Brill, Planning Board Secretary CALL TO ORDER The meeting was called to order at 7:32 P.M. The Chair confirmed with counsel that tonight’s meeting had been convened in accordance with the Governor’s Executive Order 202.1, as extended, which suspends certain provisions of the Open Meetings Law to allow municipal boards to convene meetings via videoconferencing. He asked the Planning Board Secretary to confirm that tonight’s meeting had been duly noticed. Ms. Brill so confirmed. Mr. Engel stated that members of the public received notice on how to view and participate in tonight’s meeting on TV and online. He state that this meeting is being broadcast live on LMC- TV (channel 35 on FIOS; channel 76 on Optimum) and online at LMCTV.org., and that a transcript will be provided at a later date. Ms. Brill called the roll and the Chair announced that there was a quorum present (via ZOOM). Members of the Town staff and consultants identified themselves for viewers Mr. Engel further stated that public hearings tonight will be conducted in accordance with the Governor’s Executive Order 202.15, as extended, and the notices for tonight’s meeting provided members of the public with instructions on how to view and participate in each public hearing. Action: Approved Moved by: Ira Block, seconded by Ron Mandel Vote: Yes: Ralph Engel, Elizabeth Cooney, Ira Block, Ron Mandel Abstain: Edmund Papazian 1 1. 44 Edgewood Avenue - Residential Site Plan – Dorothea Tomczyk – Public Hearing continued from March 11, 2020 Ms. Brill stated that the public hearing was duly re-noticed including instructions on the procedures for this public hearing. Michael Stein, the applicant’s engineer, addressed the Board. Mr. Stein stated that, as requested, they have expanded the tree protection to 12 feet and shifted the cul tec system outside of the drip line. Mr. Oliveri stated that there are minor items to be corrected on the final plan. Ms. Hochman clarified that the public hearing was opened in March for the residential site plan applications for the two separate lots but the subdivision amendment application will be opened tonight. Mr. Engel asked that the location map show only the single lot and that the site plan be referred as the address not Lot 1. PUBLIC COMMENT Mr. Wasp made an announcement inviting members of the public to speak but no one responded. Ms. Aitchinson stated that there were no emails. Mr. Engel asked for a nonbinding straw poll and Ms. Brill polled the Board. A draft resolution was requested. Ms. Tomczyk asked if an interim meeting could be scheduled Mr. Engel stated that there will be no decision on this application tonight and the public hearing will remain open and instructed that comments can be emailed to publicqc@townofmamaroneckny.org or sent/delivered to the Town Building Department (an appointment is required if delivered.) Mr. Engel further stated that all comments received prior th to noon on July 8 will be considered by the Planning Board prior to making any decision. 2. Judson Street – Residential Site Plan - Dorothea Tomczyk - Public Hearing continued from March 11, 2020 Ms. Brill stated that the public hearing was duly re-noticed including instructions on the procedures for this public hearing. Michael Stein, the applicant’s engineer, addressed the Board. Mr. Stein stated that, as requested, they have expanded the tree protection to 12 feet. Mr. Engel stated that the proposed house requires a house number and Mr. Polcari asked that an email requesting a house number be sent to him. 2 Mr. Engel asked that the location map show only the single lot and that the site plan be referred as the address not lot 2. Mr. Oliveri stated that plan 1 shows 2 lots – either limit it to one or make clear that permission would be required to enter onto the other lot. Mr. Stein, the applicant’s engineer, addressed the Board, stating that they returned to the Coastal Zone Management Commission and it was agreed that the condition regarding sequencing of construction to preserve trees in the original subdivision resolution is unnecessary because alternative tree protection measures will be employed. Mr. Engel asked for a nonbinding straw poll and Ms. Brill polled the Board. Mr. Engel further stated that all comments received prior th to noon on July 8 will be considered by the Planning Board prior to making any decision. 4. 