Memorandum
To: Board of Fire Commissioners
Re: Proposed Weaver Street Fire Station Renovation
Date: April 18, 2019
On the work session agenda is a discussion of the proposed renovation to the lower
level of the Weaver Street Firehouse and how best to move forward with the
project. The history of this project is that as a result of the need to replace the
apparatus floor system, the lower level was significantly impacted. So much so
that a complete demolition of the lower level was warranted. As a result, it was
decided that the renovation of the lower level would be designed and constructed
as a separate project in attempt to control construction costs. The renovation would
have to include all new mechanical systems, and general reconstruction of the
space including the reconstruction of restrooms and a shower facility.
The lower level renovation was designed and sent out for bid at the beginning of
March of this year. On April 11, 2019 the Town received three bids for the project.
The first attachment is a schedule of the bids received. The lowest bid of
$1,756,000 was submitted by Specialty Construction Systems Inc. This is the
contractor that was awarded the contract for the replacement of the apparatus floor
systems.
During preparation of the 2019 Capital Budget in the fall of 2018, a preliminary
estimate of the lower level renovation project including soft costs was $1,378,676.
In February of 2019 the project was re-estimated with probable costs rising to
$1,649,525, an increase of $270,849. The second attachment is the comparison of
the 2018 and 2019 summaries of probable cost for the project.
Based upon the low bid received on April 11, the estimated project cost is now:
Hard Construction Costs: $1,756,000
Design Contingency (5%): 58,696
Construction Contingency (10%): 123,262
Project Soft Costs: 258,588
Bonding Expense (3%) 65,000
Total Project Costs: $2,261,546
Over the last several days, staff and our consultants have discussed what options
are available to the Town. There do not appear to be any major changes that could
be made to the project scope since most of the renovation is quite basic. A review

of the bids indicate that labor costs are driving about 60% of the bid price
particularly for the new mechanical systems.
The Town will be meeting with the low bidder next Tuesday in an effort to lower the
construction costs for the renovation. There is some discretion offered to
municipalities to work with the low bidder on cost items. However, assuming that
the project costs as listed remain unchanged the Town must consider what options
are available and the implications of those options.
Before reviewing the options, the Board is reminded that the public referendum for
borrowing funds for this project will include the lower level renovation project plus
$287,370 for the additional costs incurred for the apparatus floor project. The cost
quoted for the additional apparatus floor project includes a 3% factor for borrowing
costs. Therefore, the total bond referendum would be for $2,548,916. As a matter
of additional background the following is a listing of past Fire District Referendums:
• 2007 Fire Apparatus $ 460,000
• 2013 Fire Apparatus (2) 996,000
• 2016 Fire Apparatus/Building Imp. 2,185,000
• 2018 Fire Turnout Gear 280,000
Option 1 - Move Forward with the Project
• Our costs are known at this time.
• If the project were to be rebid in the fall the level of the pricing is unknown.
• Our financial advisers have told us that at this time municipal interest rates
are low. The estimate on a 20-year serial bond is that the interest rate for a
AAA credit would be around 2.2%
• The 2020 budget impact for the Fire District will be an increase in debt
expense of $162,000. The increase in the debt expense alone would trigger
a 4.18% increase in the Fire District tax rate and $46.00 property tax impact
on a property with an average assessment. This impact does not include
other changes that may be necessary in the Fire District budget.
• If the project were to proceed now the bond referendum would occur during
the first two weeks of June.
Option 2 - Reject the bids and rebid the project in the fall
• At this time of the year, school districts are in the market bidding school
construction projects for summer construction. There is the possibility that
the bids received April 11 reflected the competition in the market for
contractors to complete school projects.
• If the project is bid in the fall, there will be less competition from the school
districts and contractors may be looking for interior construction projects as
the seasons begin to change.
• On the down side, since the project has been bid once and with the bids
known to contractors there could be little if any change in the pricing.

• Interest rates could increase as well as the cost of materials and labor. This
could result in higher borrowing costs and higher bid prices.

REQUEST FOR PROPOSALS (RFP)
for the Town of Mamaroneck
for the preparation of a Comprehensive Plan
A. Introduction
The Town of Mamaroneck is looking for proposals from qualified planning
individuals and consultant firms to prepare a comprehensive plan for the Town.
The Comprehensive Plan (the Plan) is intended to provide a vision and establish
policies that will guide the Town's future direction in a number of areas while
providing a blueprint for preserving the character of the community. The plan
will be a critical guide for the Town Board, Town staff and Town Boards and
Commissions to chart the direction of the community over the next five to twenty
years. When completed the Plan must provide guidance to the Town for meeting
the community's needs both now and in the future. The Town has a strong
record of stewardship of the environment. The expectation is that the Plan will
build upon that record by reviewing existing policies and where applicable
developing new policies and tools for sustainability.
For the Town this will be the first time in many years that a master plan or
comprehensive plan has been completed. Therefore, the Town is requiring a
very robust public outreach program that will be further detailed in this RFP.
B. Background and Community Description
The Town of Mamaroneck is a suburban community located in Southern
Westchester County on the shores of Long Island Sound approximately 23 miles
from New York City. The Town is comprised of its unincorporated area and the
Villages of Larchmont and Mamaroneck. A small portion of the Village of
Mamaroneck, known as the Rye Neck section, lies in the Town of Rye. The Town
government provides all local government services to the unincorporated area of
the Town. Although the Villages have their own autonomous governments, the
Town does provide a select menu of services to Village residents. The
population of the entire Town including the Villages is 29,156. The
unincorporated Town population is 11,977. These figures are according to the
2010 Federal Census
The Town is serviced by Metro-North Railroad with stations in the Village of
Mamaroneck and Village of Larchmont. Residents in the unincorporated area
utilize both railroad stations. In addition to Metro-North Railroad, public
transportation is available from Westchester County Bee-Line Bus service
operating three bus routes in the Town.
In terms of automobile transportation, both Interstate Route 95 and the
Hutchison River Parkway are easily accessible from the Town. Geographically,
1-95 divides the unincorporated area of the Town. Other major automobile routes

