Town of Mamaroneck Sustainability Collaborative • 2018.1010 TO: Town of Mamaroneck Town Council FROM: TOM Sustainability Collaborative RE: RBI (Re-usable Bag Initiative)Advisory Opinion At its meeting on Tuesday, October 9, 2018,the Town of Mamaroneck Sustainability Collaborative voted unanimously to ask the Town Council to consider Re-usable Bag legislation based closely on New Castle's recent law. "The Town of Mamaroneck Sustainability Collaborative(Collaborative)supports the development, adoption and implementation of the Town of Mamaroneck's RBI(Re-usable Bag Initiative)law, with legislation based closely on New Castle, New York's RBI Law, as an important next step in improving the Town of Mamaroneck's Sustainability and Quality of Life. The Collaborative will work closely with Residents, Merchants,Schools, Neighborhood Associations, Community Groups(Houses of Worship, Clubs), TOM Government and the TOM Board to shape the details of RBI, solidify support for it, and assist in its implementation."(moved,seconded, passed) The New Castle Law is considered state of the art bag legislation and has proven to be effective in changing people's behavior to encourage them to bring reusable bags when shopping. The highlights of the law include a ban on single use thin plastic bags,a fee for paper bags, and a fee for the sale of reusable bags in store, and exemptions for certain types of plastic or paper bags. Many other communities have adopted similar laws including Bedford, Lewisboro, Hastings, Ulster County, Suffolk County,and Stamford CT. The Sustainability Collaborative has been working with and coached by New Castle residents who worked on their successful law. We have taken their advice to gather signatures of supporters for the legislation (800 so far), held a student art and video contest and have accepted 1,000 donated reusable bags to be given to residents at the time the law is implemented. The law will provide the following benefits: • Reduce litter and trash on TOM streets, public areas and parks • Decrease plastic pollution in Long Island Sound, that threatens both marine and bird life • Ban single-use plastic bags in all stores • Require stores to charge for paper bags, and allow stores to keep those fees • Create a cost-neutral law for merchants requiring customers to pay a nominal fee for paper bags, reimbursing merchants for their expenses and allowing merchants to sell re-usable bags, which makes them cost-neutral to merchants • Implement a Law which makes reasonable exceptions for certain merchant types,such as restaurants, boutiques, delis and liquor stores, which are not required to charge bag fees • Allows limited exceptions on plastic bags below 1 quart volume,such as meat,produce or newspaper bags We urge the TOM Board to support the development of RBI legislation based closely on the New Castle law and to be available to the Collaborative,from time to time,to be updated on our progress and offer your input and suggestions. Section 174-3 of the legislation requires that the Town Board annually set the sewer rent rate per gallon based upon water consumption. The rate is calculated by dividing the revenue required to operate the sanitary sewer system by the adjusted water consumption of all system users. A public hearing must be held by the Town Board to consider the sewer rent rate. There are 3,200 billed water accounts in the unincorporated Town. There are an estimated 87 properties in the unincorporated area that utilize septic systems and therefore not connected to the sewer system. Below is a listing of water sales in the unincorporated area for the last three full years: ❖ 2017 Actual 470,000,000 gallons 2016 Actual 485,000,000 gallons ❖ 2015 Actual 514,000,000 gallons Three year average water sales- 489,666,666 gallons Average annual water use for a residential property is 112,500 gallons. This is the average of annual water use with and without irrigation. Based upon 87 properties not being connected to the sanitary sewer system and an average water consumption of 112,500 gallons; 9,787,500 gallons of water is deducted from the average water sales for purposes of the calculation of the sewer rent. Also, the law provides that the sewer rent to be charged be based upon 90% of the actual water consumed. Therefore for rate calculation purposes the adjusted annual water sold is determined as follows: Three year average water sales 489,666,666 gallons Deduction for properties not connected to the sanitary sewer system 9,787,500 gallons Subtotal 479,879,166 gallons Allowance for 90% of actual average water consumption 47,987,916 gallons Adjusted water sales for rate calculation 431,891,250 gallons 1IPage Ci Printed on Recycled Paper The Sewer District Budget for 2019 is $474,231. Therefore the rate calculation is $474,231/431,891,250 =$.0011/gallon, an increase of $.00044/gallon over 2018. For an average residential consumer of water using 112,500 gallons a year the property owner will be billed for 90% of the consumption or 101,250 gallons. As a result the average annual sewer rent for 2019 will be $111.37 an increase of $44.55 over 2018. For a point of comparison, a home with an average assessment of $1,253,000 would have incurred a property tax bill of $137.83 for Sewer District expenses in 2019 had the ad valorem tax been applied. So although the increase in the fee is larger than in previous years, the fee is still less than the calculated property tax. Also, by using the fee the property owner has the ability to control the expense through water conservation. In the presentation of the 2019 Tentative Budget it was pointed out that the Sewer District expense increase was entirely the result of the additional debt service in the district budget. The Town along with other communities in the County Sewer District is mandated to complete repairs and rehabilitate their sanitary sewer systems. The debt expense in the Sewer District will increase from $93,194 to $275,413 in 2019 as a result of the $2.7million in bonds issued for the mandated sewer project. tephen V. As a matter of background the members of the Consortium signed an IMA with Westchester County in 2016. The IMA required that the Consortium conduct an investigation of the sanitary sewer systems in each community and develop a plan for the rehabilitation and repair of defects found in the sewers. The purpose is to eliminate the inflow and infiltration of storm water into the sanitary sewer system in order to prevent the bypassing of sanitary sewage into Long Island Sound at the County's sewer overflow stations in Larchmont and New Rochelle. Under the terms of the IMA, all rehabilitation must be completed by August of 2020. The investigation included televising the Town's entire sanitary sewer system and an evaluation of all sewer manholes. Findings from the investigation were catalogued and from that bid specifications and plans prepared, to accept bids for the project. In October, the Consortium received bids for sewer system rehabilitation. Two separate bid contracts were issued for the project. Contract P33A covered all open cut sewer repairs. These are repairs requiring excavation and the replacement of broken or seriously cracked sewer pipes. Contract P33B was for trenchiess sewer repairs. Trenchless repairs include the re-lining of existing sewer lines. Appendix #1 is the schedule of bids received for each contract. The bids received were very favorable and below the original estimates for the project. The original engineer's estimate for the Consortium was $9.7million for both contracts. Actual bids received totaled $7.2million. As a result the Consortium has an opportunity to accomplish more sewer system repairs than originally anticipated. The opportunity is enhanced by the fact that the Consortium received 11Page 0 Printed on Recycled Paper a grant from the New York State Environmental Facilities Corporation that will reimburse 40% of the project costs. For the Town of Mamaroneck, sewer repairs are required in two separate County Sanitary Sewer Districts; the New Rochelle Sewer District and Mamaroneck Valley Sewer District. Our goal was to complete all repairs in the New Rochelle District and complete as many