TOWN OF KAMARO",=
held March 30th, 1926.
-- The meeting was called to order by Supervisor
Burton at 4 P.M,
PRESENT: Supervisor Burton
Justices boyd, Collins,Howell,Leeds
Town Clerk Sherman
Counsellor Gamble.
The Supervisor stated that the first order of
business was the reading of the advertising for receiving
of bids in connection with the reconstruction and alter-
ing of the Police house located at Edgewood Road; and
the Clerk having read the same, it was, upon motion, duly
seconded,
RESOLVED, that the notice of meeting be
and the same hereby is approved.
Upon motion, duly seconded, it was
RESOLVED, that the bids received pursuant
to said notice be opened.
The Clerk thereupon proceeded to open each of the
bids received and which were as follows :-
PLASTERING

PAINTING
A. Mosher, 1, 145.00
Upon motion, duly seconded, it was
RESOLVED, that the foregoing bids be
referred to a committee of this .Board
for their report and recommendation.
whereupon the Supervisor appointed the following committee:-
Justiese Collins,nowell and Leeds.
The next order of business was the reading of the
advertising for the receiving of bids in connection with
the erection of one complete fire alarm system at the
Weaver Street Fire House, Edgewood Road and Weaver Street
and the Clerk having read the same, it was, upon motion
duly seconded,
RESOLVED, that the notice of advertisement
be and the same hereby is approved.
Upon motion, duly seconded, it was
RESOLVED, that the bids received pursuant
to said notice be opened.
The Clerk there-t.pon pro-eeded to open and read
each of the bids received and which were as follows :-

Proposal #2, 3, 900.00
Upon motior_, dt!ly seconded, it was
RESOLVED, that the foregoing bid be
referred to a committee of this Board
for their report and recommendation
whereupon the Supervisor appointed the following committee:
Justices Collins,Howell and Leeds.
A communication from the Board of Appeals was
received and read, stating that at their meeting held on
March llth, action was taken disapproving the recommenda-
tior of the Town Board in repealing Paragraph 2 of Section
15 of Article 3 of the Zoning Ordinance, This matter was
discussed by the Board and the same was laid over for a
future meeting.
In the sane communication the Board of Appeals
recommended to the Town, Board the reclassification from
"Business OC' Districts" to "Residential ®A° Districts"
the property lying within the lines of takings for the
Pelham Portchester Parkway as shown on Skeet 9 of the
_._. Westchester County Parke Commission; and also recommend-
ing to the Town Board the reclassifying as "Business tCr
Districts" the following* property wriich is now zoned as
— "Commerical rD+ ", to-wit: that district bounded on the
west by the easterly side of Cedar Street, on the north by
the v= southerly side of Laurel Avenue, on the east by
the westerly side of Columbus Avenue and on the south by
the proposed northerly line of the Pelham Portchester
Parkway.
The Board of Appeals also recommended the reclassi-
fication as "Residential /Be District" all of the land lying
between the property of the New York New Haven & Hartford
Railroad Company on the south, the easterly border of the
Town Park on the west and the southwesterly side of the
Pelham»• Portchester Parkway or, thenorth, and east,
Mr. Stephen Ba:dolato appeared before the Board
and voiced his opposition to the changing of the "Business
tet Distract" to "Residential *A® Districts".
mr. H.J,.Brewer appeared on behalf of the
Westchester County Park Commission and stat6d that it is
the request of the Commission that action on the foregoing
rezoning be deferred to a later date.
Upon motion, duly seconded, it was
RB'SOLSTED, that action upon the resolution
of the Board of Appeals of the Town of
,mamaroneck, in the re-classifiaction of
Business C .Distra-cts to Residential A
districts, within the lines of takings for
the Pelham Portchester Parkway which
resolution was adopted pursuant to the
application of the Westchester County Parke
Commission, be deferred upon the request of
said Lommission.
A communication from the Board of Appeals was
received and read, stating that at their meeting held on
March 25th, resolutions were adopted recommending to
the Town Board that the application of Tyr. Erwin Bitter
to erect a show-room, apartments and garages on the
_._ south side of the Boston Post Road be denied; and that
the application of the Grasdon Building Corporation to
erect a sign on the west side of Deane Plaee, corner of
the Boston Post Hoad, be denied.
The communication was ordered filed and the
action of the Board of Appeals noted in the minutes.
Upon the recommendation of Counsel® the follow-
ing resolution was presented, and upon Roll Call, tuzanimously
adopted
WH I,AS, in connection with the construction
of a Sewer System in Sewer District No. 1 of
the Town of Mamaroneck, this Board has from
time to time authorized the issuance and sale
of bonds as required by law to pay for said
cost; and
WHEREAS, said bonds are now coming due, prior
to the completion of said Sewer System in its
entirety, and
WHEREAS, it is desirable and, in the opinion
of this Board, necessary that the burden of
- the payment of the outstanding bonds should
be equitably proportioned upon all of the
property owners to be served by the said

