HomeMy WebLinkAbout1981_06_03 Town Board Regular Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD ON THE 3RD DAY OF JUNE 1981 IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, TOWN OF MAMARONECK. The Supervisor called the meeting to order at 8:15 p.m. Present were the following representing all members of the Board: Supervisor Leo Goldsmith, Jr. Councilman Lee H. Bloom Councilman Stewart J. McMillan Councilwoman Charlotte P. Monsell Councilman Thomas R. Amlicke Also present were the following: Dorothy S. Miller, Town Clerk James J. Johnston, Town Attorney Carmine A. DeLuca, Comptroller Charles R. Elfreich, Town Engineer P. T. Leddy, Conservation Director Joseph V. Santoro, Acting Highway Superintendent APPROVAL OF MINUTES The minutes of the regular meeting of May 6, 1981 were presented by Councilman Amlicke, seconded by Councilwoman Monsell and unanimously approved as amended. OLD BUSINESS 1. Engineer's Request - Authorization to Advertise for Bids- Reconstruction of Highway Garage Roof In answer to the Board's request at the meeting of May 6th for more specific information relative to the above-captioned subject, Mr. Elfreich presented his memorandum and gave an oral report on his plans for the reconstruction of the roof. He noted that he had looked into several ways of correcting the problem on a permanent , basis and at the least expensive cost. In answer to the Supervisor's query about a modified or slightly pitched roof, Mr. Elfreich replied that they would both be more expensive than his recommendation. Thereupon, following some discussion, on motion by Councilwoman Monsell, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the publication in the official newspaper of the Town of Mamaroneck, The Daily Times, of a Notice of Invitation to Bid for the reconstruction of the Highway Garage Roof. -1- 2. Request - Attendance at New York State and International Association of Police Chiefs Conferences The Supervisor made reference to the Police Chief's request and the Board's desire for more information which they were advised was contained in the booklet passed among the Board members by the Supervisor for perusal. Later in the meeting, after each had noted the contents of the booklet, on motion by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that this Board hereby authorizes that expenses in the amount of $1420.00 be paid for . Police Chief Robert M. Barasch's attendance at the N.Y.S. Chiefs of Police Association Conference in Buffalo, New York from July 19 to July 23, 1981 and the International Association of Chiefs of Police Conference in New Orleans, Louisiana from September 26 to October 1, 1981. 3. Comptroller's Report of Tax Lien Sale The Comptroller reported that the Tax Lien Sale was held on May 22, 1981 and the Town of Mamaroneck bought all parcels amounting to a total of $182,894.85. 4. Town Manager Study Committee Report - Set Date for Special Meeting Supervisor Goldsmith asked if the Board was ready to set a date for an informational meeting relative to the above-captioned matter and on motion'by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that this Board hereby fixes Thursday, May 18, 1981 as the date for holding a Special Meeting of this Board at 8:15 p.m. in the Auditorium of the Weaver Street Firehouse to publicly air the matter of the Town Manager Study Committee Report; and it is further RESOLVED, that the Clerk be, and she hereby is, authorized to publish in the official newspaper, The Daily Times, the Notice of said meeting. 1 At this time the Supervisor noted the presence of George Derderian, Assessor and changed the order of the agenda and took up Item No. 1 under THE TOWN ATTORNEY. 1. Matters re Settlement of Pendin g Certioraris a) Mr. Johnston noted the Board's request at the last meeting for more detailed information concerning the certiorari proceeding relative to 1916-1918 Palmer Avenue and Mr. Derderian reviewed the situation and related his discussion with the property owner's -2- attorney. Mr. Derderian further stated that both he and Mr. Johnston are satisfied with the settlement offer and on motion by Councilman McMillan, seconded by Councilman Bloom, who commended the Assessor and requested that more definitive figures by provided to the Board in the future, it was unanimously RESOLVED, that in the matter of 1916- 1918 Palmer Avenue for reduction in assessment from $47,300. to $29,500, this Board hereby approved the settlement suggested by