repairs as possible in the Mamaroneck Valley District. Appendix #2 prepared by the Town Engineer focuses on the Town's portion of the contract. Our total expenditures including construction are estimated to be $3,260,386. Included in this cost of the original investigation and the repair of the most serious defects in the New Rochelle District and repairs in six of the ten sewer basins in the Mamaroneck district. Sewer basins are identified with MT prefix. Total funding sources equal $4,880,000 including the two Town bond issues and our share of the State grant. This leaves a surplus of just over $1.6million. On the second page of Appendix #2 is a schedule of additional repairs that will need to be made at some point in the next several years. With the total cost of those repairs being just over $4million they cannot be all completed in this first phase of construction. However the recommendation is to apply the $1.6million to the balance of the New Rochelle District Repairs ($500,000) and to as many of the Mamaroneck sewer basin repairs as funds will allow. The City of New Rochelle is serving as the lead agency for the Consortium. As lead agency they will formally award the contract for construction and will handle the financial transactions with the contractors and consultants. The other municipalities will make construction progress payments to the City. The City will also administer the application of the grant funds. ACTION REQUESTED: THAT THE TOWN BOARD APPROVE THE CITY OF NEW ROCHELLE AWARDING CONTRACTS P33A AND P33B TO THE LOWEST RESPONSIBLE BIDDERS IN ORDER TO PROCEED WITH THE SEWER REHABILITATION PROJECT AND THAT THE TOWN ADMINISTRATOR BE AUTHORIZED TO EXECUTE AN AMENDMENT TO THE EXISTING CONSORTIUM INTERMUNICIPAL AGREEMENT FOR THE CITY OF NEW ROCHELLE TO ADMINISTER THE CONSTRUCTION CONSTRACTS. tephen V. Although it's reasonable to hope for a similar outcome if additional basins are added I feel were best served to be remain conservative. I recommend that we consider addressing the additional repairs in the MT-01 and MT- 07 sewer basins. Combined with an estimated change order for additional engineering and construction administration this grouping will maximum use of the available funding. We would like to replace this system with two independent but integrated systems from separate companies. The citation (parking ticketing) system from Integrated Technical Solutions (ITS) offers a seamless integration between the pay stations and permitting software the Town currently uses. Fundamental Business Solutions (FBS) is a back end Court system and has entered into a separate agreement with ITS to integrate their systems for our benefit. The Police Department has approved their use of the new ITS citation management system to issue parking tickets. Attached please the ITS agreement. The agreement meets the technical and security requirements outlined in the Towns Cyber Security Policy. Funding for ITS is in the 2019 Capital budget request as the equipment will not be operational or deployed until January 3, 2019. This agreement needs to be approved as soon as possible so that we can start back end integration of the systems. Thank you. c. WHEREAS, the Town requires on-going software licensing. warranty and support services("the Services") in accordance with the Manufacturer's Standard Extended Licensing and Warranty for the Software; and WHEREAS, Integrated Technical Systems, Inc., (ITS) is the qualified local reseller and service company for the Software and associated hardware, and is willing to provide these goods and services on the terms and conditions as are hereinafter set forth. 1 NOW, THEREFORE in consideration of the mutual covenants and promises contained herein, the parties agree as follows: 1. Scope of Services ITS shall provide the Software Products, associated hardware, and License and Warranty Support Services in conformance with the Manufacturer's Standard License and Warranty and the Consultant's Price Proposal with monthly coverage both of which are incorporated by reference and annexed hereto as Exhibits "I" and "II"respectively. This Agreement includes software license and warranty only pertaining to covered software systems. This agreement does not include labor or travel time. If labor is required, the Town shall be billed according to standard ITS service rates of$135/hour with a minimum of 2 hours and a$95 travel charge. Service will be performed between the hours of 8:00 a.m. and 5:00 p.m. Monday through Friday, excluding legal holidays. The Consultant shall respond to a non-emergency call for such service within twenty-four(24)hours of a request, except for Holidays and weekends at which time this would be billed as Emergency Service. Emergency Service is available 24 hours per day, 7 days per week at standard emergency overtime rates on an expedited basis. This Agreement does not cover any programming and/or software interface work external to the specific systems covered by this Agreement. 2. Compensation Compensation for the Consultant's services are set forth in Exhibit II. The Services are exempt from sales tax and the Town will provide the appropriate Sales Tax Exemption Certificate. 3. Payment Full payment for the software and associated hardware as noted in Exhibit II, in the amount of $28,915.00 shall be made within 30 days after the successful implementation of the project. Software hosting, in the amount of$395.00 per month, and License and Warranty in the amount of$1,850 per year shall be made within 30 days in accordance with the terms of this Agreement. Payment for the on-going services shall be made on a monthly basis upon the presentment of a monthly invoice. 4. Term The contract shall commence on the date of full execution of the Agreement and expire upon the conclusion of the support services period for the software systems which is thirty-six (36) months. 2 ITS shall have the option to renew this Agreement with the same amount of compensation for an additional one(I)year term. All other terms and conditions of the Agreement shall apply. 5. Software User Rights, Data Management, Hosting and Approvals The parties agree to the User Rights and locations of the software, hosting requirements, data management and related appliances to be covered as part of the License and Warranty and under this Agreement. The Consultant assumes no liability for any breaches caused by others. 6. Breach and the Town's Remedies Subject to notice and opportunity to cure as specified in the notice, the failure of ITS to comply with any of the terms or conditions of this Agreement shall be deemed a breach of this Agreement and the Town shall have the right to elect to suspend the Agreement in whole or in part,maintain an action at law or in equity or commence other proceedings with respect to a breach of this Agreement. 7. Independent Contractor ITS is engaged only for the purposes and to the extent set forth in this Agreement and its relationship to the Town shall be that of an independent contractor. In accordance with such status, ITS covenants and agrees that neither it nor any of its officers, employees, agents or subcontractors will hold themselves out as, or claim to be, officers or employees of the Town, nor seek any of the rights or privileges accorded employees of the Town. The Town agrees that ITS shall not be liable for any consequential injury and/or damage or loss of revenue resulting from its performance of this Agreement. The Town agrees not to solicit or hire any ITS employee for a period of two (2) years after expiration of this Agreement. 8. Compliance ITS shall comply with applicable local, state and federal laws, rules and regulations. Any terms required by applicable law to be inserted into this Agreement shall be incorporated by reference as if fully set forth herein. Copies of all databases shall reside on Town servers. BAK files will be uploaded to the Town's FTP site on a weekly basis. PermitTech is a Permit Portal, owned by Net Tech Solutions that is designed to interface with one or more backend card payment processing providers. Net Tech Solutions does not collect or store card payment account numbers or other card information and does not serve as the Town's card payment processing provider or as an escrow agent for the Town. Net Tech Solutions merely facilitates online payments by connecting defendants to designated card payment processing providers and updating Town records accordingly, to reflect payments made and processed. 