HomeMy WebLinkAbout1979_02_21 Town Board Regular Minutes MINUTES OF A REGULAR MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, HELD FEBRUARY 21, 1979 IN THE COUNCIL ROOM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. I CALL TO ORDER • The Supervisor called the meeting to order at 8 :15 p.m. ROLL CALL Present: Supervisor Vandernoot Councilman Bloom Councilman DeMaio Councilwoman Monsell Absent: Councilman McMillan Also Present: Mrs. Miller - Town Clerk Mr. Johnston - Town Attorney Mr. Aitchison .- Superintendent of Highways Mr. DeLuca - Comptroller APPROVAL OF MINUTES The minutes of the regular meeting of June 7, 1978 were presented and on motion by Councilman Bloom, seconded by Councilman DeMaio, approved as submitted. Councilwoman Monsell abstained from the vote since she was not a member of the Board at the time of that meeting. The minutes of the regular meeting of February;'7, 1979 were also presented and on motion by Councilwoman Monsell, seconded by Councilman Bloom, approved as submitted. PUBLIC HEARING (Adjourned) : Special Permit Application- Proposed Restaurant Supervisor Vandernoot reviewed the situation relative to the applicant' s proposal and informed the Board that Richard Mannix, Attorney for the applicant had requested • a postponement and thereupon on motion by Councilwoman Monsell, seconded by Councilman DeMaio, it was unanimously RESOLVED, that this Board hereby grants the request of Richard Mannix, Attorney for the-applicant, Mr. Voutsas and adjourns this public hearing until the Board' s next regularly scheduled meeting of March 7, 1979. -1- PUBLIC HEARING: Purchase of three (3) Garbage Trucks On motion by Councilman Bloom, seconded by Councilman De Maio, it was unanimously RESOLVED, that this hearing be, and it hereby is, declared open. 1 III The Town Clerk presented the Affidavits of Publication and Posting of the Notice of Hearing for the record. Following the Supervisor' s explanation of the reasons for 111 the purchase of the trucks and his outline of the procedure to be followed during the hearing, Mrs. Margaret Shultz questioned the life expectancy of the trucks and referred to the last purchase of garbage trucks. Arthur Nelkin asked the Board if the new garbage trucks will have plow mounts. Comptroller Carmine DeLuca and Supervisor Vandernoot noted that the usual life expectancy of the trucks is five years, but the wear on the last ones had been greater than usual and that more than $10, 000. has been spent on repairs during 1978. It was further noted that the trucks will not have plow mounts due to the extra cost and the additional wear on the vehicles. Thereupon, since no one else wished to address the Board, either in favor or against, the :purchase, on motion by Councilwoman Monsell, seconded by Councilman Bloom, it was unanimously RESOLVED, that the hearing be, and it hereby is, declared closed and the Comptroller is IIhereby authorized to take such steps as necessary to proceed with the bonding. OLD BUSINESS Resolution - Authorization-Bids re Cable T.V. The Town Attorney advised the Board to table this item until the next regular meeting since all three Communities must issue a joint request for bids and Mamaroneck Village had not as yet reviewed the proposal. NEW BUSINESS • 1. Set Date for Public Hearing--Proposed Revision to Zoning Code di Following a great deal of discussion in which clarifications IIJ were made by Supervisor Vandernoot and Councilman Bloom and some questions were posed by Beth Nelkin, on motion by Councilman Bloom, seconded by Councilwoman Monsell, it was unanimously RESOLVED, that a public hearing will be held by this Board at its second regular meeting in March (March 21 , 1979) in the -2- Auditorium or Council Room of the Weaver Street Firehouse, Weaver Street, Town of Mamaroneck, for the purpose of considering amending Section 89-45 of the Code of the Town of Mamaroneck by adding a new sentence; and be it further RESOLVED, that the Clerk be, and she hereby is, authorized to publish in the official newspaper of the Town of Mamaroneck,. The Daily Times, Notice of such hearing as required by law. 2. Resolution - Recommendation of Traffic Commission. Supervisor Vandernoot presented a Resolution adopted by the Town' s Traffic Commission on February 15 , 1979 and on' motion by Councilman DeMaio, seconded by Councilman Bloom, it was unanimously RESOLVED, that pursuant to the Resolution adopted by the Traffic Commission, this Board hereby approves their recommendation to prohibit parking on the North Side of Palmer Avenue in front of 1299 on Wednesdays from 9 :00 a.m. to 12 :00 noon for purposes of street cleaning and that as soon as the appropriate signs are posted the ban will become effective. 