in the Town include Route 1 (Boston Post Road), Weaver Street (NYS Route 125),
Palmer Avenue (Westchester County Roadway) and Murray Avenue
(Westchester County Roadway)
The Town of Mamaroneck is a residential community comprised primarily of
single family homes. Other residential development in the Town consists of
multi-story rental apartments, condominiums and cooperative apartments
located in two distinct areas of the Town. The Washington Square
neighborhood, located in the southern portion of the Town is comprised of seven
multi-story multi-family buildings. The oldest of the buildings date back to before
WWII. The newest, is a condominium development of 149 units that was recently
completed. This neighborhood is located near 1-95 at the unincorporated areas
border with the Village of Larchmont and near the Larchmont train station. The
other multi-family district is located on Richbell Road at the Town's border with
the Village of Mamaroneck between the Boston Post Road and Palmer Avenue.
This neighborhood is located in the central portion of the Town.
Although the Town does not have a traditional defined downtown, the Boston
Post Road corridor serves as the Town's major commercial district. The Boston
Post Road corridor consists of retail outlets and service businesses. Residents
of the unincorporated area utilize this commercial district as well as the
downtown business districts of the Village of Larchmont and Village of
Mamaroneck.
A smaller commercial district is located at the southwest section of the Town
near the New Rochelle border. This second district is located on Myrtle
Boulevard, Madison Avenue and Fifth Avenue.
Within the unincorporated area are the Winged Foot Golf Club and Bonnie Briar
Golf Club that together comprise over 427 acres of land. In 1994 the golf course
properties were re-zoned in a new district entitled the Recreation Zone. These
properties cannot be developed for residential or commercial purposes.
There is also 310 acres of dedicated parkland including approximately 7 miles of
conservation trails.
Most of the Town including the two Villages are served by the Mamaroneck Union
Free School District. A portion of Mamaroneck Village is served by the Rye Neck
School District. In the northern section of the Town's unincorporated area, near
the Village of Scarsdale border approximately 260 homes are served by the
Scarsdale Union Free School District.
C. Scope of Work
The preparation of the Plan is to be divided into two phases. Phase 1 will
encompass the public outreach component of the Plan and Phase 2 the
preparation of the Plan itself.

Phase 1 -Public Outreach
The Town is expecting the public outreach phase of the Plan to be broad in its
scope; reaching out to the various stakeholders that can provide input into the
process of developing the plan. As an initial step however the consultant will
meet with the Town Board and designated Town staff to conduct a preliminary
visioning session. This session will help to set the baseline for the types of
questions and input to be obtained from the community. After the initial visioning
session, the consultant will:
I. Conduct three "Town Hall" style meetings in advance of preparation of
the plan to enlist comments from Town residents on their visions for
the Town. Additional meetings of this type will also be held to present
the first draft of the Plan when it is complete.
II. Arrange to meet with Town Boards and Commissions including:
a. Town Planning Board
b. Town Zoning Board
c. Coastal Zone Management Commission
d. Traffic Committee
e. Town Recreation Commission
III. Arrange to meet with neighborhood associations including
a. Larchmont Gardens Civic Association
b. Howell Park Association
c. Pinebrook Association
IV. Other Groups to be included in the public outreach phase are:
a. Local Realtors
b. Student Group from Mamaroneck High School
c. Members of the Mamaroneck School Board and School Supt.
V. Use of Social Media and Town Web Page
a. The consultant will develop a Facebook Page for the
comprehensive plan to receive comments and to update the
community on the progress of development of the Plan.
b. The consultant will also develop a web page within the Town's
website to site the progress on the development of the plan and to
conduct an online survey for residents to complete.
c. Other media that should be utilized for the public outreach phase is
the local cable television channels operated by LMCTV.
The Town will welcome other suggestions from the consultant on how best to
implement the public outreach to the community.
Phase 2- Preparation of the Plan
The purpose of the Plan is to develop policies that balance social, economic and
environmental considerations to prepare for smart growth of the Town both now

and over the next five to twenty years. The Plan must also address issues of
sustainability and resilience as the Town considers how best to address the
impacts of climate change and changes in our regional and local environment. In
this regard, the plan when completed should be a blueprint for smart growth in
the Town.
The Town is fortunate to be a community with housing of great architectural
diversity. Therefore, while the Town is aware of the need to prepare for future
change, the Plan must also establish policies that provide for the preservation of
the Town's suburban character.
Rather than a broad based comprehensive plan, the Town envisions the Plan
focusing on the following topics:
• Land Use and Land Use Development
• Housing
• Vehicular and Pedestrian Movement in the Town-Complete Streets
Analysis- Policies on Mobility of Residents
• Recreational Policies and Programs for different generational populations
in the Community and Optimal Use of our Recreational facilties
• Government Services
Although the above are the primary areas of focus, it is conceivable that the
public engagement process could lead to adjustments in the areas to be studied.
In the past there have been other significant studies prepared by the Town that
have concentrated on various topics. The previous studies are listed below. The
consultant is expected to review these studies and recommend how the policies
developed in those studies can be incorporated in the Plan. The intent is to
coordinate the Plan with the completed studies to make each more useful in the
Town's planning process and for setting priorities for the Town government.

• 1986 Town of Mamaroneck/Village of Larchmont Local Water Front
Revitalization Plan
o Amended in 1994 and in 2018
• 2004 Town of Mamaroneck Hazard Mitigation Plan
• 2014 Town of Mamaroneck Sustainability Plan
Land Use
Maintaining the character of the Town is an important mission of the Plan. Like
many communities the size of new homes and their overall mass has become an
issue in some neighborhoods. Therefore, the plan must address the question of
how best to structure land use policies and regulations to consider future
residential development.

In connection with the review of the land use regulations, the Town's current
design guidelines are to be reviewed by the consultant. The intent of this review
is to incorporate new green infrastructure techniques into both residential and
commercial site plan reviews.
The Town's commercial corridors should be evaluated in the Plan. What are
options for the future of these corridors in terms of commercial uses that best fit
the community.
Housing
The Town has developed as primarily a single family residential community with
some multifamily housing in Washington Square and on Richbell Road.
Developing workforce housing in the community is of importance to the Town
government. In that regard the Town, in 2013, amended its zoning code to
permit the development of residential housing in areas previously zoned
exclusively for businesses and service businesses. The B-R and SBR zones were
created along the Boston Post Road corridor and along Madison Avenue and
Fifth Avenue near the Town's border with New Rochelle.
The Plan should develop policies and guidelines to assist the Town in the
development of work force housing and other strategies to provide more
affordable housing in the community.
Vehicular and Pedestrian Movement in the Town & Parking
There has been a noticeable increase in traffic volumes throughout the Town's
unincorporated area over the years. The Weaver Street Corridor (NYS Route
125) is a main east-west roadway for traffic traveling from New Rochelle and
Mamaroneck to Scarsdale and White Plains. Three of the Town's public schools
are adjacent to or very close to this corridor and are also generators of traffic.
The development of policies and guidelines for how best to address the
increased traffic in this area is an important component of the Plan.
While the Plan must address vehicular movement, the Plan must also develop
policies for better and more convenient pedestrian movement in the Town. The
intent here would be to reduce the dependence on automobile travel. For
instance, how can we make the Town more walkable? The Plan should develop
policies and guidelines to incentivize increased use of bicycles and electric
bicycles to reduce dependence on automobile travel. The concept is to develop a
more specific complete streets program for the Town.
Because of its proximity to New York City, a significant number of residents in
Mamaroneck commute by train. This has created an ever growing demand for
commuter parking. With limited open space to develop more parking, the Town
is looking to address, in the Plan, alternatives to traditional parking lots for
commuters. The comprehensive plan is an opportunity to address this issue on a
more global basis.

