PRESENT: Supervisor Burton, Justices, Boyd, Collins, Dudley and Shafer, Deputy Clerk, Sherman, i The call of the meeting was then read, and upon motion same was duly approved, Pursuant to previous action of this Board, the Super- visor reported progress in the matter of the Building Ordinances. Thereupon the following Ordinance was presented for consideration. BE IT ORDAINED AS FOLLOWS: SECTION FIRST: That pending the adoption by the Town Board of the Town of Mamaroneck, New York, of a building code, no wall struc- ture, building or part thereof shall here- after be erected, constructed, built , en- larged or altered within the unincorporated portion of the Town of Mamaroneck until the plans and specifications of the proposed work shall have been submitted to the Building Commission to be hereinafter appointed, who shall, if the wall, structure, building or part thereof proposed to be built, erected, constructed, enlarged or altered is to be done in a good, safe, substantial and work- manlike manner, issue a permit for the pro- posed construction. SECTION SECOND: STRUCTURES, walls, buildings or parts thereof hereafter erected without permit, shall be removed. SECTION THIRD: Structures, walls, buildings or parts thereof now in course of construct- ion are hereby declared to be under the jur- isdiction of the building Commission. Section Fourth: No building shall be moved into or within the aforesaid district until a permit shall have been obtained from the Building Commission. SECTION FIFTH: The Building Commission shall be constituted by three citizens residing within the District who shall be appointed by the Town Board and who shall serve at the pleasure of the said Board without compensat- ion until their successors qualify. They shall meet and organize electing a Chairman and a Secretary within 5 days after they are notif- ied by the Town Clerk of their appointment. All permits shall be signed by the Secretary in the name of the Commission. SECTION SIXTH: Any and all persons who shall violate any of the provisions of this ordin- ance or fail to comply therewith, or who shall violate or fail to coomply with any order or regulation wade thereunder; or who shall build in violation of any detailed statement of spec- - ifications or plans submitted or approved there under; or any certificate or permit issued thereunder; shall severally for each and every such violation and noncomplaince respectively forfeit and pay to the Supervisor of the Town of Mamaroneck a penalty in the sure of Twenty- Five Dollars. The imposition of one penalty for any violation of this ordinance shall not ex- cuse the violation or permit it to continue: and all such persons shall be required to cor- rect or remedy such violations or defects with- in a reasonable time to be fixed by the said Building Commissions; and when not otherwise specified each five days that prohibited con- ditions are maintained shall constitute a sep- erate violation. SECTION SEVENTH: This ordinance shall take effect and be in force from and after its passage and legal publication. BE IT RESOLVED, That the Mamaroneck Paragraph and the Larchmonter Times be and they hereby are designated to publish the Building Ordinance just adopted by this Town Board, and that the cost thereof be a proper Town charge. Upon Motion by Justice Dudley, seconded by Justice Boyd the foregoing Ordinance was approved and adopted, the ROLL CALL being as follows. AYES: Burton, Boyd, Collins, Dudley and Shafer and Sherman. NAYES: None No further business coming before the Board the meeting adjourned at 11.15 P.M. Town Clerk. Deputy Clerk.