3 9. Insurance ITS shall procure and maintain at its own expense general liability insurance with coverage in the minimum amount of$1 million/$2 million dollars and name the Town as a Certificate Holder. ITS shall also provide workers compensation/employer liability coverage. ITS shall submit certificates of insurance evidencing such coverages from a carrier rated no less than A- by A.M. Best which must be approved by the Town Attorney prior to full execution of this Agreement. 10. Indemnification To the fullest extent permitted by law, ITS shall defend, hold harmless and indemnify the Town, its officers and employees and agents, from all claims, suits, proceedings,brought in equity or at law, with regard to its negligent performance of this Agreement. 11. Assignment ITS shall not assign the Agreement in whole or in part without the prior written consent of the Town. 12. Waiver Failure of the Town to insist in any one or more instances upon the strict performance of any term or condition of this Agreement shall not be deemed a waiver or relinquishment of such term or condition, but the same shall remain in full force and effect. Acceptance by the Town of any of the Services or the payment for same with knowledge of a breach of any term or condition of this Agreement shall be deemed a waiver of any such breach. 13. Notices: All notices referred to in this Agreement shall be in writing and either sent by registered or certified mail postage pre-paid, or delivered by hand or overnight courier, or sent by facsimile (with acknowledgment received and a copy of the notice sent by registered or certified mail postage pre-paid) to the addresses as set forth below or to such other addresses as the parties may designate in writing. Entire Agreement This Agreement shall constitute the entire agreement between the parties. It shall not be changed or modified except by written agreement signed by a duly authorized representative of each of the parties. 15. Dispute Resolution The parties agree that this Agreement shall be construed and enforced in accordance with the laws of the State of New York. In addition, the parties agree that for any cause of action arising out of this Agreement shall be brought in the Supreme Court of the State of New York, County of Westchester. 16. Severability If any term or provision of this Agreement is held by a court of competent jurisdiction to be invalid or unenforceable, the remainder of the terms and provisions of this Agreement shall not be affected, impaired, or invalidated, and to the extent permitted by applicable law, any such term or provision shall be restricted in applicability or reformed to the minimum extent required for such to be enforceable. This provision shall be interpreted and enforced to give effect to the original written intent of the parties prior to the determination of such invalidity or unenforceability. The citation (parking ticketing) system from Integrated Technical Solutions (ITS) offers a seamless integration between the pay stations and permitting software the Town currently uses. Fundamental Business Solutions (FBS) is a back end Court system and has entered into a separate agreement with ITS to integrate their systems for our benefit. The Court has approved their use of the FBS portal for processing the payments of parking tickets. Attached please find the agreement with FBS. The agreement meets the technical and security requirements outlined in the Towns Cyber Security Policy. The FBS agreement is a straight percentage of tickets paid after 30 days. Denise Cookingham FBS SERVICE AGREEMENT FOR PARKING ENFORCEMENT MANAGEMENT AGREEMENT AGREEMENT dated between THE Town of Mamaroneck, a municipal corporation with offices at TOWN MUNICIPAL BUILDING, 740 WEST BOSTON POST ROAD,TOWN OF MAMARONECK, NY 10543 (Hereafter referred to as Town) and FUNDAMENTAL BUSINESS SERVICE, INC., 14 FRONT STREET, HEMPSTEAD, NY 11550 (Hereafter referred to as FBS). WHEREAS, FBS, has been selected to perform these services, now therefore IT IS MUTUALLY AGREED: BY AND BETWEEN THE PARTIES AS FOLLOWS: 1. TERM &TERMINATION. The term of this agreement will commence on the date above written and will continue for a period of Three (3) years, unless extended or terminated as described below: a) The term of this agreement may be extended annually for an additional year by mutual agreement of both parties by both parties giving written notice to the other, expressing agreement to an extention, within sixty (60 days) of the end of the term. b) This agreement shall terminate upon breach by either party but only after: i) the non-breaching party gives the breaching party written notice with thirty (30) days to cure; and ii) the breaching party fails to cure the breach within such timeframe. 2. FBS shall transcribe all records and information contained therein of parking tickets/summonses/informations from original or copy issued for violation of parking ordinances and located at Town offices. FBS shall also transcribe all tickets/summonses/informations issued electronically or non- electronically for violation of parking ordihance. 3. The Town agrees to cooperate with FBS, in providing access to the aforesaid information,'including the information regarding the payment of all summonses. 4. FBS shall obtain from the Department of Motor Vehicles the name, address and vehicle registration numbers from the information provided by the Town, including license plate numbers, as found on the aforesaid tickets/summonses. 5. FBS shall engage in lawful skip tracing procedures, if determined by FBS to be necessary or appropriate, to locate delinquent violators. 6. FBS shall notify all aforesaid violators of the outstanding tickets/summonses, on a form, which has been approved by the Town prior to transmission. 7. FBS shall forward copies of all correspondence received from violators or other sources which result from the aforesaid notification and shall notify FBS SERVICE AGREEMENT FOR PARKING ENFORCEMENT MANAGEMENT the Town of Mamaroneck and the Department of Motor Vehicles of the results of said correspondence and compliance or lack thereof. 8. FBS shall maintain account files that reflect the amount of fines remitted by defendants to the Town during the term of this agreement and shall provide a monthly fine remittance report to the Town by or before the 15th of each month showing fine remittances for the previous month. 9. FBS shall repeat notification to delinquent violators by six (6)additional notices as set forth herein on forms approved by the Town at thirty (30) day intervals, unless payment is sooner made. 10. FBS shall provide a warning to all delinquent violators that failure to respond to the aforesaid six (6) notices may result in the entry of a civil judgment. 11.FBS, on behalf of and at the direction of the Town of Mamaroneck, shall prepare notices for civil default judgments for docketing by the appropriate Town officials in certain instances where violators fail to respond to the aforesaid six (6) notices, as directed by the Town. 12. FBS shall provide all responding violators with information regarding all outstanding summonses, including summons number, date and place of violation, license plate number and amount of fine. 13. FBS, on behalf of and at the direction of the Town of Mamaroneck, shall notify the Department of Motor Vehicles of scofflaws with three(3) or more unanswered violations in an eighteen (18) month period in accordance with NYS VTL. 14. FBS agrees to devote reasonable best efforts to recover the full amount of the accounts placed for collection through persistent and diligent activity which shall be at all times legal and ethical and in compliance with applicable Government (Federal, State and Local) rules and regulations including without limitation, the Federal Fair Debt Collection Practices Act. FBS shall endeavor to maintain and preserve the violator's good will toward the Town. 15. FBS shall maintain all records in relation to this agreement and perform services as required herein at and from its own business premises. FBS represents to abide by the Town's Cyber Security policy. 