the Assessor for the year 1978 provided the property owners keep the agreement not to file a protest for the year 1981; and it is further RESOLVED, that the Town Attorney be, and he hereby is, authorized to take the necessary steps to arrange for the settlement. b) Following some discussion and in accordance with the Assessor's and the Town Attorney's recommendation, on motion by Councilman Bloom, seconded by Councilman McMillan, it was unanimously RESOLVED, that the Town Attorney be, and he hereby is, authorized to enter into stipulation to dispose of the certiorari proceeding William Volpe vs. Town of Mamaroneck relative to 1906-1908 Palmer Avenue and 116-118 Chatsworth Avenue for the tax years 1977 to 1980. c) Pursuant to Mr. Derderian's statement that he and the Town Attorney have been working with Mr. Wright, Village of Mamaroneck Assessor, and all agree that the Town Assessor has reached a good settlement, on motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously RESOLVED, that the Town Attorney be, and he hereby is, authorized to enter into stipulation to dispose of the certiorari proceeding - Weissman vs. Town of Mamaroneck relative to 210-218 and 227- 231 Mamaroneck Avenue for the tax years 1975 to 1980. • NEW BUSINESS 1. Engineer's Request - Authorization to advertise for Bids-Engine Testing Equipment Mr. Elfreich presented his memorandum and explained that his request was at the urging of the Highway Superintendent and mechanics since all of the most recently acquired vehicles are electronic and the equipment is necessary for efficient work on the cars and trucks. Councilman Amlicke noted from his observations of the present procedures that the efficiency gained will be well worth the purchase -3- price of $7,000. or $8,000. Following some discussion, on motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes the publication in the official newspaper of the Town of Mamaroneck, The Daily Times, of a III Notice of Invitation to Bid on engine testing equipment. • 2. Salary Authorizations: a) Recreation - Summer Programs At this time Supervisor Goldsmith extended his heartfelt congratulations to James Kronenberger on his 25 years of dedicated service to the Town and each member of the Board added their lauds. Mr. Kronenberger thanked the Board and advised them that several of the summer programs had been moved from Central to Hommocks due to repair work in progress and thereupon, on motion by Councilman Amlicke, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that as provided for in the 1981 Town Budget, this Board hereby authorizes the following salary expenditrues to the persons named on the list annexed hereto, for the terms of employment and at the rate of compensation for each as set forth: III (see following three pages) b) Community Beautification Mr. Leddy's memorandum was presented and upon motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby authorizes that Richard Fraioli and Benedict Pacewicz, Seasonal Laborers for the Community Beautification Summer Work Program be engaged at the rate of. $4.00 per hour starting June 4, 1981 and ending on August 18, 1981. 3. Authorization to Rent Paving Equipment Following presentation of Joseph Santoro's memorandum, on motion IIIby Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously III RESOLVED, that this Board hereby authorizes the rental of Highway paving equipment from Peckham Materials Corporation, for the repaving program North Chatsworth and Rockingstone Avenues, Poplar Road, Lafayette Road, Lafayette (Dead End) , Colonial Avenue, Colonial Lane, North Brook Rd, Taylor Lane, Burton Rd, patching on No. Chatsworth, and the intersections of Poplar-Springdale, Spruce, Seton, Valley, Wildwood, Mountain, No. Chatsworth, Rochelle, Lookout, Hillside and Edgewood, in accordance with the rates set forth and subject to approval by the Westchester County Commissioner of Public Works. -4- SALARY AUTHORIZATION RECREATION STAFF SUMMER 1981 CENTRAL PLAYGROUND Paterno, Philip Sr. Rec. Supervisor Goldsmith presented a letter from the Manager of Westchester Joint Water Works relative to the revision in cost estimate of one of the joint projects (81-J.1) approved at the March 18th meeting. Following some discussion and pursuant to Mr. Hock's request, on motion by Councilwoman Monsell, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby approves the request of John G. Hock, Manager of the Westchester Joint Water Works, to revise the