3. Resolution -Authorization-Chairmen to Execute N.G.C. Contract The Supervisor referred to the -recent resignation as Chairman of N.C.G. of Dr. Frederick Feuerbach and noted it was in order for this Board to authorize either of the two present Chairmen to takeover his previous duties and thereupon, on motion by Councilwoman Monsell, seconded by Councilman DeMaio, it was unanimously RESOLVED, that either Alan Scott or Robert Polstein is hereby authorized to enter into a contract on behalf of the Larchmont-Mamaroneck • Narcotics Guidance Council with the County of Westchester, pursuant to Article 8-A of the State Mental Hygiene Lae for State aid in connection with the operation of its program. -3- COMMUNICATIONS 1. Notice of Public Hearing - Larchmont Village Zoning Board The above-captioned notice was herewith presented and ordered received and filed. 2. Notice of Public Hearing - New Rochelle City The above-mentioned notice was also presented and herewith ordered received and filed for the record. • TOWN CLERK Regular Reports The Clerk presented the Report of the Town. Clerk for the month of January 1979 which was herewith ordered received and filed. NOT ON AGENDA THE TOWN ATTORNEY III 1. Sgt. Thomas Vitro vs. Town of Mamaroneck, et al Pursuant to the Attorney's request, on motion by Councilwoman Monsell, seconded by Councilman Bloom, it was unanimously RESOLVED, that this Board hereby authorizes the Town Attorney to defend the Town of Mamaroneck, et al in the matter of action by Sgt. Thomas A. Vitro. 2. Fairway Drive Residents vs. Town Planning Board Following the Attorney' s explanation of the suit and upon his request, on motion by Councilman Bloom, seconded by Councilman DeMaio, it was unanimously RESOLVED, that the Town Attorney be, and he hereby is , authorized . to defend the Town of Mamaroneck • Planning Board in the matter-2°f - action by a group of residents I of Fairway Drive, relative to the proposal to construct a road behind their homes in the Unincorporated Area of the Town of Mamaroneck. -4- NOT ON AGENDA Arthur Nelkin of Mohegan Road, Town, addressed the Board and offered suggestions relative to snow clearance, as did Margaret Shultz. The Supervisor and other members of the Board commended the Highway Superintendent for the fantastic job done during the snowy weather under the circumstances with a reduced staff and noted they would pass on the -suggestions to Mr. Aitchison for his consideration. • ADJOURNMENT There being no further business to come before the meeting, on motion duly made and seconded, it was declared adjourned at 9 :04 p.m. , to reconvene on March 7, 1979. BOARD OF FIRE COMMISSIONERS The meeting of the Board of Fire Commissioners was convened immediately upon the adjournment of the Town Board meeting. 1. Claims • Pursuant to memorandum addressed to the Commission by the Deputy Comptroller, under date of February 21, 1979 , herewith ordered received and filed, on motion by Commissioner Bloom, seconded by Commissioner DeMaio, it was unanimously RESOLVED, that this Commission hereby authorizes payment of the following Fire Department claims as approved by the Fire Chief and audited by the Comptroller' s Office: Communications International East, Inc. $ 35. 22 Salvatore Lagani Electrical Contractor 34. 70 Office Essentials, Inc. . 44. 38 $114 . 30 2. Reports There were .no reports`.to .come3 •be-fore the Commision. 3. Other Business Commissioner Bloom commended the excellent performance by the Town' s volunteer firemen under the leadership of 2nd Deputy Chief Shaw during the recent fire in the garage under a house on Murray Avenue, and noted that Chief Condro was out of Town and 1st Deputy Chief Tortorella was in the hospital. -5- ADJOURNMENT There being no further business to come before the Commission, on- motion duly made and seconded, the meeting was declared adjourned at 9 :08 p.m. , to reconvene on March 7, 1979.
