LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State
of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted on
December 17, 2018, a Public Hearing will be held on Wednesday, January 16, 2019 at 8:00
PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post Road,
Mamaroneck, New York to consider: "Assessment of Converted Condominiums" Law.
Purpose
Pursuant to section 581 of the Real Property Tax Law, residential condominium units are
assessed at values that are significantly lower than the assessments of single-family homes
of comparable value. There is a real possibility that properties, including two-family homes,
may be converted into condominium ownership to avail themselves of this favorable tax
treatment. If that occurs,the tax burden will be shifted to the other taxpayers of the Town.
Section 581 (1) (c) of the Real Property Tax Law allows municipal corporations to adopt a
local law that prevents properties that are not condominiums from being converted to
condominium ownership and receiving the benefit of the favorable assessment treatment
provided by Real Property Tax Law§581. By this law,the Town is availing itself of the power
given to it by section 581 (1) (c) of the Real Property Tax Law to prevent converted
condominium units (defined in the new section 195-46 of the Code of the Town of
Mamaroneck) from being assessed in accordance with the provisions of section 581 (1) (a)
of the Real Property Tax Law or section 339-y of the Real Property Law.

Section 2—Addition of a new Article to a chapter of the Mamaroneck Code:
Chapter 195 of the Code of the Town of Mamaroneck hereby is amended by adding the following
chapter thereto:
Article XI Taxation of Converted Condominiums
§ 195-45 Purpose

§ 195-46 Definition
"Converted Condominium Unit" means a dwelling unit in condominium form of ownership that
(a) prior to May 1, 2019 was assessed as a dwelling unit in other than condominium form of
ownership and (b) has not been previously subject to the provisions of section 581 (1) (a) of the
Real Property Tax Law or section 339-y of the Real Property Law.
§ 195-47 Assessment of a Converted Condominium Unit
A Converted Condominium Unit shall not be assessed in accordance with the provisions of
section 581 (1) (a) of the Real Property Tax Law or section 339-y of the Real Property Law but shall
be assessed in accordance with the provisions of Article 3 of the Real Property Tax Law.
Section 3-Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4-Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

WHEREAS, the Town of Mamaroneck Vehicle and Traffic Chapter 219, § 219-44 stipulates that from
time to time by resolution or local law, the Town Board shall establish the fee, days, times and
methods of payment for permitted use of the parking lots.
NOW THEREFORE, BE IT
RESOLVED, that the Mamaroneck Town Board does hereby establish the following fees, days, times
and methods of payment for Town Lots A through G as follows:
Lot A (formerly Lot1) (i) a Daytime Parking Permit is established and required from June 1, 2018
through May 31, 2019 for a fee of$725.00 per year (ii) a Meter Parking Permit is established from
June 1, 2018 through May 31, 2019 for a fee of$ 80.00 per year (iii) for Meter Permit holders a
meter fee of$.60 per hour is required Monday through Friday betty n the hours of 5:00 am and
6:00 pm (iv) no parking is allowed from 3:00 am to 5:00 am day through Thursday (v) no permit

Date: January 10, 2019
Attached is a proposed renewal agreement between the Town and County of
Westchester; specifically the County Clerk's Office. The agreement provides the
Town the opportunity to access the land records and legal files in the County Clerk's
office. The remote access is a great advantage for the Town Attorney and Assessor
in researching matters related to their day to day tasks. There is no cost to enter
the agreement except that the Town must utilize its own computers for this
program.
REQUESTED ACTION-THAT THE TOWN BOARD APPROVE THE IMA BETWEEN THE
TOWN AND THE COUNTY OF WESTCHESTER REGARDING ACCESS TO VARIOUS
RECORDS IN THE COUNTY CLERK'S OFFICE AND THAT I BE AUTHORIZED TO
EXECUTE THE AGREEMENT ON BEHALF OF THE TOWN.

LICENSE AGREEMENT made this 4th day ofJanuary , 2019 , by and

THE COUNTY OF WESTCHESTER (hereinafter referred to as the"County"), a municipal
corporation of the State of New York, having and office and place of business in the Michaelian
Office Building, 148 Martine Avenue, White Plains,New York 10601 and
THE TOWN OF MAMARONECK
(hereinafter referred to as the"Licensee"), located at
740 W' st_Boston Post Road

