HomeMy WebLinkAbout1980_07_02 Town Board Regular Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD ON THE 2ND DAY OF JULY 1980 IN THE AUDITORIUM OF THE WEAVER STREET FIREHOUSE, TOWN OF MAMARONECK. Present were the following representing all members of the Board: ® Supervisor Leo Goldsmith, Jr. Councilman Lee H. Bloom Councilman Stewart J. McMillan Councilwoman Charlotte P. Monsell Councilman Thomas R. Amlicke APPROVAL OF MINUTES The minutes of the regular meeting of May 7, 1980 were presented and on motion by Councilman McMillan, seconded by Councilman Amlicke, unanimously approved as submitted. the minutes of the regular meeting of May 21, 1980 were presented and on motion by Councilwoman Monsell, seconded by Councilman Amlicke, unanimously approved as submitted. the minutes of the regular meeting of June 4, 1980 were presented and on motion by Councilman Amlicke, seconded by Councilwoman Monsell, unanimously approved as submitted. OLD BUSINESS 1. Planning board Recommendation - Special Permit-Auto Repair Garage (Set Date for Public Hearing) The June 27, 1980 Planning Board's memorandum recommending the approval of the Special Permit application was presented to the Town Board and on motion by Councilman McMillan, seconded by Council- woman Monsell, it was unanimously RESOLVED, that August 6, 1980 be set as the date for the public hearing on the request for Special Permit to construct a one-story building to be used as an automobile repair garage; and it was further RESOLVED, that the Town Clerk be, and she hereby is, authorized to publish in The Daily Times, the Notice of said hearing as required by law. -1- 2. Engineer's Report on Request by Old White Plains Road Residents re Sewer Extension Town Engineer, Charles Elfreich, presented his July 1st memorandum and elaborated on his preliminary investigation of the above- captioned matter. During a lengthy discussion, it was noted that the estimated cost to be borne by the sewer district with some reimbursement by the federal government would be approximately $37,460.00; that the county is urging municipalities to install sewers to replace septic systems and that a public hearing would be scheduled in a few months when the Engineer has completed the final plans and specifications. Following the discussion, the Board unanimously ordered the Town Engineer to proceed with the drawing up of the plans and specifications necessary for the sewer extension. 3. Request by Convention II New York Mamaroneck High School student, Debra J. Pritzker explained the functions of Convention II New York, a new group formed from the national organization, which gives students a better idea of how government works and how they can involve themselves. Following her presentation and questions posed by Board members, on motion by Councilman Bloom, seconded by Councilman McMillan, it was unanimously RESOLVED, that this Board hereby authorizes the donation of $400,00 to Convention II New York. 4. Appointments - Budget Committee Supervisor Goldsmith advised the Board that he had spoken to the members who previously served on the Budget Committee and they informed him that they wished to continue serving and Mrs. Monsell stated that she wished to have Mr. B.J. Santoro added to that Committee. Thereupon, on motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously RESOLVED, that this Board hereby appoints the following persons as members of the Town of Mamaroneck Citizens Budget Committee: Dale F. Bizily, 6 Wildwood Road, Town Arthur Gasparini, 189 Hickory Grove Drive, Town Ronald G. Keelan, 100 East Brookside Drive, Town Angelo Rigano, 18 Blossom Terrace, Town III Mrs. David Silverstone, 22 Glenn Road, Town Mrs. H. David Willey, 3 Glenn Road, Town Battista J. Santoro, 218 Highview Street. Village of Mamaroneck. -2- 5. Discussion - Open Container Law A brief discussion followed Supervisor Goldsmith's query of the Board as to how they wished to proceed relative to an open container law, and it was unanimously agreed that the matter would be discussed further after receipt .of recommendation from the Police Department and Police Commission. NEW BUSINESS 1. Clerk's Request re Legal Proceedings - Violation of Chapter 46 Section 1 A very lengthy discussion followed the Town Clerk's review of the situation and some clarifications by the Town Attorney. Thereafter, on motion by Councilman McMillan, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that this Board hereby authorizes the Town Engineer and Town Building Inspector and Town Attorney to determine if a violation exists and, if so, authorizes the Town Attorney to commence legal proceedings against Mrs. Olivia Lovely, 63 Harrison Drive, for violation of Chapter 46, Section 1 of the Town of Mamaroneck Code; and hereafter on a continuing basis, it is requested that the Town Attorney go forth with Code violations and take actions on Code violations. 