Wasp,P.E., C.D.T. rwasp@townofmamaroneckNY.org Town Engineer INTERDEPARTMENT MEMORANDUM DATE: March 13,2020 TO: Steve Alfieri, Town Administrator FROM: Robert Wasp, P.E., Town Engineer SUBJECT: Design Development Status Hickory Grove East Sidewalk Extension(CP-2019-64) GENERAL: Topographic survey of Town right-of-way area within the proximity of the planned sidewalk extension on Hickory Grove Drive East was completed in February 2020. Survey deliverables were reviewed by the Engineering Department and forwarded to Dolph Rotfeld Engineering for preliminary design and layout as Town consultant. Dolph Rotfeld Engineering has produced the attached schematic level drawings that show the construction of a new five foot wide concrete sidewalk following the northbound travel lane. New proposed sidewalk commences at the limit of current walk in front of#194 Hickory Grove Drive East and terminates at the intersection with Rockland Avenue in front of#808 Hickory Grove Drive east. Approximately 550 linear feet of new sidewalk is located within the Town of Mamaroneck. The portion of sidewalk extension within on Village property amounts to about 180 linear feet. Constrained space between the existing edge of road pavement and right-of-way boundary requires minor realignment of the travelway to avoid land acquisition. Areas shaded in blue on the attached drawing represents new sidewalk placement within existing roadway pavement,whereas areas shaded in red show area of necessary expanded pavement limits. Schematic drawings were reviewed with Town staff in the field on March 12th,2020. Based upon field discussions,Dolph Rotfeld Engineering will evaluate reduction in sidewalk width to 4 feet; and expansion of road pavement width to 26 feet in accordance with Town standard specifications. Resulting impacts to necessary work scope and project cost will be evaluated upon the receipt of revised drawings and cost estimate from Dolph Rotfeld Engineering. Total project costs encumbered to date sum to $9,827 for surveying and bonding. Engineering fees for Dolph Rotfeld Engineering are established at 7.5%of received price in accordance with their approved consultant contract. Detailed design drawings are expected to be available for final review in April with subsequent procurement to follow in May 2020. Contact with Town and Village residents in proximity to the construction will be established over the next several weeks. Below is a chart summarizing not only his comments but also setting forth some of the suggestions discussed at the March 4th meeting. Conceptually, a permittee would follow the existing protocols for obtaining a rock removal permit. Of course, the notification to the neighborhood would have to be re-written to account for the possibility that the rock removal may be suspended. That permit would start the 15-day removal period. If the permittee wants to suspend removal, it would so advise the Building Department. The Department would note the date of the suspension and record how many of the 15 days have elapsed. When the permittee wants to resume,it would notify the residents that the removal would resume on—X-date. Again, a letter advising resumption would have to be drafted to become part of the local law. The permittee would be allowed to remove rock for the number of unused days at the time of the suspension. The suspension-resumption period would be of short duration,say 30 days,since in most circumstances, the permittee does not want to suspend operations but finds itself compelled to do so because having commenced work, the permittee encounters rock that requires drilling in advance of actual removal and time is needed to arrange for a drill, or because a hammer has broken down and time is needed to get it repaired or have it replaced. This chapter shall apply only to that part of the Town of Mamaroneck outside of incorporated villages, and whenever and wherever the words "Town of Mamaroneck" are used, such words shall mean the Town of Mamaroneck outside of incorporated villages. § 154-2. Definitions. As used in this chapter, the following terms shall have the meanings indicated: PARK, PARKING OR PARKED The stopping of a motor vehicle or motorcycle upon any public highway and leaving such motor vehicle or motorcycle unattended by a person capable of operating it for a period longer than necessary to load or unload passengers or freight. PERSON Includes individuals, copartnerships, corporations and incorporated and joint-stock associations. Applications for licenses. [Amended 5-3-1939] Applications for licenses under this chapter may be refused by the Town Clerk, as provided by law. § 154-6. Personal permits. [Amended 7-1-1953] Where a vehicle has been licensed as provided in § 154-4 of this chapter, such license shall include the right of a driver or operator of such vehicle to sell, peddle, hawk or vend the goods, wares and merchandise carried in such vehicle; provided, however, that no person, including the owner of such licensed vehicle, shall operate the same without a personal permit to be issued by the Police Chief, upon