A general discussion of the entire situation was had at which I1r.Carles V1lhalen who was also present participated in and after considering the report in full it was : G tC that the entire matter be laid over and taken 2 n up at a special meeting to be held. on March 6, 1926 a'� P.M. Messrs. Mahlotedt and Steen together with their Ccunsel,Il4r. Gaglia±'di, appeared before the Board in relation to their application for the erection of an apartment house at the northwest corner of Chatsworth and Qztle Avenues . A general discussion of the Zoning Ordinance was had and after due consideration the fallowing resOlut- ions were presented and upon Roll Call unanimously adopted: RESOLVED that this Board ref at to the c and Board oFAppc°als for public hearing ae�.. consideration the matter of repealing Paragraph 2 of Section 15 of Article 3 of the Zoning Ordinance and the sub- stitution in its place of a paragraph to read substantially as follows,70 : „In eBa 8 or,e 'D' and 131 districts no dwelling or tenement house shall hereafter be erected or altered to accomodate or make provisions for more than 80 families CA any acre* of land, nor more than a pro- portionate number of families on a fractional the part of any acre of land, without t,,:, approval of the Board of Appeals Or of she Town Board and all appeals under this section shall be submitted to the Town Board for final determination. '' A communication from the Board of Appeals was _ received and read, stating that at its meeting held or, February 25, 1926, the following resolutions were adopted: 1. Recommending to the Town Board that the application of Jean R. Higgins for the erection of a one family dwelling on the northeast corner of Weaver Street and Heather Lane be granted and the decision of the Building Commission be reversed, provided that no part of said building be less than 30 feet from on Weaver the plans Street be nearer t no part except the nearertoHeather Lane thanb20 Steil, 2. Recommending to the Town Board that the application of Colin C.Kay for the erection, of a one family dwelling on the northeast corner ofWeaver Street and Briarcliff Road wvithin30 feet of Briarcliff Road- be granted and the de- cision of the Building Commission be�reversed, provided that the building be constructed in :accordance with the plot plan filed, 3 pheomnending to the 'Town Board that the application of the Hillside Holding Corporation for a re-location of an apartment house on theproperty line of P,Iyrtle Avenue be granted. - Whereupon the following resolutions were presented and unanimously adapted: WHEREAS, the Board of Appeals has recommended to the Town Board that the application of ,lean R. Higgins for the erection of a one family dwelling on the northeast corner of Weaver Street and Heather Lane be granted and the decision of the Building Commission_ be reversed,provided that no part of said building be less than 30 feet from Weaver Street and that no part except the brick step, as shown on the plans,be nearer to Heather Lane than 20 feet, therefore be it RESOLVED, that the Town Board pursuant to Article 5, Seetien 26 of the Town Law hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. WHEREAS, the Board of Appeals has recommended to the Town Board that the application of Colin G.Kay for the erection of a one family dwelling on the northeast corner of Weaver Street and Briarcliff Road within 30 feet of Briarcliff Road be granted and the decision of the Building Commission be reversed, provided that the building be constructed in accordance with the pleat plan filed, therefore be it _ RL'SOLVED, that the To-nn Board pursuant to Article 5, 5ecticn 26 of the Town Law hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building commission. t;HEREAS, the Board of Appeals has recommended to the Town Board that the application of the Hillside Holding Corporation for a re-Location of an apartment house to the property line of Myrtle Avenue be granted, therefore be it RESCIVID, that the Town Board pursuant to _ Article 5, Section 26 of the Town Law hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the uilding Commission.