WHEREAS, the County desires to provide a license for remote access to the County Clerk's
land records and legal files; and
WHEREAS, the Licensee desires a license for the privilege of utilizing such remote access
to the County Clerk's record; and
NOW, THEREFORE, the parties hereto agree upon the premises, terms and conditions as
follows:
1.Licensed Access: The County hereby grants to the Licensee a License at no cost for the
use of( 4 ) assigned user IDs from the Westchester County Clerk's system that would permit
Licensee to connect computer terminal(s) for remote web access to the County Clerk's land records
and legal files. Licensee accepts the land records and legal file information on an "as is"basis and
the County provides no warranty as to the accuracy of the information. To the extent permitted by
law, the County disclaims all liability for the information contained in the files and records.
2. Confidentiality: The Licensee agrees that, except in accordance with proper judicial order
or as otherwise provided by law, the Licensee and any person employed, or otherwise engaged, by
such Licensee who by virtue of such employment or engagement is given access to the County
Clerk's Office land and legal records pursuant to this License, shall not divulge or make known in
any manner any confidential information, such as social security numbers, contained in such records.
3. Conduct of Operations: The Licensee assumes all risk of operation and shall provide, at
its sole cost and expense, all equipment and hardware, as determined by the County, necessary to
gain access to the County Clerk's records. The County shall not be responsible as a bailee or
otherwise for any equipment or hardware or other personal property of the Licensee, or its
employees,used to gain remote access. The Licensee hereby waives any claim for loss or damages
sustained to any personal property, including, without limitation, theft or other casualty.
The Licensee further agrees:
(a)that except for the amount, if any, of damage contributed to, caused by or resulting from
the sole negligence of the County, the Licensee shall indemnify and hold harmless the County, its
officers, employees and agents from and against any all liability damage, claims, demands, costs,
judgments, fees, attorneys' fees, or loss arising directly or indirectly out of the acts or omissions
hereunder by the Licensee and third parties under the direction or control of the Licensee; and
(b) to provide defense for and defend, at its sole expense, any and all claims, demands or
causes of action directly or indirectly arising out of this License and to bear all other costs and
expenses related thereto.
(c) that in the event the Licensee does not provide the above defense and indemnification to
the County, and such refusal or denial to provide the above defense and indemnification is found to
be in breach of this provision, then the Licensee shall reimburse the County's reasonable attorney's
fees incurred in connection with the defense of any action, and in connection with enforcing this
provision of the License.
4. Term and Termination: The term of this License shall be for a period of one year
commencing on January 1, 2019 and terminating on December 31, 2019, with the County Clerk's
option to extend the License for four additional one-year periods on the same terms and conditions.
This License shall be extended for an additional one-year period automatically upon Licensee's
receipt of a letter notice from the County Clerk advising Licensee of the County CIerk's decision to
exercise its option and extend this License for an additional one year period.
In addition, this License may be terminated by the County upon thirty(30) days written
notice to the Licensee when, in its sole discretion, the County deems it in its best interest to do so.
Licensee shall have the right to terminate this License upon thirty(30) days written notice to the
County when, in its sole discretion, Licensee deems it in its best interest to do so.
5. No Lease: It is expressly understood and agreed that no equipment or space is leased
to the Licensee. No exclusive rights for remote access (other than the licensed user IDs granted
herein) are granted by this License.
6. Notices: All notices of any nature referred to in this License shall be in writing and
either sent by regular mail, electronic correspondence, overnight courier, or sent by facsimile(with
acknowledgement received and a copy of the notice sent by overnight courier), to the respective
addresses set forth below or to such other addresses as the respective parties hereto may designate in
writing. Notice shall be effective on the date of receipt, or in the case of notices sent by regular
mail, notice shall be effective three business days after the date of mailing.

Re: 2019 Ambulance Rates
The Ambulance District FY 2019 revenue budget is based on slight
increases to our fee schedule.
In consultation with our billing service, the new rates were established
based on the Medicare rate schedule. As you know a majority of our billing
revenue is derived from Medicare, and most private insurance companies
abide by the Medicare fee schedule. These rates reflect our long-standing
policy of keeping balance bills for patients with Medicare coverage to a
minimum.
Therefore, I respectfully request the Town Board adopt the 2019 Ambulance
District Fee Schedule. When adopted I will notify Evolution Billing Concepts
to adjust our service rates.

The Town of Mamaroneck Fire Department's Fire Council would like to recommend the
promotion of Keith Napolitano to the Position of Fire Lieutenant.
FF Napolitano has been a member of our career staff since September of 2004 and is
presently the senior firefighter. Keith has been a very active and dependable member and
has been a mentor to many of the career and volunteer firefighters of the department.
Keith has been a member of our FAST Team as well as been chair of 2 committees (EMS
and ICS). He presently is a Registered Nurse and a certified Paramedic.
The Chiefs and Fire Council feel that FF Napolitano is more than capable to perform the
duties of Lieutenant and ask the Board of Fire Commissioner's to consider his promotion
to be effective 2/1/2019.

