HomeMy WebLinkAbout1980_06_04 Town Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD ON THE 4TH DAY OF JUNE 1980 IN THE. COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE , TOWN OF MAMARONECK. Present were the following representing all members of the Board : • Supervisor Leo Goldsmith , Jr. Councilman Lee H . Bloom Councilman Stewart J . McMillan Councilwoman Charlotte P . Monsell Councilman Thomas R. Amlicke APPROVAL OF MINUTES Supervisor Goldsmith announced that although the Clerk had presented the minutes , the approval would be deferred to the next regular meeting . OLD BUSINESS 1 . Report of Bids - Three Dump Trucks-Highway Department The Town Engineer presented his memorandum , enumerated each bid and explained that the low bidder had not met the specifications . Some discussion followed specifically about how specifications are drawn up and also the reason for selling the trucks outright as opposed to a sale by trade-in , with clarifications being made by Mr . Elfreich . Thereupon , on motion by Councilman Bloom , seconded by Councilman McMillan , it was unanimously RESOLVED , that for Contract No . 80-1 - Three (3 ) Dump Trucks , this Board hereby accepts the bid of the second low bidder , namely Willow Motor Sales Corp- oration, in the gross amount of $104 ,955 ,00 , less the total trade-in of $6 ,000 . 00 , resulting in a net cost of $98 ,955 . 00 , since the low bidder ' s equipment • did not meet the-specifications set forth in the Notice for Bids . 2 . Approval - Library Contract Following presentation of the above-noted contract which had been reviewed by the Town Attorney , on motion by Councilman McMillan , seconded by Councilwoman Monsell , it was unanimously -1 - RESOLVED, that the Supervisor be , and he hereby is , authorized to execute the contract for the year 1980 between the Town of Mamaroneck , Village of Larchmont and the Larchmont Public Library in the amount of $182 ,380. 00 as provided in the 1980 budget. ADDITIONAL ITEMS NOT ON AGENDA . 1 . Larchmont Library Request re Old Town Records Supervisor Goldsmith informed the Board that the Larchmont Library wished to display the original minute books during their reception on June 11th in observance of the publication of various Town documents . After some discussion in which the Town Clerk , Town Attorney and Councilman Bloom commented , the Supervisor noted that he would advise the Library that the records would remain in the safe at the Town Clerk ' s Office and further noted that perhaps some thought should be given to special preservation and possibly another storage place for those original records . The Town Attorney advised that he would consult with the State Education Department before any decision is made about storing the records other than in the vault in the Town Clerk ' s office. 2 . Board of Review Mr. Goldsmith explained that Grievance Day is Tuesday , June 17th , the day on which the three-member Board of Review sits . He further noted that one member , Robert Plaut , is very ill and will be unable to meet on that day , and another, William Steinam, wishes to disqualify himself from several cases . Some discussion followed his notation that Mr. Plaut will resign so that someone can be appointed as his replacement. 3 . Discussion - Notification re New Assessments Councilwoman Monsell , after receiving complaints from several homeowners , urged that in the future , property owners be notified in writing of any changes in their assessments . Town Attorney , James J . Johnston and Assessor George Derderian made clarifying statements in the discussion- ® that followed . NEW BUSINESS • 1 . Salary Authorizations a ) Assistant Maintenance Man - Police Department Upon presentation of Police Chief Barasch ' s memorandum, on -2- motion by Councilwoman Monsell , seconded by Councilman McMillan , it was unanimously RESOLVED, that this Board hereby authorizes that Peter Fraioli , 85 Edgewood Avenue , Town , be engaged as Assistant Maintenance Man to assist Ben Seagraves , and be compensated at the rate of $3 . 50 per hour effective June 2 , 1980 and terminating September 1 , 1980. • b ) Community Beautification Mr. Leddy ' s memorandum was presented and upon motion by Councilman Amlicke , seconded by Councilwoman Monsell , it was unanimously RESOLVED , that this Board hereby authorizes that John Dolen and Richard Fraioli , seasonal laborersfor the Community Beautification Summer Work Program be engaged at the rate of $3 . 50 per hour starting May 27 , 1980 and ending on August 15 , 1980. c) Highway Department Pursuant to presentation of the Acting Highway Superinten- dent ' s memorandum, on motion by Councilwoman Monsell , seconded by Councilman Amlicke , it was unanimously RESOLVED, that this Board hereby authorizes the hiring of the following seasonal laborers for the Highway Department ::at the rate of $3 . 