Recreation Facilities and Programs
The Town currently offers a wide variety of recreation programs for all age
groups in the community. In terms of recreation facilities, the Town offers:
r Hommocks Pool Facility-this is a facility that is owned by the Mamaroneck
School District with the Town sharing in the use
Hommocks Ice Rink-A town owned facility used for ice related
recreational programs, and public skating. During the summer the facility
is used for our summer camp program
Memorial Park- an open park with a playground facility and tennis courts.
The park is also used for concerts and sports programs for young children
Senior Center-the Town recently purchased a former Veteran's of
Foreign War Post. The building is used primarily for senior citizen
programming.
The Plan should provide assistance to the Town in developing strategies to
evaluate the optimum use of our facilities and for the evaluation and development of
new programming.
Government Services
The Town currently offers a full menu of municipal services to the community.
However, the environment in which the government operates is changing. The
recent legislation making permanent the local property tax cap and changes in the
Federal Tax Law have in some cases changed the public's expectations of what their
property tax obligation should be. This makes municipal planning and budgeting
more difficult as the Town endeavors to determine what services are most essential
to the residents. The Plan should develop strategies for the Town for prioritizing
municipal services for future planning and budgeting.
D. Specific Tasks to be Completed in Developing the Plan
I. Completion of all of the tasks outlined in the Phase 1 Public Outreach portion
of the Plan.
II. Provide recommendations on strategies and policies for the Town to address
the areas of focus outlined in the RFP and through the Public Outreach
process.
III. Incorporate where applicable the previous studies and plans listed in the RFP
into the revised Plan.
IV. The consultant will be responsible for preparing all documentation needed for
compliance with the New York State Environmental Quality Review (SEQR)
regulations.
E. Time Line and Budget
I. The Town's goal is to complete the public outreach and preparation of
the plan in a nine to twelve-month time frame.
II. The Public Outreach phase of the Plan should begin in the fall of 2019.
III. The Town has considered that a budget of$75,000 to $125,000 is
appropriate for the completion of both phases of the Plan

F. Selection Process
Responses to this RFP will be reviewed and ranked as most qualified to meet the
Town's needs for preparation of a comprehensive plan. The selection process
will include interviews with the Supervisor and Town Board and members of the
Town Staff. The selection of a consultant will be based upon the technical skills
and relevant experience of the candidates, as follows, with a maximum possible
score of 100.
I. Technical Capability-The relevant knowledge and ability to provide the
planning services necessary to prepare a comprehensive plan. (25 points)
II. Project Understanding and Approach-The consultant's understanding the
scope of work required for this project and the approach to be used by the
consultant to prepare the plan (25 points)
III. Project Experience-The experience of the consultant to provide similar
type services in similar type communities. (25 points)
IV. References-Please provide at least five (5) references for comparable
projects (25 points)
G. Submission Requirements:
This submission shall be limited to five (5) double sided pages.
I. A description of qualifications consistent with the scoring criteria listed
above.
II. A brief description of the staff that will be assigned to the Town's project
including the primary point of contact or project manager. Brief information
on proposed sub-consultants should be provided.
III. A brief listing of no more than five (5) projects undertaken over the past five
(5) years of a similar type work and scope related to the development of a
comprehensive plan. Information should include location, project cost and
relevant information.

VI. The consultant should comment upon their estimated fee for the project and
their ability to effectively complete the project in the time frame listed in the
RFP
The Town of Mamaroneck reserves the right to accept or reject any or all proposals
submitted and to waive informalities and negotiate changes in the scope of work,
services to be provided and fees proposed.
Once a consultant has been selected, the Town will commence final contract
negotiations with the most qualified planning firm or individual to establish a final
scope of services, total fee and project schedule. If the Town and the selected

discretion, can start negotiations with the second ranked consultant

Section 190-22 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§190-22 Fees.
Every application for subdivision plat approval shall be accompanied by the fee set forth in §A-
250-1. Should an agency of the Town having jurisdiction over that application deem it necessary to
hire consultants for technical review and/or on-site inspection, the applicant shall be required to
pay the actual cost to the Town for such services.
Section 3-Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4-Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

Re: Authorization- License Agreement
National Water Main Cleaning Co.
The Town along with the City of New Rochelle, Village of Larchmont and Village of
Pelham Manor is in the midst of the renovation and restoration of the Town's
sanitary sewer system. National Water Main Cleaning Co. is one of the companies
that was contracted for the project. They have approached the Town with a
request to utilize the vacant lot at the corner of Fifth Avenue and Madison Avenue
in order to stage equipment for the project. For the Town the advantages to the
arrangement are that the contractor can more easily mobilize the work sites in the
Town which we hope will lead to a shorter construction period.
Attached is a proposed license agreement between the Town and National Water
Main Cleaning Corp.(Licensee). The main points of the agreement are:
4 Licensee shall pay $6,000 or $1,000 per month for the six-month agreement
4 Licensee shall be required to install a gravel pad and silt fencing to prevent
erosion into the street.
4 Licensee must provide insurance coverages as stipulated in the agreement.
Requested Action: that the Town Board approve the license agreement
with National Water Main Cleaning Co. and authorize the Town
Administrator to execute the agreement.