cost estimate of Project 81-J.1 to $52,000. from $44,000. since all bids came in higher than originally estimated and it is essential that the project proceed as previously authorized. b) Report - Water Conservation Supervisor Goldsmith reported that the reservoirs from which our • water supply is obtained are presently at 75% capacity and noted that that level is still way below the normal since the level should be at 100%. Since no runoff is expected, he added, and although water usage in this area has gone down, conservation should continue. c) Request to Purchase Town-owned Property The Supervisor brought to the Board's attention the letter received from Philip A.J. Giangrande, Attorney for Joseph Zavaglia who resides at 5 Byron Place and who desires to purchase several parcels of Town- owned land across the street from his house. After a brief discussion, the Board deferred action on the matter and asked the Town Engineer to report to the Board with monetary figures about the property. -7- COMMUNICATIONS Letter, Larchmont Village Engineer - Use of Reservoir Grounds Mr. Goldsmith presented a letter from Larchmont Village Engineer, Mr. Kellogg and noted that he had answered that communication since it is felt that problably a joint Town/Village project was being held rather than just Town. • THE TOWN CLERK Regular Reports Report re New Fee Schedule - Vital Records The Town Clerk presented the Report of the Town Clerk's office for the month of May 1981 and the Report of the Building and Plumbing Inspector for the month of May 1981. The Clerk then advised the Board of the recent communication received from Albany relative to the increase in the Vital Record fees. She noted that effective June 1st the total for issuing marriage licenses will be $10.00 with $1.25 to be sent to Albany and the remainder to be retained by the Town, and a $5.00 fee for copies of all marriage, birth and death certificates. NOT ON AGENDA Hydrologic Study - Sheldrake River Basin Supervisor Goldsmith made reference to a telephone inquiry from the League of Women Voters about the above-referenced matter and a memoramdum received from Mr. Hock of the W.J.W.W. about the same subject. He further noted that both the League and the Friends of the Reservoir had requested such a study, but had been advised that the request should be forthcoming from a municipality. Pursuant to some discussion, on motion by Councilman Amlicke, seconded by Councilwoman Monsell, it was unanimously RESOLVED., that this Board hereby endorses and supports the request by the Friends of the Reservoir that the Westchester County Soil and Water Conservation District undertake a hydrologic study of the Sheldrake River Basin; and it is further RESOLVED, that the Supervisor be, and he hereby is, authorized to convey the request to the Westchester County Soil and Water Conservation District. THE SUPERVISOR Proclamation - Flag Day The Supervisor presented the aforementioned proclamation and on motion by Councilman Bloom, seconded by Councilwoman Monsell, the Supervisor was unanimously authorized to issue the proclamation annexed hereto. -8- OBSERVANCE OF FLAG DAY WHEREAS, Congress authorized the first official Flag of the United States on June 14, 1977; and • WHEREAS, that date has been officially recognized as Flag Day since August 3rd of 1949; and WHEREAS, our national emblem has represented the best of America's ideals for 203 years and has been the inspiring symbol of our Founders and of countless patriots and veterans who have sacrificed so that we might enjoy the blessings of liberty; NOW, THEREFORE, I, Leo goldsmith, Jr. , Supervisor of the Town of Mamaroneck do hereby proclaim the 14th of June, 1981, as --- FLAG DAY ---in the Town of Mamaroneck, and request all of the residents of our Community to honor our Flag with gratitude by observing that date throughout our Community. Leo Goldsmith, Jr. Supervisor for the Town Council Dated: June the 3rd, 1981. -9- NOT ON AGENDA Joseph Santoro announced the formal dedication of a building located at Harbor Island in honor of B.J. Santoro on June 14th. THE TOWN ATTORNEY 1. Matters re Settlement of Pending Certioraris The above matters were taken up earlier in the meeting. • NOT ON AGENDA 2. Mr. Johnston reported that the action relative to the Marx Property was dismissed in Federal District Court, but that he had been advised by the attorney for the plaintiffs that the arrangements will be made for a possible rearguement