00 per hour and effective June 2 , 1980 : Benedict Pacewicz , Robert Byrne , Thomas Fiermonte. d ) Recreation A brief discussion ensued following presentation of Mr. Kronenberger ' s memorandum relative to Ford Winters ' starting date and hours to be worked and upon motion by Councilman Bloom , seconded by Councilwoman Monsell , it was unanimously • RESOLVED , that this Board hereby authorizes that Ford Winter , Hammocks Pool Director , be compensated at the annual rate of $5 , 500 . 00 , effective June 1 , 1980. -3- • The Recreation Superintendent ' s second memorandum was presented and on motion by Councilwoman Monsell , seconded by Councilman Amlicke , it was unanimously RESOLVED , that this Board hereby authorizes that Doug Bessone , Director of the Day Camp at Flint Park be' compensated at the rate of $1,450 . 00 and Janine Buccolo , Assistant Director of the same Camp be compensated at the rate of $525 . 00 ,. both for the period of seven (7 ) weeks (June 23 thru August 8 , 1980) . 2 . Authorization to Rent Paving Equipment Following presentation of Joseph Santoro ' s memorandum, on motion by Councilwoman Monsell , seconded by Councilman Bloom, it was unanimously RESOLVED , that this Board hereby authorizes the rental of Highway paving equipment from Peckham Materials Corporation , for the repaving program of Echo Lane , Hillside Road , Lookout. Circle , Overlook Terrace , Edgewood Avenue , Judson Street , Hillcrest Avenue , Preston Street , Thompson Street , Laurel Avenue , Cabot Road and Emerso.n. Place , in accordance with the rates set forth and subject to approval by the Westchester County Commissioner of Public Works . 3 . Application for Special Permit. -Auto Repair Garage- 20 Valley Place An application for a Special Permit for the construction of a one-story building to be used as an automobile repair garage was submitted to the Board . Said application included the plans and specifications , as well as a memo- randum addressed to the Board by the Building Inspector , William Paonessa , and upon motion by Councilwoman Monsell , seconded by Councilman Amlicke , it was unanimously RESOLVED , ..that the Special Permit Application submitted for the construction of a one-story building to be used as an automobile repair garage is hereby referred to the Planning Board for its study and recommendation and report back to the Town Board . -4- . it 4. Authorization - Execute General Code Contract Pursuant to a communication addressed to the Town Clerk by General Code Publishers and clarifications by the Town Attorney , on motion by Councilman Bloom, seconded by Councilman Amlicke , it ' was unanimously RESOLVED , that this Board hereby authorizes execution of the contract between the Town of Mamaroneck and General Code Publishers Corporation for the supplementation of the Code of the Town of Mamaroneck through • December 31 , 1981 . • 5 . Discussion - Open Container Law The Supervisor advised the Board that both Larchmont . and Mamaroneck Villages have adopted open container laws and asked that this Board be prepared to discuss this subjec- at the next meeting relative to the advisability of enacting such a law in the Town of Mamaroneck . COMMUNICATIONS • 1 . Notice of Public Hearing - Village of Scarsdale Planning • Board Following the acknowledgement of receipt of the above- mentioned notice , Town Engineer , Charles Elfreich , advised the Board that he had consulted with the Engineer in Scarsdale for clarifications on the application which will have no effect on this Town . • • TOWN CLERK Regular Reports The Town. Clerk presented the Report of the Building and Plumbing Inspector for the month of May 1980 . THE SUPERVISOR • • Proclamation - Flag Day On motion by Councilwoman Monsell , seconded by Councilman Bloom, the Supervisor was authorized to issue the proclamation which is annexed . hereto so that all residents of the Community will be encouraged to observe the day by displaying and honoring the American Flag . -5- Observance of Flag Day WHEREAS , Congress authorized the first official Flag of the United States on June 44 , 1777 ; and • WHEREAS , that date has been officially recognized as Flag Day since August 3rd of 1949 ; and WHEREAS , our national emblem has represented the best of .America ' s ideals for 203 years and has been the inspiring symbol of our Founders and of countless patriots and veterans who have sacrificed so that we might enjoy the blessings of liberty ; NOW , THEREFORE , • 1 , Leo Goldsmith , Jr . , Supervisor of the " Town of Mamaroneck , do hereby proclaim the 14th of June 1980 as FLAG DAY in the Town of Mamaroneck , and request all of the residents of our Community to honor our Flag with gratitude by observing that date throughout