MAMARONECK HELD FEBRUARY 7, 1979 IN THE COUNCIL ROOM OF THE
WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK.
CALL TO ORDER
The Supervisor called the meeting to order at 8:15 P.M.

PUBLIC HEARING (adjourned) : Special Permit Application -
Proposed Restaurant
Supervisor Vandernoot stated that upon learning that only three
Board members would be in attendance this evening, he informed
III Richard Mannix, Attorney for the applicant who reserved the right
to be heard before the full Board, and thereupon it was unani-
mously agreed that the above captioned hearing would not be
reopened tonight, but would reconvene on February 21, 1979.
NEW BUSINESS
1. Salary Authorization - Recreation
The Clerk presented a memorandum addressed to the Board by the
Recreation Superintendent under date of January 26, 1979, here-
with ordered received and filed, and on motion by Councilman
Bloom, seconded by Councilwoman Monsell, it was unanimously

RESOLVED, that as provided for in the 1979
Town Budget, this Board hereby authorizes
the hiring of Charles J. Manion as Recrea-
tion Attendant at the Hommocks Ice Rink,
replacing Ed Swort, to be compensated at
the rate of $2.20 per hour, effective
January 27, 1979.
2. Authorization to Advertise for Bids - Sale of Bucket Truck
Pursuant to the Comptroller's memorandum under date of February 1,
1979, herewith presented by the Clerk and ordered received and
filed, on motion by Councilman Bloom, seconded by Councilwoman
Monsell, it was unanimously

RESOLVED, that this board hereby authorizes
publication in the official newspaper of the
Town of Mamaroneck, The Daily Times, of a
Notice of Bids for the sale of a 1966 Ford
Bucket Truck with a minimum starting bid of
$500.00
3. Snow & Ice Removal Agreement - County Roads
Pursuant to a communication addressed to the Town Clerk by Arthur
D. Ludwig, Director of Transportation Facilities for the County of
Westchester, herewith presented and ordered received and filed, on
motion by Councilwoman Monsell, seconded by Councilman Bloom, it
was unanimously
RESOLVED, that the Supervisor be and he
hereby is authorized to sign the Agreement
with the County of Westchester for the
removal of snow and ice on County Roads
the Unincorporated Area of the
Town of Mamaroneck, at a maximum amount of
$1,530.00 for 1.64 miles.
NOT ON AGENDA
Supervisor Vandernoot called to attention a meeting to be held in
White Plains with County Executive Del Bello for Town and Village
Officials on February. 16, 1979 and noted that the allocation for
snow removal would probably be one of the topics brought up at
that time.
4. Set Date for Public Hearing - Plumbing Code Revisions
Pursuant to the Supervisor's presentation of a letter addressed to
the Town Board under date of January 31, 1979 by the two plumbers on
the Town's Board of Examining Plumbers, Samuel Paonessa and Paul
Rigano, Jr. and following some discussion, on motion by Councilwoman
Monsell, seconded by Councilman Bloom, it was unanimously
RESOLVED, that a public hearing will be
held by this Board at its first regular
meeting in March (March 7, 1979) in the
Auditorium or Council Room of the Weaver
Street Firehouse, Weaver Street, Town of
Mamaroneck, for the purpose of considering
amending certain portions of the Plumbing
Code of the Town of Mamaroneck by revising
certain fees and extending the length of
time of a bond;
and be it further
RESOLVED, that the Clerk be and she hereby
is authorized to publish in the official
newspaper of the Town of Mamaroneck, The
Daily Times, Notice of such hearing as
required by law.

5. Set Date for Public Hearing - Purchase of 3 Garbage Trucks
Pursuant to Supervisor Vandernoot's review of the need for the
Town Board to hold a public hearing for the borrowing to finance
the cost of purchasing garbage trucks and following a question
as to whether this was in the capital budget, the following re-
solution was offered by Councilman Bloom, who moved its adoption,
seconded by Councilwoman Monsell, to-wit:

RESOLUTION DATED FEBRUARY 7, 1979
A RESOLUTION CALLING A PUBLIC HEARING IN
CONNECTION WITH THE PURCHASE OF GARBAGE
TRUCKS FOR REFUSE IN GARBAGE DISTRICT NO.
1 OF THE TOWN OF MAMARONECK, WESTCHESTER
COUNTY, NEW YORK.
WHEREAS, the Town Board of the Town of
Mamaroneck, Westchester County, New York,
has had under consideration the purchase
of three 1979 Garbage trucks with 18
cubic yard refuse bodies to be used for
garbage and refuse collection purposes
for Refuse in Garbage District No. 1
in said Town;
and
WHEREAS, the maximum amount proposed to
be expended for the purchase of said trucks
is $135,000;
and
WHEREAS, it is now desired to call a public
hearing pursuant to Section 202-b of the
Town Law upon such matter;
NOW, THEREFORE, BE IT
RESOLVED, by the Town Board of the Town of
Mamaroneck, Westchester County, New York
as follows:
Section 1. A meeting of the Town Board of the
Town of Mamaroneck, Westchester County, New York,
will be held at the Weaver Street Firehouse, in
Larchmont, New York, in said Town, at 8:15 o'clock
P.M., Eastern Standard Time, on the 21st day of
February 1979, for the purpose of conducting a
public hearing upon the aforesaid matter, at which
time and place said Town Board will hear all persons
interested in the subject matter thereof.
Section 2. The Town Clerk is hereby authorized and
directed to cause a notice of said public hearing to
be published once in The Daily Times, the official
newspaper of said Town, and posted in the manner
provided by law, which notice shall be in substan-
tially the following form, to-wit:

NOTICE OF PUBLIC HEARING
NOTICE IS HEREBY GIVEN, that the Town Board of the
Town of Mamaroneck, Westchester County, New York,
will meet at the Weaver Street Firehouse, in
Larchmont, New York, in said Town, on the 21st day
of February, 1979, at 8:15 o'clock P.M. , Eastern
Standard Time, for the purpose of conducting a
public hearing in relation to the proposed purchase
of three 1979 Garbage trucks with 18 cubic yard refuse
bodies to be used for garbage and refuse collection
purposes for Refuse in Garbage District No. 1 in
said Town. The maximum amount proposed to be ex-
pended therefor is $135,000, including $3,000 to be
provided by a trade-in of three used vehicles. At
such time and place, said Town Board will hear all
persons interested in the subject matter of said
hearing.
Section 3. This resolution shall take effect
immediately.
The question of the adoption of the foregoing
resolution was duly put to a vote on roll call,
which resulted as follows:

The resolution was thereupon declared duly adopted.
6. Acceptance of Performance Bond - Blossom Grove Subdivision
In accordance with the memorandum addressed to the Town Board by
the Town Engineer under date of February 6, 1979 and the pre-
sentation of the Performance Bond, both herewith presented and
ordered received and filed as a part of the record of this
meeting, on motion by Councilman Bloom, seconded by Council-
woman Monsell, the following resolution was adopted by majority
vote:
RESOLVED, that this Board hereby authorizes the
acceptance of Performance Bond #925222 in the
amount of $16,000, dated January 30, 1979 upon
which The Republic Insurance Company is Surety
and Spencer Construction Corporation of 174 East
Boston Post Road, Mamaroneck, New York is Principal;
and be it further
RESOLVED, that said resolution is contingent upon
the review and approval of the Bond by the Town
Attorney as to its form, sufficiency and manner
of execution.

7. Request for Use of Voting Machines - Mamaroneck Village
A letter addressed to the Town Clerk under date of February 5,
1979 by Joseph P. Fraioli, Mamaroneck Village Clerk was herewith
presented and ordered received and filed, and thereupon on motion
by Councilwoman Monsell, seconded by Councilman Bloom, it was
unanimously
RESOLVED, that this Board hereby grants the
request of the Village of Mamaroneck for the
use of seventeen (17) voting machines to be
used in the Annual Village Election of March
20, 1979.
COMMUNICATIONS
1. Letter, Congressman Ottinger re Flood Control
The Supervisor presented a letter addressed to him under date of
January 29, 1979 by Congressman Richard L. Ottinger, herewith
ordered received and filed, indicating that he is trying to amend
the bill which excluded the upper Sheldrake River flood control
project from the overall flood control plan for this area.
Mr. Vandernoot further noted that he had expressed his thanks to
the Congressman for his efforts.
Not on Agenda
Supervisor Vandernoot also acknowledged receipt of a letter from
Assemblyman John M. Perone dated February 1, 1979 advising of his
and Senator Pisani's introduction of a proposed bill which would
mandate the State to create a Flood Control Program so that each
community having been turned down by the Federal government could
apply for specific one hundred percent Flood Control Projects.
The letter was herewith ordered received and filed.
2. Notice of Public Hearing - New Rochelle City
The above-mentioned Notice was presented and herewith ordered
received and filed with the notation that the items to be covered
are of no real concern to the Town of Mamaroneck.
THE TOWN CLERK
Regular Reports
The Clerk presented the following reports which were ordered
received and filed:

THE SUPERVISOR
1. Authorization to Apply for Additional Section 8
Rent Subsidy Units
Mr. Vandernoot briefly reviewed the Rent Subsidy Program and noted
that HUD has notified the Town of its eligibility to apply for 75
additional units, and thereupon on motion by Councilman Bloom,
seconded by Councilwoman Monsell, it was unanimously
RESOLVED, that the Supervisor be and he
hereby is authorized to execute the appli-
cation required in order to subsidize an
additional 75 units under Section 8.
2. 1978 Senior Center Annual Report
Supervisor Vandernoot acknowledged receipt of the above captioned
report which outlined a very busy year and commended Oscar L.
Birch, President and Bess Bernstein, Vice-President. He highlighted
some of the outstanding activities of the members of the Center
and noted that a delegation of seniors had intended to be in attend-
ance at this meeting, but were unable to attend due to the weather.
The Board hopes to have them present at a later date. The report was
ordered filed.
3. Proclamation - Engineers' Week
Following the Supervisor's presentation of a communication
addressed to him under date of November 28, 1978 by the Westchester
Chapter of the New York State Society of Professional Engineers,
and with the unanimous consent of the Board, the following
proclamation was issued:
ENGINEERS WEEK
1979 PROCLAMATION
WHEREAS, the week of February •18th to 24th, 1979 has
been designated throughout the nation as
Engineers' Week;
and
WHEREAS, the National Society of Professional Engineers
has chosen the theme for National Engineers'
Week - "Engineers - People Bringing Purpose
to Progress";
and
WHEREAS, the gold is to explain how engineering has
contributed to the growth of our nation, the
ways in which engineering technology makes
life more comfortable for us, and what is
being done to improve the quality of life in
Westchester County and other areas of the
country;
and

WHEREAS, it is fitting that we set aside a week of
acknowledging and commemorating the important
role of the professional engineer in American
life;
NOW, THEREFORE,
I, Joseph F. Vandernoot, Supervisor of the Town
of Mamaroneck, in recognition of the contributions
of the engineering profession in applying techno-
logy to meet the urgent problems of the day and
create a better tomorrow, do hereby proclaim the
period of February 18th to February 24th, 1979 as:
Engineers' Week in the Town of Mamaroneck
Charles Elfreich, Town Engineer pointed out at this time that the
Westchester Chapter will be presenting exhibits and displays as well
as giving lectures throughout the week at various malls in the County.
THE COUNCILMEN
Mr. Bloom
1. Reappointments to Zoning Board
Pursuant to Councilman Bloom's recounting of Mr. Hardesty's and Mr.
Moore's qualifications and service thus far on the Zoning Board, and
following notation that due to an oversight, Mr. Hardesty has not been
appropriately reappointed last year when his term expired, on his motion
which was seconded by Councilwoman Monsell, it was unanimously
RESOLVED, that Egbert Hardesty, Chatsworth
Gardens Apartments, Town be and he hereby
is reappointed a member of the Town of
Mamaroneck Zoning Board of Appeals to serve
for a term of office of five years, retro-
active to February 19, 1978 and terminating
February 19, 1983;
and be it further
RESOLVED, that Peter G. Moore, 104 North
Chatsworth Avenue, Town be and he hereby is
reappointed a member of the Town of Mamaroneck
Zoning Board of Appeals to serve for a term
of office of five years effective February
19, 1979 and terminating February 19, 1984;
and be it further
RESOLVED, that Mr. Hardesty and Mr. Moore be
notified accordingly.
Not on Agenda
Margaret Shultz addressed the Board and suggested a letter writing
campaign to Governor Carey relative to his proposed budgets cuts of
federal revenue sharing and further questioned the status of the
Daitch Certiorari proceeding which had not only been discussed at
the Town Board's last meeting, but was also discussed at the most
recent meeting of the Larchmont Village Board. Supervisor Vander-
noot answered the querys posed by Mrs. Shultz.

ADJOURNMENT
There being no further business to come before the meeting, on
motion duly made and seconded, it was declared adjourned at
8:45 P.M. , to reconvene on February 21, 1979.
BOARD ON FIRE COMMISSIONERS
The meeting of the Board of Fire Commissioners was convened
immediately upon the adjournment of the Town Board meeting.

Pursuant to the memorandum addressed to the Commission by the
Deputy Comptroller under date of February 7, 1979, herewith
presented and ordered received and filed, on motion by Commis-
sioner Bloom, seconded by Commissioner Monsell, it was
unanimously
RESOLVED, that this Commission hereby
authorizes payment of the following