16. All fines remitted in response to the efforts of FBS shall be remitted directly to the Town. In no instance shall FBS engage in the service of, or be considered in any way, to be the escrowee of the Town. 17. The parties further agree that all correspondence to be sent to scofflaws and violators shall be subject to the prior approval of the Town. 2 • FBS SERVICE AGREEMENT FOR PARKING ENFORCEMENT MANAGEMENT 18. FBS agrees to hold the Town harmless and indemnify against any liability imposed upon the Town as a result of acts committed by FBS, in • violation of this agreement and of the Fair Debt Collection Act and all applicable Federal, State and Local regulations in regard to debt collections. TheTown of Mamaroneck agrees to hold FBS harmless and indemnify against any liability imposed upon FBS as a result of erroneous or incorrect information transmitted by the Town to FBS and actions taken by FBS in reliance thereon. 19. It is understood that FBS' relationship to the Town is that of an independent contractor and not its employee or agent. Any arrangements made by FBS with outside agents or attorneys shall be solely FBS' responsibility and shall in no way constitute or incur additional obligation on the part of the Town. The Town's obligation is limited to payment to FBS of compensation earned in accordance with this agreement. 20. FBS shall be compensated on a contingent basis and shall be entitled to: Thirty percent (30%) of all monies paid thirty one days from issuance forward. The compensation due FBS shall be based upon a percentage of that actually collected and not upon the face amount of the summons/ticket. FBS shall submit invoices and be compensated pursuant to customary Town billing procedures. All costs of operation incurred by FBS in furtherance of the services enumerated in this agreement shall be borne soley by FBS, excluding statutory court and filing fees and fees imposed by the Department of Motor Vehicle directly upon the Town, all of which shall be borne soley by the Town. 21. NOTICE. Notice shall be delivered to the address first written above. Notice is effective upon delivery unless notice is delivered by mail, in which case notice is effective 3 days after mailing. 22. In addition to the FBS services described in this agreement, FBS agrees to supply (IF APPLICAPLE) software and equipment contained in Exhibit "A"annexed hereto. The provisions of this agreement, together with Exhibit A, identifies all FBS services, software, and hardware included under this agreement. If the Town desires additional services, software, or hardware from FBS, the parties may amend this agreement to identify the scope, cost, and terms of such additional items. 3 • FBS SERVICE AGREEMENT FOR PARKING ENFORCEMENT MANAGEMENT 23. Upon expiration or termination of this agreement: a) FBS shall give Town all Town records and data in the possession of FBS; b) Town shall return all equipment and discontinue use of all software and intellectual property owned or furnished by FBS under • this agreement; and c) Town will be responsible to FBS for fees due as a result of the collection efforts of FBS but shall incur no other liability as a result of termination or cancellation. 24. All equipment and hardware and software provided by FBS during the course of this agreement shall remain the property of FBS or the entity which licenses its use. All intellectual property provided by FBS during the course of this agreement shall remain the property of FBS or the entity which licenses its use. All right, title and interest in and to any technical information of either party which is provided to the other party in the course of the provision of services with FBS Clients or any portion thereof, including all ideas, concepts, software, interfaces, designs, text, graphics, animation, audio and/or digital video components, and all other component materials that are created by or for either party to this Agreement, including without limitation, any patents, copyrights, trademarks, trade secrets, and other intellectual or industrial property rights therein, shall remain the exclusive property of the providing party. All patents and other intellectual property and related rights in and to all inventions made and technical information developed jointly by the parties in the course of performance under this agreement shall be jointly owned by the parties and each patty shall have the right to grant licenses to any third party for such jointly owned property without accounting to the other party. Both parties hereby grant to the other a non-exclusive limited license to use the intellectual property of the other as needed to perform obligations under this Agreement. When FBS has Town records or data in its possession it shall protect the confidentiality and security of such records and data as required by all applicable federal, state, and local laws. 25. Backups of all Town records are retained in a such manner that all records are fully recoverable.This is achieved using a combination of image copies, incremental backups, differential backups, transaction logs, or other techniques. The frequency of backups is determined by the volatility of data; the retention period for backup copies is determined by the criticality of the data. At a minimum, backup copies are retained for 30 days. At least three versions of Town Records are maintained. One fully recoverable version of all Town records will be stored in a secure, off-site location. An off-site location may be in a secure space in a separate facility. The practice of taking backup media to the personal residence of staff persons is not acceptable. All Town Record information is stored on 4 FBS SERVICE AGREEMENT FOR PARKING ENFORCEMENT MANAGEMENT network file servers to allow for backup. Town Record information located directly on FBS workstations, laptops, or other portable devices should be backed up to networked file server drives. Required backup documentation includes identification of all critical data, programs, documentation, and support items that would be necessary to perform essential tasks during a recovery period. Backup and recovery processes are reviewed and updated regularly to account for new technology, business changes, and migration of applications to alternative platforms. Recovery procedures are tested on an annual basis. 26. FBS represents that it provides an optional payment website service known as "ParkingTicket Assist," located online at www.parkingticketassist.com, which the Town may elect to use to facilitate online electronic credit and debit card payments from defendants during the course of this agreement. ParkingTicket Assist is a web service owned by FBS that is designed to interface with one or more backend card payment processing providers. ParkingTicket Assist works by 1) accepting a ticket number and payment request from a defendant; 2) forwarding payment amount and certain ticket data to the Town's designated card payment processing provider; 3) receiving back confirmation or rejection data from the Town's card payment processing provider. FBS does not collect or store card payment account numbers or other card information and does not serve as the Town's card payment processing provider or as an escrow agent for the Town. FBS merely facilitates online payments by connecting defendants to designated card payment processing providers. FBS will use reasonable efforts to interface ParkingTicket Assist with such other designated card payment processing provider without charging the Town for such FBS efforts, but may not be able to provide full services, such as updates to Town records and automatic case closure, if the payment processing provider is unable or unwilling to provide all necessary data back to ParkingTicket Assist. Moreover, FBS shall not be responsible for any fees or costs quoted or charged by such other designated card payment processing provider to interface its services with ParkingTicket Assist. BY DESIGNATING A CARD PAYMENT SERVICE PROVIDER AND AUTHORIZING FBS TO USE PARKINGTICKET ASSIST TO INTERFACE WITH ITS DESIGNATED CARD PAYMENT PROCESSING PROVIDER, THE TOWN HEREBY AGREES TO HOLD FBS HARMLESS AND INDEMNIFY FBS AGAINST ANY LIABILITY IMPOSED UPON FBS AS A RESULT OF ANY ACTS OF THE TOWN'S DESIGNATED CARD PAYMENT PROCESSING PROVIDER. 