HomeMy WebLinkAbout1979_11_07 Town Board Regular Minutes .MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD NOVEMBER 7th, 1979, IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ORDER The Supervisor called the meeting to order at 8:15 p.m. ROLL CALL Present: Supervisor, Vandernoot Councilman Bloom Councilman Mc Milian Councilwoman Monsell Absent: Councilman De Maio Also Present: Mrs. Miller - Town Clerk Mr. Johnston - Town Attorney Mr. Aitchison - Superintendent of Highways Mr. De Luca - Comptroller Mr. Elfreich - Town Engineer Supervisor Vandernoot acknowledged the presence of and welcomed Supervisor-elect Leo Goldsmith, Jr. and his wife, Beryl, and Councilman-elect Thomas Amlicke. OLD BUSINESS 1 . Report of Bids - Police Cars A memorandum addressed to the Supervisor and Town Board by Robert M. Barasch, Police Chief, under date of November 6th, 1979, enumerating the bids and recommending award to the low bidder was herewith presented and ordered received and filed as part of the record of this meeting. Following Mr. Vandernoot's notation that the new cars would be Volares, and the Comptroller's statement that arrange- ments would be made for the cars to be serviced locally even though the car agency was a distance away, on motion by Councilman McMillan, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that this Board hereby accepts the bid of the low bidder, namely Airport Motors, for five (5) Police vehicles in the amount of $24,750.00 -1- 2. Acceptance of Street - Blossom Terrace Pursuant to memorandum addressed to the Town Board by the Engineer under date of November 7th, 1979, herewith pre- sented and ordered received and filed as part of the record of this meeting, on motion by Councilman Mc Millan, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby accepts as a public street or highway of the Town of Mamaroneck the street known as Blossom Terrace (0.06 miles in length) located in the Blossom Grove Subdivision of the Spen- cer Property - Section 2-B and shown on Map No. 19464 filed in the office of the County Clerk, Division of Land Records, of Westchester County, New York, on May 3rd, 1978; and be it further RESOLVED, that in accordance with the recommendation of the Town Engineer, this Board hereby cancels Performance Bond No. 925222 in the amount of $16,000.00, dated January 30th, 1979, upon which the Republic Insurance Company, 129 Fulton Street, New York City, New York, is Surety and Spencer Construction Corporation of 174 East Boston Post Road, Mamaroneck, New York, is Principal and Anthony Spencer and Susan K. - - Spencer are Co-Principals. 3. Authorization - Supervisor to Execute Urban County Contract Years 2 and 3 Pursuant to Supervisor Vandernoot's review of the work to be done under the above captioned contract in the amount of ap- proximately $45,770.00 (with almost $3,300.00 having already been received), on motion by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that the Supervisor be and he hereby is authorized to execute the contract between the County of Westchester and the Town of Mamaroneck for Urban County Years 2 and 3 funds. -2- NEW BUSINESS 1 . Presentation of 1980 Tentative Budget (Set date for Public Hearing) A brief discussion followed the Town Clerk's submission of the Departmental Requests that compose the 1980 Tentative Budget with Supervisor Vardernoot noting. that an effort would be made to have copies available to the public by November 28th. And thereupon pursuant to the Supervisor's suggestion that the Pub- lic Hearing on the Preliminary Budget be held on December 5th, on motion by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that this Town Board does hereby acknowledge the presentation of the Tentative Budget and approves it as the Preliminary Bud- get of this Town for the fiscal year beginning on the first day of January 1980, the itemized statement of estimated revenues and expendi- tures hereto attached and made a part of this resolution; and be it further RESOLVED, that such Preliminary Budget shall be filed in the Office of the Town Clerk, where it shall be available for inspection by any interested person at all reasonable hours; and be it further RESOLVED, that the Town Clerk give Notice of Public Hearing in the manner provided in Section 108 of the Town Law, and that the Notice be published and posted in substan- tially the following form: Public Notice Notice is