HomeMy WebLinkAbout1975_03_05 Town Board Regular Minutes S3 3-5-75 MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD MARCH 5th, 1975 IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor Helwig Deputy Supervisor Vandernoot Councilman Bloom Councilman White Councilman McMillan Absent: None Also Present: Mrs. Miller - Town Clerk Mr. DeLuca - Comptroller Mr. Doyle - Town Assessor Mr. Elfreich - Town Engineer Mr. Aitchison - Superintendent of Highways Mr. Johnston - Town Attorney APPROVAL OF MINUTES The minutes of the regular meetings of November 6th and 20th, 1974 were presented and on motion duly made and seconded, approved as submitted. OLD BUSINESS 1. Laurel Avenue - Certificate of Necessity - Denial The Clerk presented a letter addressed to Mr. Charles Elfreich, Town Engineer, under date of February 25th, 1975 by F. E. Trendell, Regional Highway Maintenance Engineer of the New York State Depart- ment of Transportation wherein reference was made to previous corre- spondence citing reasons for denial of the Certificate of Necessity for Laurel Avenue. The Supervisor indicated, according to Councilman Bloom's sugges- tion, that we advise the attorney for Mr. Carducci that, should he proceed with a reversal attempt, the Town Board would lend its support in this regard. NEW BUSINESS 1. Salary Authorization - Conservation Pursuant to memorandum of March 3rd, 1975, presented and ordered received and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman White, it was unanimously RESOLVED, that this Board hereby authorizes that Michael W. Dolen, Park Attendant, be compensated at the rate of $3.25 per hour, effective March 3rd, 1975. - 1 - S4 3-5-75 2., Engineer's Request for Authorization to Release 10% Retained Percentage for Contract No. 74-10 - Electrical Maintenance Bond - Air Structure Pursuant to memorandum herewith presented and ordered received and filed for the record, on motion by Councilman White, sec- onded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the acceptance of a Maintenance Bond No. 070095 in the amount of $4,084.00 in lieu of the 10% retained percentage to G. C. Monaco Electric, Inc. for electrical in- stallation - Air Structure (Mamaroneck Ice Skating Rink) as approved by the Town Attorney. 3. Engineer's Request - Authorization for Bids for (1) Pickup Truck, (2) Dump Trucks and (1) Pass- enger Car for the Highway Department Pursuant to memorandum addressed to the Board by the Town Engineer under date of February 28th, 1975 herewith presented and ordered received and filed, on motion by Deputy Supervisor Vandernoot, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes publication in the official newspaper of the Town of Mamaroneck, The Daily Times, of a Notice for Bids for One (1) Pickup Truck, Two (2) Dump Trucks and One (1) Passenger Car for the Highway Department, said bids to be returnable on March 31st, 1975 and reported to the Town Board on April 2, 1975. COMMUNICATIONS 1. Letter - March of Dimes Walkathon Pursuant to the recommendation of the Police Chief, on motion by Deputy Supervisor Vandernoot, seconded by Councilman McMillan, it was unanimously RESOLVED, that this Board hereby grants the request of the National Foundation- March of Dimes to conduct a March of Dimes Walkathon on April 13th, 1975; and be it further RESOLVED, that Mr. Lawrence Lehmann, Field Representative of the aforesaid organization be so notified. 2. Letter - Larchmont Rotary Annual Antiques Flea Market - July 20th, 1975 Pursuant to a request of the Rotary Club of Larchmont, dated February 8th, 1975 herewith presented ordered received and filed, it was unanimously resolved that the request be granted with Mr. John B. Forrest so notified and the Police Chief and Recreation Superintendent advised accordingly. - 2 - 35 3-5-75 3. County Warrant & Tax Rates The Supervisor presented the County Warrant for taxes and assessments levied and assessed by the Westchester County Board of Legislators against the 1975 taxable property and a comparison of these rates with the 1974 rates, which was ordered received and filed. 