LICENSE AGREEMENT
AGREEMENT made this day of April 2019, by and between the Town
of Mamaroneck, a municipal corporation, with offices at the Town Center, 740 West
Boston Post Road, Mamaroneck, New York 10543 ("Licensor") and National Water
Main Cleaning, Co., a private corporation, with offices at 1806 Newark Turnpike,
Kearny,NJ 07032 ("Licensee").
WHEREAS, the Licensee is in the process of completing repairs and
improvements to sanitary sewer infrastructure in what is termed the "Trenchless Lining
and Manhole Repairs" ("Construction Contract") procured through the City of New
Rochelle, and
WHEREAS, the Licensee needs to locate a place where it can store certain
materials to be incorporated into the "Construction Contract" and equipment to be used in
connection with the "Construction Contract"program, and
WHEREAS, the Licensor owns real property located at the corner of Fifth
Avenue and Madison Avenue in the Town of Mamaroneck ("Staging Area"), and
WHEREAS, the Staging Area suits the Licensee's needs.
NOW, THEREFORE, intending to be bound, the parties agree as follows:
1. The Licensor grants a License to the Licensee to have its contractor for the
Streetscape program ("Contractor") use the Staging Area to store materials to be
incorporated into the "Construction Contract" and equipment to be used in connection
with the "Construction Contract" program; however under no circumstances shall the
Licensee or the Contractor store fuel, combustible items, hazardous material or
demolition debris within the Staging Area. In addition, there will be only one access
point to and from the Staging Area which shall be from Fifth Avenue only. Neither the
Licensee nor the Contractor shall use the Staging Area for any other purpose.
2. Before this License shall become effective, the Licensee shall, at its or the
Contractor's sole cost and expense,
(i) arrange temporary security measures to restrict access to the Staging
Area with a barrier that contains a lock,
(ii)deliver a key to the aforementioned lock to the Town Administrator,
(iii) submit a license fee of$6,000 payable at rate of$1,000 per month due
on the first day of each month of the license term,
(iv) install a gravel pad at the entrance to the Staging Area that is adequate
to reduce the tracking of dirt or debris onto the public streets,
(v) install erosion control silt fencing around the perimeter of the site and
(vi) deliver to the Town Administrator one or more certificates of
insurance issued to the Licensee by an insurance company acceptable to the Licensor
meeting the requirements of paragraph 10.
3. This License will commence when the items listed in paragraph 2 are
completed and will terminate upon completion of a six month term.
4. During the entire period of the License (including any renewal thereof),
(a) whenever the Staging Area is unoccupied by either the Licensee or the Licensee's
personnel, the gate shall be closed and locked, (b) the Licensee shall be responsible for
(I) maintaining the temporary security measures described in paragraph (2) (i) and (v),
(II) maintaining the lock for the gate, (III) maintaining the gravel pad described in
paragraph (2) (iv), (IV) either keeping the insurance policies described in paragraph (10)
in full force and effect or replacing such policies with comparable ones, (V) keeping the
Staging Area clean and free of debris and refuse and in good repair and (VI) assuring that
it complies with the terms of this Agreement.
5. If the Licensee fails to discharge the responsibilities undertaken by it
under this Agreement, the Licensor may discharge such responsibilities and the Licensee
will reimburse the Licensor for the cost and expense of doing so.
6. The Licensee has inspected the Staging Area and agrees to accept it in its
"as-is" condition. In addition to the items listed in paragraph (2), at its sole cost and
expense, the Licensee may make only improvements or changes to the Staging Area that
the Licensor approves. In its absolute discretion, the Licensor may refuse to allow the
Licensee or the contractor to make any other improvements to the Staging Area
7. The Licensee understands and agrees that this License is personal to it
only and is not a lease, that the Licensee is a "licensee" within the meaning of section
713(7) of the New York Real Property Actions and Proceedings Law and that the
Licensee does not have and has not been granted an interest in the Staging Area. If a

dispute arises between the Licensor and the Licensee, and a Court of competent
jurisdiction should find that this Agreement grants the Licensee certain rights commonly
granted to a tenant, whether by statute or by common law, the Licensee waives any and
all rights which such Court may grant to them.
8. At its sole cost and expense, the Licensee (i) will comply with all the
requirements of the Department of Labor, and all other municipal authorities, whether
Federal, State, County or Town of Mamaroneck and of any and all their Departments and
Bureaus having jurisdiction over the Licensee and (ii) will obtain all licenses and permits
required to use the Staging Area for the purposes stated in this Agreement.
9. The Licensee will not let or grant any person, other than its personnel or the
Contractor's personnel to use of the Staging Area without the prior permission of the
Licensor.
10. (i) The Licensee will provide the Licensor with current certificates of
insurance holding harmless, indemnifying and defending the Licensor, its officers,
agents, employees and contractors from any and all claims for personal injury, death or
damage to property arising directly or indirectly from the occupation or use of the
Staging Area by the Licensee. Such insurance shall not be less than two million
($2,000,000.00) Dollars of general liability, broad form insurance which shall provide for
a sixty (60) day notice of cancellation and which shall specifically include coverage for
products liability, negligence, and public liability insurance and shall name the Licensor
as co-insured. Each time an insurance policy expires, the Licensee will provide the
Licensor with a new certificate of insurance.
(ii) The Licensee will provide the Licensor with current certificates
indicating that the Licensee has the proper Workers' Compensation Insurance. Each time
a Workers' Compensation Policy expires, the Licensee will provide the Licensor with a
new certificate of insurance.
11. The Licensee cannot assign its rights under this Agreement.
12. The Licensor may terminate this Agreement for any reason or for no
reason at all by giving the Licensee 10 business days' written notice of its decision to
terminate.
13. The parties agree that this Agreement does not constitute a joint venture.

14. The Licensee will create or permit any nuisance in the Staging Area.
15. Notices pursuant to this Agreement shall be in writing and sent by
certified mail,return receipt requested, to the other party at the address indicated above.
16. The Licensee will not mortgage or pledge this License. The Licensee will
not permit the Staging Area to be used in a manner deemed by the Licensor to be
hazardous or in a manner which would increase the insurance premiums paid by the
Licensor.
17. At the expiration of this Agreement, the Licensee will quit and surrender
the Staging Area to the Licensor in good condition, reasonable use and wear excepted,
remove the temporary security measures, gravel pad and fences described in paragraphs
(2) (i), (iv) and (v), and restore grass on the site.
18. Besides providing insurance in accordance with this Agreement, the
Licensee shall indemnify the Licensor from any and all liability for personal injury, death
or damage to property caused by or resulting from the occupation or use of the Staging
Area by the Licensee and shall keep, hold harmless and defend the Licensor from all
liability arising out of the Licensee's operation of the Concession.
19. The Licensee must give the Licensor prompt notice of fire, accident,
damage or dangerous or defective condition in the Staging Area. If the Licensee or its
employees, agents, contractors or invitees cause damage to the Staging Area, the
Licensee will be responsible for the cost of all repairs necessitated by such actions.
20. The Licensor shall have the right to enter in and upon said Staging Area at
all reasonable hours of the day to ascertain whether the Staging Area is being kept clean
and being used in accordance with the terms of this Agreement.
21. If the Licensee defaults under any of the provision contained herein, the
Licensor may take possession of the Staging Area and all of the items thereon. The
Licensee waives the service of any notice of an intention to re-enter.
22. The failure of the Licensor to insist upon strict performance of any of the
terms, conditions and covenants herein, shall not be deemed a waiver of any rights or
remedies that the Licensor may have, and shall not be deemed a waiver of any subsequent
breach or default in terms, conditions and covenants herein contained.
23. This Agreement is subject to a permissive referendum.

24. This Agreement constitutes the entire understanding between the parties
hereto and may only be changed by a writing signed between the parties hereto.
25. The signatories to this Agreement represent that he or she has the right to
enter into this Agreement on behalf of the party for which he or she is signing this
Agreement.