the production of satisfactory proof of the fitness of the applicant therefor, and such permit shall expire on the 31st day of December after the issuance thereof, unless sooner revoked. Nothing herein contained shall be construed to permit any salesman or helper upon any vehicle for which a peddler's or hawker's license has been obtained to peddle, hawk or vend the goods, wares or merchandise carried in such vehicle, by means of any stand or box or otherwise than from the vehicle itself, unless a peddler's or hawker's license has been separately obtained for each such salesman or helper, in accordance with the provisions of§ 154-3 of this chapter. § 154-7. License fees. [Amended 5-3-1939; 7-17-1996 by L.L. No. 14-1996; 8-17-2011 by L.L. No. 8-2011] The fee for a license issued pursuant to this chapter is as set forth in § A250-1. § 154-8. Exceptions. A. Delivery vehicles. The provisions of this chapter requiring licenses for vehicles shall not be construed to require licenses for delivery vehicles owned by or used by grocers, bakers or other persons, firms or corporations having within the Town a store, storehouse or warehouse for the sale or distribution of or an establishment for the manufacture of the merchandise carried in said vehicle nor for the drivers or operators of such vehicle. B. Interstate and solicited orders. The provisions of this chapter shall not apply to the selling, bartering or vending of goods, wares or merchandise where such goods, wares or merchandise are shipped from outside the state or where orders for goods, wares or merchandise are solicited and such goods, wares or merchandise are subsequently delivered. State-licensed parties. The provisions of this chapter shall not apply to the holder of a license granted pursuant to § 32 of the General Business Law. § 154-9. Licenses: cancellation; nontransferability; expiration. Any person violating any of the provisions of this chapter, as the same may be from time to time amended, for which no other penalty is provided, shall be guilty of a misdemeanor punishable by imprisonment for not more than one year or by a fine of not more than $500, or both. [Amended 12-17-1953] (1) Violation of §§ 154-3 and 154-4 of this chapter shall subject the offender, for each offense, to a civil penalty not to exceed $50. (2) The penalty for violation as above provided shall be in addition to any fine provided for in § 154-11A. The vehicle that would have been purchased under the plan is a 2020 Chevrolet Tahoe. We have learned that due to problems in the production of the vehicles, we will not be able to purchase this vehicle from Chevrolet until 2021. As a point of information, the Chevrolet Tahoe produced for emergency service use is different from the standard vehicle that purchased for regular passenger use. The production problems appear to be with the emergency service version of the vehicle. Because of the delay, the request is to amend the capital plan and switch the purchase of a Chiefs vehicle to the replacement of the Fire Department's utility vehicle. Currently,the Fire ,,. Department uses a 2010 Chevy Tahoe as a utility vehicle. The Fire Department is recommending that the current utility vehicle be replaced with a four-door pickup truck with an enclosed rear bed that will provide greater storage and greater flexibility as an emergency response vehicle. The current utility is used as follows: ® Transporting volunteers to training centers and emergency response on 1-95 ® Staged at downed wires and for blocking roadways to avoid tying up a piece of fire apparatus. . ® Used to carry equipment such as extra Scott packs, and temporary lighting. ® A new NFPA guideline requires that fire turnout gear that is exposed to any carcinogens at a tire scene be transported separately so that it can be cleaned. This vehicle would be used for that purpose. A four-door pick-up truck will provide greater capabilities for additional storage for barricades and turn out gear for firefighters. The cost of the vehicle and its outfitting will be between $46,000 and $50,000. Therefore, no additional funding will be required for to amend the capital project. The vehicle is available on a Westchester County Purchasing Contract. Attached is the original request explaining the need for the equipment. The Town has been discussing this project with the Village of Mamaroneck and there is agreement that this can be a tremendous shared service opportunity between the communities since both communities have the same obligation to inspect our respective sewer systems. To that end, the Village of Mamaroneck and the Town will enter into an agreement for the Village to pay 50%of the cost of the vehicle. Under the shared service plan, the Town and Village have agreed that the Town will assume responsibility for the operation and maintenance of the vehicle and equipment. The Town will provide sewer inspection services to the Village. Therefore, in addition to the Village providing 50%of the capital cost to purchase the vehicle, they will pay an hourly fee to the Town for providing inspection services.