27. Ultimately, the Town's insurance carrier labeled it a total loss. The aerial lift truck is critical to the Town Highway Department for the maintenance and repair of the Town's street lights and traffic signals. The Town has identified a replacement vehicle that is available under a New York State purchasing contract at a cost of$104,500.00. As a result of the insurance company's decision, they have provided funds in the amount of $44,000.00 towards the replacement of the vehicle. In order to proceed, the Town would need to fund $60,500.00 for the purchase. The funding required can be transferred from the unreserved surplus in the part town budget fund. Any person violating any provision of this Article shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. § 219-39. School drop off zones. Except within fifteen (15) feet of any fire hydrant, a motor vehicle shall be allowed to stand on the east side of Murray Avenue School, during School Times on School Days, for the sole purpose of discharging and receiving students of the Murray Avenue School. § 219-40. Reserved. ARTICLE IV Paid Parking PART I. PARKING LOTS § 219-41. Definitions and word usage. A. Terms defined. For the purposes of this chapter,the following terms, phrases, words and their derivations shall have the meanings given herein: PARKING LOTS -Any Town-administered off-street space where motor vehicles may be parked for a fee. PERMIT-A permit to park in a specific parking lot PERMIT HOLDER-A person to whom a permit is issued pursuant to this article. §219-42.Applicability. The provisions of this Article shall apply to all persons using any of the parking lots designated in § 219-43. § 219-43. Designation of parking lots Parking lots are designated as follows: A. Lot A(formerly Lot 1)is the parking lot situated at Myrtle Boulevard and Vine Street. B. Lot B (formerly Lot 3)is the parking lot and deck situated at Myrtle Boulevard and North Chatsworth Avenue. C. Lot C (formerly Lot 4) is the parking lot situated on Myrtle Boulevard which is shared with the occupants of 178 Myrtle Boulevard. D. Lot D (formerly Lot 5)is the six parking spaces located off of Myrtle Boulevard,near Madison Avenue. E. Lot E (formerly Lot 6) is the six numbered spaces on Vine Street. F. Lot F(formerly Lot 7)is the employee parking spaces on Maxwell Avenue G. Lot G (formerly Lot 8) is Byron Place near Madison Avenue § 219-44. Fees, days,times and methods of payment. From time to time by resolution or local law,the Town Board shall establish the fee, days, times and methods of payment for permitted use of the parking lots. §219-45. Special permit parking areas. From time to time the Town Administrator, Superintendent of Highways or Chief of Police,may designate certain areas within the parking lots for such parking as the needs of the community may require. §219-46. Permit requirements. No motor vehicle shall be parked in any parking lot unless the Town Clerk shall have issued a permit allowing the motor vehicle to be parked in a particular parking lot and the permit holder shall have attached the insignia to the motor vehicle in accordance with the instructions given to the permit holder by the Town Clerk. § 219-47. Permit application. A. There shall be five types of permits for parking in the parking lots: daytime meter parking permits, daytime non-meter parking permits, overnight parking permits, twenty-four-hour parking permits, and area business parking permits. B. Application for a permit shall be made to the Town Clerk upon such form as prescribed by the Town Clerk. C. Except for semi-annual permits, each permit shall be effective for a twelve month period from the effective date established by the Town Board, or for semi-annual permits shall be effective for a six month period from the effective date set forth by the Town Board. D. The Town Board from time to time by resolution or local law may create such other types of parking permits or create such other rules for parking in the parking lots as it may determine to be necessary. § 219-48. Issuance of permits. A. The Town Clerk may only issue permits to residents of the Town. At the time of application, the applicant must submit proof of such residency in a form satisfactory to the Town Clerk. B. The Town Clerk shall keep a record of the number of each permit issued,the date it is issued, the name and address of the person to whom it is issued, the numbers, words or letters appearing on the license plate of the motor vehicle or vehicles for which the permit is issued and the letter designation of the parking lot for which that permit is issued. The Town Clerk shall maintain a record of all permit fees collected. C. The Town Clerk shall not issue a twenty-four-hour permit to a person if another person in the applicant's household already is the holder of a twenty-four-hour permit. The preceding sentence shall not apply to persons who held permits issued prior to April 17, 2002. Such permits may be renewed even if two or more permit holders are members of the same household. For the purpose of this subsection, the term "household" shall mean one or more persons living together as a single housekeeping unit. D. Each permit shall entitle only the motor vehicle or vehicles listed in the permit application to be parked in the parking lot for which such permit is issued. A daytime meter permit or a daytime non-meter permit shall authorize either one of two motor vehicles to be parked in the parking lot for which such permit is issued, and the insignia associated with that permit shall contain the numbers, words or letters appearing on the license plate of each motor vehicle specified on the permit application. At the permit holder's discretion the insignia can be moved from one motor vehicle to the other at any time; however,under no circumstances can both motor vehicles specified on the permit application be parked at the same time in the same parking lot, except at times when parking in such parking lot is unrestricted. E. The Town Clerk shall revoke a permit if the Town Clerk, acting reasonably, determines that such permit was issued based upon false information or was otherwise issued or used improperly or the insignia is altered. The Town Clerk shall mail written notice of the revocation to the person to whom such permit was issued at the address for such person that appears on the application for the permit being revoked. The revocation shall be effective on the third business day after the notice is mailed. The permit holder shall return the permit to the Town Clerk's Office. The failure to do so shall be a violation of this section. A revoked permit may be reinstated by curing the underlying basis for the revocation and the payment of a fee that is triple the amount of the fee for the permit. §219-49. Attachment of insignia. The Town Clerk, upon issuing a permit, shall issue an insignia to the permit holder and instruct the permit holder where the insignia is required to be placed within the motor vehicle. The type, size and form of the insignia shall be determined from time to time by the Town Clerk;however, the insignia shall bear the permit number assigned, the numbers, words or letters appearing on the license plate of the motor vehicle or vehicles for which the permit is issued, the words "Town of Mamaroneck," the parking lot for which the permit is issued and the expiration date of the permit. §219-50. Renewal or denial of permit. A permit may be renewed if an application to renew is made and the required fee paid no later than a date specified annually by the Town Clerk which date shall be prior to the expiration date of such permit. The Town Clerk may refuse to renew any permit for which the required fee is not paid on or before the last day specified for payment. The Town Clerk shall refuse to issue a permit to any person whose prior usage of any permit has been