4. Memo - Perry B. Duryea Minority Leader, The Assembly - State of New York The Supervisor briefly reviewed the memorandum addressed to New York State Local government Officials under date of February 25, 1975 from Perry B. Duryea, Minority Leader of the State of New York Assembly, concerning the staff analysis of the impact on local governments and school districts of the 1975-76 Executive Budget request submitted by Governor Carey on February 1st, 1975, which was ordered received and filed. REPORTS The Town Clerk-- The Town Clerk presented the following reports which were herewith ordered received and filed. Report of the Town Clerk for the month of February, 1975. Report of the Building & Plumbin g Inspector ector for the month of February, 1975. For the record the Clerk reported that: the Annual Report of the Supervisor for the Fiscal Year Ending 12-31-74 and the Annual Report of the Fire District Treasurer for the Fiscal Year Ending 12-31-74 had been filed with the State Department of Audit and Control and herewith both were ordered received and filed in the Office of the Town Clerk. The Town Attorney-- 1. Report - Con Edison vs State Board of Equalization Upon presentation of a progress report (memorandum) under date of February 24th, 1975, herewith ordered received and filed, the Attorney stated that as a result of the meeting of 2-21-75 a committee of three municipal attorneys has been authorized to select a lawyer with expertise in the field of special fran- chise chise assessments to represent and fight the litigation brought by Con Edison affecting 18 Towns and 6 Cities in Westchester County. Mr. Johnston explained also, that while the municipalities have actively sought the support of the County in this regard, the County has indicated that while they would lend their name in the present litigation, they could not, at this point in time, become active participants in the suits, since regardless of the assessment, they would still collect the full amount from the Towns and Cities. - 3 - 36 3-5-75 The Supervisor stated, however, that since Con Edison has filed for additional reductions, and inasmuch as the county has the responsibility to oversee the general welfare of its residents, that the Town request, by resolution, assistance of the County Executive and the chairman of the County Board of Legislators. Whereupon, on motion by Deputy Supervisor Vandernoot and seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes that a letter be forwarded to County Executive Alfred Del Bello and the Chairman of the Board of Legislators, Thomas Keane, Jr. soliciting the assistance of the County re the litigation of Con Edison vs. the State Board of Equalization. ADJOURNMENT There being no further business to come before the Board, the Supervisor noted that George E. Mills, Jr. Councilman of the Town of Mamaroneck from January 1946 to December 1949 and a Volunteer for more than 40 years in the Town of Mamaro- neck Fire Department had passed away suddenly on February 24, 1975. It was thereupon moved, seconded and unanimously resolved that this meeting stand adjourned in respect to the memory of GEORGE E. MILLS, JR. and in recognition of his long and dedicated service to the Town. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board Meeting. 1. Claims Upon presentation for payment by Commissioner Bloom and on his motion, seconded by Commissioner McMillan, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comp- troller's Office: AAA Emergency Supply Co. , Inc. $ 48.90 Dri-Chem Extinguisher Co. 139.30 Excelsior Garage & Machine Works, Inc. 859.97 Exterminating Services Co. 7.88 N. Report Commissioner Bloom presented the following report which was ordered received and filed for the record. Fire Report for the month of February, 1975. III3. Appointment to Lieutenant - _ Fireman Kenneth Valle Pursuant to a letter dated February 3rd, 1975 addressed to the Board of Fire Commissioners by Carlo Boniello, Secretary - Fire Council, herewith presented and ordered received and filed, on motion by Commissioner Bloom, seconded by Commissioner Vandernoot, it was unanimously RESOLVED, that this Commission hereby authorizes the appointment of Fireman Kenneth Valle, to Lieutenant of the Town of Mamaroneck Fire Department. ADJOURNMENT There being no further business to come before the Fire Commission, on motion duly made and seconded, it was declared adjourned at 8:55 p.m. , to reconvene on March 19th, 1975.
