PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR SERVICE: Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet and take such actions authorized by the law without permitting in public in-person access to meetings and authorizing such meetings to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed; PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION Additionally Present: Lindsey Luft Assistant to the Town Administrator On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Worksession was unanimously opened at 5:00 p.m. EXECUTIVE SESSION On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Board unanimously agreed to enter into an Executive Session to discuss appointments to Boards and Commissions, and the salary and employment history of a particular employee. On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the Board unanimously agreed to resume the Worksession. Town Clerk Memo – Parking items The Town Clerk presented a resolution to legislate the fifteen minute parking on Myrtle Blvd. This item was previously reviewed by the Traffic Committee and the Town Board. The adoption of the resolution was added to the regular agenda for this evening. The discussion of adding scooter parking in Lot A was deferred. Local Law – Property Maintenance The Town Board reviewed and discussed the draft legislation. The Town Board asked for a redraft, which removed the jail time penalty and clarification of where the violation notices are being mailed. Mr. Maker will have another draft for review at the next worksession on March 17. Communicable Disease Response Plan The Town Board reviewed the draft of the Communicable Disease Response Plan prepared by Lindsey Luft. Ms. Luft noted that the Town is awaiting comments from the unions before final approval. 1 March 3, 2021 Review of Town Local Law – Small Cell Deployments/5G At the request of the Town Board, Mr. Altieri presented the Board with a proposal from Menkes Associates, to review the Town’s law for Small Cell Developments/5G, and make “recommendations and updates to meet current needs.” Mr. Altieri will discuss with Mr. Menkes, what the procedure will be for drafting an actual law. The Town Board reviewed the proposal, and the resume of Hank Menkes, and moved its approval to the regular meeting agenda for this evening. The Town Board asked that Mr. Menkes come and give a tutorial. Contract – G and S Community Solar Anchor Contract Mr. Altieri’s memo explained, that when the Town has previously “investigated community solar programs, they have been for the benefit of private entities and residential properties. Sustainable Westchester has partnered with G & S Solar Developers to offer a community solar program for local governments and their facilities. Under the terms of the program, a municipality signs up as a subscriber thus making the community eligible for the program.” Mr. Altieri stated that this does not bind the Town to any particular site. The approval for this agreement is on the regular agenda for this evening. Review – Floor Area Ration Law Deferred due to time limitations CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson at 8:00 p.m. Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this evening. PRESENTATION – Introduction of the Comprehensive Plan and the Steering Committee Supervisor Seligson announced the commencement of the Comprehensive Plan. This project was put on hold due to the Coronavirus Pandemic. Supervisor Seligson introduced the consultants Peter Feroe and Nina Peek of AKRF, and Shachi Pandey and Madeleine Helmer of MUD. The consultants will be introducing the Comprehensive Plan this evening, outlining the key processes for the project, and the proposed timeline. Supervisor Seligson introduced the members of the Steering Committee, Melissa Kaplan-Macey – Chair, Ann Lobue, Bethie Miller, Ralph Engel, Doris Block, Robin Nichinsky, Jim Drucker, Jaine Elkind Eney, and Lindsey Luft. Mr. Feroe gave a PowerPoint presentation to the audience, outlining the Comprehensive Plan, the process and the time line. Shachi Pandey spoke more specifically about the public outreach. Supervisor Seligson thanked everyone for their participation in the virtual ‘kick-off’. The Town looks forward to beginning this exciting process. SUPERVISOR’S REPORT You heard about the Comprehensive Plan beginnings and we are all excited to move forward on this. Please keep a lookout for opportunities to participate in the public engagement. The Community Solar project on the roof of the Hommocks Ice Rink began construction this week. This project enables the Town to rent out the roof of the Ice Rink to a solar contractor who will build solar panels on the roof providing solar power to the grid that will be offered to Town residents. The marketing of the solar power will be offered to low and moderate income and apartment-dwelling residents first. This allows those residents to participate in sustainability efforts who cannot install their own solar panels on a site. The participants receive a 10 present decrease in their electric bills when they sign up for solar power. The Hommocks Ice Rink locker room project should be complete by the end of March. This project created new renovated locker rooms at the Hommocks Ice Rink to include a separate locker room for females. 