251 Murray Avenue – Residential Site Plan – PDFO2 – Public Hearing continued from March 11, 2020 Ms. Brill stated that the public hearing was duly re-noticed including instructions on the procedures for this public hearing. Michael Stein, the applicant’s engineer, addressed the Board, stating that a copy of the recorded deed has been provided. He further stated that three letters in support of the proposed project were submitted. Mr. Wasp stated that he received the letters and will forward them to the Board. Mr. Stein stated that the bamboo has been removed and a barrier installed, as requested. Mr. Oliveri asked that detail of the pavers cross section be provided on the site plan. He further stated that Westchester County approved the storm water connection. Mr. Wasp stated that he inspected the connection. Mr. Engel further stated that all comments received prior th noon on July 8 will be considered by the Planning Board prior to making any decision. 5. 16 Greystone Road – Residential Site Plan – Light Greystone LLC - Public Hearing Ms. Brill stated that the public hearing was duly noticed including instructions on the procedures for this public hearing. Motion: To open the public hearing Action: Approved Moved by Ira Block, seconded by Elizabeth Cooney Yes: Ralph Engel, Elizabeth Cooney, Ira Block, Ron Mandel, Edmund Papazian 4 Benedict Salanitro, the applicant’s engineer, addressed the Board stating that he presented in February and since then met with staff and updated the plan for removal of the single-family residence. He further stated that there is a net decrease of impervious surface proposed and eight test pits were dug and water quality treatment is proposed due to shallow rock. They are nd scheduled to appear before the Coastal Zone Management Commission on June 22. Mr. Polcari stated that the proposed plan is zoning compliant. Mr. Oliveri asked that the minor comments be addressed on the site plan. Ms. Cooney asked about the quantity of rock removal and Mr. Salanitro answered that about 200 yards will be removed by hammering. Mr. Salanitro stated that the proposed first floor will be 2 feet lower than existing. Mr. Wasp asked that grading be tapered and shown as such on the site plan. PUBLIC COMMENTS Mr. Wasp made an announcement inviting members of the public to comment. Ms. Spellman of 197 Mulberry Lane, voiced concerns about hammering and drywells. Mr. Salanitro stated they will only be allowed 15 days for rock removal and the water is being directed to the front of the property to rain gardens. Ms. Spellman asked if neighbors’ homes will be inspected prior to hammering, Mr. Salanitro responded the Board can make it a condition. Mr. Conner of 195 Mulberry Lane questioned the proposed retaining wall height and materials, Mr. Salanitro explained that the elevations and height of the unilock wall that will be eight inches off the property line and does not require footings. He further explained the area of the regrading and that the result will be to direct water flow toward the proposed new house, significantly decreasing runoff from the property. Ms. Aitchinson stated that there were no emails. Mr. Engel asked for a nonbinding straw poll and Ms. Brill polled the Board. A draft resolution was requested. Mr. Engel further stated that all comments received prior to th noon on July 8 will be considered by the Planning Board prior to making any decision. 6. 1240 West Boston Post Road – Special Use Permit – The Nautilus – Public Hearing 5 Ms. Brill stated the public hearing was duly noticed including instructions on the procedures for this public hearing. Motion: To open the public hearing Action: Approved Moved by Ron Mandel, seconded by Elizabeth Cooney Yes: Ralph Engel, Elizabeth Cooney, Ira Block, Ron Mandel, Edmund Papazian Jeffrey Schwartz, Esq, the applicant’s attorney, addressed the Board and requested that the special use permit be approved. Mr. Polcari stated that there are no open violations. Mr. Engel stated that, since 1992, when the original approval was granted, the diner has been expanded. Ms. Hochman stated that this application is being treated as a brand new application, not a renewal. The Board discussed the request, the original resolution and operating hours. Mr. Schwartz requested 7 days a week 6am to midnight. PUBLIC COMMENT Mr. Wasp made an announcement inviting members of the public to comment but no one responded. NEW BUSINESS Mr. Papazian voiced concerns regarding whether applicants can expect decisions at the next board meeting. Ms. Hochman explained that due to concerns about using new procedures and technology, the decision was made to leave the public hearings open to maximize opportunities for members of the public to participate. She further stated that she expects decisions to be made in July consistent with prior practices. 6 Mr. Block asked for an update about the Pepe Porsche matter and Mr. Wasp stated that he met with the applicant’s attorney and they plan to submit for the July meeting. Mr. Wasp further stated that the plan did not address parking concerns which will require a variance. Mr. Polcari stated that, under the site plan regulations, the Planning Board can grant a variance to reduce parking requirement by up to 15 percent. ADJOURNMENT The meeting was adjourned at 9:24 P.M.