deemed by the Town Board to be an abuse of the privileges granted by such permit. § 219-51. Transfer of ownership. A. Permits cannot be transferred between permit holders except as provided in §219-48 D. B. Upon the transfer of title of a motor vehicle for which a permit has been issued, the insignia shall be removed and returned to the Town Clerk's Office. Upon proper application and payment of a required fee, a replacement insignia shall be issued for the unexpired term of the original permit. Under no circumstances shall the fee for the unexpired term be refunded. § 219-52. Violation. Any person violating any provision of this Article shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. § 219-53. Reserved. § 219-54. Reserved. PART II. OTHER PAID PARKING. § 219-55. Public highway parking. A. The Town Board designates the following public highways, or portions thereof("Designated Public Highways"), as places where during certain times of the day, payment is required for the right to park a motor vehicle: Both sides of Myrtle Boulevard between North Chatsworth Avenue and Madison Avenue. Both sides of Madison Avenue between Fifth Avenue and Myrtle Boulevard. The eleven parking spaces on Maxwell Avenue, situated closest to Madison Avenue. The eight parking spaces on the south side of Baldwin Avenue beginning at the corner with Myrtle Boulevard. § 219-56. Cost, days,times and method of payment. A. From time to time, by resolution, the Town Board shall establish the exact location, number of spaces, cost for parking, and the time of day, when payment is required for parking on designated public highways. §219-57.Tampering with parking control devices. It shall be unlawful for any person to deface, injure, tamper with, open, willfully break or destroy any device used in connection with the payment for parking on designated public highways, or in designated parking lots. §219-58. Violation. Any person violating any provision of this Article shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. §219-59.Reserved. §219-60. Reserved. Part. III Residential Parking System §219-61. Permit parking on section of Lester Place. A. Definitions. As used in this section, the following terms shall have the meaning indicated: CAREGIVER—A person who either: (1) Provides assistance with the activities of daily living to a Lester Place resident (defined below) whose doctor certifies, in writing, that the Lester Place resident requires such assistance for more than three hours per day, or (2) Cares for a Lester Place resident's child whose parent certifies, in writing, that the applicant for the LP resident parking permit (defined below)takes care of the Lester Place resident's child for more than three hours per day. CONTRACTOR—A person whose motor vehicle displays an insignia indicating that he/she/it is a home improvement contractor licensed by the County of Westchester and who is performing work on a property located on Lester Place either for a Lester Place resident, one of the entities named in section 219-63 (L), or the owner or the managing agent of one of the multi-family buildings on Lester Place. ELIGIBLE PERSON - A Lester Place resident, a caregiver or an entity whose principal owner is a Lester Place resident. LESTER PLACE (LP) RESIDENT-A person who resides on Lester Place. LP RESIDENT PARKING PERMIT - The permit issued by the Town Clerk for a motor vehicle owned or leased by an eligible person that allows that motor vehicle to be parked on that section of Lester Place that lies within the zoning district known as the R-7.5 District. When reference is made to an LP resident parking permit being "issued," that reference includes both the issuance of the original LP Resident Parking permit for a particular motor vehicle and all renewals thereof. PUBLIC PARKING SPACES - Those parking spaces where a motor vehicle can be legally parked on Lester Place, whether or not it has an LP resident parking permit. (B) Fifteen (15)percent of the total number of parking spaces that lie within that section of Lester Place that is situated within the zoning district known as the R-7.5 District shall be public parking spaces. The Superintendent of Highways shall establish the location of the public parking spaces. (C) Except in the parking spaces designated by the Superintendent of Highways pursuant to section 219.61 (B), and except as provided in section 219.63 (L), only a motor vehicle to which an LP resident parking permit has been issued shall be permitted to park on that section of Lester Place that lies within the zoning district known as the R-7.5 District. § 219-62. Permit Parking on Washington Square, New Jefferson Street, a section of North Chatsworth Avenue and the section of Murray Avenue between Myrtle Boulevard and Leafy Lane. A. Definitions. As used in this section, the following terms shall have the meaning indicated: AREA RESIDENT - A person who resides within the WS Residential Area (defined below) or who resides on the section of Myrtle Boulevard that lies between North Chatsworth Avenue and Madison Avenue. A person who is employed by an entity that maintains a place of business on this section of Myrtle Boulevard but who does not reside on this section of Myrtle Boulevard is not an"area resident." CAREGIVER - A person who between the hours of 9:00 a.m. and 2:00 p.m. (prevailing time) either: (1) Provides assistance with the activities of daily living to an area resident whose doctor certifies, in writing, that the area resident requires such assistance for more than three hours per day, or (2) Cares for an area resident's child whose parent certifies, in writing, that the applicant for the WS Resident Parking Permit(defined below)takes care of the area resident's child for more than three hours per day. CONTRACTOR - A person whose motor vehicle displays an insignia indicating that he/she/it is a home improvement contractor licensed by the County of Westchester and who is performing work on a property located within the WS Residential Area (defined below) either for an area resident, or one of the entities named in 219-63(L), or the owner or the managing agent of one of the multifamily buildings within the WS Residential Area. ELIGIBLE PERSON - An area resident or caregiver or an entity whose principal owner is an area resident. WS RESIDENTIAL AREA - Washington Square, New Jefferson Street, the section of North Chatsworth Avenue between Myrtle Boulevard and the northern boundaries of the lots on the opposite side of the public highway improved with the buildings known by the postal addresses of 35 North Chatsworth Avenue and 40 North Chatsworth Avenue and the section of Murray Avenue between Myrtle Boulevard and Leafy Lane. WS RESIDENT PARKING PERMIT - The permit issued by the Town Clerk for a motor vehicle owned or leased by an eligible person that allows that motor vehicle to be parked on a public highway within the WS Residential Area for a period of time longer than motor vehicles not having such a permit are allowed to park on a public highway within the WS Residential Area. When reference is made to a WS resident parking permit being "issued," that reference includes both the issuance of the original WS resident parking permit for a particular motor vehicle and all renewals thereof. § 219-63. Sale and issuance of resident parking permits. A. In this section the term "resident parking permit" shall refer to both LP Resident Parking Permits and WS Resident Parking Permits. B. The Town Clerk shall keep a record of the number of each resident parking permit issued,the date it is issued, the name and address of the person to whom it is issued and the numbers, words or letters appearing on the license plate of the motor vehicle for which a resident parking permit is issued.The Town Clerk shall maintain a record of all permit fees collected. The Town Clerk shall not issue a resident parking permit for a motor vehicle: (1) Unless the owner or lessee of that motor vehicle demonstrates to the satisfaction of the Town Clerk, acting reasonably, that such owner or lessee is an eligible person; (2) For which the Town Clerk has issued a parking permit that allows that motor vehicle to be parked in any of the Town's