Dear Town Administrator Altieri:
This letter is submitted on behalf of Eric Gold and Melissa Katz (the "Petitioners"), owners of the
above referenced Premises, requesting that the Town of Mamaroneck (the "Town") abandon a
portion of the drainage and retention easement encumbering the Premises. The subject easement
was offered to and accepted by the Town in relation to the original Marbourne Meadows
subdivision. Upon development of that subdivision and construction of the drainage and
retention infrastructure,the Town Engineering Department determined that it did not require the
entire easement for the continued operation and maintenance of that drainage and retention
infrastructure and that the remainder of the easement could be abandoned. In furtherance of the
anticipated sale of the Premises scheduled to close on May 1, 2019, the Petitioners have been
working with the Town Engineer to evaluate the easement and infrastructure and to establish the
easement area no longer needed by the Town for current or future maintenance of the existing
drainage and retention infrastructure.
It is hereby petitioned that the Town release'and abandon all easement, right,title and interest in
that portion of the drainage and retention easement that the Town Engineer determined is no
longer needed by the Town. In support of this petition, enclosed please find a draft Town Board
resolution releasing and abandoning said rights and authorizing the Town Administrator to sign
and deliver the enclosed declaration partially terminating the Town's rights and easement with
property descriptions and updated survey. Also enclosed is a draft "Partial Termination of
Declaration of Drainage and Retention Easement" with attached property descriptions and

WHEREAS, a plat entitled "Subdivision Map of Marbourne Meadows Section 2 in the Town of
Mamaroneck,Westchester County,New York"made by Arthur J. VanSuetendael,III, P.A.and L.S.dated
October 27, 1978 and filed in the Office of the Clerk of the County of Westchester (Division of Land
Records)as Map No. 20060 on October 11, 1979 (the"Plat")depicted a drainage and retention easement
area across Lots 47,48,and 49 as shown on the Plat;
WHEREAS,the Town of Mamaroneck Town Board agreed to reduce the size of the drainage and retention
easement insofar as it impacted Lot 47 (also known as 11 Marbourne Drive (SBL: 3-34-47)) ("11
Marbourne Drive") and accepted the indenture dated March 8, 1990 which memorialized the Town's
acceptance of the revised easement;
WHEREAS, the aforementioned indenture which identified the easement area by a metes and bounds
description of the revised easement area and a map showing the easement area known as "Map of Drain
and Retention Easement to be Abandoned prepared for Enclave Associates in the Town of Mamaroneck,
Westchester County,N.Y."made by Ward Carpenter Engineers, Inc. dated October 3, 1988 was recorded
in Liber 9854, Page 18 in the Office of the County Clerk of Westchester, Land Records Division on July
20, 1990;
WHEREAS, the Town of Mamaroneck no longer needs additional easement area encumbering 11
Marbourne Drive and wishes to abandon and release the Town's rights to such easement area but only in
the areas indicated by the attached survey known as "Survey of Lot No. 47 as shown on a certain map
entitled subdivision map of Marbourne Meadows Section Two Located in the Town of Mamaroneck,
Westchester County,New York"made by Gabriel E. Senor,P.C. last updated March 25,2019;
NOW,THEREFORE, BE IT RESOLVED:
The Town of Mamaroneck Town Board hereby releases and abandons any and all easement,right,
title and interest, if any, in that portion of the 11 Marbourne Drive described in the Partial

This Partial Termination of Declaration of Drainage and Retention Easement
(referred to herein as this "Termination") is made as of , 2019, by the Town
of Mamaroneck,New York,a municipal corporation having an address at 740 West Boston

WITNESSETH:
WHEREAS, the Declarant's Planning Board approved the application of
Marbourne Meadows Associates for approval of a subdivision known as "Marbourne
Meadows" in 1978 located in the Town of Mamaroneck, County of Westchester and State
of New York,as shown,in relevant part,on a plat entitled"Subdivision Map of Marbourne

by Arthur J. VanSuetendael, III, P.A. and L.S. dated October 27, 1978 and filed in the

& Retention" are not abandoned by this Termination and the Declarant shall continue to
have the same rights with respect to that area of 11 Marbourne Drive that it currently has
under the Accepted Easement.
3. This Termination shall run with the land in perpetuity and shall bind the
parties hereto and their respective successors and assigns.

Landscape Maintenance Services
Date: March 17, 2019
On April 1, 2019 the Town publicly opened and read bids for the above referenced
contract. The scope of this contract includes the clean-up and monthly maintenance of
the Town's nine cemeteries, the Gardens Lake and the Senior Center at 1288 Boston
Post Road. There are also 24 other smaller locations that include road shoulders and
small pocket parks. Included in the scope of work is a spring and fall cleanup, pruning
of low branches, regular grass cutting and where applicable removal of weeds. This
contract was last bid in 2017. Bids were requested for the years 2019 and 2020.
The Town received three bids for this contract. Attached is a schedule of the bids
received. The low bid was submitted by Acocella Contracting who has been the Town's
contractor for this work the last four years. The bid for the two years of the contract is
$25,450 for 2019 and $25,950 for 2020 or a total of$51,400 for the two years. The total
price for the two years of the contract is up by about$6,000 over the last contract.
Acocella Contracting's work continues to be of good quality and they are responsive to
the needs of the facilities listed in the contract.

Grass Maintenance-Hommocks Field and Hommocks Pool
Date: April 17, 2019
On April 1, 2019 the Town publicly opened and read bids for the above referenced
contract. The scope includes a spring and fall cleanup and regular maintenance of
the Hommocks Field grass and the grassy areas at the Hommocks Pool. Unlike the
Landscape Maintenance Contract, this contract has very specific requirements for
the time and day that these areas are maintained as well as a maximum height
requirement for the grass. For these reasons we award separate contracts.
The Town received two bids with the lowest bid submitted by Pasquale Ferraro
Landscaping. A schedule of the bids received is attached. Bids were requested for
the years 2019 and 2020. However, the bid specification does give the Town, at its
discretion the ability to extend the contract for a third year. The extension is
predicated upon the contractor agreeing to hold their 2020 price for the additional
year. For the years 2019 and 2020 the total contract price is $17,800 which is only
$200 higher than the cost of the expiring contract.

Re: Report of Bids—TA-19-06 Service Body—Central Garage
Date: April 18, 2019
Included in the 2019 Capital Project schedule is the replacement of the service vehicle used
by the Central Garage for road repair calls on Town vehicles. The current vehicle is a 1990
utility truck that was previously used by the Fire Department before it was transferred to the
Central Garage. At almost 30 years old, the vehicle has outlived its useful life and there are
problems finding replacement parts for repairs.
The Town was able to purchase the truck chassis on a Westchester County Cooperative
Purchasing Contract at a cost of $41,066.72. A competitive bid, however, was required for
the service body to be mounted on the chassis.
On April 17, 2019, bids were publicly opened and read for the contract to Furnish, Deliver and
Install the Service Body. The bid notice was advertised in the newspaper and bid packages
were sent to 3 alternative vendors for this product. The Town, however, received only one
bid from Trius, Inc. The bid price for furnishing and installing the service body is $24, 691.00.
Although the Town only received one bid for this contract, the total price for the vehicle is
within the cost estimate set within the 2019 capital project. Therefore, the bid price for the
service body appears reasonable.
ACTION REQUESTED: THAT THE TOWN BOARD APPROVE THE BID SUBMITTED BY TRIUS,
INC. TO FURNISH AND INSTALL A SERVICE BODY AT A TOTAL COST OF $24,691.00
PURSUANT TO CONTRACT TA-19-06 AND THAT THE TOWN ADMINISTRATOR BE
AUTHORIZED TO EXECUTE THE CONTRACT.

