HomeMy WebLinkAbout1977_07_06 Town Board Regular Minutes MINUTES OF THE REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON JULY 6, 1977 IN THE AUDITORIUM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK (compiled on January 26, 2007 from the July 6, 1977 file and cassette tape) PRESENT: Supervisor Vandernoot Councilman Bloom Councilman McMillan Councilman DeMaio Councilman Perone • ABSENT: None ALSO PRESENT: Mrs. Miller - Town Clerk Mr. Johnston - Town Attorney Mr. DeLuca - Comptroller Mr. Elfreich - Town Engineer Mr. Leddy - Conservation Director CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. APPROVAL OF MINUTES The minutes of the regular meeting of November 17, 1976 were presented and on motion by Councilman Perone, seconded by Councilman Bloom, approved as submitted. At this time, with the consent of the Board, the Supervisor changed the order of the agenda and moved on to Item #5 under Communications. COMMUNICATIONS 5. Letter, Irving Scharf, Richbell Road Parking Committee Pursuant to presentation of a letter addressed to the Supervisor by Irving A. Scharf, Chairman of Richbell Road Parking Committee under date of June 11, 1977 which was herewith presented and ordered received and filed for the record, Ed Josephs, Committee member, presented the group's report. Included in the report was a petition containing names of approximately 60 persons indicating their willingness to pay a monthly fee for parking in a lot. The main recommendation of the report was that the apartment dwellers' problems of parking on Richbell Road would be alleviated by a municipal parking lot and requested that the Town purchase the lot behind 2353 Boston Post Road for said purpose. The matter of extending overnight parking on Palmer Avenue was also discussed. Following presentation of the report and some discussion, the Board thanked the Committee members namely, Irving Scharf, Ed Josephs, Lynn Habib, Irene Giordano, Ted Moore and Gary Stevens. Supervisor Vandernoot noted no action would be taken this evening, but consideration would be given to the recommendations, emphasizing it is not likely the Town could purchase the lot. The Supervisor also pointed out that the overnight parking ban on Palmer Avenue from Burton Road to Elkan Road has already been lifted and that they should contact Mamaroneck Village regarding the other side near the Mamaroneck High School. July 6, 1977 The Supervisor then returned to the regular order of the agenda. OLD BUSINESS 1. Discussion - Report of Master Plan Review Committee Alengthy discussion followed Supervisor Vandernoot's acknowledgement of receipt of a letter, herewith ordered received and filed, from Paula Willey, President and Margaret Shultz, Workshop Chairman, of the Larchmont League of Women Voters. The Supervisor enumerated the League's recommendations that the Town formulate a plan to preserve open space and acquire any country club or some area thereof, if and when it becomes available; formulate a zoning code change to allow for greater flexibility to maintain open space and increase the tax base; any Town facility (Town Hall, Police Station, Courthouse complex) should be built on the Thruway access property; the Town and two Villages should develop senior citizen housing jointly; the Town Property Maintenance Code should be reviewed to cover single and two family homes and be strictly enforced; the Town should establish a Board of Architectural Review and improve the visual appearance of the business areas; the Town and Village of Larchmont should jointly develop Recreation and Conservation areas in the Premium River complex and continue to work towards cooperation between the two communities on the use of the Hommocks areda and Flint Park for recreational purposes; and finally, there should be an ongoing Master Plan Review Committee. There was discussion to formulate a committee to look into current and proposed re-zoning of large parcels, particularly those susceptible to the National Flood Insurance Plan. The Chairman of the Planning Board (Fred) agreed to review those areas in question and was asked to issue a report by December 1st discussing zoning modifications that have been commented on, the zoning modifications suggested in the Plan taking the flood point into consideration and their recommendations as to total review and revision. Watershed and water storage issues were discussed. The Guadagnola property and the thruway access area were discussed. It