MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD FEBRUARY 19th, 1975 IN THE AUDITORIUM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 p.m.

OLD BUSINESS
1. Report of Planning Board - Application for Special
Permit - Frank Micelli, Block 131 - Parcels 36 & 40
The Supervisor presented a memorandum addressed to the Town
Board from Fred L. Maggini, Chairman of the Planning Board
under date of February 18th, 1975 relative to the request for
a special permit by Frank Micelli, which had been referred to
the Planning Board at the Town Board Meeting of February 5th
for its study and recommendation herewith ordered received
and filed.
Since the Planning Board at its regular meeting on February 13th,
1975 unanimously recommended that this request be approved, with
certain conditions enumerated in the memo, Mrs. Helwig indicated
that although a report from the Conservation Commission had not
yet been received, it was in order for the Board to set a date
for a Public Hearing on March 19th, 1975 relative to the afore-
mentioned.
On motion by Councilman Bloom, seconded by Councilman White,
it was unanimously
RESOLVED, that this Board hereby fixes
the date of March 19th, 1975, the second
regular meeting in March, for holding a
Public Hearing on the request for a Special
Permit by Frank Micelli to construct a
1-story building for the maintenance and
storage of buses on Block 131, parcels
36 & 40;
and be it further
RESOLVED, that the Town Clerk be and she
hereby is authorized to publish in the
official newspaper of the Town of Mamaroneck,
The Daily Times, the Notice for said hearing
as required by law.

NEW BUSINESS
1. Reappointment: Zoning Board of Appeals
Laurence G. Bodkin, Jr.
Councilman White called to the Board's attention the expiration
of Mr. Bodkin's term of office on the Zoning Board of Appeals
and with great pleasure recommended his reappointment.
III He commended Mr. Bodkin's contributions to the community as a
member of this Board and expressed his pleasure that he was
willing to continue serving in this post, and thereupon on
his motion, seconded by Councilman Bloom, it was unanimously
RESOLVED, that this Board hereby reappoints
Laurence G. Bodkin, Jr. of 9 Homer Avenue,
Larchmont, New York, a member of the Zoning
Board of Appeals, to serve for a five-year
term of office, effective immediately and
terminating on February 19th, 1980;
and be it further
RESOLVED, that Mr. Bodkin be notified of
his reappointment with an expression of the
Board's appreciation of his willingness to
continue serving in this important capacity.
2. Reappointment: Park Board
Henry S. Sayers
The Supervisor called to attention the expiration of the term
ill of office of Mr. Henry S. Sayers of 12 Mohegan Road, Larchmont,
as a member of the Board of Park Commissioners and placed his
name in nomination for reappointment.
Councilman White, after stating that Mr. Sayers had served on
this Commission with great distinction, professionalism and
devotion, moved his reappointment with great pleasure. His
motion was seconded by Councilman Bloom, whereupon it was
unanimously
RESOLVED, that Henry S. Sayers of 12
Mohegan Road, Larchmont be and he hereby
is reappointed a member of the Board of
Park Commissioners of the Town of Mamaroneck,
to serve for a term of 5-years, effective
immediately and terminating on February 19th,
1980;
and be it further
RESOLVED, that Mr. Sayers be notified with
an expression of the Board's thanks and
appreciation for his outstanding service
to the Town and its gratification that he
was willing to continue to serve.
3. Salary Authorizations - Recreation
Pursuant to memoranda addressed to the Board by the Superintendent
of Recreation under dates of February 11th and 14th, 1975 here-
with presented and ordered received and filed, on motion by Council-
man White, seconded by Councilman Bloom, it was unanimously,

