MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF
MAMARONECK, HELD APRIL 20, 1977 IN THE AUDITORIUM OF THE WEAVER
STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 P.M.

APPROVAL OF MINUTES
The minutes of the regular meeting of May 5, 1976 were presented
and on motion by Councilman Perone, seconded by Councilman DeMaio,
approved as submitted.
The minutes of the special meeting of May 14, 1976 were presented
and on motion by Councilman McMillan, seconded by Councilman
DeMaio, approved as submitted. Councilman Bloom abstained from
voting since he had not been in attendance at that meeting.
OLD BUSINESS
1. Set Date for Public Hearing - Increase in Building & Plumbing
Department Fees
Supervisor Vandernoot noted that the above captioned subject had
been discussed at two previous meetings and now that the Board
has had the opportunity to review thoroughly the proposed
revisions, the following resolution was adopted by unanimous vote
of the Board:
RESOLVED, that a public hearing will be
held by this Board at its regular meet-
ing on Wednesday evening, May 4, 1977
in the Auditorium of the Weaver Street
Firehouse, Weaver Street, Town of
Mamaroneck, for the purpose of consider-
ing amending the Schedule of Fees now
set forth in the Building Code, Plumbing
Code, Smoke Control Code, Fire Preven-
tion Code and Zoning Code of the Town
of Mamaroneck;

and be it further
RESOLVED, that the Clerk be and she hereby
is authorized to publish in the official
newspaper of the Town of Mamaroneck, "The
Daily Times", Notice of such hearing as
required by law.
2. Report of Fact Finder - Paid Firemen's Impasse
The Supervisor announced that the Fact Finder in the above
captioned matter has recommended an $1,100.00 increase
effective January 1, 1977 with an additional $500.00
increase effective July 1, 1977. Following some discussion
in which Mr. Vandernoot urged residents to contact
Assemblyman Ryan and Senator Pisani relative to negotiations
with municipal employees and ask them not to extend the
state's binding arbitration law, it was unanimously so
ordered that the Supervisor be authorized to meet with
the representatives of the Paid Firemen's Union and to use
his best judgement on how to proceed.
3. Report of Bids - Storm Drains - Contract No. 77-2 & No. 77-3
A memorandum addressed to the Board by the Town Engineer, Town
Attorney, and Superintendent of Highways under date of April
20, 1977, enumerating the bids and recommending award thereof
was herewith presented and ordered received and filed as part
of the record of this meeting. Thereupon, on motion by
Councilman Perone, seconded by Councilman McMillan, it was
unanimously
RESOLVED, that this Board hereby accepts the
bid of the low bidder for the following:
Contract No. 77-2 Storm Drain Improvements
Mulberry Lane - J. Carducci, Inc. - $16,913.50
And, whereupon on motion by Councilman Perone, seconded by
Councilman Bloom, it was unanimously
RESOLVED, that this Board hereby accepts the
bid of the low bidder for the following:
Contract No. 77-3 - Storm Drain Improvements
Easement 12 Jason Lane - Manny Excavating - $6,938.00
4. Report of Bids - Sanitary Sewer - Contract No. 77-4
Pursuant to memorandum addressed to the Board by the Town Engineer,
Town Attorney, and Superintendent of Highways under date of April
20, 1977 enumerating the bids and recommending award thereof and
herewith presented and ordered received and filed, on motion by
Councilman Perone, seconded by Councilman DeMaio, it was unanimously
RESOLVED, that this Board hereby accepts the
bid of the low bidder for the following:
Contract No. 77-4 - Sanitary Sewer Improvements
Myrtle Boulevard - DiBaccari & Riccio - $32,110.00