was determined the deed does not restrict the thruway access area to specifically public use. Senior Citizen Housing was discussed. Supervisor Vandernoot expressed his opinion that an appropriate site had not yet been determined for Senior Citizen Housing.. There is currently a lot maintenance code which covers single and two family homes and a property maintenance code covering multi family units. Supervisor Vandernoot remarked that the visual appearance of the town's business area needs improvement. He suggested the town establish a Board Of Architectural Review. There was discussion regarding the state of the Town's sidewalks and the responsibility of the homeowners to keep the sidewalk clean and safe. 2. Authorization - Supervisor to Execute Deeds Re: Parcel J. Property Supervisor Vandernoot described property given to the Town by the County and noted the restriction which has since been changed and referred to purchase by Mr. Carlucci for$1,000 to build 4 or 5 homes and is now ready to sell the property to various property owners. NEW BUSINESS 1. Appointments - Committees - Study Manager Form of Government 8& Paddle Tennis 2 July 6, 1977 The first is to look into a new law which will advise of the feasibility of how to go to a manager form of government. Councilman Bloom commented on 1976 legislation permitting the Town to create such a manager. The Town of Fallsburg received specific legislation to have a manager and in that Town the salary is a general town charge. No doubt managing the affairs of the Town of Mamaroneck requires full time and competent management. Local law g aw establishing such must specifically spell out the duties of such a person. A Committee will meet soon with the Town Board. Councilman Perone commented on the important aspect for the Committee to address themselves to the general town charge since the Village of Mamaroneck already has one. Councilman DeMaio stated that either the full time Supervisor or Manager should be referred to the League of Women Voters' study and wants the Committee to look especially at the Town's present structure. This has been a Political topic and cannot be separated from politics. There is general agreement that this group report will be pushed back after the election. Objectivity is important with no pressure from political candidates. Councilman McMillan agreed with Councilman DeMaio. Councilman Perone denied any political reason for setting up the group now. Possible reporting back date would be the 1st of December..The committee would study and recommend costs, sites, etc. on Paddle tennis and would meet with the Town Board to outline what the Board is looking for- date to be set at the meeting with the Board. (no resolution needed) 2. Set Date for Public Hearing -Increase Senior Citizen Tax Exemption. Following the Supervisor's explanation that a public hearing must be held to amend Section 467 of the Real Property Tax Law to increase the annual income amount from $6,500 to $7,200 for tax abatements for senior citizens, on motion by Councilman Bloom, seconded by Councilman Perone, it was unanimously RESOLVED, that a public hearing will be held before this Board at its next regular meeting on Wednesday evening, August 3, 1977 in the Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck to consider the adoption of a resolution enabling the Town of Mamaroneck to increase the income ceiling from $6,500 to $7,200 for a partial exemption from Town taxes, of real property owned by certain persons with limited income who are sixty- ' five years or over pursuant to the provisions of Section 467 of the Real Property Tax Law as amended provided such persons meet the requirements set forth in said Section 467; BE IT FURTHER, RESOLVED, that the Clerk be and she hereby is authorized to publish in the official newspaper of the Town of Mamaroneck, The Daily Times, Notice of such Hearing as required by law. 3. Salary Authorizations 3 July 6, 1977. a) Deputy Town Clerk Pursuant to memorandum addressed to the Board by Dorothy S. Miller, Town Clerk, under date of July 6, 1977, herewith presented and ordered received and filed, on motion by Councilman Perone, seconded by Councilman McMillan, it was unanimously, RESOLVED, that this Board hereby authorizes the hiring of Roberta L. Fischer in the Exempt Title of Deputy Town Clerk at a salary of $8,680 per annum, effective IJuly 11, 1977. b) Community Beautification Pursuant to memorandum addressed to the