Date: April 18, 2019
The 2019 Capital Project schedule approved by the Town Board included the replacement of a
dump truck for the Highway Department. Unlike prior years when these purchases have been
put out for bid, the Town utilized the HGAC Cooperative Purchasing Consortium that was
previously authorized by the Town Board. Attached is the requisition and the specification sheet
for the vehicle which is priced at $221,752.00. Our original estimate for the purchase of the
vehicles was$260,000.00.
Requested action: that the Town Board approve the purchase of one 2020 freight liner 6-wheel
dump truck and that the Town Administrator be authorized to execute the purchase contract.

Re: Authorization- Information Technology Audit
Date: April 17, 2019
With the significant expansion in our information Technology function, the decision
was made that an audit and assessment should be conducted. During the month of
March, the Town ran an advertisement for proposals for a technology audit.
Attached is a copy of the RFP that was prepared for the audit. The deadline for
submissions was April 3.
In addition to the advertisement for submissions, RFPs were sent to two firms that
conduct these types of audits. The Town received one proposal from PKF O'Connor
Davies. A copy of the proposal is attached. The proposal submitted is responsive
to the Town's RFP and actually goes a bit farther in terms of the scope of the audit
that would be conducted. The specifics of the proposal begin on page 19. In
addition to the scope as described in the RFP, the consultant proposes to test our
systems and to also insure that we are compliant with various regulations such as
HIPPA. The consultant will review technology functions in each of the Town's
departments as well.
I did have the opportunity to speak with one of the consultant's references. It was
a larger organization than the Town with a staff of 31 people in their IT
department. The organization's representative was very pleased with the audit and
indicated that aside from just auditing the technology function, the consultant made
recommendations for improvements to the systems. At the time of this writing I
am awaiting a call from a school district representative in New Jersey where the
consultant conducted a technology audit.
The consultant is proposing a fee of $18,500 for the audit plus out of pocket
expenses for which the maximum would be $500. We know from past experience
that PKF has a good working knowledge of government operations which will be
invaluable for an audit of this type.

Information Technology Audit/Assessment
A. General Information
The Town of Mamaroneck is a local government operating under the laws of
the State of New York and the Town of Mamaroneck. The Town is a full
service government with 12 operating departments, each having their own
technology needs. The Town has on staff a full time Information Technology
Director plus two part time staff. The IT department is responsible for all
aspects of the operation and maintenance of the IT function and its security.
B. Purpose of the RFP
The Town is seeking proposals from qualified consultants experienced in
auditing and assessing the IT functions of the Town government. The
purpose is to review existing equipment, software, policies and procedures
for the continued reliable function of the IT operation and data storage.
C. Critical Dates for the RFP
The deadline for the submission of proposals is 4:00pm Wednesday,
April 3, 2019.
D. Form of Submission
The firms submitting proposals shall submit 5 copies of their proposal in a
sealed envelope marked and addressed as follows:

E. Scope of Services
The firm selected for this project shall obtain an understanding of the key IT
operations of the Town government, the IT environment, new and ongoing IT

initiatives, key data information flows. Current operating and security
policies shall be reviewed along with compliance with all applicable regulatory
requirements including but not limited to HIPPA Security protocols and PCI
compliance. The audit and assessment should evaluate the Town IT
departments ability to respond to a HIPPA audit should the Town be selected
for such an audit.
The consultant will analyze and evaluate the quality of protocols, routines
and controls following general IT processes:
I. Organization and management of IT operations
II. Local Area networks infrastructure
III. Application development and maintenance
IV. Computer operations and business continuity plan
V. Recommendations regarding expansion of business continuity plan to a
disaster recovery plan
VI. IT application, network and infrastructure security, anti-virus systems
and virus protection.
VII. Identity opportunities for improvement and develop practical and cost
effective recommendations.
VIII. A review of system access control.
IX. A review system vulnerabilities
X. Protection from environmental hazards
F. Implementation and Deliverables
The consultant shall meet with members of the Town's executive
management team to discuss the scope of services prior to implementation
of the audit. At the end of the process the consultant shall be expected to
present their findings to the executive management team and the Supervisor
and Town Board. The consultant shall provide the following:
• A detailed report unique to the Town of Mamaroneck regarding the
consultant's findings and recommendations
• The report shall include an executive summary of reviews and findings
• The main body of the report shall present detailed findings of in place
and needed technology improvements and controls, especially those
required to meet regulatory and identified frameworks.
• A documented prioritized list of required and suggested remediation or
recommendations.
• On-site meetings with the Executive management team to review
progress and set dates for completion of various phases of the audit.
• Critical or urgent findings will be reported as soon as they are
identified

G. Proposal Requirements
The proposal must include:
I. An overview of the firm, years of experience with IT Audits.
II. Provide a list of similar audits conducted for local governments
including listing references, dates of the audits.
III. Provide a listing of the qualifications and experience of those members
of the consultant's team that will conduct the Town IT audit.
IV. The team must include at least one audit professional with a valid
Certified Information Systems Security Professional (CISSP)certificate.
V. Fee Schedule: Provide a standard fee schedule for personnel assigned
to this project and the estimated total fee for this audit.
VI. Five (5) copies of the proposals must be submitted by 4:00pm

The Town is intending to have the consultant begin the audit in April of 2019

I. Selection Process
The Town will review each proposal received to determine if it meets the
requirements as set forth in this RFP. The Town reserves the right to reject
any and all proposals, to waive any technicalities and informalities to reject
or accept all or part of a proposal. The Town shall be the sole judge of
consultant's suitability for this audit.
The basic criteria for evaluation shall include:
I. The ability and capacity of the consultant to perform the scope of work
particularly experience with government IT audits.
II. Proposed fee structure that is in the best interest of the Town.
III. Staff qualifications
IV. Reference Check
J. Terms and Conditions
The consultant may withdraw their proposal before and after the submission
date by written request to the Town Administrator. Proposals withdrawn
before the submittal date may not be re-submitted after the submittal date.
All costs associated with the preparation and presentation of the proposal
shall be borne by the consultant. All documents submitted as part of the
response to the RFP will become the property of the Town of Mamaroneck.

