Building Inspector From: William Maker, Jr., Attorney for the Town Subject: Amendment to the law regarding Rock Removal by Mechanical Means Date: November 15, 2019 I attach a redline of the Town's current law regarding rock removal by mechanical means. The changes shown by the redlining reflect the recommendations expressed in the memorandum submitted to the Town Board by the Town Administrator after being reviewed by the Building Inspector to assure their practicality. If the proposed law is in acceptable form, the Town Board can set a public hearing where members of the public can express their views on the proposal. It 1111t to Printed on Recycled Paper §106-58.1 Duration and hours for mechanical rock removal. As used in this section, the following terms shall have the meanings indicated: A. MECHANICAL MEANS The use of any tools that are not operated solely by human muscular power. Explosives and the tools used in connection therewith shall not be considered mechanical means. ORIGINAL CONSTRUCTION Streets and curbs, and the lines, pipes, culverts and conduits used for transporting potable water, stormwater, sewage and utilities, such as gas, telephone, electricity, cable television and Internet service,that are built on land subdivided after February 1, 2004, if the subdivision plat creating the lots in that subdivision also created one or more new private or public streets or created extensions to any existing private or public street. ROCK REMOVAL PERMIT A permit issued for rock removal on a subject property. SUBJECT PROPERTY A lot for which a rock removal permit is required,or land where original construction is to occur if such land lies outside a lot. B. A rock removal permit is required for the removal of rock of any quantity. No rock removal permit shall be issued until the Building Inspector approves the dust mitigation plan submitted by the applicant. Such plan must incorporate the best dust control practices, including but not limited to, a water spray system (air suppression or surface wetting) or other practices that are considered best dust practices at the time the application for a rock removal permit is made. The dust mitigation plan also must present the measures the applicant intends to use to control water runoff as a result of water spraying. C. Rock removal shall be allowed only on the 15 days (not including Saturdays, Sundays and public holidays listed in §24 of the New York General Construction Law) ihmieftiately fellewstarting on the date specified for the commencement of the rock removal permitcontained in the notice to neighbors described in§106-581 F.The rock removal permit shall contain the date after which rock removal no longer will be allowed to be done pursuant to that permit. Upon a showing of undue hardship,the Building Inspector or the Director of Building Code Enforcement and Land Use Administration may extend the last day on which rock may be removed pursuant to a rock removal permit by up to five days. If the number of additional days would include a day or days on which rock removal is prohibited by this section,the extension period will bypass such days and resume on the first day thereafter when rock removal is permitted by this section. This subsection shall not apply to original construction. D. For original construction, rock removal shall be allowed only for the 180 days (not including Saturdays, Sundays and public holidays listed in §24 of the New York General Construction Law) immediately following the date of the rock removal permit. That permit shall contain the date after which rock removal no longer will be allowed to be done pursuant to that permit. E. Before rock removal can begin, the applicant shall conduct a survey of the condition of the improvements existing on each lot that has a lot line lying within 150 feet of any lot line of the subject property. If the occupant of a lot lying within the area to be surveyed refuses to allow a survey to be done, the applicant shall submit an affidavit stating that he/she had attempted to gain access but was denied. Submission of such an affidavit will be obviate the requirement for a survey of that lot. Notwithstanding the foregoing, a survey shall not be required if all of the rock removal will be done using mechanical means that are designed to handheld while operating. &.. Notice to neighbors;affidavit of mailing. (1) No later than 10 days before rock removal : - . . - . .