5. Bond Resolution - Construction of Storm Drains
Pursuant to the Comptroller's request, the following resolution
was offered by Councilman Bloom who moved its adoption, seconded
by Councilman DeMaio, to-wit:
BOND RESOLUTION DATED APRIL 20, 1977.
III A RESOLUTION AUTHORIZING THE ISSUANCE OF
$75,000 SERIAL BONDS OF THE TOWN OF
MAMARONECK, WESTCHESTER COUNTY, NEW YORK,
TO PAY THE COST OF THE CONSTRUCTION OF
STORM DRAINS IN AND FOR SAID TOWN.
BE IT RESOLVED, by the Town Board of the
Town of Mamaroneck, Westchester County,
New York, as follows:
Section 1. The class of objects or
purposes to be financed pursuant to
this resolution is the construction
of new storm drains and appurtenant
facilities in and for the Town of
Mamaroneck, Westchester County, New
York.
Section 2. The maximum estimated
cost of such class of objects or
purposes is $75,000, and the plan for
the financing thereof is by the issu-
ance of $75,000 serial bonds of said
Town, hereby authorized to be issued
pursuant to the Local Finance Law.
Section 3. It is hereby determined
that the period of probable usefulness
of the aforesaid class of objects or
purposes is thirty years, pursuant to
subdivision 11(a) (1) of paragraph a
of Section 11.00 of the Local Finance
Law. It is hereby further determined
that the maximum maturity of the aerial
bonds herein authorized will not exceed
five years.
Section 4. The faith and credit of
said Town of Mamaroneck, Westchester
County, New York, are hereby irrevo-
cably pledged to the payment of the
principal of and interest on such
bonds as the same respectively become
due and payable. An annual appropria-
tion shall be made in each year suffi-
cient to pay the principal of and
interest on such bonds becoming due
and payable in such year. There
shall annually be levied on all the
taxable real property in said Town a
III tax sufficient to pay the principal
of and interest on such bonds as the
same become due and payable.

Section 5. Subject to the provisions of the
Local Finance Law, the power to authorize the
issuance of and to sell bond anticipation
notes in anticipation of the issuance and sale
of the serial bonds herein authorized, includ-
ing renewals of such notes, is hereby delegated
to the Supervisor, the chief fiscal officer.
Such notes shall be of such terms, form and
contents, and shall be sold in such manner,
as may be prescribed by said Supervisor,
consistent with the provisions of the Local
Finance Law.
Section 6. The validity of such bonds and
bond anticipation notes may be contested only
if:
1) Such obligations are authorized
for an object or purpose for
which said Town is not authorized
to expend money, or
2) The provisions of law which should
be complied with at the date of
publication of this resolution are
not substantially complied with,
and an action, suit or proceeding contesting such
validity is commenced within twenty days after
the date of such publication, or
3) Such obligations are authorized
in violation of the provisions
of the Constitution.
Section 7. This resolution, which takes effect
immediately, shall be published in full in The
Daily Times, the official newspaper, together
with a notice of the Town Clerk in substantially
the form provided in Section 81.00 of the Local
Finance Law.
The question of the adoption of the foregoing
resolution was duly put to a vote on roll call,
which resulted as follows:

The resolution was thereupon declared duly adopted.

Supervisor Vandernoot diverted from the usual procedure and
took up Item #5 under THE SUPERVISOR. In noting the presence
of students from Hommocks School and Mamaroneck High School,
on behalf of the Board he commended them for their participa-
tion in Convention II 1977, a model congress held in Washington,
D.C. Following the introduction of the Chairman of the group,
Timothy Leighton, who briefly recited the origin and purpose
of Mamaroneck High School's Model Congress and described the
proceedings that took place in Washington, D.C. , on motion
unanimously made and seconded, the following resolution was
presented to Timothy Leighton as Chairman with a copy thereof
for each student who attended Convention II 1977:
WHEREAS, thirty-five students from Mamaroneck
High School and twenty-three students
from Hommocks School attended Convention
II 1977 in the Chambers of the Congress
of the United States along with one
hundred thirty-four students from five
other States,
and
WHEREAS, their purpose was to meet the challenges
of today and during the course of their
session proposed eighty-two amendments
to the Constitution of which fifteen
passed Committees and eight were con-
sidered in Convention Plenary sessions,
and
WHEREAS, these actions attest to the competence,
diligence, leadership, maturity and
serious application to government and
law of these students and has earned
them the highest praise and admiration
of all with whom they came in contact
in our Nation's Capitol,
NOW, THEREFORE, BE IT
RESOLVED, that the Town Council of the Town of
Mamaroneck is proud of the efforts of
all the young Americans who participated
in this historic event and takes special
pride in the participation of the local
students whose names are attached to and
made a part of this resolution,
and be it further
RESOLVED, that this resolution shall be spread
upon the minutes of this meeting and
a copy presented to each of the delegates
named herein.