K. Insurance Requirements
The consultant shall indemnify, defend, and hold harmless the Town of
Mamaroneck, its employees, agents and officers from claim, liability, loss,
injury or damage arising out of, or in connection with the consultant's
performance of this agreement. The consultant shall reimburse the Town for
all costs, attorney's fees, expenses and liabilities incurred with respect to any
litigation in which the Consultant is obligated to indemnify, defend and hold
harmless the Town under this agreement.

Engagement Details
Scope of the Engagement
Based on your RFP and the information provided to us, it is our understanding that you require the
following services:
• A review of existing equipment, software, policies and procedures for the reliable function of
IT operations and data storage.
• A review of current operating and security policies along with compliance and all applicable
regulatory requirements (e.g. HIPAA, PCI-DSS, State Breach Notification Laws, etc.).
o Specific to HIPAA, evaluate the Town IT Department's ability to respond to a HIPAA
audit by the Office for Civil Rights.
• Analysis and evaluation of the quality of protocols, routines and controls for the following IT

Assessment Approach for the Town
We will perform a complete inspection of the environment to understand the architecture, operational
procedures, controls, and resultant cybersecurity, compliance and data privacy risks and provide
recommendations, which, in our judgment, would mitigate possible deficiencies and/or risks. To
accomplish this task our review will include, but may not be limited to, the areas below. What is key
to our approach is that we have a comprehensive understanding of IT operations used by Towns.
While this assessment will be very technical in nature, we believe that to have a strong information
security and compliance program, an organization cannot account for just the technical, but also
must assess the people and processes and the risk to the data consumed and produced by the
organization. As such, our approach, in addition to the detailed technical review, will be to interview
all key personnel, understand their processes, the risk to the data they handle and identify any
areas that should be modified or enhanced to further manage the risk. This will ensure that our end

Monitoring is a control activity of each control area reviewed and will be assessed
accordingly.
Change Control
While it is unlikely that a highly robust change control process exists, we will evaluate
the process to ensure that the process is reasonable and effectively controlled for the
Town's size and potential future changes.
User Account Management
The employee lifecycle will be assessed from employee on-boarding to modifications
and to termination.
Privileged Account Management
As an extension to the assessment of the user account management lifecycle, we will
specifically review how privilege accounts are controlled and monitored.
Implementation of New Systems/Applications
We will review the process by which new systems and applications are deployed into
the environment. This will include all facets of the system development lifecycle.
Security of Operating Systems, Applications and Data
A comprehensive assessment of all operating system, application and data security
configurations. This includes, but is not limited to:
• Active Directory design and implementation
• Group Policy implementation
• Local operating system security configurations (Window, Mac, Linux, AS400)

password expiration.
• Active Directory account passwords scanned to identify weak passwords and
those known to be part of a breach
• Service accounts identified to see how and where they are used.
• Machines reconciled to see if any are missing anti-virus or any other key security
software.
• Internal Network Security
The internal network architecture will be assessed to identify how devices are
interconnected and how the risk of that connectivity is managed. Further, such
devices as switches, printers, wireless access points, storage area network and
network attached storage devices will be assessed to ensure an appropriate and
secure configuration methodology.
Specific to any Virtual LANs, if access control lists have been configured for
segmentation purposes, we will test the segmentation to ensure the segmentation is
functioning as designed.
Key to our approach of assessing the internal network security will be to evaluate how
the Town has tried to reduce and manage the risk of cybercriminal lateral movement
once breached.
▪ Perimeter Network Security
Perimeter network devices will be reviewed to ensure that key controls and
configurations have been implemented to prevent and identify threats that target and
traverse the perimeter devices. Firewall configurations will be manually reviewed to
ensure reasonable protection from external penetration. This is inclusive of any DMZ
and remote access solution implemented.
Physical Security
All aspects of physical security will be evaluated from the point of entry into the facility
to access network ports, workstations, printers, communication closets and the server
room.
• Back-up and Media Management
The back-up mechanism will be audited to ensure that all key data is:
• selected for inclusion
• appropriately monitored to identify failures
• securely stored after creation
• all procedures are reasonably defined to ensure recovery in the event of failure,
inclusive of a Ransomware attack.

Disaster Recovery/Contingency Planning/Incident Response
The Plan, if it exists, will be evaluated to ensure that the Plan as discussed is practical
and appropriately defined for execution, should it be needed.
• Application Data Flows
All key applications and data flows will be reviewed to ensure the Town's financials
and data are reasonably protected from unauthorized access and modification while
in transit.
• Protection of Personal Information
All repositories of sensitive information will be identified and the controls assessed to
ensure proper safeguards have been implemented.
• Online Banking Security
Online banking security procedures will be evaluated to ensure the Town is following
best practice guidelines and is reasonably protected from online banking fraud.
Payment Card Industry — Data Security Standard ("PCI-DSS")
We will review the credit card acceptance and processing procedures to make a
general determination if the Town is in compliance with the security standards set
forth by the PCI-DSS requirements.
Note —This will be a review of all material aspects of the PCI-DSS
requirements and not a detailed gap analysis specific to the requirements
only.
• Health Insurance Portability and Accountability Act ("HIPAA")
We will identify all areas in which electronic protected health information ("ePHI") is
created, stored, processed and/or transferred and make a general determination if the
Town is in compliance with the HIPAA Security Rule.
Note —This will be a review of all material aspects of the HIPAA Security Rule
requirements and not a detailed gap analysis specific to the requirements only.
Spam And Web Filter Effectiveness
We will systematically construct phishing e-mails of varying types to identify how the
spam filter responds. This will allow us to offer recommendations on how to enhance
the spam filter's effectiveness and ultimately prevent phishing schemes. In addition,
we will test the Web filter, to see which types of files can bypass the application level
scanning. This will help answer key questions regarding your spam and web filters
such as:
How can malware potentially enter your network?
What type of file types can be sent as attachments to the end user?
= What type of file types can be downloaded from a website by the user?
Does your internet and mail protection software detect potential malware?
Does your internet and mail protection software detect obfuscated malware?