• ___-. , the following notice shall be mailed to the owners of each lot that has a lot line lying within 150 feet of any lot line of the subject property: 2 "Dear Neighbor, Rock removal from the property known as [INSERT THE STREET ADDRESS OR THE LOCATION OF THE SUBJECT PROPERTY IF IT HAS NO STREET ADDRESS]by mechanical means,such as drills,jackhammers and other types of gas,diesel or electric powered equipment is scheduled to begin on[INSERT EFFECTIVE DATE OF THE ROCK REMOVAL PERMIT]. The law does not permit rock removal by mechanical means to occur on Saturdays,Sundays or public holidays.It also prohibits such removal before 9:00 a.m. (prevailing time)and after 62:00 p.m. (prevailing time)on those days when rock removal by mechanical means is permitted. The last day on which rock cart be removed from this site by mechanical means is [INSERT THE LAST DATE ON WHICH ROCK REMOVAL BY MECHANICAL MEANS CAN OCCUR]. The owner of the subject property shall attest to that affidavit. G. There shall be no more than two machines and two hammers operating on the subject property at the same time. I-I. Rock crushing on the subject pr perty is not permitted at any time, I. Motor vehicles used to transport particulate matter must be covered. T. While on the subject property, any particulate matter must be sufficiently soaked or stored so as to prevent the particulate matter from becoming airborne,The Building Inspector may require secured tarps or coverings made of plastic or other material to further reduce dust emissions. F,K Rock removal shall not be permitted in any residence district or in the Recreation District of the Town of Mamaroneck: (1) On Saturdays; 3 (2) On Sundays; (3) On public holidays listed in§24 of the New York General Construction Law;or (4) Before 9:00 a.m. (prevailing time) or after 63:00 p.m. (prevailing time) on weekdays which are not public holidays listed in§24 of the New York General Construction Law. G-L No more than one rock removal permit shall be issued for a subject property within any twelve-month period. Ivy Arty person who violates this section shall be guilty of a violation which shall be punishable by a fine of not more than$1,000, and also shall be liable for the civil penalty imposed by§106- 55C of the Code.Each use of mechanical means to remove rock on a day or at an hour when rock removal is prohibited by this section shall constitute a separate offense. IN. If there is a violation of this section by someone other than the owner of the subject property, the owner of the subject property also shall be guilty of a violation which shall be punishable by a fine of not more than$1,000, and also shall be liable for the civil penalty imposed by§106-55C of the Code. K. This section shall not apply to the removal of rock which is excavated without first being reduced in size. KP. This section shall not apply to public utility companies, the United States of America, the State of New York,the County of Westchester,the Town of Mamaroneck,the Mamaroneck Union Free School District, the Villages of Larchmont, Mamaroneck or Scarsdale or any independent contractors engaged by any of them. Section 174-3 of the legislation requires that the Town Board annually set the sewer rent rate per gallon based upon water consumption. The rate is calculated by dividing the revenue required to operate the sanitary sewer system by the adjusted water consumption of all system users. A public hearing must be held by the Town Board to consider any change in the sewer rent rate. There are 3,200 billed water accounts in the unincorporated Town. There are an estimated 87 properties in the unincorporated area that utilize septic systems and therefore not connected to the sewer system. Below is a listing of water sales in the unincorporated area for the last three full years: • 2018 Actual 413,137,000 gallons • 2017 Actual 470,362,000 gallons • 2016 Actual 483,843,000 gallons Three-year average water sales- 455,780,666 gallons Average annual water use for a residential property is 99,975 gallons. This is the average of annual water use with and without irrigation based upon the average of the last three years of total water use in the Town, With 87 properties not connected to the sanitary sewer system and an average residential water consumption of 99,975 gallons; 8,697,825 gallons of water is deducted from the average water sales for purposes of the calculation of the sewer rent. Also, the law provides that the sewer rent to be charged be based upon 90% of the actual water consumed. Therefore, for rate calculation purposes the adjusted annual water sold is determined as follows: Three-year average water sales 455,780,666 gallons Deduction for properties not connected to the sanitary sewer system 8,697,825 gallons Subtotal 447,082,841 gallons Allowance for 90% of actual average water consumption 44,708,284 gallons Adjusted water sales for rate calculation 402,374,557 gallons 1 I Pace to Printed on Recycled Paper The funding to be raised for Sewer District expenses in 2020 is $571,324. Therefore, the rate calculation is $571,324/402,374,557 =$.0014/gallon, an increase of $.0003/gallon over 2019. For an average residential consumer using 99,975 gallons of water per year the property owner will be billed for 90% of the consumption or 89,978 gallons. As a result, the average annual sewer rent for 2020 will be $125.97, an increase of $14.33 over 2019. For a point of comparison, a home with an average assessment of $1,257,000 would have incurred a property tax bill of $173.71 for Sewer District expenses in 2020 had the ad valorem tax been applied. For property owners, the decision by the Town to convert from