HomeMy WebLinkAbout1919_02_21 Town Board Minutes Minutes of meeting of the Town Board of the Town of Mamaroneck held February 21st, 1919. Supervisor Burton called the meeting to order at 8:30 P.M. The Clerk reported the following present: Supervisor Burton, Justices Collins, Boyd, Dudley, Shafer, Clerk Fairchild and Ralph A. Gamble, Counsel. The minutes of the meeting of February 10th, 1919, were read, and upon motion approved. The Supervisor presented a communication from Receiver of Taxes Howell, asking for the approval by the Board of the appoint- ment of Harry T. McGivney as Deputy Receiver of Taxes for the year 1919. Upon motion duly made, seconded and carried, it was RESOLVED that this Board condirm the appointment of Mr. McGivney as Deputy Receiver of Taxes and that the communi- cation be received, filed and spread in full upon the minutes, and it is as follows: "RECEIVER OF STATE, COUNTY, TOWN AND SCHOOL TAXES" TOWN OF MAMARONECK NEW YORK Office of Receiver of Taxes 8 Elm Street MAMARONECK, N.Y. "T. Palmer Howell, Receiver "H.T. McGivney, Deputy Receiver. February 18th, 1919. "To The Honorable Town Board, " Town of Mamaroneck, " Mamaroneck, N.Y. "Gentlemen: " I respectfully ask the approval of your Honorable "Board, of the appointment of Harry T. McGivney as " Deputy Receiver of Taxes, for the Town of Mamaroneck, "dating from January 1st, to December 31st, 1919. " Respectfully yours, " T. Palmer Gowell " Receiver of Taxes. " Upon motion duly made, seconded and carried, it was RESOLVED that a sum not to exceed $300.00 be appropriated for extra expenses incurred in the office of Receiver of Taxes during the fiscal year beginning April 1st, 1919. Supervisor Burton presented his annual report for the fiscal year ending December 28th, 1918. Upon motion duly made, seconded and carried, it was RESOLVED that the Supervisor's Report for the fiscal year ending in December 28th 1918 be received and placed on file, and that the Supervisor be and he hereby is authorized and direct- ed to have the said report published. The Board next took up the matter of concluding the award- ing of the contract for swill, ashes and garbage and refuse. Messrs. Wm. A. and Wm. I. Palmer appeared before the Board in regard to the dumping grounds to be used by the contractor. The contract as prepared by Counsel was then taken up and referred to a Commit- tee consisting of Justices Shafer, Collins and Dudley. The Com- mittee was instructed to take up with the proposed contractor the terms of the contract and the location of the dumping ground, and report back to this Board on February 24th, 1919. The Supervisor presented the Budget for the year 1919 and the Budget was read and considered item by item, and upon motion, duly made, seconded and carried it was RESOLVED that the budget for the year 1919 as presented by the Supervisor be and the same hereby is approved; and it was FURTHER RESOLVED that the said Budget be spreat at length upon the minutes, and it is as follows: "BUDGET OF THE TOWN OF MAMARONECK For the Year 1919 First:- RESOLVED, that there be levied and assessed upon the taxable property of the Town of Mamaroneck, and collected, the following amounts foe the purposes hereinafter set forth, to wit:- a. To pay the salary of the Supervisor under the Westchester County Tax Act, $2,000.00 b. To pay the salary of the Clerk to the Supervisor, 960.00 c. To pay the salary of the Receiver of Taxes, 3,600.00 d. To pay the salaries of 3 Assessors, 4,050.00 e. To pay the salary of the Overseer of the Poor, 1,000.00 f. To pay the salary of the Janitress of the Town Hall, 600.00 g. To pay the compensation of the Super- visor in Highway matters, 500.00 h. To pay to the Town Clerk compensation in Highways matters, 300.00 i. To pay to the Town Clerk compensation in Election matters, 600.00 j. To pay the salary of the Highay Sup't, 1,525.00 k. To pay rent of Court rooms for the Justices of the Peace, 960.00 Amount carried forward, $16,095.00 Amount brought forward, $16,095.00 l. To pay for the rent of offices for the Town Clerk, Supervisor, Assessors, Receiver of Taxes and Town Auditors, 540.00 m. To pay for this rent of office for the Overseer of the Poor, 100.00 n. To pay for the temporary support of the poor, 4,500.00 o. To pay compensation of election officials, rent of polling places and supplies, 2,500.00 p. To pay assessment map bond #5, due Nov. 1, '19, 1,000.00 q. To pay interest on $6,000.00 assessment map bonds, 300.00 Total, Town at large, $25,035.00 OUTSIDE OF VILLAGES OF LARCHMONT & MAMARONECK Second:- RESOLVED, that there be levied and assessed upon the taxable property of the Town of Mamaro- neck lying outside of the corporate limits of the Villages of Larchmont and Mamaroneck, and collected, the following amounts for the purposes hereinafter set forth, to-wit:- a. To pay Boston Post Road (Dillon Park) Highway improvement bond #10, due May 1st, 1919, 1,000.00 b. To pay interest on $3,000.00 Boston Post Road Highway improvement bonds, at 5% 150.00 c. To pay Murray Avenue Highway improvement bond #2, due September 1st, 1919, 1,000.00 d. To pay interest on $7,000.00 Murray Avenue Highway Improvement bonds, at 5% 350.00 e. To pay Murrya Avenue Completion Highway Improvement bond #4, due September 1st, 1919. 