Board by P.T. Leddy under date of June 20, 1977, herewith presented and ordered received and filed, on motion y Councilman McMillan, seconded by Councilman Perone, it was nanimously, RESOLVED, that this Board hereby authorizes the hiring of the following part-time seasonal laborers to be compensated at the hourly rates as listed here below: John Dolen, at $2.75 per hour, effective 07/05/77. Richard Fraioli, at $2.50 per hour, effective 06/21/77. Chris Shaw, at $3.00 per hour, effective 06/20/77. Brian Kammerer, at $2.50 per hour, effective 07/05/77. Nick Arpaia, Jr., at $2.50 per hour, effective 07/05/77. c) Police Upon the Supervisor's explanation that several promotions had been recommended by the Police Commission with the approval of Police Chief darasch as part of a reorganization of the Town of Mamaroneck Police epartment and following presentation of 5 letters addressed to the Board by John H. Hanlon, Chairman of the Board of Police Commissioners under date of June 17, 1977 and one from Police Chief Barasch, under date of June 28, 1977, all herewith ordered received and filed, on motion by Councilman McMillan, seconded by Councilman Bloom, it was unanimously, RESOLVED, that this Board hereby authorizes that the following Patrolmen be appointed to the ranks of Detectives effective July 7, 1977, each to be compensated at the rate of $18,568.00 per year: Paul Adamo Charles Baumblatt Joseph Passafume And be it further RESOLVED, That this Board hereby authorizes the appointments of Detective Sergeant Ralph Perritano, and Detective Sergeant Thomas Mahoney to the ranks of Lieutenants effective July 7, 1977, each to be compensated at the rate of $21, 472.00 per year. And be it further 4 July 6, 1977 RESOLVED, THAT THIS board hereby authorizes a salary increase for Lieutenant Christopher Loveley, to be compensated at the rate of $21,472.00 per year, effective July 7, 1977. d) Recreation Pursuant to memorandum addressed to the Town Board under date of June 30, 1977 by the Superintendent of Recreation, herewith presented and ordered received and filed, on motion by Councilman McMillan, seconded by Councilman Bloom, it was unanimously, RESOLVED, That as recommended and approved by the Recreation Commission, this Board hereby authorizes the following salary expenditures to the persons named on the hereinafter list, for the terms of employment and at the rate of compensation for each as set forth thereon: PROGRAM DIRECTOR William Reilly Sr. Rec. Hock, P.E., Manager, Westchester Joint Water Works, together with a cost estimate sheet, herewith ordered received and filed, and the Town Engineer reviewed the details of the project. Thereupon, on motion by Councilman DeMaio, seconded by Councilman McMillan, it was unanimously, RESOLVED, That this Board hereby authorizes the Westchester Joint Water Works to install 400 feet of 6-inch water main on Althea Lane replacing the existing 4-inch main at a cost not to exceed $30,000.00, as submitted in estimate dated June 14, 1977, cost of said installation to be paid by the Town of Mamaroneck. 5. Authorization to Replace Water Line - Glen Eagles Drive The Supervisor presented a letter addressed to him under date of June 21, 1977 by John G. Hock, P.E., Manager, Westchester Joint Water Works, Iltogether with a cost estimate sheet, herewith ordered received and filed, and the Town Engineer reviewed the details of the project. Thereupon, on motion y Councilman McMillan, seconded by Councilman Bloom, it was unanimously, RESOLVED, That this Board hereby authorizes the Westchester Joint Water Works to replace the existing water main on Glen Eagles Drive (between Glen Eagles, South Drive and Knollwood Drive) by installing 240 feet of 6- inch main at a cost not to exceed $20,000.00, as submitted in estimate dated June 21, 1977, said cost to be paid by the Town of Mamaroneck. 6. Authorization to Replace Water Line - Garfield Street Supervisor Vandernoot presented a letter addressed to him together with a Plan, an Estimate and Data under date of June 23, 1977 by John G. Hock, P.E., Manager, Westchester Joint Water Works, herewith ordered received and filed. Mr. Elfreich reviewed the project and the need for the replacements. Thereupon, on motion by Councilman DeMaio, seconded by Councilman McMillan, it was unanimously, RESOLVED, 8 July 6, 1977 That this Board hereby authorizes the Westchester Joint Water Works to install 570 feet of 12-inch water main and appurtenances on Garfield Street replacing the existing main at a total cost of $20,000.00 with the Town of Mamaroneck's share being $4,500.00 as submitted in estimate dated June 23, 1977. 