NEW BUSINESS
1. Set Date for Public Hearing - Local Law #1-1977 - S.E.Q.R.
Supervisor Vandernoot expressed the Board's mixed feelings about
the State Environmental Quality Review Law and deferred to
Councilman Bloom who reiterated what the Supervisor said and
called to attention that the law is a lengthy and complex piece
of legislation, will require environmental impact statements
before approval of construction projects and will add admin-
istrative costs to the Town. Councilman Bloom further commented
that since the State has in effect mandated passage by certain
dates and our Town Attorney has worked hard and long to prepare
a draft of a local law, it is in order that a date for a public
hearing be set on said local law, and thereupon on his motion,
seconded by Councilman DeMaio, it was unanimously
RESOLVED, that a public hearing will be
held by this Board at its regular meeting
on Wednesday, May 4, 1977, in the
Auditorium of the Weaver Street Firehouse,
Weaver Street, Town of Mamaroneck, for the
purpose of considering the adoption of
Local Law #1-1977 entitled Environmental
Quality Review Law for the Town of
Mamaroneck.
and be it further
RESOLVED, that the Town Clerk be and she
hereby is authorized to publish the Notice
of said hearing in "The Daily Times", the
official newspaper of the Town of Mamaroneck,
as required by law.
2. Salary Authorization - Patrolman
Pursuant to memorandum addressed to the Town Board by the Chief
of Police, Robert M. Barasch under date of April 19, 1977,
herewith presented and ordered received and filed, on motion by
Councilman DeMaio, seconded by Councilman McMillan, it was
unanimously
RESOLVED, that this Board hereby authorizes
that Patrolman Raffaele J. Cerbone be
compensated in the amount of $14,894.00 per
annum, effective as of April 28, 1977.
3. Authorization - Advertise for Bids - Van for Highway Department
Pursuant to memorandum addressed to the Board by the Town Engineer
under date of April 20, 1977, herewith presented and ordered
received and filed for the record, on motion by Councilman Perone,
seconded by Councilman McMillan, it was unanimously
RESOLVED, that this Board hereby authorizes
publication in the official newspaper of the
Town of Mamaroneck, "The Daily Times", of a
Notice of Bids for a Van for the Highway
Department, said bids to be returnable on
May 2, 1977 and reported to the Town Board
on May 4, 1977.

4. Approval of Claim - Narcotics Guidance Council
A letter and attached claim addressed to the Town Board under
date of April 5, 1977 by Dr. Frederick J. Feuerbach, Chairman
of the Narcotics Guidance Council requesting funds to adequately
cover the expense of liability insurance for its members was
herewith presented by Councilman McMillan and ordered received
and filed and on Mr. McMillan's motion which was seconded by
III Councilman Perone, it was unanimously
RESOLVED, that this Board hereby authorizes
payment of $935.00 to H & R Phillips, Inc.
for General and Professional Liability
Insurance covering the members of the
Narcotics Guidance Council, such payment
to be made as a General Town charge.
In answer to a question posed by Mrs. Paula Willey, Councilman
McMillan noted that in the past all three municipalities had
shared the cost, but at this time it is uncertain of the other
contributions this year, and for that reason he felt it was
important that the Town accept and pay the voucher.
5. Authorization to Adjust 1977 Budget - Comptroller's Request
Pursuant to memorandum addressed to the Board by the Comptroller
under date of April 19, 1977 herewith presented and ordered
received and filed, on motion by Councilman Bloom, seconded by
Councilman McMillan, it was unanimously
RESOLVED, that this Board hereby authorizes
the Comptroller to adjust the 1977 Budget
by $5,236.00 in the Federal Revenue Fund

