HomeMy WebLinkAbout1983_07_26 Town Board Special Minutes 372 MINUTES OF THE SPECIAL MEETING OF THE TOWN BOARD OF THE TOWN OF MAMARONECK, IN THEIR CAPACITY AS THE POLICE COMMISSION, HELD ON THE 26TH DAY OF JULY 1983 IN THE AUDITORIUM OF THE WEAVER STREET FIREHOUSE, WEAVER STREET, TOWN OF MAMARONECK. CALL TO ATTENTION - Location.:o:f: Exits Supervisor Goldsmith pointed-out to those assembled the location of exits as required by law for public gatherings. The meeting was called to order by Supervisor Goldsmith at 8:00 P.M. Present were the following: Supervisor Leo Goldsmith, Jr. Councilman Lee H. Bloom Councilman Thomas R. Amlicke Councilwoman Caroline Silverstone Councilman Stewart J. McMillan was not in attendance at this meeting. Also present were the following: Dorothy S. Miller, Town Clerk James J. Johnston, Town Attorney Stephen V. Altieri, Town Administrator Charles S. Blaumblatt, Police Chief Charles R. Elfreich, Town Engineer Supervisor Goldsmith gave the background of the Rock Ridge Road situation, specifically reviewing the last regular meeting of the Town Board. He then deferred to the Town Administrator who continued to review the matter and enumerated what had taken place since the July 13th meeting; as well as enumerating those conditions negotiated with the developer, Mr. Loewentheil and Attorney, Mr. Zingesser, as outlined in Mr. Altieri's memorandum to the Town Board dated July 22nd. Town Engineer Charles Elfreich elaborated further on the matter making references to a visual aid which depicted the subject area. The letter addressed to the Town Board by William and Alice Eng, 27 Rock Ridge Road, in which they stated their idea of how to alleviate the problem, was made a part of the record of this meeting, since they . were unable to be in attendance. Following Councilwoman Silvefstone's query about the matter of a temporary :_,njunction, Supervisor Goldsmith answered that it had been explored and found that it was not feasible-to go forth with that procedure at this time. A very lengthy discussion ensued during which the following persons spoke in addition to Board members and Town staff: Jerry & Marilyn Glaser, 19 Rock Ridge Road Howard Loewentheil, President of Fairway Green, Inc. Mrs. Mary Anger, 23 Rock Ridge Road William Roehr, 21 Rock Ridge Road -1- 373 Mrs. Marsha Kirchoff, 25 Rock Ridge Road Lawrence Lerman, 41 Lansdowne Drive Dolores Battalia, 14 Knollwood Drive Mary Carson, 17 No. Chatsworth Ave (Speaking as a Member of the Town Planning Board) The following aspects of the matter being addressed were discussed: -Rock Ridge Road resdients' concerns relative to safety, condition of their road and possible damage to underground utilities. -The matter of the trucks being escorted. -The building of the new road - access from Mamaroneck Village -The installation and maintenance of and the access to the proposed gate across Rock Ridge Road -The proposed ordinance restricting truck traffic on Rock Ridge Road and the implications thereof -The matter of the public notice - Mamaroneck Village Planning Board meeting -The proposal to designate Rock Ridge Road as a "dead end" -The proposed ordinance relative to through trucking. -The 1980 recommendation by the Town Planning Board regarding restricting vehicles connected with the construction site with Rock Ridge Road as an access to the site -The matter of the Town Board acting as the Police Commission Thereafter, the discussion turned to the specific stipulations and conditions outlined in Mr. Altieri's July 22nd memorandum, and on motion by Councilwoman Silverstone, who proposed several amendments, seconded by Councilman Amlicke, the following resolution was unanimously adopted: WHEREAS, this board wishes to find a solution to the concerns expressed by the residents of Rock Ridge Road; NOW, THEREFORE, BE IT RESOLVED, that this Board hereby directs the Town Attorney to address a letter to Howard Loewentheil, President of Fairway Green, Inc. requesting his signature thereon within seven (7) days of receipt of the letter containing the following stipulations and agreements: 1. Any and all trucks will be escorted in both directions on Rock Ridge Road to watch for children and other safety hazards. Trucks delivering materials and supplies to the construction site shall telephone the construction site prior to delivery so that an escort may be provided. 2. The Town Engineer will be notified of all deliveries involving large trucks or deliveries requiring a number of trucks. 3. After the showcase and first 400 feet of road are constructed, all traffic to the development site will be eliminated from Rock Ridge Road. -2- 374 Effective December 1, 1983, a gate will be installed at the end of Rock Ridge Roathby the developer to prevent the ingress and egress from the site. If the developer should fail to complete the construction of the showcase and roadway or fail to install the gate by December 1, 1983, the Town through its own resources will install a gate at the end of Rock Ridge Road. 4. The Town Engineer and Town` Superin- tendent of Highways will determine the current condition of the road. Any damage caused by construction related traffic will be repaired by the developer. 5. At the end of the development roadway near Rock Ridge Road, the developer will realign the curb in accordance with the attached drawing. The curbing shall be 6" high except for a 12' section whieh .will be 2" high to allow for emergency vehicles. 6. If the model showcase is constructed prior to December 1, 1983, Rock Ridge Road shall not be the access for the advertising or showing of such model. 7. An 18' gateway made up of two 9' sections will be installed and fencing the entire width of Rock Ridge Road. The gate shall be locked and the keys for the lock shall be held by the Mamaroneck Village Fire Department, Mamaroneck Village Police Department, Mamaroneck Town Fire Department, Mamaroneck Town Police Department, Mamaroneck Village Rescue Squad and Larchmont- Mamaroneck Volunteer Ambulance Corps. As mentioned in condition #3, the fencing and gate shall be installed by December 1, 1983. 8. On either side of the fencing, shrubbery will be planted and the buffer area will be lined with woodchips. 9. Screening through the use of Hemlock trees will be placed along the Village/ Town border. The developer will submit a plan for Items 7, 8 and 9. 10. If it is agreeable to the Westchester Joint Water Works, a fire hydrant will be placed at the end of Rock Ridge Road. and it is further RESOLVED, that the Town Attorney be and he hereby is further directed to prepare an ordinance restricting vehicles of a certain tonnage from Rock Ridge Road -3- 375 Councilman Amlicke requested that this matter be placed on the August 3rd agenda for the possibility of setting a date for a public hearing on the proposed ordinance. At this time on motion duly made and seconded, the Special meeting was unanimously declared adjourned at 10:10 P.M. III Town Clerk III III -4-