2 March 3, 2021 The Town Board plans to work with a consultant to update our local laws to prepare for 5G and cell tower communication changes. We also plan to address FAR and size and scale of houses in the community on a fast track in in tandem with the Comprehensive Plan update. Westchester County continues to hold weekly calls for municipal leaders on updates and information regarding Coronavirus statistics. We know the Covid numbers are greatly reduced from a month ago, but they are still active. Please continue to wear masks, wash hands often, avoid large gatherings and maintain social distancing. I had the opportunity to address ninth graders in the OCRA program last week to talk to them about my job as supervisor and town government. Finally, the Sustainability Collaborative, along with the environment committees of the Villages of Larchmont and Mamaroneck are working to create a tri-municipal community solar campaign in coordination with NYS Clean Energy Communities program. This would be a marketing campaign to encourage all residents to sign up for community solar for reduced electric prices and investment in renewable energy. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: February 24, 2021 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously opened. Mr. Maker explained the purpose for the law. Supervisor Seligson asked Lindsey Luft, who is staffing the email this evening, if the Town has received any new emails as well as if any viewers had (virtually) raised their hand to speak, and Ms. Luft responded, no. On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Public Hearing was unanimously closed. 3 March 3, 2021 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following was adopted: Local Law No. 3 - 2021 This local law shall be known as the “Addition of Members of the Town of Mamaroneck Housing Authority to the List of Sensitive Positions in the Code of Ethics” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The Town adds the position of member of the Town of Mamaroneck Housing Authority to the list of Sensitive Positions in the Town’s Code of Ethics. Section 2 – Amendment of a current section of the Mamaroneck Code: Section 17-4 AA. of the Code of the Town of Mamaroneck hereby is repealed and the following substituted in its place: SENSITIVE POSITIONS The following positions entail potential conflicts of interest and are deemed to be sensitive positions: . . . “AA. Member of the: (1) Board of Appeals. (2) Board of Architectural Review. (3) Board of Assessment Review. (4) Board of Ethics. (5) Town of Mamaroneck Housing Authority (6) Planning Board. (7) Town Board.” Section 3 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 4 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. Purpose: The Town Board concludes that the state requirement of four hours of training per year for seasoned members of the Board of Appeals and the Planning Board is more than necessary and that a lesser requirement will allow such members to remain schooled in the changes in and the updates to the laws on land use. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: March 26, 2021 On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Public Hearing was unanimously opened. During the worksession the Town Board discussed some amendments to the draft, of note was the removal of carryover hours for training. Additionally, Mr. Altieri is reviewing the protocol for reimbursable expenses so that it can be included in the resolution that will accompany this law. The Town will need to adjourn the Public Hearing and reschedule it for April 7, to allow for a new draft to be completed. The accompanying resolution will also be deferred. Supervisor Seligson asked Lindsey Luft, who is staffing the email this evening, if the Town has received any new emails as well as if any viewers had (virtually) raised their hand to speak. Ms. Luft responded that John Cuddy would like to address the Board. Mr. Cuddy addressed the Town Board and asked if time served on other Boards, would be acceptable as training? The Town Board stated that this does not seem to be an issue, and so they are not inclined to include it. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously adjourned until, April 7, 2021. Ms. Luft responded that Kevin Crowe would like to address the Board. Mr. Crowe thanked the Town Board on behalf of the Larchmont Gardens’ Civic Association for drafting this legislation. The Larchmont Gardens’ Civic Association is in favor of this law. On motion of Councilwoman Katz, seconded by Councilman King, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, the following Local law was approved: Local Law No. 4 – 2021 This local law shall be known as the “Prohibition on Parking between the paved areas on East and West Brookside Drive and the Brook” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The purpose of this law is to prohibit parking on the grassy area between the pavement on East and West Brookside Drives and the Brook itself. Section 2 – Prohibition of Parking within between Pavement and the Brook: Section 219-18 of the Code of the Town of Mamaroneck hereby is amended to add a new subsection C. to read as follows: C. No motor vehicle shall be parked between the pavement on East Brookside Drive and the pavement on West Brookside Drive and the Brook for the entire length alongside the Brook. Section 3 – Sign(s) to be Erected and Painting to be Done: 6 March 3, 2021 An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of East and West Brookside Drives indicating where parking is prohibited by this law. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. BOARD OF FIRE COMMISSIONERS Commissioner Seligson called the Meeting to order, then on motion of Commissioner Elkind Eney, seconded by Commissioner Katz, the Board of Fire Commissioners was unanimously declared open. Other Fire Department Business Commissioner Elkind Eney read the Fire Report for the Month of February as submitted by Chief Hughes as follows: ALARM TYPE NUMBER Generals 23 Minors 20 Stills 5 Out of Town (Mutual Aid) 2 EMS 36 Drills 4 TOTAL 90 Total number of personnel responding: 443 Total time working: 37 hours and 50 minutes Commissioner Elkind Eney gave an update on the Thruway turnaround; something the Fire Department has been lobbying for with the New York State Legislature. The project has been approved, and now our State representatives are looking for funding. Funding will most likely come through the Department of Transportation or from NYS Capital project funding. There being no further business to come before the Commission, on motion of Commissioner Katz, seconded by Commissioner Fiddelman, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization Extension of Lawn Maintenance Contract at Hommocks Field/Pool On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the extension of the contract with PA Ferraro Landscaping through 2021, for the Law Maintenance and related work at the Hommocks Field and Hommocks Pool at a cost, unchanged from 2020, of $8,950, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town, and notify the contractor of the approved extension. Authorization G and S Community Solar Agreement On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve, subject to review of Counsel, the Subscription Agreement between the Town of Mamaroneck and G & S Solar Developers, to participate in a municipal community solar program, and BE IT, FURTHER 8 March 3, 2021 RESOLVED, that the Town Administrator is hereby authorized to execute said agreement on behalf of the Town. Authorization New York State Contract Bus Grant On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was RESOLVED, that the Mamaroneck Town Board does hereby approve, subject to review of Counsel, The Contract between the Town of Mamaroneck and the New York State Department of Transportation, for funding for the replacement of a senior citizen bus, and BE IT, FURTHER RESOLVED, that the Town Administrator is hereby authorized to execute said Contract on behalf of the Town. Renewal of Retainer - Counsel to Planning and Zoning Board On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the annual retainer agreement with Lisa Hochman, Esq., to provide all general legal services to the Town’s Planning Board and Zoning Board of Appeals, as detailed in the March 4, 2021 memorandum to the Town Board, and shall be effective March 4, 2021. Set Public Hearing Property Management Law DEFERRED 7. Authorization Consultant Contract 5G/Cell Tower Law Review On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the proposal from Menkes Associates, LLC, to review the Town’s telecommunications zoning ordinance, update the Town’s existing ordinance, or draft a new telecommunications ordinance, and prepare and present to the Town Board a tutorial on the evolution of the existing wireless infrastructure and the advent of 5G technology, for the total cost of $6,000, with any additional requested work to be billed at a rate of $300 per hour. Resolution for the Town of Mamaroneck Vehicle and Traffic Code § 219-56 A On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby establish fees, days, times and methods of payment for parking on designated public highways, and rescinds any previous resolutions as follows: The four (4) designated parking spaces on Myrtle Boulevard lying in front of the properties known by the street addresses of 172 Myrtle Boulevard and 166 Myrtle Boulevard shall allow parking for fifteen (15) minutes between 8:00 am to 6:00 pm (prevailing time), Monday through Saturday, except holidays at a fee of $.05 for four minutes, $.10 for eight minutes and $.15 for fifteen minute. The remaining twenty two (22) designated parking spaces on both sides of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue shall allow parking for up to three (3) hours from 8:00 am to 6:00 pm (prevailing time), Monday through Saturday, except holidays at a fee of $.05 for four minutes, $.10 for eight minutes, and $.25 for twenty minutes. The ten (10) designated parking spaces on Maxwell Avenue shall allow parking up to ten (10) hours, 24 hours a day/7days a week, except holidays, at a fee of $.05 for six minutes, $.10 for twelve minutes, and $.25 for thirty minutes.