1,000.00 f. To pay interest on Murray Avenue Completion Highway Improvement bonds in the sum of $12,000.000 at 4-1/2%, 540.00 g. To pay Boston Post Road Highway Improve- ment bond #5, due July 1st, 1919, 2,000.00 h. To pay interest on $24,000.00 Boston Post Road Highway Improvement bonds, at 4-1/2% 1,080.00 i. To pay interest on $10,000.00 Chatsworth Ave- nue Highway Improvement Bonds, at 5% 500.00 j. To pay sidewalk improvement bond #2, due September 1st, 1919, 1,000.00 k. To pay interest on $9,000.00 sidewalk im- provement bonds at 5% 450.00 l. To pay interest on $4,000.00 sidewalk im- provement bonds (second issue) at 5% 200.00 Amount carried forward $9,270.00 Amount brought forward $9,270.00 m. To pay sidewalk improvement bond #1, (second issue) due March 1st, 1919, 1,000.00 n. To pay audited claims for the construction of sidewalk, 1,080.00 o. To pay salary of special constable, 1,020.00 p. To pay salary of Health Officer, 300.00 q. To pay salary of Clerk to Board of Health, 100.00 Total, Outside of Villages, $12,770.00 Lighting District. Third:- RESOLVED, that there be levied and assessed upon the taxable property of the Town of Mamaroneck lying within the Lighting District of said Town, and collected, the sum of $4,000.00 to pay for rental of street lights for the year 1919. 4,000.00 Fire District No.1. Fourth:- RESOLVED, that there be levied and assessed upon the taxable property of the Town of Mamaro- neck lying within Fire District No.1, and col- lected, the following amounts for the purposes hereinafter set fourth:- a. To pay or rental of fire hydrants, 1,500.00 b. To pay the salary of a Special Constable, 1,020.00 c. To pay audited claims for the alteration of Weaver Street Fire House, 1,250.00 d. To pay Fire District Bonds #1 and #2, due July 1st, 1919, 2,000.00 e. To pay interest on $10,000.00 Fire District Bonds, at 5% 700.00 f. To pay for repairs, equipment and maintenance of fire apparatus and fire house, 350.00 Total, Fire District No.1, $7,820.00 FIRE DISTRICT NO.2. Fifth:- RESOLVED, that there be levied and assessed upon the taxable property of the Town of Mamaroneck lying within Fire Disctict No.2, and collected, the following amounts for the purposes hereinafter set forth:- a. To pay rental of fire hydrants, 90.00 b. To pay rental of fire house and for equip- ment, maintenance and repair of fire apparatus, 216.00 Total, Fire Disctict No. 2, $306.00" Counsel reported that he had settled the Valentine- Malaney tax matter with Mr. Rumsey for the sum of One Hun- dred and Fifty Dollars ($150.00), and presented a resolution for the approval of the Board. Upon motion duly made, seconded and carried, it was resolved: WHEREAS on November 1st, 1918 a petition was presented on behalf of Ellen Valentine who was at that time the owner of a portion of Lots numbers 85, 87 and 91 "Map of Washing- tonville, Surveyed by C.B. Hopkins, Surveyor, Mamaroneck, N.Y. of Taxes to cancel certain taxes and assessments which have been levied on said lot amounting to a total of $407.52, $87.50 thereof being the amount of taxes and $320.32 being the approximate amount due with interest, upon the petition- er's making payment of the original amount of said taxes and assessments as of the date when first levied and without pay- ment of the expenses of any tax sale and without interest or additional charges; and WHEREAS said Town Board denied said petition on November 1st, 1918; and WHEREAS on or about December 21st, 1918 an action was commenced in the Supreme Court of Westchester County against the Town of Mamaroneck by one Agnes M. malaney, the then owner of said lots above described, which action alleged that said taxes and assessments have been levied in violation of the statutes for the reasons set forth in said complaint, and asking judgement that said taxes and assessments might be ordered cancelled and annulled; and WHEREAS the Town Board has authorized its appearance to be filed and also has authorized Counsel to take the necessary steps to protect the interests of the Town of Mamaroneck; and WHEREAS the total assessed valuation of the three lots above mentioned is only $500.00; and WHEREAS the said Agnes M. Malaney has offered to make payment of the sum of $150.00 in full payment of all unpaid tazes and assessments and to discontinue the aforesaid action; THEREFORE BE IT RESOLVED, That the Receiver of Taxes be and he hereby is authorized and directed to cancel the fol- lowing said Taxes and Assessments upon the payment by said Agnes M.