Help Desk
Even the smallest organization can benefit from a robust and streamlined help desk
process. We will ensure that all help desk processes are reasonably defined to
effectively capture end user issues, respond in a timely manner and provide the
necessary management metrics upon which to make meaningful IT decisions.
Perform Internal and External Vulnerability Scans
External Network Security Vulnerability Scan — Internet accessible devices and
services have a high risk of compromise if the devices and services are not properly
secured and managed. The purpose of this scan will be to identify all available
devices and services that are accessible from the internet and assess those devices
and services to identify if they are vulnerable to known technical exploits. Specific to
the website, we will attempt to identify any issues that can result in unauthorized
access and/or manipulation of the website content.
Internal Network Security Vulnerability Scan —We will perform the same
procedures executed during the External Network Security Vulnerability Scan
assessment. However, we will direct our efforts to identify known technical
vulnerabilities for all internal workstations, servers and network devices (switches,
printers, etc.) that support the Town's day-to-day operations.
The intent of these scans is to perform a detailed security diagnostic of all internal and
external network devices giving the Town a deeper understanding of system
vulnerabilities that may exist.
While we don't believe in utilizing a single framework to gauge best practice operations and
configurations for smaller entities, we will leverage key cyber and information security frameworks
to ensure that a holistic and practical approach to information security and compliance has been
taken and implemented by the Town. Such frameworks include: National Institute of Standards and
Technology (NIST) Cybersecurity Framework or the Center for Internet Security (CIS) Top 20
Critical Security Controls. However, should the Town want a one-to-one mapping, we will map the
control set directly to the CIS Top 20.
Complimentary Services
Throughout this proposal, we stress the value we can add to the Town should we be engaged. As
part of that value, the following will be added to our approach as a complimentary addition.
Dark Web Scan —Accounts across all organizations are frequently compromised and the
credentials (username and password) are placed for sale on the Dark Web. As part of this
service, we will scan the Dark Web to see if we can identify any credentials associated with
the Town that have been compromised and exist on the Dark Web.

Execute a Social Engineering campaign — Experience and industry statistics have shown
that employees are the number one cause of information security breaches. Social
engineering is the act of influencing a person to accomplish goals that may or may not be in
the "target's" best interest. This may include obtaining information, gaining access, or getting
the target to take certain action.
Specific to the Town, we will attempt a Phishing Campaign. Phishing is an e-mail fraud
method in which the perpetrator sends out legitimate-looking e-mails in an attempt to gather
personal and financial information from recipients. In this test, PKF O'Connor Davies will
attempt to trick employees, via a crafted fake e-mail, into either clicking on a link and/or
entering credentials into a form.
The ultimate goal of the phishing campaign is to assist the Town in identifying employees who
are prone to these types of social engineering attacks and help the Town target their
awareness efforts. Our report will include the results of this test specifying which employees
passed and failed.
Practical Guidance
For our recommendations, we will focus on practicality and not over-engineering a solution that is
neither affordable nor sustainable due to its complexity. Many times organizations already have the
necessary technologies in place, they just either need to use them more effectively or modify
existing processes. While frameworks are great to aspire to, they are often not pragmatic in their
entirety for all entities for multiple reasons. We will help make those determinations and focus on
leveraging existing technologies and processes before resorting to recommendations for additional
capital expenditures. Further, in today's environment, all data and information is not equal and the
cost of protecting all data equally is no longer practical and economically feasible. As part of our
recommendations, we will ensure we specify where certain higher or more advanced controls would
be applicable to specific data sets and applications. This will allow the Town to effectively allocate
resources and budget.
Knowledge Transfer
We have learned over the years that a key component to any engagement is the knowledge

Deliverables
We will provide the following:
• A letter report consisting of an executive summary and a detailed listing of our findings and
recommendations. For each finding, we will qualitatively assign a risk ranking of Low, Moderate
or High, to assist the Town in their risk management efforts.
• The results of the internal and external vulnerability scans.
• A detailed review of the report results in draft form.
• A review with senior management to address any concerns.
• A close out meeting will be held with senior management.
Proposed Time Frame
The project is to begin in April 2019 and conclude by June 21, 2019. As part of our planning, we
hope to maximize our onsite time over the shortest period possible. To avoid any unnecessary
delays, as needed, we will perform remote web-based meetings to accommodate employee
schedules. Using web-based meetings will not sacrifice the quality of our work; it will allow us to
offer maximum flexibility with employee schedules.
Engagement Fees
We are committed to providing you with exceptional service at a fair and reasonable fee. We are
confident we deliver the highest quality of service; we have extensive training and review processes
in place to ensure it and our outstanding record of peer reviews confirms it.
Our fee for this project will be $18,500 plus any out-of-pocket costs. We agree to limit our out-of-
pocket costs to $500. Our total billings will not exceed $19,000.
Our fee is based on a blended rate of$225 per hour.
Our fees reflect routine consultation regarding recommendations we may provide. The Town need
not be concerned about being billed for each phone call. In fact, we encourage regular
communication and the opportunity to assist with minor issues and questions as they appear.

Re: Intersection of Palmer Avenue and Weaver Street

The intersection of Palmer Avenue and Weaver Street was recently the scene of
accidents on March 29 and April 4. Fortunately, the accidents resulted in no serious
injuries. The accident history at the intersection does reveal some frequency which
in some cases is due to the many turning movements at the intersection and the
high level of traffic.
Weaver Street is a State owned road and Palmer Avenue a County owned road.
The traffic signal is operated by the State. Some years back we petitioned the
State to review the intersection and install left turn arrows to improve traffic flow.
The State, at that time denied the request on the basis that a left turn arrow could
not be installed on Weaver Street in the northbound direction (towards Myrtle Blvd)
because of insufficient space in the northbound direction for a left turn lane. The
State's position is that a left turn lane must be available for the installation of a left
turn arrow. At that time, we reminded the State that left turn arrows were
operating on single lane State road in Scarsdale at the intersection of Weaver
Street and Griffen Avenue and in Harrison at the intersection of Harrison Avenue
and Union Avenue. However, the State's response was to only install a left turn lane
on Weaver Street in the southbound direction but without a left turn arrow on the
traffic signal.
I have spoken with the New York State DOT to request that because of the number
of accidents, the intersection should again be evaluated. Under a new policy of the
DOT, they require a resolution of the governing body of the community to initiate a
traffic study on a New York State roadway. Attached is a proposed resolution for
your consideration. If acceptable, I will forward this to the DOT to initiate an
investigation of the intersection.

Resolution of the Town Board of the Town of Mamaroneck
To request a study of the intersection of Weaver Street and Palmer Avenue
Whereas, the intersection of Palmer Avenue and Weaver Street (Route 125) is
located in the unincorporated Town of Mamaroneck, and,
Whereas, Weaver Street (Route 125) is a New York State owned road, and, Palmer
Avenue a Westchester County owned road,
Whereas, the traffic signal at the intersection is controlled by the New York State
Department of Transportation, and,
Whereas, the intersection has been the site of a frequent number of cars accidents,
the most recent occurring on March 29 and April 4, and,
Whereas, the Town believes that based upon the accident history, it is time to
evaluate the intersection to improve traffic flow and vehicular safety, now be it
RESOLVED, that the Town Board of the Town of Mamaroneck unanimously requests
that the New York State Department of Transportation initiate straightaway an
evaluation of this intersection to investigate traffic flow and to consider safety
improvements including the installation of left turn arrows on the traffic signal for
traffic traveling in all directions on Palmer Avenue and Weaver Street (Route 125).
And be it,
FURTHER RESOLVED, that the Town of Mamaroneck is prepared to provide
whatever assistance is necessary to assist with the review of the intersection by the
New York State Department of Transportation.