RESOLVED, that this Board hereby authorizes
that Hilary Wise, Recreation Assistant for
the Basketball Program, be compensated at
the rate of $6.00 per session effective
January 4th, 1975 and that Harold K. Mero,
Jr. , Recreation Assistant at the Ice Rink,
be compensated at the rate of $4.50 per
hour, effective as of January 27th, 1975.
4. Resolution Authorizing 25-Year Retirement Plan
In the absence of Deputy Supervisor Vandernoot, and at the
Supervisor's request, Mr. DeLuca, Comptroller, explained the
25-year retirement agreement made with the members of the
C.S.E.A. and other non-union employees of the Town of Mamar-
oneck emphasizing that this contract settlement was negotiated
within the terms of the 1975 budget.
Whereupon on a motion by Councilman Bloom, seconded by Council-
man White, the following resolution was offered:
"BE IT RESOLVED, that the Town Board of the
Town of Mamaroneck does hereby elect to pro-
vide the benefits of Section 75-g of the Re-
tirement and Social Security Law as presently
or hereafter amended entitled, "Career Retire-
ment Plan for Employees of Participating Employers";
and
BE IT FURTHER RESOLVED, that this election shall
become effective with the payroll period begin-
ning on the 1st day of March, 1975."
Upon roll call, the vote on the foregoing resolution was as
follows and the resolution thereby adopted by a majority vote
of 4 Ayes with one absence:

5. Resolution Authorizing Permits for Work
Within the County Road Area
Pursuant to communication of the County Department of Public
Works under date of January 21st, 1975 herewith presented and
ordered received and filed, on motion by Councilman Bloom,
seconded by Councilman White, the following resolution was
adopted unanimously:
WHEREAS, pursuant to the provisions of Chapter 605
of the Laws of 1941, revised as of June 5, 1961,
the Commissioner of Public Works of Westchester
County with the approval of the Board of Super-
"' and the County Executive of Westchester,
has prescribed rules, regulations, safeguards,
specifications and conditions for the protection,
reconstruction, maintenance or restoration of any
County Road or portion thereof, and for the pro-
tection and safety of the travelling public thereon
during any operations of reconstruction, maintenance
or restoration of such County Road or portion thereof;

and
WHEREAS, the said rules and regulations require
any person, corporation, improvement district, or
municipality doing any work upon any County Road
to obtain a written permit from the Commissioner
of Public Works and to deposit a certified check
made payable to the order of the County of West-
chester in an amount computed by the extent of
the proposed work;
and
WHEREAS, the said rules and regulations provide that
any city, village, town public improvement district,
or other municipality may, in lieu of making the
said mentioned deposit, file with the Commissioner
of Public Works a certified copy of a resolution
duly adopted by the Governing Board of such munic-
pality guaranteeing faithful performance by the
said municipality of all terms, covenants and con-
ditions as set forth in the permit, which resolution
shall be effective for permits issued during the
remainder of the calendar year after adoption;
and
WHEREAS, the Town of Mamaroneck, from time to
time, is required to do work within the County
Road area for which a written permit from the
Commissioner of Public Works of the County of
Westchester is required, and for which a certi-
fied check deposit is required;
NOW THEREFORE BE IT,
RESOLVED, that the Town of Mamaroneck does here-
by guarantee faithful performance of all the
terms, agreements, covenants and conditions of
each and every written permit as referred to
herein issued by the Commissioner of Public
Works of the County of Westchester and that
this guarantee of faithful performance shall
be applicable to all such written permits
issued during the present calendar year -
January 1, 1975 to December 31, 1975.
COMMUNICATIONS
1. Letter - Chauncey E. Smith,
Detective Sergeant Retired
The Clerk read with pleasure a letter received from Chauncey
E. Smith, Detective Sergeant Retired, addressed to the Super-
visor under date of February 5th, 1975 relating his thanks and
appreciation to the Town for its generosity in increasing the
current Police Pension this year as well as his thoughts about
the many wonderful years he was associated with the Town of
Mamaroneck and which was ordered received and filed.

