HomeMy WebLinkAbout1981_06_22 Town Board Special Minutes MINUTES OF A SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD ON THE 22ND DAY OF JUNE 1981 IN THE AUDITORIUM OF THE WEAVER STREET FIREHOUSE, TOWN OF MAMARONECK. Present were the following representing all- members of • the Board: Supervisor Leo Goldsmith, Jr. Councilman Lee H. Bloom Councilman Stewart J. McMillan Councilwoman Charlotte P. Monsell Councilman Thomas R. Amlicke Also present were the following: Town Clerk, Dorothy S. Miller Deputy Town Clerk, Clara Tracy Town Attorney, James J. Johnston Town Engineer, Charles R. Elfreich Conservation Director, P. Thomas Leddy 1. Comptroller' s Request - Authorization to Execute Agreement re Senior Community Services Project Pursuant to presentation of Mr. DeLuca' s memorandum, on motion by Councilman Bloom and seconded by Councilman Amlicke, it was unanimously RESOLVED, that the Comptroller be, and he hereby is, authorized to sign the Agreement between the Town of Mamaroneck and the County of Westchester for the Senior Community Services Project to be effective July 1, 1981 and to terminate on June 30 , 1982. 2. Salary Authorization a) Recreation Upon presentation of the Recreation Superintendent' s memorandum of June 12 , 1981 and on motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes the salary expenditures to the following persons for the terms of employment and at the rate of compensation for each as set forth: (see next page for listing) -1- Music School • I Connie Grossman •Sr. Rec. Assistant 5 weeks $350.00 Councilman McMillan abstained from the vote since his son was one of those for whom salary expenditures were being authorized. b) Highway - Summer Help Pursuant to presentation of P.T. Leddy' s memorandum, on motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes that Robert Byrne, Seasonal Laborer for the Highway Department be engaged at the rate of $4 . 00 per hour effective June 22 , 1981 and terminating August 21, 1981. 3. Appointments - Litter Task Force Committee Councilman Amlicke proposed eight names for appointment to the above-captioned committee and noted that there still remained one vacancy from the Village of Mamaroneck and following a brief discussion, on his motion, which was seconded by Councilman McMillan, it was unanimously RESOLVED, that this Board hereby appoints the following persons as members of the Litter Task Force Committee of the Town of Mamaroneck, effective immediately and to serve at the pleasure of the Board: Mrs. Eileen Mason, Jr. , Janet Walker, and Mrs. Diane Cannon, all Unincorporated Area; Mr. Lawrence Lowy, Mrs. Joan Williams and Mr. Richard G. Murphy, all Village of Larchmont; Mr. William M. Boyd and Mrs. Joan Heilman, both Village of Mamaroneck. -2- 4. Town Clerk' s Report re Access Ramps at Polling Places for Elderly and Physically Handicapped. Mrs. Miller apprised the Board of the Section of the New York State Election Law requiring the Town to provide access for the physcially handicapped and elderly to their polling places. She further related her discussion with Commissioner McNamara of the County Board of Elections and requested authorization to petition that Board for waiver of that Section of the law. Following some discussion, on motion by Councilman Bloom, seconded by Councilwoman Monsell , it was unanimously • RESOLVED, that upon recommendation of the Town Clerk, this Board agrees that a waiver of Section 4-104 (1-1) of the New York State Election Law should be requested; and it is further RESOLVED, that the Town Clerk be, and she hereby is , authorized to convey said request for waiver to the Westchester County Board of Elections. 5. Apportionment Councilman Bloom submitted to the Board a report with respect to an apportionment, as annexed hereto , and on his motion, seconded by Councilman McMillan, it was unanimously RESOLVED, that the recommendation by the Assessor' s Office in the form annexed herdto, be and it hereby is, in all respects approved relative to the property located at 1602 Ellis Place in the Village of Mamaroneck. 