, it was unanimously RESOLVED, that the request of Mrs. Frank Meeske of 3 Locust Terrace, Town, to hold a block party on Saturday, August 9, 1975 from 2:00 P.M. to 10:00 P.M. on Parkland Avenue, Locust Terrace and Edgewater Place be and it hereby is approved; -5- 104 7-16-75 and be it further RESOLVED, that Mrs. Meeske be notified accordingly. 7. Report of Town Attorney re: a) Con Edison The Town Attorney reported that the Town had received the Special Franchise Assessment for Con Edison properties within the Town and noted that it was more than the preceeding year but still less than the value that had been placed on this property formerly. Thereupon, to preserve the Town's position before the Courts, Mr. Johnston requested an authorization to file an additional com- plaint to this assessment asking that the Town's assessment figure be returned to what had been assigned in previous years and on motion by Councilman McMillan, which was seconded, by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the Town Attorney to prepare and the Supervisor to sign on behalf of the Town, the aforementioned complaint and be it further RESOLVED, that this Board hereby authorizes James J. Johnston, Town Attorney to be present at the hearing in Albany. b) Guadagnola Pursuant to the Town Attorney's request and on motion by Councilman Bloom, seconded by Councilman McMillan, it was unanimously RESOLVED, that the Town Attorney be and he hereby is authorized to interpose an answer on behalf of the Town in the appeal taken by Frank Guadagnola on a recent decision by the Zoning Board of Appeals denying a use-variance. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 8:45 P.M. , to reconvene on August 6, 1975. T n Clerk