and $7,223.00 in the General Fund, said
adjustments being made as the result of
monies received per Anti-Recession Fiscal
Assistance.
6. Authorization to Open Savings Account - Capital Fund
Pursuant to presentation of the Comptroller's memorandum under
date of April 14, 1977, herewith ordered received and filed,
on motion by Councilman McMillan, seconded by Councilman Perone,
it was unanimously
RESOLVED, that this Board hereby authorizes
the Comptroller and the Deputy Comptroller
to open a savings account with Barclay's
Bank of New York, Mamaroneck Avenue,
Mamaroneck, New York, for the Town of
Mamaroneck Capital Fund;
and it is further
RESOLVED, that hereafter all deposits and
withdrawals shall be authorized when
signed by the signature or facsimile
signature of Joseph F. Vandernoot, Super-
visor, and Carmine A. DeLuca, Comptroller;

Genevieve F. Soriano, Deputy Comptroller.

7. Authorization to Open Savings Account - Federal Revenue Sharing
Upon presentation of the Comptroller's memorandum addressed to
the Board under date of April 14, 1977 and herewith ordered
received and filed for the record, on motion by Councilman
McMillan, seconded by Councilman Perone, it was unanimously
RESOLVED, that this Board hereby authorizes
the Comptroller and Deputy Comptroller to
open a savings account with the Bank of New
York, Mamaroneck Avenue, Mamaroneck, New
York for the Town of Mamaroneck Federal
Revenue Sharing Fund;
and it is further
RESOLVED, that hereafter all deposits and
withdrawals shall be authorized when signed
by the signature or facsimile signature of
Joseph F. Vandernoot, Supervisor, and
Carmine A. DeLuca, Comptroller; or Joseph
F. Vandernoot, Supervisor and Genevieve F.
Soriano, Deputy Comptroller.
8. Appointment to. Committees
a) Community Action Program Board of Directors
Following Councilman DeMaio's review of Dr. William DiScipio's
particular qualifications and willingness to serve this community,
on his motion, which he offered with pleasure, and seconded by
Councilman Bloom, it was unanimously
RESOLVED, that Dr. William DiScipio of
40 Myrtle Boulevard, Town, be and he
hereby is appointed to represent the
Town of Mamaroneck on the Board of
Directors of the Community Action
Program effective immediately to fill
the vacancy created by the resignation
of George Mulcahy;
and be it further
RESOLVED, that Dr. DiScipio be notified
accordingly.
b) Board of Ethics
Councilman McMillan called to attention the vacancy existing on
the above mentioned Board and proposed the name of former Town .
Councilman Thomas E. White of 260 Barnard Road, Town and noted
that the Town is fortunate that he is willing to serve and upon
his motion, seconded by Councilman DeMaio, it was unanimously
RESOLVED, that this Board hereby appoints
Mr. Thomas E. White a member of the Board
of Ethics of the Town of Mamaroneck,
effective immediately and to serve for the
remainder of this year;
and be it further
RESOLVED, that Mr. White be notified
accordingly.