7. Acknowledgement - 1st Quarterly Report -Westchester Joint Water Works Supervisor Vandernoot presented the above-mentioned report which was herewith ordered received and filed for the record. 8. Report - Comprehensive Study of Water System by Hazen & Sawyer Engineers The Supervisor acknowledged receipt of the above-captioned report herewith presented and ordered received and filed. The Supervisor noted that upon further study of the report, the Board would take whatever action it deemed necessary to assure an adequate water supply for the foreseeable future. 9. Request for Block Party A letter addressed to the Town Board under date of June 15, 1977 from Chip Hargrave of 6 Colonial Avenue, Town, requesting permission for a block party on Colonial Avenue was herewith presented and ordered received and filed. The Clerk reported that she had obtained the necessary approvals from the Police Chief, V.A.C. and the Fire Chief and thereupon on motion by Councilman Perone, seconded by Councilman DeMaio, it was unanimously, RESOLVED, That the request of Chip Hargrave of 6 Colonial Avenue, Town, to hold a block party on July 17, 1977 from 5:30 p.m. to 10:00 p.m. (or in the event of rain, July 24, 1977) on the portion of Colonial Avenue extending from Damon Terrace to Weaver Street be and it hereby is approved; And be it further RESOLVED, That Chip Hargrave be notified accordingly. COMMUNICATIONS (Cont'd) 1. Notification of Final State Equalization Rate - 1976 Assessment Roll The Supervisor presented the Notice of the Final State Equalization Rate which was received from the State Board of Equalization and Assessment under date of June 29, 1977. Following his notation that after a hearing, the tentative rate had been adjusted to 28.57%, the Supervisor ordered the Notice received and filed for the record. 2. Notification of Tentative Special Franchise Assessments The Notice of Tentative Special Franchise Assessments was presented and, following some discussion, it was ordered received and filed. 3. Letter, Senator Pisani Re: Home Rule Request A letter addressed to the Supervisor under date of June 13, 1977 by Senator Joseph R. Pisani, State Senator, regarding the status in the State Senate of the Town's Home Rule Request to abolish the Town of Mamaroneck Park District was herewith presented and ordered received and filed. Councilman Bloom noted that the first step in the actual implementation would be whether 9 July 6, 1977 or not the Park Commission could function in its present capacity or be reassigned as a Park Committee. 4. Letter, Conrail The Supervisor read a letter addressed to him under date of June 13, 1977 by Walter G. Rescorla, Police Superintendent of Conrail, commending the Town of Mamaroneck Police Department for its aid to the Conrail Police in the investigation of an incident in which the Engineer of a train passing under the Weaver Street bridge was seriously injured by a rock thrown from above. The letter, herewith ordered received and filed, specifically mentioned the fine work of Detective Sergeant.Thomas Mahoney and Detective Peter Gerardi, as well as Police Chief Robert Barasch, in apprehending the perpetrator and commended the Department for its assistance and cooperation. 5. Letter, Irving Scharf, Richbell Road Parking Committee. This item was taken up earlier on the agenda. 6. Letter, Alice Model, Larchmont Committee on the Arts Supervisor Vandernoot acknowledged receipt of a letter sent to him by Alice Model, Chairman of the Larchmont Committee on the Arts, thanking him for cooperating to make the Larchmont-Mamaroneck Summer Musical Theatre project possible. The letter was herewith ordered received and filed for the record. 7. Notice of Public Hearing Re: Petition of Joseph Charla, Jr. The aforesaid Notice was herewith presented and ordered received and filed. TOWN CLERK Regular Reports The Town Clerk presented the following reports which were ordered received and filed: Report of the Town Clerk for the months of May and June, 1977 Report of the Building & Plumbing Inspector for the month of June, 1977 THE SUPERVISOR 1. Report - Recycling The Supervisor detailed a trip he and Virginia Braumann took to the Town of West Orange in order to observe their recycling program. The Supervisor stated a program of smashing the voluntarily recycled glass at the Town Yard and then having it hauled away would be studied. Nancy Hartford added the current cost of the recycling program was approximately equal to the revenue received by the Town from selling the glass. The new program would involve building a permanent bin for the glass as opposed to the dumpsters currently rented by the Town. The program would also involve having trucks from NJ haul the smashed glass out of the County. 