Severer System, part of which hadnot g et been
constructed or completed, and it is desirable
to permit a portponement of the payment of the
outstanding bonds by the issuance of Refunding
Bonds until suer. time as the entire system
will be completed and the burden can then be
equitably adjusted upon all of the property
owners then served by the entire system, and
WELEREAS, it is the opinion of this Board that
special legislation should be enacted to bring
about this result and other corelated sewer
matters, a draft of which legislation has
been prepared and submitted to this Board;
trerefore be it unanimously
RESOLVED, that this Board approves of the
draft of a proposed bill prepared entitled
"An Act Relating to the issuance andPayment
of Bonds of the Twwn of Mamaroneck for the
Sewer System in Sewer District Vo. 1 in
said Towr-11 ; and be it
2JR2HER RESOLVED, that this Board earnestly
and respectfully petitions the Legislature
of the State of uew York that said Act may
be promptly enacted into law, so that the
provisions thereof may bemade available to
the Town of Yamaroneck; and be it
FURTHER RESOLVED, that the Supervisor and
Counsel be and they hereby are authorized
and directed to have said Act introducte
and enacted into Law.

A communication from Mr. Austin K. Griffen
representing 1dr. Thomas H. Fagan the owner of premises
on the north side of the Boston Post Road,Lareftont,
where the town has an election, booth at the present
time under a lease dated8epternber 25, 1921, was received
and read, .giving formal notice to the Town of the
.- termination of the lease as of September 25, 1926, which
is the expiration date of said lease.
The communication was ordered placed on file
and the matter referred to the Town Clerk.
Upon the recommendation, of Counsellor Gamble
the following resolution was presented, and upon Roll Call
unanimously adopted
WhMEAS, an action was heretofore started in the Supreme
Court of Westchester County by RoseF.Peters, plaintiff, vs.
the Town of Mamaroneck, demanding judgment that certain
taxes and tax sales upon the plaintiff's premises described
in the complaint be declared illegal and void, vacated and
set aside and for further relief, and
AREAS, after investigation of the matter and conference
caith the attorneys for the plaintiff, Counselhas reecmmended
that said action be compromised and settled, and
WHEREAS, the plaintiff has agreed to pay certain taxes,
penalties and interest that have accrued in full on certain
of the property and/or lots covered by said action and
to pay the flat amount of the tax levied and assessed dor
each year plus 61% interest thereon from the due date of
each respective tax thereon, and the test of advertising
-- on certain other lots provided the penalties and interest
at the rate of 12% herein is waived, and
WHEREAS, it appears to be to the interest of the Town of
Mamaroneck to compromise and settle the aforesaid action,
therefore, be it
RESOLVED, that the Supervisor and Receiver
of Taxes upon the payment by the plaintiff
or her assigns of the full amount of taxes
plus penalties and interest and cost of
advertising on lots 3, 4, 5, 6 and 7, and 10
to 15, inclusive, Block 63, Section 9 on the
Tax Map of the Town of Mamaroneck for years
1919 to 1925 inclusive,be and they hereby
are authorized and empowered to accept in
full payment for the taxes due on Block 68
Section 9 on the Tax Map of the Town of
Mamaroneck, the flat amount of the taxes
levied, assessed and due for the years 1918,
1920, 1921, 1922, 1923 and 1924(for the Tax
- - Sales of 1919, 1921, 1922, 1923, 1924 and
1925 ),plus interest at the rate of 6% per
annum on the amounts due for each respective
— year from the respective due date thereof,
plus the cost of advertising, and
BE I'T FURTHER RESOLVED, that the Supervisor
and Receiver of Taxes be and they hereby
are authorized and empowered to cancel on
the proper 'books of record the unpaid amount of

penalties and interest now shown and accrued
on the aforesaid property for said respective
years upon receipt of the payments in the
amounts provided for in this resolution and
to issue such certificates of payment as they
may intheir judgment deem advisable for
said years 1919, 1921, 1.922® 1923, 1924 and 1925
on said property; and it was
FURTHER RESOLVED, that the Clerk be and he
hereby is authorized and empowered to
certify and deliver to the Supervisor and
Town Receiver of Tares the necessary copies
of this resolution for their respective
records ; and it was
FURTHER RESOLVED, that Counsel be and he
hereby is authorized and empowered to take
such action, as may be necessary to settle
and compromise the aforesaid action as herein
provided.
Upon motion, the meeting adjourned at 5.30 P.19,