hereby given that the Preliminary Budget of the Town of Mamaroneck, New York, consisting of the estimated revenues for the year 1980 has been completed and filed in the Office of the Town Clerk of said Town, where the same may be examined by any person inter- ested therein, and that a Public Hearing on said Budget together with the use of $128,925. of Federal Revenue Sharing Funds will be held by and before the Town Board of said Town on • Wednesday evening, December 5th, 1979, at 8:15 o'clock in the Auditorium of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, New York, at which time and place all those who appear and are interested will be given an opportunity to be heard with -3- respect to said Preliminary Budget, or any part or item thereof and the use of said Fed- eral Revenue Sharing Funds. Please take further notice, that the proposed salaries of the members of the Town Board are follows: Supervisor - $12,000.; Town Councilmen (4) - $2,000. each; and that the proposed salary of the Town Clerk is .$22,000. Report of the Building and Plumbing In- spector for the month of October 1979. -5- THE COUNCILMEN Mr. Bloom 1 . Apportionment Councilman Bloom presented the following apportionment and on his motion, which was seconded by Councilman McMillan, the following resolution was unanimously adopted: WHEREAS, the Assessor has presented petition for the correction of the assess- ment roll for certain years pursuant to the provisions of Section 557, Article 16 of the Westchester County Tax Law; and WHEREAS, after due consideration, this Board finds it desirable to grant said pe- tition for the correction of said assess- ment roll: NOW, THEREFORE, BE IT RESOLVED, that the assessment roll of 1979, taxes of 1980, which shows prop- erty now appearing on the roll as follows: Block Parcel Owner Land Improvement Total 806 6 Bernard Fraioli $5,400. $ 23,100. $28,500. be apportioned as follows in accordance with the provisions of Subdivision 5 of Section 557: Block Parcel Owner Land Improvement Total -- 806 6 Bernard&An- $1 ,000. $ 1 ,000. toinette Fraioli 806 8 Bernard Fraioli 4,400. 23,000. 57,500. • NOT ON AGENDA The Town Attorney 1 . Towns of Scarsdale & Mamaroneck vs. State Board of Equalization & Assessment The Town Attorney reported that in the action by the Towns of Scarsdale and Mamaroneck against the State Board of Equali- zation and Assessment, he had heard from their Special Coun- sel, Marvin S. Fink, that the Appellate Division, Third -6- Department had on October 11th, 1979 rendered a unanimous opinion dismissing the petitions of both Towns. He then gave a brief summary to the Board of some of the reasons for the dismissal and advised the Board that Mr. Fink wished to make an application to the Court of Appeals for permission to appeal the decision of the Appellate Divtsion. After some discussion among the members of the Board and following a motion that failed due to a lack of a second, on motion by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that this Board hereby authorizes Special Counsel, Marvin S. Fink, to make ap- plication to the Court of Appeals for permission to appeal the decision of the Appellate Division provided the cost to the Town of Mamaroneck does not exceed the sum of $1 ,000. , with the further understanding that the said figure will not cover the actual presentation of the appeal to the Court of Appeals if the permission sought is granted. ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 8:40 p.m. , to reconvene on November 21st, 1979. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1 . Claims Pursuant to the memorandum addressed to the Commission by the Deputy Comptroller under date of November 7th, 1979, herewith presented and ordered received and filed, on motion by Commissioner Bloom, seconded by Commissioner Monsell, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller's Office: General Tire Service $ 70.00 Philip J. Other Business Following Commissioner Bloom's announcement that the new Pumper had arrived, he made reference to the old piece of equipment (the Quad) and pursuant to his description of it and the notation of its market value, on his motion, which was seconded by Commissioner McMillan, it was unanimously RESOLVED, that this Commission hereby authorizes the advertisement in the appro- priate publications of a Notice for Bids for the sale of the 1950 Ward La France Quad Ladder.