the ad valorem tax to the sewer rent continues to be a favorable one. The sewer rent calculation is based upon average water use for residential properties, however, property owners can further control this expense through their own water conservation measures. Procedurally, the Town Board must hold a public hearing on the proposed sewer rent rate increase before a new rate can be implemented. ' Stephen V. We are requesting a$20,000 increase over a two year period;a$10,000 increase this year,and a $10,000 increase the following year. Bid documents are available for viewing in the Town Administrator's office.The Town prepares copies of the bid documents for interested vendors. Questions are initially received in the Town Administrator's office and then directed to the appropriate Department Head for individual handling. Between preparing materials for distribution and answering questions,the bidding process can become quite cumbersome for Town Staff. However, it is becoming more customary that municipalities post their bid notices and documents electronically. BidNet Direct(BidNet)is a commonly used web-based system that provides full solicitation and bidding services. In the system,all New York State Government Agencies are added to the Empire State Purchasing Group.This provides for centralization and standardization,such as piggybacking off of another municipality's bid and a centralized location for vendors to search. There are numerous benefits to using BidNet's services.There is no annual subscription for the Town. Vendors may join for free or opt for the notification subscription for a nominal fee. Bid documents can be electronically uploaded,allowing vendors to download at their leisure.There is a question and answer section that can be made public or private and there is no limit to the number of user logins.The Town of Mamaroneck would have its own landing page within the BidNet system,which would be connected to the Town's website via a direct link. The Town would provide BidNet with our current list of vendors.They would then send a letter informing vendors the Town has joined BidNet and explain how they are able to join.The Town is responsible for reimbursing BidNet for any postage costs incurred for this one-time mailing. BidNet also sends out a press release stating the Town has joined, BidNet has offered to waive this one-time cost of $195. Attached for your review is the Agreement for Services, which has been reviewed by the Town Attorney. RECITALS: WHEREAS the Participating Organization is in need of web-based solicitation and bidding services,including maintenance and support services; WHEREAS under the Agreement, BidNet has developed a web-based solicitation system, providing on-line bidding services, including maintenance and support services(hereinafter referred to as "The Network") WHEREAS the Participating Organization wishes to join The Network and benefit from the services provided by BidNet; THE PARTIES AGREE: 1. Description of Services: System Membership: The Participating Organization has agreed to join The Network. It is understood that BidNet will provide the Participating Organization with access to The Network. 2. Term of Agreement: This Agreement shall become effective on the date of the execution for an initial term of twelve(12)months(the"Initial term"). The Initial Term of this Agreement may be extended in one-year increments,without notice unless terminated by either party. 3. Payment for Services: 3.1 Participating Organization Fees: 3.1.1. Subscription Fees: There will be no subscription fees incurred by the Participating Organization under this Agreement. 3.1.2. Mailing Fees: BidNet will send an invoice to the Participating Organization for reimbursement of postage fees incurred to produce the mailing to suppliers. 3.1.3. Any customized work requested by the Participating Organization shall be made available at One Hundred and Twenty-five dollars($125)per hour. 3.1.5. Surplus Auction Fees: Should the Participating Organization choose to use the Surplus Auctions program to sell unwanted goods and equipment,a 5%commission will be paid to BidNet for items sold. 3.1.6. Future Enhancements: BidNet reserves the right to offer future services to the Participating Organization which may or may not include service fees. 3.2 Supplier Registration Fees: 3.2.1. Basic Service: This option gives suppliers access to search for documents of interest for all Participating Organizations actively using The Network at no charge,but requires them to remember to login frequently to ensure they are able to view opportunities before they close. This includes bids,addendums and awards. 3.2.2. Optional Value Added Service: Suppliers that choose to register for the value added service option will be charged a nominal annual subscription fee. This includes notification from all Participating Organizations when bids,addendums and awards are posted on The Network that matches their profile. 