parking lots; or (3) That has or is required to have a commercial license plate. C. The Town Clerk shall not issue a resident parking permit for any motor vehicle which has three or more outstanding and unpaid parking violations against it for parking violations that occurred within the unincorporated Town of Mamaroneck. D. The Town Clerk shall collect the amount shown in § A250-1A for each resident parking permit and shall be valid until the last day of September in the first September after the permit is issued. E. The fees collected from the sale of resident parking permits and replacement resident parking permits shall be credited to the General Fund Part Town. F. The Town Clerk shall revoke a resident parking permit if the Town Clerk, acting reasonably, determines that such permit was issued based upon false information or was otherwise issued or used improperly or the insignia was wrongfully altered. The Town Clerk also shall revoke a permit if, after such permit is issued, the number of outstanding and unpaid parking violations against a motor vehicle for which such permit had been issued for parking violations that occurred within the unincorporated Town of Mamaroneck reaches three or more. The Town Clerk shall mail written notice of the revocation to the person to whom such permit was issued at the address for such person that appears on the application for the resident parking permit being revoked. The revocation shall be effective on the third business day after the notice is mailed. The eligible person shall remove a revoked resident parking permit from the motor vehicle and return it to the Town Clerk's Office. The failure to do so shall be a violation of this section. A revoked resident parking permit may be reinstated by curing the underlying basis for the revocation and the payment of a fee that is triple the amount of the fee for a resident parking permit, except where WS resident parking permit has been issued other than April, May,June, July or August as shown in §A250-1A. G. The insignia for a resident parking permit shall be affixed at such location(s) on the motor vehicle as the Town Clerk may determine. An eligible person's failure to affix a resident parking permit in the location determined by the Town Clerk shall be a violation of this section. H. An eligible person shall be guilty of violating this section if the resident parking permit insignia issued to the motor vehicle owned or leased by the eligible person is affixed to another motor vehicle. Resident parking permits are not transferable. If title to a motor vehicle to which a resident parking permit has been issued is transferred or if such motor vehicle is returned to the company from which it was leased, the permit for that motor vehicle no longer shall be valid and the eligible person shall remove the resident parking insignia from the motor vehicle and destroy it. The failure to do so shall be a violation of this section. J. If an eligible person replaces a motor vehicle to which a resident parking permit had been issued with another motor vehicle that he/she owns or leases, the Town Clerk shall issue a replacement resident parking insignia; provided that on the date that the replacement resident parking permit is issued, the motor vehicle is eligible for a resident parking permit. A replacement resident parking permit shall expire on the same day as the day on which the resident parking permit that it is replacing would have expired if that permit were not replaced. The Town Clerk shall collect the amount established by §A250-1A for each replacement resident parking permit issued. K. An eligible person shall remove the resident parking permit insignia from the motor vehicle owned or leased by the person immediately if that person ceases to be an eligible person. The failure to do so shall be a violation of this section. L. This section shall not apply to motor vehicles registered pursuant to § 404-a of the New York Vehicle and Traffic Law or to motor vehicles owned or operated by public utility companies, the United States of America, the State of New York, the County of Westchester, the Unincorporated Town of Mamaroneck, the Mamaroneck Union Free School District,the Village of Larchmont,Village of Mamaroneck or Contractors. M. It shall be a violation of this section for a person to supply false information in connection with an application for a resident parking permit or a replacement resident parking permit. Such a violation shall be punishable by a fine of not less than $300 and not more than$500. For the twenty-four-month period following the date on which a person is convicted of supplying false information in connection with an application for a resident parking permit, the Town Clerk shall not issue such a permit for any motor vehicle owned or leased by that person. §219-64. Violation. Any person violating any provision of this Article other than section 219-63 (M) shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. 219-65.Reserved. 219-66. Reserved. ARTICLE V Accessible Parking § 219-67. Spaces designated. A. Accessible parking spaces shall be created and suitably marked in the following locations: Name of Public Side Location Highway Copley Road North Located one hundred(100) feet from Alden Road. Daymon Terrace West In front of the Daymon Terrace entrance to the Murray Avenue School Murray Avenue West In front of 14 North Chatsworth Avenue, two-hundred forty five(245) feet north of Myrtle Boulevard Myrtle Boulevard West In front of 172 Myrtle Boulevard,two- hundred and twenty(220) feet southwest from North Chatsworth Avenue North Chatsworth North In front of 16 North Chatsworth Avenue, Avenue two-hundred and sixty(260) feet northwest of Myrtle Boulevard North Chatsworth South In front of 21 North Chatsworth Avenue, Avenue two-hundred and sixty(260) feet northwest of Myrtle Boulevard Washington Square West In front of 1 Washington Square,two- hundred(200) feet southwest from North Chatsworth Avenue Washington Square West Twenty five(25) feet from North Chatsworth Avenue Washington Square East Twenty five(25) feet north of entrance to 2 Washington Square B. Accessible parking spaces shall be created and suitably marked in Parking Lot B. C. No motor vehicle shall park in any accessible parking space on the public highway or in any Town Parking Lot without an accessible parking permit. §219-68. Violation. Any person violating any provision of this Article shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. §219-69.Reserved. § 219-70. Reserved. ARTICLE VI Towing of Motor Vehicles Part I— Removal and Storage of Motor Vehicles §219-71. Authority to tow and impound vehicles. A. In addition to any other penalties or fines imposed for the violation of any law, rule or regulation, this article shall apply to motor vehicles parked in any fire safety zone designated in section 108-2, or which(1) either violate any provision of any municipal, state or county ordinance, law,rule or regulation or have three or more outstanding and unpaid parking violations issued against them for parking violations that occurred in the Unincorporated Town of Mamaroneck, and (2)are located: (i)on any property owned by, leased by or in the possession and control of the Town, or (ii) on any public highway or private road located in the Unincorporated Town of Mamaroneck whether or not open to public travel, paved or unpaved, or (iii) in any public parking lot located in the Unincorporated Town of Mamaroneck, or (iv)in any parking area of an office building, office building complex,place of public assembly, shopping center,private apartment house complex,private condominium complex or cooperative apartment complex located in the Unincorporated Town of Mamaroneck whose owner or the person in general charge of the operation and control of such area has made a written request to the Town pursuant to New York Vehicle and Traffic Law § 1660-a. B. For the purpose of this article, "outstanding and unpaid parking violations" do not include parking tickets which,by their terms, are not yet required to be paid or parking tickets which are outstanding and unpaid because the owner or lessee of the motor vehicle has pleaded "not guilty" to