MAMARONECK, HELD ON THE 15TH DAY OF OCTOBER 1980 IN THE AUDITORIUM
OF THE WEAVER STREET FIREHOUSE, TOWN OF MAMARONECK.
Present were the following representing all members of the Board:
Supervisor Goldsmith
Councilman Bloom
Councilman McMillan
Councilwoman Monsell
Councilman Amlicke
Supervisor Goldsmith noted with regret the recent passing of T.
Roosevelt Allen and B. J. Santoro and deviated from the usual moment
of silence and stated a better tribute would be made to them if we
would think in joybul terms of the contributions made by these men to
this community and therefore asked that this moment be dedicated to
them.
Not on Agenda
Assemblyman John Perone addressed the Board relative to a meeting to be
held at 8:00 P.M. on Thursday, October 30th in the Weaver Street Fire-
house concerning Co-op Conversion and also referred to the recent meet-
ing in the Supervisor's office regarding the restoration of the hand
control traffic device on the Boston Post Road and Weaver Street.
PUBLIC HEARING: Proposed Uses of Federal Revenue Sharing Funds - 1981
On motion by Councilwoman Monsell, seconded by Councilman Amlicke, it
was unanimously
RESOLVED, that the public hearing be and it hereby
is declared open.
The clerk then presented for the record the Affidavits of Publication and
Posting of the Notice of Hearing.
A brief discussion ensued in which the Comptroller explained his reasons
for certain items being proposed for federal revenue funding, although
the town is not sure how much will be received and has based the pro-
posed expenditures on the past allocations of $170,000.00. A suggestion
was made that federal revenue sharing funds be used for the pool re-
pairs. Since no one wished to speak against the proposed uses, on motion
by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously
RESOLVED, that the hearing be and it hereby is
declared closed.
On motion by Councilman Bloom, seconded by Councilwoman Monsell, the
following resolution was adopted by unanimous vote of the Board:
WHEREAS, this Town Board has met on this date at
the time and place specified in the Notice of
Public Hearing on the Proposed Uses of Federal
Revenue Sharing Funds and has heard all persons
desiring to be heard thereon;
NOW, THEREFORE, BE IT

RESOLVED, that this Town Board does hereby adopt
the Proposed Schedule of Spending of Federal Revenue
Sharing Funds in the amount of $170,000.00 as a part
of the 1981 Budget for the fiscal year beginning on
the first day of January 1981, the itemized statement
of expenditures hereto attached and made a part of this
resolution;
and be it further
RESOLVED, that in accordance with the 1976 Amendments
to the Federal Revenue Sharing Act, said adoption is
made subject to a second hearing to be held in con-
junction with the budget hearing on December 3, 1980.
PUBLIC HEARING::. Proposed Local Law No. 1-1980 - Helicopters and
Other Aircrafts.
On motion by Councilwoman Monsell, seconded by Councilman Bloom, it
was -unanimously
RESOLVED, that the public hearing be and it hereby is
declared open.
The Clerk then presented for the record the Affidavits of Publication
and Posting of the Notice of Hearing.
Supervisor Goldsmith read the text of the proposed law for the infor-
mation of those in attendance. Mrs. David Benford, 45 Hommocks Road
inquired about the approved landing areas and when the Supervisor noted
there were none, Mrs. Benford stated she was in favor of the law. Very

little discussion ensued and since no noe wished to speak against the
local law, on motion by Councilman Bloom, seconded by Councilwoman
Monsell, it was unanimously
RESOLVED, that the public hearing be and it hereby
is declared closed.
Thereupon, on motion by Councilman Bloom, seconded by Councilman Amlicke,
the following resolution was adopted by ynanimous vote of the Board:
WHEREAS, this Town Board has met on this date, at the
time and place specified in the Notice of Public Hearing
to consider the adoption of Local Law No. 1-1980
Helicopters and Other Aircraft and has heard all persons
desiring to be heard thereon;
NOW, THEREFORE, BE IT
RESOLVED, that this Board does hereby adopt Local Law No.
1-1980 entitled "Helicopters and Other Aircraft", and that
such Local Law as so adopted and herewith inserted be made
a part of the minutes of this meeting:
The following Local Law shall apply to the Unincorporated Area of the
Town of Mamaroneck.
All takeoff's and landings of helicopters or other aircrafts from other
than approved areas are prohibited within the Unincorporated Area of
the Town of Mamaroneck.
The hovering of helicopters so as to discharge or accept passengers is
prohibited within the Unincorporated Area of the Town of Mamaroneck.
The discharging or accepting of a passenger from or into a hovering
helicopter within the Unincorporated Area of the Town of Mamaroneck is
prohibited.