6. Planning Board' s Recommendation re Special Permit Application Proposed Nursery School, Larchmont Acres Apartments - (Set Date for Public Hearing) The Town Clerk presented the memorandum from the Planning Board recommending approval with a condition of the above- noted application and thereupon the Attorney for the Applicant presented to the Board a Memorandum of Law in support of the application. ® Following a brief discussion in which it was requested that the Town Attorney review the memorandum of law submitted by Mr. O'Brien, on motion by Councilwoman Monsell, seconded by Councilman Bloom, it was unanimously RESOLVED, that August 5 , 1981 be set as the date for. the public hearing on the request for Special Permit so as to allow the use of the proposed Nursery School at Larchmont Acres; and it is further RESOLVED, that the Town Clerk be and she hereby is authorized to publish in The Daily Times, the Notice of said hearing as required by law. -3- • louL dace Mamaroneck REPORT OF TAX DEPARTMENT Apportionment in accordance with Paragraph "Fifth", Section 557 of the Westchester County Administrative Code (Chapter 852 of the.Laws of 1948 as amended) requested on property carried on the Assessment Roll of 1980-1981 taxes of 1981 School taxes Only REASON: Sale - 5-1-81 Liber 7697 Page 728 Liber 7697..Page 736 DEPARTMENTAL RECOMMENDATION: DATION That the property carried on the Assessment Roll of 1980 taxes of 1981 - - School taxes only • TO BE APPORTIONED.^ . Appointment - Deputy Superintendent of Highways Supervisor Goldsmith spoke of the present illness of Joseph Santoro and noted that it is necessary to appoint a Deputy until Mr. Santoro is able -to return to his duties, and thereupon on motion by Councilman Amlicke, seconded by Councilman Bloom, it was unanimously RESOLVED, that P. Thomas Leddy be, and he hereby is , appointed to serve as Deputy Superintendent of Highways, effective immediately. • DISCUSSION - REPORT OF THE TOWN MANAGER STUDY COMMITTEE After a brief introduction to the topic of discussion by the Supervisor, Councilman Bloom initiated the discussion by relating the Town' s efforts to keep government efficient, efforts to change laws requiring certain charges to the two Villages and the efforts to accomplish the efficiencies by a record of cooperation and joint ventures (citing Garbage, Assessor, Senior Center and Teen Center and Cable T.V. ) . He further noted that although the Town has been and is still being served by dedicated persons and although the Board has reservations about delegating certain powers, there is need for full-time management. He also made reference to the 1979 Report by the Committee which was chaired by Mr. Goldsmith. Councilman Bloom specifically outlined the cost, if an administrator were to be hired, to the taxpayers in each Village and noted that they must be convinced this would be for the good of everyone and hoped the people would be willing to bet between $5 - $10 per year to find out if hiring an administrator would work. Trustee Gary Bastian spoke against the implementation of the Study Committee' s recommendation since, he noted, his Village of Mamaroneck already has its own manager and sees only duplication and no benefit for the Village of Mamaroneck of having a Town Administrator. Margaret Shultz replied to Mr. Bastian' s comments that only 2. 8% of the Town Budget is paid by village residents , but she can forsee the Administrator spending more time working for the Villages. Mr. Bastian emphasized that he was not speaking officially for his Board, but noted they have gone on record previously as being opposed and reminded everyone of their efforts to become coterminous. • Mrs. Heidi Stearne, Larchmont Village, spoke in favor and noted it must be tried in order to judge the benefit. Richard Coulter, Town, spoke as a member of the Committed and in favor of the proposal and emphasized the size of the Town Budget and the amount of work put into administering such a budget and urged that it be tried. Caroline Silverstone, Town, spoke as a member of the League of Women Voters and member of the Town' s Citizen Budget Committee in favor of the hiring of an administrator and -5- • gave specific calculations relative to home assessments in relation to tax bills and the impact on the budget and felt this would definitely benefit the Villages for the tax dollar spent. She also made references to areas of Town government where departments exceed budgetary outlays and unauthorized purchases which she noted could be controlled by an administrator. Arthur Gasparini, Town, spoke as member of the Citizen Budget Committee and referred to some of the same items as Mrs. Silverstone, namely control of department`. budgets , policy on automobile purchasing and part-time employees becoming full-time employees. These items can be reviewed and controlled by a full-time administrator. He then commended Supervisor Goldsmith and the Board on doing a tremendous job and their initiative in carrying out suggestions made by the Budget Committee, but noted that a full-time administrator can be there to oversee and do even better. Suzanne Carpenter, President of the Larchmont League of Women Voters., read and presented for the record a prepared statement which has been- annexed her. to. In a time of increasing costs, the cost of salary and benefits for a Ton Adninis tr atar raises a question in