2. Report - Solid Waste Supervisor Vandernoot referred to the problem of solid waste and noted the cost increase of the Grasslands facility. He further noted that he is not presently aware of what is going on. Some communities have incinerators which will have to be closed and referred to Mr. Passidono's request to the County for a piece of Saxon Woods, but noted another site further up on Mamaroneck Cove (other side of Hutchinson River Parkway). 3. Report - Supervisor's Conference 10 July 6, 197.7 Supervisor Vandernoot - effective January 1, 1978 - did pass resolution regarding certain employees being exempt from unemployment insurance. A change is being studied in the fiscal year to July 1st. THE COUNCILMEN Councilman Bloom 1. Report - Closing of Obstetrics & Related Services at United Hospital Councilman Bloom described the meeting held on June 30, 1977 at United Hospital to discuss closures of Maternity Facilities at United, Lawrence, St. Agnes and other hospitals. He reported those in attendance at the meeting made rational and moving arguments as to why United's maternity facility should not be shut down. Councilman Bloom suggested to those in attendance that they send a telegram asking the TASK force to reserve its decision until a hearing was held in Westchester County where adequate opportunity would be given for people to be heard. Councilman Bloom wrote a telegram requesting this. It was read by the Supervisor and sent off the next day. 2. Apportionments Councilman Bloom presented the following apportionments and on his motion, seconded by Councilman McMillan, the following resolution was unanimously adopted: WHEREAS, the Assessor has presented petition for the correction of the assessment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Tax Law; And WHEREAS, after due consideration, this Board finds it desirable to grant said petition for the correction of said assessment roll; NOW, THEREFORE, BE IT RESOLVED, That the assessment roll of 1976-77, school taxes of 1977, which shows property now appearing on the roll as follows: BLOCK PARCEL OWNER LAND IMPROVE. The council has had two meetings since their appointment and have reviewed various issues such as the property maintenance code, having someone attend rent meetings in Yonkers, review of the Section 8 Housing Program, and parking problems in the Richbell Road area. Councilman Perone 1. Solar Energy Committee Meeting The Committee has been in contact with various cities regarding proposed codes and ordinances under study. The Chairman, Moses Cammer, has obtained a minimum property standards basis for code development in use of Solar Energy and Heating for 1 and 2 family dwellings. He also obtained drafts of the Parkway, Housing and Urban Development for the Hudson. 2. Dog Situations Councilman Perone requested the Town Attorney look into updating the Town of Mamaroneck's ordinances as they pertain to barking dogs and dogs at large so fines are compatible with the Village of Larchmont, the Village of Mamaroneck and the City of New Rochelle who all have higher fines. Councilman Perone also suggested working with the Police Department to deal with enforcement of the current laws as well as obtaining evidence against citizens who have continuously barking dogs. THE TOWN ATTORNEY Authorization for Drain Easements (not on the Agenda) Mr. Johnston stated he needed a resolution from the Board authorizing the Supervisor to sign some drain easements which the Engineering Department said they need immediately. The agreements have been prepared, and are awaiting the Supervisor's signature so they can be passed on to the two owners who are going to be burdened with the easement area. 1. Authorization - Settlement of Certiorari Proceedings Mr. Johnston asked that this be kept confidential until disposal of the matters. 12 July 6, 1977 ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 11:47 p.m. BOARD OF FIRE COMMISSIONERS Board of Fire Commissioners' Fire Report for the Month of May 1977 from Peter R.