such ticket and there has not yet been an adjudication of such ticket. §219-72.Removal of motor vehicles. A. A Police Officer is authorized to provide for the removal of any motor vehicle meeting the description contained in section 219-71 to an impound yard or storage facility maintained by a company or individual with which the Town has entered into a contract to tow, impound or store motor vehicles. B. If the removed motor vehicle is registered with the State of New York,the Police Department shall advise the owner of the place where the motor vehicle may be recovered and the conditions under which it will be released by sending a certified letter with such advice to the motor vehicle's registered owner or lessee, at the address shown for him,her or it on the records of the New York State Department of Motor Vehicles. Such letter shall be mailed no later than the first business day after a motor vehicle has been removed. If the removed motor vehicle is not registered with the State of New York, the Police Department shall use its best efforts to advise the owner of the place where the motor vehicle may be recovered and the conditions under which it will be released. The Police Department's failure to comply with this section shall not entitle the owner or the lessee to recover the removed motor vehicle without paying the amounts required to be paid pursuant to § 219-74. § 219-73. Identification required. No removed motor vehicle shall be released to anyone other than its registered owner, that owner's representative or the motor vehicle's lessee. Such person must establish his or her identity and, in the case of a person other than the registered owner or lessee, must establish that he or she has the registered owner's or the motor vehicle's lessee's permission to take possession of such motor vehicle. No removed motor vehicle shall be released unless the person to whom it is released has signed a receipt therefor. §219-74.Amounts to be paid before release of motor vehicle. Before a removed motor vehicle is released, proof that the following items have been paid in full must be exhibited to the person in charge of the impound yard or storage facility to which the motor vehicle was removed: A. all sums due to the Town for any outstanding and unpaid violations of this Chapter or the NY State Vehicle&Traffic Law that occurred within the Unincorporated Town of Mamaroneck, including penalties and interest, if any; and B. the cost of towing; and C. the cost of storage for each day or portion of a day that such motor vehicle is so stored; and D. the fine established in §219-88. §219-75. Penalties for offenses. The owner or lessee of a motor vehicle removed pursuant to this article shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. That fine shall be in addition to the amounts required to be paid pursuant to §219-74 A., B., and C. §219-76. Reserved. §219-77. Reserved. Part II Contracts with Towing Companies §219-78. Contracts with towing companies. A. The Town Administrator is authorized to enter into contracts on behalf of the Town with one or more companies to tow, impound and store any motor vehicle which (i) is parked where or during times when stopping, standing or parking is prohibited in the parking lots owned by the Town or on a public highway, or (ii) is parked in a parking lot owned by the Town or on a public highway during a storm, flood, fire or other public emergency if the Police Department or the Highway Department determines that it is in the Town's best interest to remove such motor vehicle, or (iii) is parked unattended in a parking lot owned by the Town or on a public highway if the Police Department or the Highway Department determines that such motor vehicle constitutes an obstruction to traffic, or (iv) satisfies the elements of§ 219-71 B. Each such contract shall specify that the company performing the service shall charge the owner or the lessee of a motor vehicle a reasonable amount for towing, impounding and storing that motor vehicle. The Town shall not be liable to the company for payment of any fees whatsoever. It is not mandatory that such contracts provide for the company to pay a fee to the Town; however, at the Town Administrator's discretion,he/she may request proposals for such contracts that would require each company that submits a proposal to designate, either by a fixed sum or by a percentage of revenue collected, the amount that it would pay to the Town during the term of such contract. C. Each company which enters into a contract with the Town to tow, impound and store motor vehicles shall supply proof satisfactory to the Town Administrator that the company is insured against personal injury and for property damage in an amount per occurrence that is satisfactory to the Town Administrator and that it possesses all of the licenses required to tow, impound and store motor vehicles. Unless waived by the Town Administrator, each such insurance policy shall provide that the Town is an "additional insured"under that policy. On or before the expiration or termination date of any insurance policy or license which a company is required to maintain pursuant to this section, that company will supply the Town Administrator with proof that such insurance policy has been renewed or replaced by an insurance policy which is satisfactory to the Town Administrator and that such license(s)have been renewed. From time to time the Town Administrator may request each such company to produce proof that the required insurance policy and/or licenses are in full force and effect and that the Town is an "additional insured" on the insurance policy. D. Each company which enters into a contract with the Town to tow, impound and store motor vehicles shall act in accordance with all applicable laws,rules and regulations concerning the towing, impounding and storage of motor vehicles. § 219-79. Reserved. §219-80. Reserved. ARTICLE VII Snow Emergencies §219-81. Snow emergency public highways A. The Town Supervisor, or whoever may be acting in his or her absence is authorized to declare a snow emergency. B. The following public highways are snow emergency public highways upon which there will be no parking at any time during a declared snow emergency. Avon Road Boston Post Road Fenimore Road Fifth Avenue Forest Avenue Griffen Avenue Madison Avenue Murray Avenue Myrtle Boulevard North Chatsworth Avenue Old White Plains Road Palmer Avenue Richbell Road Rockingstone Avenue Rockland Avenue Weaver Street C. Any motor vehicle parked on a designated snow emergency public highway during a snow emergency is subject to being towed. § 219-82. Violation. Any person violating any provision of this Article shall be guilty of a violation and shall be subject to the fine for such violation contained in section 219-88. § 219-83. Reserved. § 219-84. Reserved. ARTICLE VIII Miscellaneous Provisions § 219-85. Reserved. §219-86. Reserved. ARTICLE IX Enforcement and Fines §219-87. Enforcement. A. Every Police Officer, Code Enforcement Officer and Parking Enforcement Officer shall have the authority to enforce the provisions of this chapter. The Town Board hereby is authorized to delegate to persons other than officers named in this section the authority to enforce the provisions of this chapter. B. Any person violating any provision of this chapter other than those set forth in 219-88, shall be deemed guilty of a violation and, upon conviction thereof, shall be fined in an amount not to exceed $25.00. The above fines must be paid no later than 30 days from the date on which the summons or appearance ticket is issued("Issuance Date"). C. The amount of the fine, if paid more than 30 days after the Issuance Date, shall be: (1) double the amount of the fine, if payment is made after the 30th day, but before 61' day, after the Issuance Date. (2) double the amount of the fine computed pursuant to section 219-88 C. (1) if payment is made on or after the 61St day,but before 91St day after the Issuance Date. (3) double the amount of the fine computed pursuant to section 219-88 C. (2) if payment is made on or after the 91St day after the Issuance Date. Section 8—Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions.