the minds of some merzters of our community* at, we are not limited to the two o `av'iou ;. choices: either to increase the 'tax burden or to cat services* We urge you to opt for an alternative that nay require patience, planning and courage: to increase governmental efficiency-and productivity ty by hiring a • professional Town A:k nistva .Arty„-. Harry DeMaio, Town resident and former Town Councilman, stated that if a cooperative effort were made, certainly some benefit to both Villages can be derived from a Town Administrator. -6- Larry Miralia, Town, served as the Chairman of the Study Committee and spoke in that capacity in favor of his Committee' s recommendation and noted that the Villages should not deny the Town the right to efficient government. He further stated that a little more spending now would mean savings in the future. Supervisor Goldsmith thanked the Chairman, Mr. Miralia and the other members of the Committee for a diligent and well prepared study report. Councilwoman Monsell also thanked the Committee and its liaisons from each Village and commented in answer to some of Mrs. Silverstone' s statements and further to Mr. Miralia' s statements. She stated that the public should not be circumvented and should be allowed to make a decision on the proposal to institute a new type of government especailly since tax dollars would be involved. She noted that she is mainly opposed to the proposal because it must be a Town-wide charge. Councilman McMillan commented about the present Town system of government and the present and former supervisor and noted that he would be inclined toward the hiring of a full-time administrator and would be in favor of the Committee' s recommendation. Councilman Amlicke also stated that he would be in favor of hiring a- full-time administrator and noted he feels it would benefit both Villages as well as the Town. He further stated that he hoped that the economies brought to the job by the Administrator would offset the amount paid out by the Villages which would work to keep costs down. Supervisor Goldsmith gave special thanks to the department heads who he noted have done the job he requested at the beginning of his term, noting there. is always room for improvement. He stated that he was presently against the recommendation of the Committee since he has always tried to bring people and things together which has worked out well. This proposal, has tended to fragment further the three municipalities and he is against this. He spoke of his time spent at the Town offices and in his office tending to Town business. At this time, he noted that he would be in favor of cooperative ventures instead. Some further discussion ensued relative to Supervisor Goldsmith' s comments. At this time the Supervisor thanked all in attendance for their input. ADJOURNMENT - In Memoriam - John William Stahr There being no further business to come before the Board, and following expressions of sympathy by individual Board members, on motion unanimously made and seconded, this meeting was declared adjourned at. 10 : 07 p.m. in respect to the memory of John William Stahr with the following resolution spread upon the minutes of this meeting as a public tribute to the man who served this Community in a dedicated manner: -7- In Memoriam W h e r e as , John William Stahr, a resident of the Town for the past forty-four years and a world-renouned tennis official and author, died on. June 17th, 1981 , and . Whereas , Mr. Stahr was a charter, member of the Town Rec- reation Commission since its inception in 1954, and served as its Chairman for fourteen years until he retired on January 1st, 1976, and Whereas , he played a vital role in the development of our program widely recognized in the County and State, and was instrumental in formulating plans that in- cluded our tennis courts, an indoor-outdoor pool, an artifical ice rink and various parks and recrea- tion areas, and Whereas , he also gave unstintingly of his time and unique tal- ents to his service in many other civic posts, Now , Therefore , Be It R es o l v e d , that this Council, the staff, and all of the residents of the Town Express their sense of tremendous loss and grief at his passing, and their deep apprecia- tion and gratitude for the fine things he did which have meant so much to so many throughout the years, and be it further . Resolved , that this meeting, convened in special session this 22nd day of June, 1981 , stands adjourned in,respect to and in honor of his memory, and that this resolu- tion be entered upon its minutes as a permanent and lasting tribute to -- John William Stahr and conveyed to Mrs. Stahr and her family with deep sympathy and condolences at this sorrowful time.