SUBJECT: Administrative Intern —Administrator's Office
Authorization is requested to appoint Lindsey Luft to the position of Administrative Intern in the
Town Administrator's Office. The effective date of the part-time appointment would be January
28, 2019 at an hourly rate of$35 and the full-time appointment would be effective February 19,
2019 at an annual salary of$64,000.
The position has been vacant since November 2018 due to a resignation and the funding of
such is reflected in the 2019 budget. Ms. Luft would receive a similar benefits package afforded
other non-union and management staff. Enclosed for your review is the tentative employment
offer letter.
Ms. Luft has a Master of Science in Public Administration from the College of Brockport and is
currently working for the Administrator in the Village of Ardsley. In her current position she is
involved in the daily operations of the Village and serves as the Workers' Comp safety
coordinator. While attending graduate school, Ms. Luft also worked as an intern for the City of
Batavia.
Ms. Luft would handle the administrative duties that pertain to Civil Service administration,
Workers' Compensation claims, employee benefits, employee training and compliance with
federal and state regulations and reporting.
Since an employee classified as an Administrative Intern can only hold the title for a period not
to exceed one year, a position will need to be created. A determination will be made as to the
appropriate Civil Service position that would best meet the needs of the Administrator's Office.
Once a job title has been selected, Ms. Luft will be classified as a provisional employee in that
title and will be required to take a test for that position. In order for her to be appointed to the
position she will need to attain a score equal to or higher than the third highest ranking eligible
on the list. If appointed, she will be required to serve a fifty-two (52) week probationary period.
ACTION REQUESTED: That the Town Board approve the appointment of Lindsey Luft working
part-time commencing January 28, 2019 at an hourly rate of$35 and full-time as of February
19, 2019 at an annual salary of$64,000.

RE: Proposed Employment Agreement—Administrative Intern
Dear Ms. Luft:
As discussed, since your appointment is subject to Town Board approval, we
would like to extend a tentative offer of employment. The Administrative Intern
position is full-time, however, Civil Service limits the term of this position to one
year. Therefore, prior to the expiration of the term, you will be required to take
a Civil Service exam for a title that would appropriately reflect the position's job
duties and responsibilities. In order to be appointed to that position, you will
need to obtain a score equal to or higher than the third highest ranking eligible
on the Civil Service list. If appointed to the position, you will be required to
serve a fifty-two (52) week probationary period.
As the Administrative Intern you will be afforded the compensation and benefits
stipulated below:
➢ Salary: Your annual salary will be $64,000 which is paid bi-weekly.
➢ Health Insurance: You will be eligible to participate in the New York State
Health Insurance Program (NYSHIP), the first of the month following your hire
date. If you elect the coverage, you will be required to contribute five
percent (5%) of the premium.
➢ Health Insurance "Buy-out": If you decide not to elect the NYSHIP coverage,
you will be entitled to the "buy-out", provided you are not covered by the
NYSHIP for a period of twelve (12) consecutive months. The "buy-out"
amount is $4,000 if you would have elected individual coverage or$5,000 if
you would have elected family coverage. The payment, which is subject to
applicable taxes, is issued after the twelve (12) month period of non-

participation. If you initially elect the "buy-out" option you may change to
the NYSHIP at any time, however, there may be a waiting period of up to
three (3) months.
➢ New York State & Local Retirement System: As a full-time employee you will
be required to participate in the retirement system and contribute a
percentage of your annual salary in accordance with the plan provisions.
➢ Dental Plan& Optical Plan: You will be eligible to participate in the MetLife
Dental Plan and the CSEA Employee Benefit Fund Optical Plan effective the
first of the month following your hire date at no cost to you.
➢ Life Insurance &Accidental Death&Dismemberment Insurance: You will be
covered by a $10,000 life insurance policy and a$10,000 accidental death
and dismemberment policy on the first of the month following your hire date
at no cost to you.
➢ Voya 457(b) Deferred Compensation Plan: You are eligible to participate in
the Voya 457(b) Plan which permits salary deferrals on a pre-tax basis. The
457(b) Plan is governed by the regulations stipulated in the Internal Revenue
Code.
➢ Sick Days: You will receive one sick day for each full month employed in 2019.
On January 1St of each subsequent year you will be credited with twelve (12)
days. An additional sick day is earned if you have not taken sick time in a
consecutive four-month period in a calendar year. The balance of unused sick
days is carried over to the following calendar year and there is no limit as to
the number of days that can be accumulated.
➢ Workers' Compensation: You will be entitled to Workers' Compensation
insurance pursuant to the applicable requirements of the laws of New York
State. If you are necessarily absent from work because of a job related injury
as defined by the law, you shall be granted leave with full pay for a period not
to exceed nine (9) months exclusive of accumulated sick leave and vacation
leave.
➢ Vacation Days: During your first year of employment you will be entitled to
fifteen (15) vacation days. Scheduling of such is subject to the approval of the
Deputy Town Administrator.
➢ Personal Time: You will be entitled to personal leave for appointments and
personal business that cannot be otherwise completed outside the normal
work hours. Requests for personal leave are subject to the approval of the
Deputy Town Administrator.
➢ Holiday Pay: You will receive the paid holidays that are listed on the Town's
2019 Holiday Schedule.
The offer for you to serve as the Administrative Intern is made with the understanding
that there is no personal conflict of interest pertaining to you that will adversely affect
your ability to perform the duties of this position. You agree that you shall not conduct
any private work that would be in conflict with your duties in the Town of Mamaroneck.
