Meeting of TOWN BOARD of the Town of Mamaroneck
held January 14th, 1919.
The meeting was called to order by Supervisor Burton
at 8:30 P.M.
The clerk reported the following present: Supervisor
Burton, Justices Collins and Boyd, John C. Fairchild, Town Clerk
and Ralph A. Gamble. Counsel.
The minutes of the meeting of December 5th, 1918, were
read and upon motion approved.
The minutes of the Public Meeting held at the Weaver
Street School House on December 18th, 1918 for the consideration
of the Ashes and Garbage Matter were read and upon motion approved.
The Supervisor reported, that he had received the Report
of the Receiver of Taxes from the 1st to and including the 16th
of December, 1918.
Same was received and ordered filed and spread upon
the minutes of the meeting, and is as follows:

A communication from the State Tax Comnassioner, and also
one from Local Board of Assessors in relation to attending a Con-
ference of the Tax Officials at Albany was presented to the meeting
and referred to later order of business.
The report of the Receiver of Taxes of 1918, State and
County Taxes uncollected, unpaid taxes for the year 1918 up to and
including December 16, 1918 and also a report showing the amount of
1918 Town and Highway Taxes uncollected to and including December
16th, 1918, were submitted, received, ordered filed and spread upon

Upon notion of Justice Collins, seconded by Justice Boyd
the following resolution was adopted.
WHEREAS, the Receiver of Taxes of the Town of Mamaroneck
has reported to the Town Board of said Town pursuant to the pro-
visions of Section 28 of the Westchester County Tax Laws that at
the close of business of December 16th, 1918, the sum of $7,152.12
in Town and Highway taxes levied on April 1st, 1918, was still
outstanding and uncollected; now, therefore, be it
RESOLVED, that the Supervisor be and he hereby is
authorized and empowered to issue against the aforesaid uncollected
-' 1918 Highway and Town taxes one or more Certificates of Indebted-
ness for a sum not exceeding $7,000.00 and to dispose of the
same for not less than par. Said Certificates to mature at such
time as the Supervisor deems advisable and to bear interest at a
rate not exceeding 5% per annum.
Upon motion of Justice Collins, seconded by Justice Boyd
the following resolution was adopted:
WHEREAS, the Receiver of Taxes of the Town of Mamaroneck
has reported to the Town Board of said Town, pursuant to the provi-
sions of Section 28 of the Westchester County Tax Law that at the
close of business of December 16th, 1918, the sum of $10,447.91
in State and County Taxes levied on April 1st, 1918, was still
outstanding and uncollected: now, therefore, be it
RESOLVED, that the Supervisor be and he hereby is
authorized and empowered to issue one or more Certificates of
Indebtedness for a sum not exceeding $10,000.00 and dispose of the
same for not less than par against the aforesaid 1918 State and
County uncollected taxes. Said Certificates to bear interest at a
rate not to exceed 5% and to mature at such time as the Supervisor
may deem advisable.
Supervisor Burton reported the receipt of a communication
from Mr. Kinley, Attorney for the Westchester Street Railroad
Company regarding fare matters.
Upon motion duly made, seconded and carried it was
received and referred to the Joint Town Board.
The matter of Collection of Ashes and Garbage in Fire
District No. 1 was taken up. Counselor Gamble reported on the
legality of the Town Board entering into a contract for such
collection.
Upon motion of Justice Collins duly seconded by Justice
Boyd, it was
RESOLVED That WHEREAS petitions signed by a number of
residents and taxpayers of Fire, Lighting and Water Supply District
No. 1 of the Town of Mamaroneck outside of any corporate village
have presented to the Town of Mamaroneck petitions asking that the
Town Board provide for the collection and consumption or disposal
otherwise of garbage, ashes or other indestructible matter in the
part of the Town described in said petition, and asking further that
the expense thereof be levied, assessed and collected upon the
taxable prorerty in the district of the Town therein described as
to which said expense is incurred.
AND WHEREAS after hearing Committees representing said
petitioners and duly filing said petitions the Town Board by
resolution duly called a public meeting of the residents of the
aforesaid District of said Town for the public consideration by
the people interested in said matter.
WHEREAS said Public Meeting was pursuant to said
resolution duly called, advertised and held pursuant to said call,
largely attended and the question discussed at length ; and
WHEREAS by resolution the said Public Meeting of resi-
dents and taxpayers approved of and recommended to the Town Board
that it act favorably upon the proposition of the Town assuming
the collection and disposal of ashes, and garbage:
AND WHEREAS it is necessary to advertise for and procure
bids and estimates to ascertain the cost of said collection, con-
sumption or disposal of said garbage, ashes or other indestructible
matter before this Board can proceed further with the matter;
THEREFORE, BE IT RESOLVED that the Supervisor and Town
Clerk be and they hereby are authorized and directed to advertise
for sealed bids and proposals for said collection and disposal of
garbage, ashes or other indestructible matter from that portion
of the Town known as Fire, Lighting and Water Supply District No. 1
of the Town of Mamaroneck for the period of one year;
BE IT FURTHER RESOLVED that the Town of Mamaroneck re-
serves the right to reject any or all bids submitted if it shall
be deemed for the best interests of the Town of Mamaroneck to do so.
Counselor Gamble reported on the Tax suit of Malaney
brought by Merriam & Rumsey against the Town of Mamaroneck. He
stated that process had been served on the supervisor , and that
he had entered the appearance of the Town and had obtained an ex-
tension of time before answering and asked for instructions from
the Board. Upon motion, counsel was directed to confer with
Mr. Rumsey regarding a settlement of the matter and to report back
to the Board.
The matter of the application of the Board of Assessors
to attend the Conference of Tax Officials of the State of New York--
upon motion same was referred back to the Board of Assessors no-
tifying them that the Board approved of their attending said
meeting and calling their attention to the fact that any expense
would be a County charge and without the scope of the Town Board 's
jurisdiction.
On motion the meeting adjourned at 10:15 P.M.