Mrs. Helwig presented a letter dated February 17th, 1975 addressed
to her by John F. Gilfoy, retired, expressing his sincere thanks
to the Town Board for the recent increase in the Police Pension
benefits, which was thereupon ordered received and filed.
For the record, the Supervisor also noted a recent telephone
conversation with John Caputo, retired policeman, expressing
his thanks for the aforementioned increase in the Police Pen-
s ion benefits.
2. Letter Westchester Shore Humane Society, Inc.
The Town Clerk read a letter addressed to the Supervisor under
date of February 6th, 1975 by Halford J. Pope, Vice President
of the Westchester Shore Humane Society, Inc. relative to obtain-
ing legislation for the increase of dog license fees. Some dis-
cussion followed during which the Town Clerk who has direct re-
sponsibility for licensing all dogs in the Unincorporated Area
commented in favor of the proposed increase for dog licenses
also urging that the present allotment of $.25 per license
remaining with the local issuing agent, as mandated by the
New York State Agriculture and Markets Law, be changed so as
to effect a major increase.
Whereupon on motion by Councilman Bloom, seconded by Councilman
White, it was unanimously directed that this recommendation be
forwarded to our State Representatives.
REPORTS
1. The Town Clerk
The Town Clerk presented the following report which was here-
with ordered received and filed:
Town Clerk's Report for the month
of January, 1975.
2. Recycling Programs
The Supervisor reviewed a report on programs for recycling glass
and newspaper during 1974 prepared by Mr. Kellogg, Sanitation
Superintendent of the Joint Garbage Disposal Commission, which
was herewith ordered received and filed. This paper noted that
costs in general for both glass and newspaper collection were
roughly at a "stand-off" with sales.
A.question was asked about the status of aluminum recycling to
which Councilman Bloom replied that as of this date no action
had been taken by the Board. He acknowledged, however, that
when it was feasible, the proper steps would be taken regard-
ing this matter.

1. Approval of Narcotic Guidance Council
Part-Time Appointments (2)
Following Councilman McMillan's presentation of the qualifications
and background of Mario Tonti and Dr. Fern Schwartz for appointment
to the Narcotics Guidance Council as Social Worker (part-time)

and Psychologist (part-time) respectively and on his motion
which was seconded by Councilman Bloom, it was unanimously
RESOLVED, that the Town Board of the
Town of Mamaroneck hereby approves the
appointments of Mario Tonti as Social
Worker (part-time) and Dr. Fern Schwartz
as Psychologist (part-time) to the Nar-
cotics Guidance Council provided similar
resolutions are adopted by the Villages
of Larchmont and Mamaroneck.
ADJOURNMENT
There being no further business to come before the meeting,
on motion duly made and seconded, it was declared adjourned
at 8:45 p.m. to reconvene on March 5th, 1975.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board Meeting.

Upon presentation for payment by Commissioner Bloom and on
his motion, seconded by Councilman McMillan, it was unanimously
RESOLVED, that this Commission hereby
authorizes payment of the following Fire
Department claims as approved by the Fire
Chief and audited by the Comptroller's

Retirement of Louis Testa
At this time the Supervisor recognized Mr. Louis Testa who,
after 43 years of exemplary service to this community as a
member and Lieutenant of the Town of Mamaroneck Fire Depart-
ment, would be retiring as of March 1st. Mrs. Helwig, as well
as the other members of the Board along with Chief Acocella
complimented Lt. Testa for his long, dedicated and outstanding
service to the community as well as his conscientious devotion
while during these years working with some 22 Fire Chiefs.

On behalf of the Board, the Supervisor then expressed the
Town of Mamaroneck's gratitude and thanks to Mr. Testa and
the hope that this would not be the end of an association
adding "this is not good bye, but thank you".
ADJOURNMENT
There being no further business to come before the meeting on
motion duly made and seconded, it was declared adjourned at
8:49 p.m. to reconvene on March 5th, 1975.
PRESENTATION OF POLICE REPORT FOR 1974
Chief Robert M. Barasch presented to the members of the Town
Board and all present the 1974 Annual Report of the Town of
Mamaroneck Police Department. He expressed appreciation to
the Town Board and the Police Commissioners for their unfail-
ing support and assistance at all times and to the members
of the Department for their outstanding work in the field
of Law Enforcement.
A clear and most effectual video-taped presentation was
prepared by Police personnel with the help of Mamaroneck
High School students was presented with this evening's
Report which illustrated the daily activities of the Town's
39-man Police Force and included a tour of the Headquarters
building.
Following the presentation, there was general discussion of
the Report and Chief Barasch answered various questions asked
by members of the Board and residents of the Town.