3.2.3. Future Enhancements: BidNet reserves the right to offer future services to all registered suppliers which may or may not include separate service fees. 4. Termination: This Agreement may be terminated by either party upon sixty(60)days notice. Notice shall be in writing,sent by certified mail,return receipt requested. 5. Entire Agreement: This Agreement constitutes the entire understanding of the parties and the parties agree that there are no other understandings,representations or warranties,either expressed or implied,whether written or oral,made by either party,except as stated within this Agreement. 6. Amendments: No alteration of this Agreement shall be valid unless made in writing and signed by the parties and no oral understanding or agreements not incorporated herein shall be binding on the parties. 7. Governing Law: This Agreement shall be governed by the laws of the State of New York. 8. Severability: If any provision of this Agreement will be held to be invalid or unenforceable for any reason,the remaining provisions will continue to be valid and enforceable. 9. Work Product Ownership: Any copyrightable works,ideas,discoveries,inventions,patents, products,or other proprietary information developed in whole or in part by BidNet in connection of this Agreement,will be the exclusive property of BidNet. 10. Unauthorized Use: The Participating Organization agrees to require each user obtain a username and password to gain access to The Network. Sharing of usernames and passwords is strictly prohibited. Section 174-3 of the legislation requires that the Town Board annually set the sewer rent rate per gallon based upon water consumption. The rate is calculated by dividing the revenue required to operate the sanitary sewer system by the adjusted water consumption of all system users. A public hearing must be held by the Town Board to consider any change in the sewer rent rate. There are 3,200 billed water accounts in the unincorporated Town. There are an estimated 87 properties in the unincorporated area that utilize septic systems and therefore not connected to the sewer system. Below is a listing of water sales in the unincorporated area for the last three full years: :• 2018 Actual 413,137,000 gallons • 2017 Actual 470,362,000 gallons • 2016 Actual 483,843,000 gallons Three-year average water sales- 455,780,666 gallons Average annual water use for a residential property is 99,975 gallons. This is the average of annual water use with and without irrigation based upon the average of the last three years of total water use in the Town. With 87 properties not connected to the sanitary sewer system and an average residential water consumption of 99,975 gallons; 8,697,825 gallons of water is deducted from the average water sales for purposes of the calculation of the sewer rent. Also, the law provides that the sewer rent to be charged be based upon 90% of the actual water consumed. Therefore, for rate calculation purposes the adjusted annual water sold is determined as follows: Three-year average water sales 455,780,666 gallons Deduction for properties not connected to the sanitary sewer system 8,697,825 gallons Subtotal 447,082,841 gallons Allowance for 90% of actual average water consumption 44,708,284 gallons Adjusted water sales for rate calculation 402,374,557 gallons Wage 4111 � Pnnted on Recycled Paper The funding to be raised for Sewer District expenses in 2020 is $571,324. Therefore, the rate calculation is $571,324/402,374,557 =$.0014/gallon, an increase of $,0003/gallon over 2019. For an average residential consumer using 99,975 gallons of water per year the property owner will be billed for 90% of the consumption or 89,978 gallons. As a result, the average annual sewer rent for 2020 will be $125.97, an increase of $14.33 over 2019. For a point of comparison, a home with an average assessment of $1,257,000 would have incurred a property tax bill of $173.71 for Sewer District expenses in 2020 had the ad valorem tax been applied. For property owners, the decision by the Town to convert from the ad valorem tax to the sewer rent continues to be a favorable one. The sewer rent calculation is based upon average water use for residential properties, however, property owners can further control this expense through their own water conservation measures. Procedurally, the Town Board must hold a public hearing on the proposed sewer rent rate increase before a new rate can be implemented. ' Stephen V. For your reference, enclosed is a photo of the intersection where the proposed yield sign would be placed. Residents expressed their concern for safety, given vehicles do not always reduce their speed when driving west on Country Lane and continuing onto Country Road. Although their initial request was to have a stop sign, those in attendance at the meeting expressed their satisfaction with the Traffic Committee's recommendation to install a yield sign. If the Town Board is in favor of the recommendation, a Public Hearing would need to be set, since the Town's Vehicle and Traffic regulations would have to be amended to include this intersection, if enacted.