of the case. 3. Mr. Johnston advised that he would be following up with Scarsdale on an action taken by the Town Board at the meeting of July 11, 1979 regarding Mrs. Adam Walinsky's request to connect to a Town of Mamaroneck sewer. THE COUNCILMEN AND COUNCILWOMAN Mr. Amlicke Larchmont Reservoir - Abatement of Taxes Councilman Amlicke brought up the subject of abatement of taxes on the Reservoir property and during the discussion that followed, the Town Attorney was asked to review a memorandum of law submitted by James G. Johnson representing the Friends of the Reservoir. Mr. McMillan Cable Television Councilman McMillan gave an update on the status of agreements relative to cable television and proposed the names of persons to serve on the Control Board. Thereupon, on motion by Councilman McMillan, seconded by Councilman Bloom, it was unanimously ® RESOLVED, that Carmine A. DeLuca, Comptroller of the Town of Mamaroneck, Joseph P. Fraioli, Manager of the Village of Mamaroneck, heretofore designated Administrator of the Cable Television system; Gary D. Bastian, Trustee of the Village of Mamaroneck, Mark D. Scheffler, Trustee of the Village of Larchmont and Stewart J. McMillan, Councilman in the Town of -10- Mamaroneck, be, and they hereby are, appointed members of the Board of Control of the Cable Television system, effective immediately and terminating April 1, 1982, notwithstanding any other term previously agreed to. IllOn motion by Councilman McMillan, seconded by Councilman Amlicke, it was unanimously RESOLVED, that Mary Anne Sullivan, 14 Glen Eagles Drive, Town, and • Arthur G. Tebbins, 20 Helena Avenue, Village of Larchmont, be, and they hereby are, appointed members of the six-member Advisory Committee of the Cable Television system, effective immediately and terminating May 31, 1983; and it is further RESOLVED, that both resolutions are subject to appropriate appointments being made by the Village of Larchmont and Mamaroneck. Mr. Bloom 1. Unused Reservoirs Councilman Bloom made note of the two reservoirs in this area, Larchmont Reservoir and Mamaroneck Reservoir, which are presently not in use and suggested that it be kept in mind that they both could be used for water use if necessary. He also referred to the present condition of the Gardens Lake in its low state and hoped that the engineering work on the brook would help alleviate some of the buildup in the Lake. 2. State Codes Councilman Bloom reported on his discussion with the Fire Council relative to the State Fire Code and other codes and stated that even though he realized the massive task of reviewing these codes, he hoped the Town could begin to undertake such a review with a look toward adopting same. Town Attorney, James Johnston, advised that adoption of any of those codes must be done in total and not in parts. • Mrs. Monsell Youth Advocate and Teen Center Councilwoman Monsell reported that the Office of the Youth Advocate is closed until September and that she has asked Mr. Reilly to attend the next regular meeting and report to the Board on the progress of his office in the last year. Mrs. Monsell also noted that the Youth Council is currently interviewing candidates for a new director of the Teen Center; that the Teen Center will not be open in the afternoons during the summer, only evenings and that the Center has moved from the second floor to the gymnasium. -11- ADJOURNMENT There being no further business to come before the Board, on motion duly made and seconded, the meeting was declared adjourned at 9:30 p.m. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immedi- ately upon the adjournment of the Town Board meeting. • 1. Claims Commissioner Bloom presented the fire claims for authorization of payment and on his motion, seconded by Commissioner Monsell, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's office: Dri-Chem Extinguisher Co. $ 28.50 Excelsior Garage & Machine Works 23.12 Exterminating Services Corp. 14.16 Garfield-Wolar Electrical Corp. 3.84 Garfield-Wolar Electrical Corp. 15.36 Garfield-Wolar Electrical Corp. 202.87 New York Telephone Co. 665.47 III New York Telephone Co. 31.20 Deputy Richard Shaw 13.72 Signacon Controls Inc. 60.00 Town of Mamaroneck Highway Fund 72.84 Town of Mamaroneck Highway Fund 23.62 $1,154.70 2. Other Business Commissioner Bloom reported that the proposed buyer of the old quad fire engine still has not come to Town to look over that piece of apparatus for a possible sale.