our Community . • Leo Goldsmith , Jr . Supervisor • • For the Town Council • Dated : June the 4th , 1980. -6- THE TOWN ATTORNEY 1 . Report - Con Edison vs . S . B. E .A. et al Case Town Attorney, James J . Johnston , reported on the status of the above-captioned case and requested authorization for this Town to share with the other municipalities the fees for Special Counsel , Henry J . Smith to prosecute the appeal . Following a brief discussion , on motion by Councilman Bloom, seconded by Councilman McMillan , it was unanimously RESOLVED , that this Board hereby • authorizes Special Counsel , Henry J . Smith to prosecute the appeal in the matt er of Con Edison vs . S . B. E. A. (Special Franchise Assessments ) at a cost of $125 . 00 per hour to be shared with the following municipalities : Scarsdale , White Plains , Mount Vernon and Eastchester . 2 . Authorization to Settle - United Artists Certioraris Mr. Johnston advised the Board that since neither of the Villages are ready to proceed toward settlements , the above-captioned matters will not br presented tonight . ADDITIONAL ITEMS NOT ON AGENDA 4. Retirement - Philip Librandi Supervisor Goldsmith noted the impending retirement of Philip Librandi from the Highway Department and on motion by Councilwoman Monsell , seconded by Councilman Amlicke , the resolution of appreciation , annexed hereto , was unanimously adopted . 5 . Comptroller' s Report 0 re Tax Lien Sale Comptroller Carmine DeLuca reported to the Board that the Tax Lien Sale was held on Friday , May 23 , 1980 and that the Town of Mamaroneck bought all 74 parcels amounting to $195 , 212 . 69 . i 6 . Letter re Convention II Mr. DeLuca informed the Board that he had received a communication requesting financial support for Convention II . The matter was deferred to this Board ' s next meeting of July 2nd at which time Mrs . Debra J . Pritzker will be in attendance to enlighten the Board about Convention II . -7- WHEREAS , Philip Librandi has retired from the Town of Mamaroneck Highway Department after sixteen years of service ; and WHEREAS , Mr . Librandi also served as Deputy Fire Chief for four years and as Fire Chief for two years ; and WHEREAS , his services to the Town as an employee and as a volunteer have been many and varied ; NOW , THEREFORE BE IT RESOLVED , that this Council expressed to Mr . Librandi its gratitude for his years of loyal and untiring services to the Town ; and be it further RESOLVED , that this resol,ution ,°=unanimously adopted this evening , be spread upon the minutes of this meeting" i'n tribute to him; and be it further RESOLVED , that a copy be forwarded to him with the Council ' s sincere thanks for his devoted service to the Town Highway Department and his distinguished volunteer service to the Community and all of its residents . Supervisor For the Town Council . • Dated :_ June the fourth , 1980 . -8- 7 . Appointment of Budget Committee In answer to a question raised by Mrs . Wolf of the Larchmont League of Women Voters relative to the above- noted matter , Supervisor Goldsmith explained that the appointments would probably be made at the next Town Board meeting . 8. Communications - re helicopter Landing Application Supervisor. Goldsmith noted that numerous communications relative to the above-captioned subject have been received and asked the Board members to give consideration to all of the letters and in that regard Councilman Bloom read excerpts from the previous Master Plan. 9: for Sewer Extension - Old White Plains Road Residents Following the Town Engineer ' s presentation of the above- captioned matter and his review and clarification of the situation , it was unanimously so ordered that Mr . Elfreich investigate and report his findings to the Board relative to the feasibility of the sewer extension . ADJOURNMENT Ther: e , being' no further business to come before this Board , on motion duly made and seconded , the meeting was declared adjourned at 9 :44 p .m. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting . 1 . Claims Commissioner Bloom presented the fire claims for authorization of payment , and on his motion , seconded by Commissioner Monsell , it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller ' s Office : -9- Excelsior Garage & Machine Works , Inc . $1 ,926 . 30 Excelsior Garage & Machine Works , Inc . 65 . 00 Exterminating Division 12 . 87 $2 ,004 . 17 • Thereafter , upon noting the amount paid to Excelsior Garage and Machine Works , Inc . , for repairs to fire apparatus , Commissioner Bloom asked the Comptroller for a rundown of repair costs to the fire vehicles . ADJOURNMENT There being no further business to come before this Board , on motion duly made and seconded , the meeting was unanimously declared adjourned at 9 :47 p .m. Town Clerk S -10-