A violation of this Local Law shall be a misdemeanor.
A violation of this Local Law shall be punishable as follows:
A. A person found guilty may be sentenced to thirty (30) days in
jail or a fine of Five Hundred Dollars ($500.00) , or both, for
a first offense.
B. A person found guilty of violating this Local Law a second time
may be sentenced to up to sixty (60) days in jail or fined up
to One Thousand Dollars ($1,000.00) , or both.
C. A person found guilty of a third violation and subsequent
violations of this Local Law may be sentenced up to one hundred
twenty (120) days in jail or fined up to Two Thousand Dollars
($2,000.00) , or both.
D. As provided in Section 80.00 and Section 80.05 of the Penal
Law of the State of New York, in lieu of the foregoing schedule
of fines, a fine equal to two (2) times the profit made as a
result of such prohibited landing, takeoff or hovering, may be
imposed.
Emergency landings are exempt from this Local Law. However, in the event
of an emergency landing, no movement of the helicopter or other aircraft
may be made or permited until such time as an administrative authority
designated by the Town Council has approved the movement of the helicopter
or other aircraft.
The invalidity of any section, provision or portion of this Local Law
shall not invalidate any other section, provision or remaining portion
thereof.
This Local Law shall take effect immediately as provided by and pursuant
to the Laws of the State of New York.
and it was further
RESOLVED, that the Town Clerk is hereby authorized
to publish in the official newspaper of the Town
of Mamaroneck, The Daily Times, Notice of the
Adoption of the aforesaid Local Law and to post
same on the Town Clerk's Bulletin Board as re-
quired by law.
OLD BUSINESS
1. Set Date for Public Hearing - Proposed Local Law No. 2-1980 -
Open Containers
Since the Town Attorney had not yet arrived at the meeting, Councilwoman
Monsell requested this item be deferred to later in the meeting as she
had questions to pose to him relative to his draft of the aforementioned
proposed local law.
2. Report of Bids - 1979 Demo Model Bucket Loader & Accessory Equipment
The Town Engineer presented his memorandum, enumerated the only bid re-
ceived and at the request of Councilman Amlicke, gave extensive clarifying
information about the bucket loader and equipment. A lengthy discussion
followed and on motion by Councilman Amlicke, seconded by Councilman
Bloom, it was unanimously

RESOLVED, that, for Contract No. 80-2 - one
Bucket Loader, this Board hereby accepts the
bid of the only bidder, namely Trius Inc. in
the amount of $39,307.00;
and it was further
RESOLVED, that the Comptroller be and he hereby
is authorized to proceed with the necessary
stepts to obtain the papers in order to bond the
aforementioned equipment.
3. Request to Install Metal Wood Burning Stove & All Fuel Chimney -
2 Bruce Road
The above noted request was presented and after the Board was assured
that all preliminary steps and approvals as to design and otherwise had
been approved, a motion was made by Councilman Bloom and seconded by
Councilwoman Monsell, it was unanimously
RESOLVED, that this Board hereby varies the
regulations of the Building Code as permitted
under Article V Sections 14-19 so as to permit
the installation of the metal wood burning stove
and "0" clearance metal chimney as shown on the
plans and in accordance with the manufacturer's
specifications, in the residence located at 2
Bruce Road, Town of Mamaroneck.
4. Application for Special Permit - Restaurant & Catering Business -
Dandry Property
An application for a Special Permit to use the above mentioned property
for a restaurant and catering service business was submitted to the
Board. Said application included the plans and specifications as well
as a memorandum addressed to the Board by the Building Inspector,
William Paonessa and upon motion by Councilman Amlicke, it was
unanimously
RESOLVED, that the Special Permit Application
submitted for the Dandry Property at the corner
of Harrison Drive and Palmer Avenue to be used
for a restaurant and catering service business
is hereby referred to the Planning Board for its
study and recommendation and report back to the
Town Board.
5. Authorization - Youth Service & Recreation State Aid Application
In accordance with the request of the Comptroller and Recreation
Superintendent, on motion by Councilwoman Monsell, seconded by
Councilman McMillan, it was unanimously
RESOLVED, that this Board hereby authorizes
the Supervisor to execute the Youth Service
and Recreation Project Application and submit
to the New York State Division for Youth re-
questing State Aid in the amount of $10,629.00
for the period January. 1, 1981 to December 31,
1981.

COMMUNICATIONS
1. Letter, Pet Assistance, Inc. re Animal Control in the Town of
Mamaroneck.
The Board noted receipt of the letter but deferred any action since
no one was in attendance from Pet Assistance, Inc.
Not on Agenda
Elizabeth Siegel of 7 East Drive, Town addressed the Board relative
to the german shepherd dog at the Town Yard and the Supervisor asked
for time to look into the matter.
Letter & Petition re Larchmont Acres Parking - Don Brown
The Board noted receipt of Mr. Brown's correspondence but took no action
since he was not at the meeting.
3. Memorandum - Increase in User Fee - Croton Point Sanitary Landfill
The above captioned item was ordered received and filed and it was noted
that residents should be encouraged to continue to participate in the
recycling programs.
THE TOWN CLERK
Regular Reports
The Town Clerk presented the Report of the Town Clerk's office for the
month of September 1980 and the Report of the Building and Plumbing
Inspector for the month of September 1980.
NEW BUSINESS
1. Salary Authorizations - Recreation
Pursuant to presentation of the Recreation Superintendent's memoranda,
on motion by Councilman McMillan, seconded by Councilman Amlicke, it
was unanimously
RESOLVED, that this Board hereby authorizes
that Daniel Purcell and Robert Lunde, Recreation
Assistants, Hommocks Ice Rink, be compensated at
the rate of $2.50 per hour, effective October 8,
1980;
and it was further
RESOLVED, that this Board authorizes payment to
the following persons at the rates and effective
dates as listed below:

2. Authorization to Advertise for Bids - 1981 Police Uniform Requirements
Upon presentation of the Police Chief's memorandum, on motion by Council-
man Bloom, seconded by Councilman McMillan, it was unanimously
RESOLVED, that this Board hereby authorizes
publication in the official newspaper of the
Town of Mamaroneck, The Daily Times, of a Notice
of Bids for 1981 Police Uniform Requirements.
Not on Agenda
Councilwoman Monsell recognized the presence of Mrs. Beverly Brewer
Villa, Director of C.A.P. and Mrs. Villa thanked the Board for their
continued support.
Not On Agenda
Councilman Amlicke reported on his follow-up with the C.A.C. regarding
the structure and goals of a Town-wide Litter Committee. Following a
review of his meetings, he presented the Supervisor for his consider-
ation a list of possible candidates to serve on such a committee and a
draft letter to be sent by the Supervisor to these candidates.
Supervisor Goldsmith thanked Councilman Amlicke for the recommendations
and his prompt follow through on this matter.
THE COUNCILMAN
Mr. Bloom
1. Apportionment
Councilman Bloom submitted to the Board a report with respect to an
apportionment, as annexed hereto and on his motion, seconded by Council-
woman Monsell, it was unanimously
RESOLVED, that the recommendation by the Assessor's
Office in the form annexed hereto, be and it hereby
is in all respects approved relative to the property
located on Lester Avenue in the Village of Mamaroneck.

Mr. McMillan
1. Appointment to N.G.C. Board of Directors
Following Mr. McMillan's presentation of the qualifications of Miles
Federman who has been recommended to fill the last vacancy, on his
motion, seconded by Councilman Amlicke, it was unanimously
RESOLVED, that the Town Board of the Town of
Mamaroneck hereby approves the appointment of
Miles Federman as a member of the Board of
Directors of the Narcotics Guidance Council to
fill the last vacancy provided similar resolutions
are adopted by the Villages of Larchmont and
Mamaroneck.
2. Report re Cable T.V.
Mr. McMillan reported that the negotiations have been completed with
U.A. Columbia and the three municipal attorneys are reviewing the tri-
municipal contracts. He further stated that although he did not have
a specific timetable, it is planned that an informational meeting will
be held, then the three individual municipal boards would vote on the
recommendations and perhaps within a year after all approvals, most of
the installations would be accomplished.

A brief discussion followed Marie Wolf's request for more publicity
about the rules and regulations for residents to follow regarding
leaves and her query about the status of the thruway property. Super-
visor Goldsmith reported on a recent meeting with Mr. Feder and his
Attorney, Mr. Forbes at which time they proposed certain modifications
to the contract which the Supervisor would not agree to and further
stated that the Town is awaiting the appraisal.
Councilwoman Monsell referred back to Item #1 under OLD BUSINESS and
noted that since the Town Attorney was not in attendance that this
matter be deferred to another meeting in order that the wording of
the proposed law be clarified.
ADJOURNMENT - In Memoriam - Battista J. Santoro
There being no further business to come before the Board, on motion
unanimously made and seconded, this meeting was declared adjourned at
9:26 P.M. , in respect to the memory of --
Battista J. Santoro
with the following resolution spread upon the minutes of this meeting
as a public tribute to him:

IN MEMORIAM
WHEREAS, B. J. "Busty" Santoro, beloved resident of the Village
and Town of Mamaroneck for seventy-four of his seventy-
eight years, died on the 14th day of October, 1980.
and
WHEREAS, Busty, author of the phrase, -- "The Friendly Village",
epitomized his slogan during his more than fifty years
of public service to the Village, the Town, and the
County-- in addition to his unceasing endeavors for
innumerable civic and charitable organizations,
and
WHEREAS, he truly earned and deserved the respect and love of
his fellow-men through his selfless and singular
service to one and all, ever devoting himself to the
well-being of his family, his Church, and his
communities,
NOW, THEREFORE, BE IT
RESOLVED, that this Council, the staff, and the residents pay
homage to a great gentleman and a fine public official --
and pay to him the greatest tribute that can be paid to
any man in expressing their love for Busty,
and be it further
RESOLVED, that we convey this expression of our deep sense of
loss and sorrow to Mrs. Santoro and to the other mem-
bers of his family with our deepest sympathy,
and be it further
RESOLVED, that this resolution be entered upon the minutes of this
meeting in public and permanent tribute to --
B. J. "BUSTY" SANTORO
and that this meeting, convened in regular session this
15th day of October, 1980, stands adjourned in honor of
and in respect to his memory.
BOARD OF FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened immediately
upon the adjournment of the Town Board meeting.
There were no reports or other business to come before the Commission,
therefore on motion duly made and seconded, it was declared adjourned
at 9:26 P.M.
