THE MINUTES OF THE REGULAR MEETING
OF THE ZONING BOARD OF APPEALS
OF THE TOWN OF MAMARONECK
HELD REMOTELY Via ZOOM ON DECEMBER 16, 2020
Present via ZOOM: Arthur Wexler, Chairman, Stephen Marsh, Jonathan Sacks, Irene O’Neill,
Robin Nichinsky, Carol Miller (Alternate), Seth Bronheim (Alternate)
Also present via Zoom: Richard Polcari, Building Inspector, Lisa Hochman, Counsel to the
Zoning Board of Appeals, Francine M. Brill, Zoning Board of Appeals Secretary, Abby Katz,
Town Board Liaison (arrived late)
CALL TO ORDER
The meeting was called to order at 7:24 P.M.
Ms. Hochman stated that tonight’s meeting has been convened in accordance with the
Governor’s Executive Order 202.1, as extended, which suspends certain provisions of the Open
Meetings Law to allow municipal boards to convene meetings via videoconferencing.
She asked the Zoning Board Secretary to confirm that tonight’s meeting had been duly noticed.
Ms. Brill so confirmed.
Ms. Hochman further stated that members of the public received notice on how to view and
participate in tonight’s public hearings in accordance with the Governor’s Executive Order
202.15, as extended, she stated that this meeting is being broadcast live on LMC-TV (channel 35
on FIOS; channel 76 on Optimum) and online at LMCTV.org., and that a transcript will be
provided at a later date.
Ms. Brill called the roll and the Chair announced that there was a quorum present (via ZOOM).

Motion: To approve the minutes of November 18, 2020 with technical corrections.

Application # 1 – Case No. 3191 – Marina Milonova and David Weinstein – 9 Bonnie
Briar Lane – Public Hearing
Motion: To open the public hearing
Moved by Arthur Wexler, seconded by Irene O’Neill
Action: Unanimously Approved
Mr. Weinstein the owner and Justin Mineri the architect were present via ZOOM.

Ms. Brill stated the request was duly noticed.
Mr. Mineri stated they are requesting a variance to replace and enlarge an existing
nonconforming deck with a more attractive and safer deck.
The Board discussed the original variance as well as the proposed plan. It was noticed that the
property line tapers in, in the middle of the property.
Mr. Sacks stated the proposed deck will not change the character of the neighborhood.
Mr. Wexler stated the applicant is burdened with 2 front yards.
Mr. Polcari made an announcement inviting members of the public to comment, there was no
response.

Application # 3 – Case No. 3194 – James and Fiona Blanco – 68 N Chatsworth Avenue –
Public Hearing
James Blanco, owner, Lawerence Gordon, Architect, and Joe Guiliamo, Architect, were present
via ZOOM.
Ms. Brill stated the request was duly noticed.
Mr. Gordon explained the proposal for the renovation and extension of 2 small bedrooms. The
addition will be similar in scale to the neighbors. The addition will be over an existing terrace 46
square feet.
The Board discussed the terrace and asked if it could be a pervious deck to lessen mass.
The owner responded they are ok with the proposed change.
Mr. Polcari made an announcement inviting members of the public to comment, there was no
response.

Application # 4 - Case No. 3195 – Jason and Erica Gaswirth - 21 South Drive – Public
Hearing
Erica and Jason Gaswirth the owners and Liam Winters the Architect were present via ZOOM.
Ms. Brill stated the request was duly noticed.
Motion: To open the public hearing

Action: Unanimously Approved
Mr. Winters shared his screen and explained the request. He stated the screened porch received a
variance July 1966 now they are asking to make it a four season room.
The Board discussed the proposal.
Mr. Polcari made an announcement inviting members of the public to comment, there was no
response.

Application # 6 – Case No. 3197 – Sarah and Edward Keating – 8 Hawthorne Road –
Public Hearing
Mr. Keating, owner, Rick Yestadt the Architect were present via ZOOM.
Ms. Brill stated the request was duly noticed.
Motion: To open the public hearing
Moved by Arthur Wexler, seconded by Stephen Marsh
Action: Unanimously Approved
Mr. Yestadt stated the front of the house is 44 feet from the property line the existing vestibule is
38.5 feet from the property line which received a variance in 2016. They propose to add an open
front porch on both sides of the entrance connecting to the one side porch.
The Board discussed the proposal, Mr. Marsh stated for the record he measured 43 feet to the
side walk as there is a 5 foot right of way there.
Mr. Polcari made an announcement inviting members of the public to comment, there was no
response.