c) Committee on Family and Youth
Following the Supervisor's reference to the Committee's decision
to change the participation category, and since Councilman DeMaio
had attended many of their meetings, Supervisor Vandernoot
proposed that Mr. DeMaio be appointed an Advisory Member of that
committee, and on motion by Councilman Bloom, seconded by
Councilman Perone, it was unanimously
RESOLVED, that this Board hereby appoints
Councilman Harry B. DeMaio an Advisory
Member to the Larchmont-Mamaroneck
Committee on Family and Youth effective
immediately.
COMMUNICATIONS
1. Public Notice - Village of Larchmont Zoning Board of Appeals
The aforesaid Notice was herewith presented and ordered received
and filed for the record.
NOT ON AGENDA
A delegation of five physicians with Dr. Norman Steiger as the
spokesman addressed the Board concerning the dispute at United
Hospital between the doctors and hospital administration
regarding diminishing quality patient care. Their request was
specifically for the Town Board to call for the reinstatement
of Dr. William Felch as Chief of Staff and Dr. Sam Drago as
Chief of Medicine, and for the resignations of President Richard
Stolnacke and Chairman of the Board Richard Dammann. During a
rather lengthy discussion Dr. Edwin H. Kaufman, Dr. James J.
Doyle, Dr. Thomas Landau and Dr. Martin Neschis joined Dr.
Steiger in relating the facts of the on-going problem and the
members of the Town Board indicated that they had not had an
opportunity to study the issues and did not wish to take sides.
Whereupon on motion by Councilman Perone, seconded by Councilman
Bloom, the following resolution was unanimously adopted by the
Board:
WHEREAS, this Board is distressed at the
crisis at United Hospital,
and
WHEREAS, since this crisis may affect quality
patient care,
IT IS HEREBY
RESOLVED, that this Board urges immediate
discussion to settle problems
between the Executive Committee
of the doctors and the Board
of Trustees. Further we
suggest that all terminations
of',personnel be reconsidered
pending the result of these
discussions.

TOWN CLERK
Regular Reports
The Clerk presented the following report which was ordered
received and filed:
Report of the Building & Plumbing Inspector
for the month of March 1977.
THE SUPERVISOR
1. Suggested Change in County Solid Waste Act
Supervisor Vandernoot acknowledged receipt of the proposed amend-
ment to the original County Solid Waste Act and announced that
this Board finds the provisions of Section 2 satisfactory since
it removes any reservations the Board had regarding the implemen-
tation of the Act.
Thereupon on motion duly made and seconded it was unanimously so
ordered that the Supervisor write to the County Board of Legislators'
Committee on Legislation indicating the Town Board's approval of
the passage of the Act as long as the provisions of Section 2
remain in the proposed legislation.
Mr. Vandernoot announced at this time that he has been notified
by the County that the rate for dumping at Croton will go from
$9.75 per ton to $12.50 starting in January 1978.
2. Proclamation - Environmental Enhancement Week
With the unanimous consent of the Board, the Supervisor issued
the following proclamation:
PROCLAMATION
WHEREAS, we recognize the importance of our re-
lationship to our natural environment
to gain renewal of spirit and awareness
of the genuine wonder of nature;
and
WHEREAS, the New York Turf and Landscape
Association and the Cooperative
Extension Service of Hudson Valley
and Long Island and the Long Island
Gardeners Association work cooper-
atively to stimulate interest and
provide education for the public
in the conservation and care of our
environment;
and
WHEREAS, a member of the Board of Directors
of the New York Turf and Landscape
Association and the Cooperative Ex-
tension Service will donate and plant
an ornamental tree on Arbor Day, April
the 29th, 1977, on Town property to
add to our natural resources;

