WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting.to order at 8:15 P.M.

APPROVAL OF MINUTES
The minutes of the regular meetings of June 1, 1977 and August
3, 1977 were presented and on motion by Councilman Bloom, seconded
by Councilman McMillan, approved as submitted.

OLD BUSINESS
1. Amendment - Freedom of Information Law
Supervisor Vandernoot presented a communication from the State
of New York Committee on Public Access to Records dated January
25, 1978 herewith ordered received and filed, and noted that the
amended rules must be adopted by March 1, 1978. He then called to
attention the proposed changes made as the result of review of
the original law by town officials and drawn up by the Town
Attorney.
Thereupon, following some discussion, on motion by Councilman
Perone, seconded by Councilman Bloom, it was unanimously
RESOLVED, that this Board hereby amends
the Regulations of the Town of Mamaroneck
Relating to Inspection and Copying of
Public Records as adopted on February 5,
1975 and herewith presented and filed as
a part of the record of this meeting.
2. Report of Bids - Highway Trucks
Mr. Elfreich presented his memorandum addressed to the Board under
date of March 1, 1978, which was herewith ordered received and

filed, and noted that the Larchmont Village Board at its meeting
on Monday night had rejected all bids and authorized their
Engineer to advertise separately. Following some discussion and
pursuant to the Engineer's recommendation that this Board reject
all bids and his request to readvertise, on motion by Councilman
Perone, seconded by Councilman Bloom, it was unanimously
RESOLVED, that this Board hereby authorizes
the Engineer to readvertise by way of
publication in the official newspaper of
the Town of Mamaroneck, The Daily Times,
of a Notice of Bids for two (2) pickup
trucks, one (1) truck chassis and one (1)
stake body dump truck for the Highway
Department, said bids to be returnable
on March 13, 1978 and reported to the
Town Board on March 15, 1978.
3. Report of Bids - Aerial Tower and Body and Related Accessory
Equipment
A memorandum addressed to the Town Board by Charles Elfreich,
Town Engineer under date of March 1, 1978, enumerating the bids
and recommending award thereof, was herewith presented and
ordered received and filed as part of the record of this meeting.
Following some discussion relative to the number of bids received
and suppliers of this type of equipment, in which the Engineer
noted that he had contacted other suppliers and they declined to
bid, on motion by Councilman McMillan, seconded by Councilman
Perone, it was unanimously
RESOLVED, that this Board hereby accepts
the bid of the only bidder for the
following:
Contract No. 78-2 - Aerial Tower and Body
Baker Equipment Engine Co. - $17,717.00
and be it further
RESOLVED, that this Board hereby accepts
the bid of the low bidder for the
following:
Contract No. 78-3 - Accessory Equipment for Aerial Body
Equipment Sales & Service Co. , Inc. - $3,832.72
NEW BUSINESS
1. Resolution Authorizing Permits for Work Within the County Road Area
Pursuant to the communication from the County Department of Public
Works under date of February 2, 1978, herewith presented and
ordered received and filed, on motion by Councilman Bloom, seconded
by Councilman McMillan, the following resolution was adopted by
majority vote:

WHEREAS, pursuant to the provisions of
Chapter 605 of the Laws of 1941, revised
as of June 5, 1961, the Commissioner of
Public Works of Westchester County with
the approval of the Board of Legislators
and the County Executive of Westchester,
has prescribed rules, regulations, safe-
guards, specifications and conditions
for the protection, reconstruction, main-
tenance or restoration of any County Road
or portion thereof, and for the protection
and safety of the traveling public thereon
during any operations of reconstruction,
maintenance or restoration of such county
road or portion thereof;
and
WHEREAS, the said rules and regulations re-
quire any person, corporation, improvement
district, or municipality doing any work
upon any. County Road to obtain a written
permit from the Commissioner of Public Works
and to deposit a certified check made payable
to the order of the County of Westchester in
an amount computed by the extent of the pro-
posed work;
and
WHEREAS, the said rules and regulations provide
that any city, village, town public improvement
district or other municipality may, in lieu of
making the said mentioned deposit, file with the
Commissioner of Public Works a certified copy of
a resolution duly adopted by the governing board
of such municipality guaranteeing faithful per-
formance by the said municipality of all terms,
covenants and conditions as set forth in the
permit, which resolution shall be effective for
permits issued during the remainder of the calen-
dar year after adoption;
and
WHEREAS, the Town of Mamaroneck from time to time,
is required to do work within the County Road area
for which a written permit from the Commissioner of
Public Works of the County of Westchester is required,
and for which a certified check deposit is required;
NOW, THEREFORE, BE IT
RESOLVED, that the Town of Mamaroneck does
hereby guarantee faithful performance of all
the terms, agreements, covenants and conditions
of each and every written permit as referred to
herein issued by the Commissioner of Public Works
of the County of Westchester and that this guaran-
tee of faithful performance shall be applicable
to all such written permits issued during the
present calendar year.

2. Authorization - Disposition of Obsolete Equipment - Assessor's Office
Pursuant to the Supervisor's presentation of a memorandum addressed
to the Town Board by George Mellersten, Assessor, under date of
February 24, 1978, herewith ordered received and filed, requesting
the disposition of certain obsolete and unneeded equipment in his
office, on motion by Councilman McMillan, seconded by Councilman
Bloom, it was unanimously
RESOLVED, that this Board hereby authorizes
the disposal of the following obsolete and
unneeded equipment in the Assessor's Office
and approves the presentation of said
equipment to the Association for Mentally
Ill Children in Dobbs Ferry:

3. Engineer's Report Drainage Study - Rockland Avenue & Jason Lane

Charles Elfreich, TownEngineer presented his memorandum addressed
to the Town Board under date of March 1, 1978, herewith ordered
received and filed. Tlie report indicated the excessive flooding
problem noted after the January 20th storm in the above captioned
areas and following some discussion and pursuant to the Engineer's
recommendation that flood drains be installed in those areas and
that the cost of these projects be added into the 1978 capital
funding, on motion duly made and seconded, it was unanimously
so ordered that the Engineer proceed further with his research
of the project and report to the Board with a proposal.
4. Set Date for Public Hearing - Full Stop Signs
Supervisor Vandernoot presented Police Chief Barasch's memorandum
addressed to the Town Board under date of March 1, 1978, herewith
ordered received and filed for the record and pursuant to his
notation that the Traffic Commission had investigated the areas
as requested by residents and were recommending that the stop
signs be installed, on motion by Councilman Bloom, seconded by
Councilman McMillan, it was unanimously
RESOLVED, that a public hearing will be
held by this Board at its next regular
meeting on Wednesday evening, March 15,
1978 in the Auditorium or Council Room
of the Weaver Street Firehouse, Weaver
Street, Town of Mamaroneck, for the pur-
pose of considering the installation of
stop signs at the intersections of Doris
Road and Fairway Drive, Barnwall Lane
and Fairway Drive, Barnwell Lane and
Stonewall Lane, and Glenn Road and North
Chatsworth Avenue;