2. Approval of Snow Removal Contract - County Roads Pursuant to a communication and its enclosures addressed to the Town Clerk, on motion by Counciowoman Monsell, seconded by Council- man Bloom, it was unanimously RESOLVED, that the Supervisor be, and he hereby is, authorized to sign the Agreement with the County of Westchester for the removal of snow and control of ice on certain County Roads within the Unincorporated Area of the Town of Mamaroneck, at a rate of $700.00 per mile for the 1979-80 winter season. 3. Salary Authorizations a) Highway Department Following presentation of the Comptroller's memorandum, on motion by Councilwoman Monsell, seconded by Councilman Amlicke, it was unanimously -3- RESOLVED, that this Board hereby authorizes the promotion of Roland F. Reidy to the position of Heavy Duty Motor Equipment Operator at the annual rate of $14,020.00 effective as of July 3, 1980. b) Recreation - Summer Programs Upon presentation of the Recreation Superintendent's memorandum of June 27, 1980 and on motion by Councilman Amlicke, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that as provided for in the 1980 Town Budget, this Board hereby authorizes the following salary expenditures to the persons named on the list annexed hereto, for the terms of employment and at the rate of compensation for each as set forth on said list: (see list on next three pages) NOT ON AGENDA Councilman McMillan gave a brief report on the negotiations between the Town and the C.S.E.A. and on his motion, seconded by Councilman Bloom, it was unanimously RESOLVED, that the Supervisor be, and he hereby is, authorized to sign the Memorandum of Agreement between the Town and the Town of Mamaroneck Unit of theWestchester County C.S.E.A. COMMUNICATIONS 1. Letter from Meighan & Necarsulmer re Mr. Charlap's Application - Helicopter Landing Supervisor Goldsmith acknowledged receipt of the above-captioned letter in which Mr. Charlap's withdrawal of his application for a helicopter landing was noted. Following the Supervisor's notation that no further action is needed, Councilman Amlicke stated that he has been advised that the take-offs and landings are continuing. Some discussion ensued about whether or not a violation is occurring; navigation laws of New York State and the responsibility of Town Police Department relative to logging complaints. James Savage, Mary Savage and Eleanor Fredston commented during the discussion. The Town Attorney was requested to research the situation and report to the Board. 2. Petition re Van Guilder Street The Supervisor acknowledged recipt of the above-noted petition from Mr. Donald Ritacco to take over ownership of the full width and length of Van Guilder Street to which the Assessor, George Derderian, stated that he could not make a recommendation at this time, and therefore, no action was taken relative to the request. -4- • CENTRAL PLAYGROUND Metz, Harry ' Sr. Rec. Reports by C.A.C. re Helicopter Landing Applications & Litter Control Problems The above-captioned reports were discussed and Councilman Amlicke noted that relative to litter and thr recommendations of the C.A.C. , in connection therewith a committee would be a good idea in an attempt to carry out the C.A.C. 's recommendations. Mr. Amlicke was requested to gather information and advise the Board relative to the committee's makeup, an expertise if necessary, to serve, how:many',and' the duties to ,be 'performed. THE TOWN CLERK Regular Reports The Town Clerk presented the Report of the Building and Plumbing Inspector for the month of June 1980, and the Reports of the Town Clerk's Office for the months of May and June 1980. NOT ON AGENDA Supervisor Goldsmith acknowledged receipt of a letter from the Urban County Community Development Program relative to guidelines for the residential rehabilitation portion of Urban County's Neighborhood Preservation Program. Thereupon, on motion by Councilman Bloom, seconded by Councilwoman Monsell, the following resolution was adapted by uananimous vote: WHEREAS, the County of Westchester has received grant funds from the Department of Housing and Community Development; and WHEREAS, the County of Westchester has embarked on a preservation program with the use of such funds; and WHEREAS, the County has offered to the Town of Mamaroneck financial assistance for a voluntary program of residential rehabilitation and