NOW, THEREFORE,
I, Joseph F. Vandernoot, Supervisor of
the Town of Mamaroneck, do hereby pro=
claim the week of April 24th through
April 30th, 1977
Environmental Enhancement Week
in the Town of Mamaroneck and urge my
fellow citizens to increase their per-
sonal enjoyment and appreciation of
the beauty inherent in natural harmony
by adding the joy of living plants to
their daily lives.
3. Proclamation - Law Day
Pursuant to Supervisor Vandernoot's acknowledgment of receipt
of a letter addressed to him by George P. Forbes, Jr. , President
of the local Bar Association, the aforementioned being herewith
ordered filed, and on presentation by Councilman Perone, the
following proclamation was unanimously issued:
PROCLAMATION
Our Courts of Law - representative of the
vast judi system s stem of our state and nation -
are one of the cornerstones of our structure
of government. They have been a bulwark in
recognizing the importance of every person,
in protecting individual rights and
maintaining a free society.
It is fitting, therefore, that on the occasion
of the 20th annual nationwide observance of
LAW DAY U.S.A. on May 1, we as citizens of
this city, state and nation, reflect on our
great heritage: a system of government under
laws devised by representatives of the people
and administered by independent courts.
As responsible citizens we should become more
aware of Court needs and problems and our role
in support of them; we should be mindful of
the great new demands being placed upon them
because of growth in government and litigants;
and we should champion legislative efforts to
improve and modernize our Courts. They need
and deserve the support and good will of every
American.
Now, Therefore, I, Joseph F. Vandernoot, Super-
visor of the Town of Mamaroneck, do hereby
proclaim Sunday, May 1, 1977, as LAW DAY U.S.A.
in the Town of Mamaroneck and urge the people,
organizations, churches, schools and the media
of public information to observe Law Day with
appropriate ceremonies and recognition and to
reaffirm their faith in our judicial system.

4. Report on Rent Subsidy Program
Mr. Vandernoot reported that the preliminary stages of the program
are complete, local landlords have given assurance of full
cooperation and several leases on subsidized units are about to be
signed. He further noted that an application has been received
from HUD to apply for additional units and upon motion duly made
and seconded, it was unanimously
RESOLVED, that the Supervisor be and he
hereby is authorized to execute the
application required in order to subsidize
an additional 100 units under Section 8;
and be it further
RESOLVED, that a copy of this resolution
be forwarded to Larchmont Village.

1. Apportionment
Upon Councilman Bloom's presentation of the following apportionment
and on his motion, seconded by Councilman McMillan, the following
resolution was unanimously adopted:
WHEREAS, the Assessor has presented petition
for the correction of the assessment roll
for certain years pursuant to the provisions
of Section 557, Article 16 of the Westchester
County Tax Law;
and
WHEREAS, after due consideration, this Board
finds it desirable to grant said petition
for the correction of said assessment roll;
NOW, THEREFORE, BE IT

IllCouncilman Perone
Mr. Perone noted that pursuant to the two recent shootings of
Police Officers Dematte and McLeod, he has drawn up a proposal
to provide tax exemptions to families of public safety employees
who are killed in the line of duty and is forwarding it to the
State Legislature.
THE TOWN ATTORNEY
1. Report re Certioraris
Mr. Johnston announced that the reports he had planned to present
this evening will have to be delayed due to the lack of receipt
of the necessary information.
2. Report re Guadagnola vs. Zoning Board
The Town Attorney reported on the recent Supreme Court decision
relative to the above mentioned matter. He stated that Judge
Isaac Rubin dismissed Mr. Guadagnola's petition which sought to
have declared illegal the Town's Zoning Board refusal to permit
a proposed seven-story building.
3. Report re Con Edison & State Board of Equalization
Mr. Johnston stated that the above noted matter in which the
Town has joined with four other communities is still pending
and a decision will be forthcoming soon.
ADJOURNMENT

The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.

Commissioner Bloom, seconded by Commissioner DeMaio, it was

3. Other Business
Commissioner Bloom briefly reported on two items. First he
noted that the Fire Council informed him by letter under
date of April 14, 1977 that they are still in the process
of reviewing the Fire Prevention Code.
Secondly, he referred to the Fire Chief's request for matching
funds from the Town in order to affect a proper celebration
in 1982 of the Fire Department's 75th Anniversary and stated
the matter will be discussed by the Board prior to a decision
being rendered.

before the Board, on motion unanimously made and seconded,
this meeting, to reconvene on May 4, 1977, was declared
adjourned at 10:42 P.M. in memory of Earl Mellor, former
Town of Mamaroneck Fireman, with a moment of silent prayer
