CZMC Minutes
August 18, 2020
A meeting of the Coastal Zone Management Commission (CZMC) was held on Tuesday, August 18,
2020 via Zoom and was aired live on LMCTV. A public email account was monitored during the
meeting for the submission of public comments and LMCTV provided a written transcript of the meeting.
The meeting was called to order at 7:30 p.m.

2. Approval of Minutes
Approval of the minutes of the February 24, 2020 and June 22, 2020 were approved as submitted.
3. Referral – Westchester Design Center, 2444 Boston Post Road, Special Use Permit
A presentation was made by Anne Marie and Valentino Lopergolo for the proposal to open a
design center in the retail location previously occupied by CVS. The design center will have a
display area for tile, doors, flooring and cabinetry samples and office areas. Also present at the
meeting was Kent Covington, who represents the property management.
CZMC found the proposed action to be consistent with the policies in the Local Waterfront
Revitalization Program. Because there are known drainage problems in the parking area, it was
suggested that the property manager inspect the stormwater drainage system as soon as possible.
The system should be immediately cleaned and repaired as necessary and annual inspections
should be conducted in the future. It was also suggested that copies of annual inspection reports
be provided to the Town Building or Engineering Departments.

4. Referral – 5 Cornell Street - Residential Site Plan Approval
Property owner Ami Ziff and his team of professionals: Greg Caccioppoli, Engineer; Dan
Sherman, Landscape Architect; and Jordan Rosenberg, Architect, presented the proposal to
construct a new residence at 5 Cornell Street. The property is contiguous to the Bonnie Briar
Country Club which is a part of the Critical Environmental Area known as the “Larchmont
Reservoir-Sheldrake-Leatherstocking Freshwater Wetlands Complex.”
The proposal includes the construction of retaining walls, filling and leveling the property, and
the construction of the house, a tennis court, a swimming pool and a stormwater management
system. During the meeting, CZMC members expressed some concerns about the design of the
stormwater management, adequate tree protection as well as the quantity and quality of fill
material. The applicant’s consultants were able to address some of these concerns, but it is
ultimately the responsibility of the Town’s professional staff and the NYSDEC to review these
issues and ensure that all requirements are met before permits are issued.
CZMC found the proposal for the construction of the house and accessory structures to be
consistent with the policies in the Local Waterfront Revitalization Program, however CZMC
recommends the following:
Adequate tree protection be provided during construction for the northern red oak that
will include the use of woodchips and plywood over the root zone of the tree. Details and
notes should be added to the plans to clarify this as well as how the root systems of any
trees on neighboring properties will be protected during the installation of the retaining
walls.
The applicant should clarify the amount of fill needed, the number of truck loads
required, provide documentation on the source of the fill material and provide a copy of
the beneficial use determination.
The design of the stormwater management system be reviewed by the Town’s consulting
engineer and modified as needed.
5. Old Business
Councilwoman Jaine Elkind Eney updated CZMC on the proposed amendment to the Town’s
rock removal ordinance. CZMC recommended that the amended ordinance require dust control
measures.