commercial rehabili- tation; and WHEREAS, the preservation program for the Town of Mamaroneck includes the provisions for grants, low interest loans and public improvements; NOW, THEREFORE BE IT • RESOLVED, that the Town Board of the Town of Mamaroneck supports the proposal for a voluntary program of housing rehabilitation and commercial rehabilitation in the Town of Mamaroneck; that the residents of the Town of Mamaroneck be apprised of the program, be given the opportunity to comment on the program guidelines and boundaries, and also be afforded the opportunity to express their interest in receiving preservation loans and grants. -8- THE SUPERVISOR Tribute to Dr. William DiScipio Councilwoman Monsell presented the resolution of tribute to Dr. DiScipio and on her motion, seconded by Councilman Bloom, the Supervisor was unanimously authorized to sign the resolution which is annexed hereto. III (see page 10); ' ) • REPORTS OF THE COUNCILMEN AND COUNCILWOMAN Councilman Bloom submitted to the Board a report with respect to apportionment, as annexed hereto (see page 11) and on his motion, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that the recommendation by the Assessor's Office in the form annexed hereto, be and it hereby is, in all respects approved relative to the properties located at 8 Parkway, 6 Parkway and Palmer Avenue, all in the Village of Larchmont. (see page 11) Councilman McMillan spoke of a resignation from the Narcotics Guidance Council and gave his presentation of the qualifications of the person recommended to fill the vacancy, and on his motion, seconded by Councilman Amlicke, it was unanimously RESOLVED, that the Town Board of the Town of Mamaroneck hereby approves the appointment of Mrs. Theodora Becker as a member of the Board of Directors of the Narcotics Guidance Council to fill the vacancy created by the resignation of Mr. Anthony Pappalardo, provided a similar resolution is adopted by the Village of Larchmont, since Mamaroneck Village has already approved the appointment. THE TOWN ATTORNEY Requests for Authorization to Settle Pending Certioraris Pursuant to the Town Attorney's request and in accordance with the Assessor's and his recommendation, on motion by Councilman Bloom, III seconded by Councilman McMillan, it was unanimously RESOLVED, that the Town Attorney be, and he hereby is, authorized to settle certiorari proceeding - United Artists Eastern Theatres, Inc. -9- WHEREAS, Dr. William DiScipio, Chairman of the Larchmont-Mamaroneck Committee on Family and Youth, is resigning from this post; and • WHEREAS, Dr. DiScipio has served both as a member of this Committee and as its Chairman; and WHEREAS, he was instrumental in obtaining a Youth Advocate and establishing the Parents Meeting Program; NOW, THEREFORE BE IT RESOLVED, that this Council expresses to Dr. DiScipio it gratitude for his years of devoted and untiring service to the Community; and be it further RESOLVED, that this resolution, unanimously adopted this evening, be spread upon the minutes of this meeting as a public tribute to him; and be it further RESOLVED, that a copy of this resolution be presented to him with the Council'a appreciation and sincere thanks for his singular service and the many contributions he has made to the Town and all of its residents. Pursuant to the Town Attorney's request and in accordance with the Assessor's and his recommendation, on motion by Councilman McMillan, • seconded by Councilman Bloom, it was unanimously RESOLVED, that the Town Attorney be, and he hereby is, authorized to settle the certiorari proceeding - 1-3 Dillon Road (Leslie Cauldwell) . NOT ON AGENDA - Resignation-Larchmont/MamaronrckYouth Council Councilwoman Monsell presented a letter written by Norman Wilson in which he tendered his resignation from the above-mentioned Council and on her motion, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board with regret, hereby accepts the resignation of Norman Wilson as a member of the Larchmont-Mamaroneck Youth Council effective immediately; and it was further RESOLVED, that this Board's thanks and appreciation be conveyed to Mr. Wilson. NOT ON AGENDA - Aqua Dredge Extension re Hommocks Field Councilman Amlicke questioned whether or not schedule could be met due to present condition of the field. Mr. Elfreich answered that he was optimistic that the schedule, with planting of grass and cutting by September 1st, could be met. ADJOURNMENT • There being no further business to come before the Board, on motion duly made and seconded, the meeting was declared adjourned at 9:46 p.m. -12- BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1.