and be it further
RESOLVED, that the Clerk be and she hereby
is authorized to publish in the official
newspaper of the Town of Mamaroneck, The
Daily Times, the Notice of said hearing
as required by law.
5. Authorization to Collect 1978 State, County, Town & Special
District Taxes
Pursuant to the request of the Receiver of Taxes for authorization
to collect the 1978 State, County, Town and Special District taxes
and publish and post the necessary Notice thereof, on motion by
Councilman Bloom, seconded by Councilman McMillan it was unanimously
RESOLVED, that this Board hereby authorizes
the Deputy Receiver of Taxes of the Town of -
Mamaroneck to collect the 1978 State, County,
Town and Special District taxes and the water
rents which become a lien on January 1st, 1978;
and be it further
RESOLVED, that in accordance with the provisions
of Section 500 of the Westchester County Admin-
istrative Code, "The Daily Times", the official
newspaper published in the Village and the Town
of Mamaroneck, is hereby designated as the news-
paper in which the Deputy Receiver of Taxes and
Assessments shall publish the "Notice of the
Collection of State, County, Town and Special
District taxes and water rents";
and be it further
RESOLVED, that in accordance with the provisions
of Section 550 of the Westchester County Admin-
istrative Code, the Town Board does hereby direct
the Deputy Receiver of Taxes and Assessments to
mail to each taxpayer of the Town of Mamaroneck,
whose address is known to said Deputy Receiver of
Taxes and Assessments, a tax bill for all taxes
and water rents, the expense thereof to be a
Town charge.
COMMUNICATIONS
1. Letter, Westchester Developmental Center
The Supervisor presented the letter addressed to him by John A.
O'Donnell, Westchester community Service Council and Charles
Await, Westchester Developmental Center under date of February
14, 1978, herewith ordered received and filed, regarding the ._
requirement that community residences be established for the
mentally retarded throughout Westchester County. Mr.
Vandernoot stated that a meeting has been scheduled for Wednes-
day, March 8th at the Town Offices and invited interested
residents to attend.

2. Letter, Samson Management Corp.
A letter addressed to the Supervisor by Arnold Goldstein, Vice-
President of Samson Management Corp. under date of February 28,
1978 relative to the elevator and water damage problems at
Larchmont Acres East, was herewith presented and ordered
received and filed for the record.

TOWN CLERK
Regular Reports
The Clerk presented the following reports which were ordered
received and filed:
Report of the Town Clerk for the month
of February 1978
Report of the Building and Plumbing Inspector
for the month of February 1978
For the record the Clerk reported that the Annual Report of the
Supervisor for the Fiscal Year ending December 31, 1977 and the
Annual Report of the Fire District Treasurer for the Fiscal Year
ending December 31, 1977 have been filed with the State Department
of Audit and Control, and that copies thereof have been filed in
the Clerk's Office and are available to any interested person.
Not on Agenda
At this time Ellie Berlin, Chairman of the Town Democratic Com-
mittee, inquired as to the status of the committee studying the
manager form of government for the Town of Mamaroneck, to which
the Supervisor replied that the group is awaiting an opportunity
to speak to persons who have held such positions and Councilman
Bloom noted that the committee's last meeting was cancelled due
to the storm.
THE COUNCILMEN
Mr. Bloom
1. Apportionment
Councilman Bloom presented the following apportionment and on
his motion, which was seconded by Councilman McMillan, the
following resolution was unanimously adopted:
WHEREAS, the Assessor has presented petition
for the correction of the assessment roll
for certain years pursuant to the provisions
of Section 557, Article 16 of the Westchester
County Tax Law;
and �
WHEREAS, after due consideration, this Board
finds it desirable to grant said petition for
the correction of said assessment roll;

RESOLVED, that the assessment roll of
1977-78 taxes of 1978, which shows
property now appearing on the roll as

Mr. Perone
Councilman Perone made very brief reference to the letter he
forwarded to Congressman Ottinger relative to the proposed
federal funding in the Mamaroneck Sewer District and the flood
control project on the Mamaroneck and Sheldrake Rivers.
Not on Agenda
At this time since Councilman Perone is the liaison to the Solar
Energy Group, Councilman Bloom called to his attention a recent
article in Technology Review relative to a solar energy project
in Massachusetts and stated that our local group might be
interested in investigating the specifics of that project.
ADJOURNMENT
There being no further business to come before the meeting, on
motion duly made and seconded, it was declared adjourned at 8:55 P.M. ,
to reconvene on March 15, 1978.

The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.

ordered received and filed, on motion by Commissioner Bloom,
seconded by Commissioner McMillan, it was unanimously

Thanks was expressed to the Fire Department by the Board of Fire
Commissioners for their able assistance extended earlier today
during a very bad fire in Larchmont Village.
