The County of Westchester has decided that they will establish a charitable trust and accept donations. We have met with the County and the highlights of their plan are as follows: • The County will with their own personnel and computer software accept any donations received. • The County will issue and execute the acknowledgement for receipt of the donation for distribution to those taxpayers that make donations. • Taxpayers will bring to their local tax collector the signed acknowledgement of the donation from the County and will then be expected to pay the balance of the County tax bill. • The County has expressed a willingness to consider reimbursing the Towns and Cities that will be issuing the tax credit for expenses associated with the program. At this point it is not possible to predict the number of Town residents that will avail themselves of the County donation program so it is unclear what our expenses will be. However we will need to make provisions to accept the acknowledgement and issue a balance bill for the remaining tax owed. The Mamaroneck School District has not yet made a decision on whether to participate in the program. Their legal counsel has indicated that the acknowledgement form which states that "No goods or services were provided in exchange for this donation" cannot be altered since it is a State form. Also the School has been advised that they cannot delegate the collection of the donations to the Town. The School must establish its own collection procedure. I am meeting with the School this coming Monday and will expect to have more information available at our Wednesday work session. In terms of participation in the program the Villages of Rye Brook and Scarsdale did adopt the resolution and local law to participate. The Village of Rye Brook had six taxpayers participate in the program. I am awaiting word from Scarsdale on the level of participation by their taxpayers. The Villages of Larchmont and Mamaroneck have for the moment opted not to participate in the program. Finally the State of New York has put together a website on the program. TE Charitable Contributions Frequently Asked Questions General Information When does the law take effect? The law took effect when signed by the Governor in April 2018. Local governments and school districts are currently authorized to establish charitable funds. Has the IRS indicated whether contributions to local charitable funds will be deductible for federal tax purposes? On May 23, 2018, the IRS issued a Notice announcing its plans to propose regulations that will address the federal tax treatment of certain contributions to state and local governments. No regulations or guidance have been issued to date. As always, taxpayers should be advised to consult a qualified tax advisor regarding their personal situation. Can local governments and school districts make changes to the Acknowledgment of Contribution and Credit Claim forms that the Department of Taxation and Finance has provided? If one unit of local government sets up a charitable fund, can contributions to those funds generate tax credits that can be applied against property taxes owed to other units of government? For example, if a town sets up a charitable fund, will contributions to that fund provide tax credits that can be applied against school, village, or county taxes? Each school district and unit of local government must decide for itself whether to establish a charitable fund and whether to offer a tax credit for contributions to that fund. Those tax credits are specific to that locality and cannot be applied to taxes levied by other jurisdictions. Can special districts such as fire districts set up a local charitable fund program under the statute? No. The statute authorizes the governing boards of counties, cities (including New York City), towns, villages, and school districts to establish a charitable gifts reserve fund to receive unrestricted charitable monetary contributions. Can a local government or school district create a new 501(c)(3) or designate an existing 501(c)(3) to receive contributions that qualify for tax credits? No. The governing boards of counties, cities (including New York City), towns, villages, and school districts are authorized to establish a charitable gifts reserve fund to receive unrestricted charitable monetary contributions. This authority is granted in section 6-t of the General Municipal Law (counties and New York City), section 6-u of the General Municipal Law (all other cities, towns, and villages), and subdivision 44 of section 1604, subdivision 12-b of section 1709, and subdivision 54 of section 2590-h of the Education Law (school districts). This is a fund of the government itself, and the monies in this fund are to be deposited and secured like other local government or school district funds, pursuant to section 10 of the General Municipal Law (see Guidance at page 3). Therefore, contributions received by this public governmental fund need to be received by the local government or school district itself, not a newly created or designated 501(c)(3). The governing board of the local government or school district must designate a local official, such as the Chief Fiscal Officer or Finance Director, to serve as the fund's administrator. The Administrator is authorized to appoint agents to act on the Administrator's behalf for purposes of administering the charitable fund. Can contributions be made in the form of real property? No. Contributions must be monetary. Can contributors direct that their contributions be used for specific purposes? No. Contributions must be unrestricted for use by school districts and local governments for public educational and charitable purposes, respectively. How should local governments and school districts account for the charitable gift reserve funds on their books? The Office of the State Comptroller will establish appropriate account codes. We are considering the creation of a single charitable fund to cover a number of local governments. Would this be permitted, and, if so, would this constitute as a shared services activity under the recently enacted County Wide Shared Services law that would qualify for state matching funds? Local governments and school districts are required to establish their own individual charitable funds; a single fund for multiple local governments or school districts is not permitted. However, to the extent that net savings can be demonstrated by sharing services related to the fund (e.g., two towns sharing a fiscal officer that manages both towns' finances, including the separate charitable funds), matching funds could be available, consistent with the other requirements of the County-Wide Shared Services Initiative. A taxpayer who wishes to claim a credit for contributions to a local charitable fund should present a completed credit claim form to the tax collector for that locality, together with a copy of the acknowledgement form for that donation. Can a local government and school districts take measures to ensure that property tax credits are not fraudulently claimed? Yes. Local governments and school districts can take steps to ensure that credit claims are legitimate by, for example, providing for information sharing between fund administrators and tax collectors. The guidance states that donations must be received in the 12-month period prior to the last day prescribed by law that taxes may be paid without interest or penalties to be eligible for a tax credit in that year. What if taxes are paid in installments? Taxpayers who have made donations in the 12-month period prior to the last day prescribed for paying the first tax installment without interest or penalties can claim a tax credit based on that donation. The credit will be applied to the first installment and any excess credit will be applied to the subsequent installments until the credit is exhausted. Contributions made after the last day prescribed for paying the first tax installment without interest or penalties will not be able to claim a tax credit based on that donation until the following year. Will tax collectors be able to certify tax warrants when many of their receipts have come in the form of credit claims? For purposes of certifying the warrant, each credit should be treated as if the recipient of the credit had paid cash in the amount of the credit. The amount of taxes remaining to be collected for the corresponding county, city, town, village or school district should be reduced accordingly. To the extent the Real Property Tax Law normally requires property tax payments to be applied to satisfy the warrant in a specific order (e.g., first to town taxes and then any "residue" goes to the county; see§ RPTL 904(2); see a/so Town Law §§ 35 and 37), the charitable credit statute would take precedence over that requirement. That is because it specifically states that "the owner or owners of real property shall be allowed a credit against the real property taxes of a participating municipal corporation that have been imposed upon such property" (RPTL § 980-a(1)(b). Taxpayers who make charitable contributions entitling them to real property tax credits but nonetheless pay their taxes in full (without taking into account the value of the credit) may present the acknowledgment form and the credit claim form to the local government/school district chief fiscal officer/chief financial officer or their designee to receive a refund of property taxes in the amount of the credit. This refund mechanism would be available to taxpayers who pay their taxes through an escrow account with a bank. The Department of Financial Services, in consultation with the Department of Taxation and Finance, will promulgate regulations related to mortgage escrow accounts. If a taxpayer makes a large donation in one year, can the tax credit associated with that donation be used to offset multiple years of property taxes? No. A donation must be received in the 12-month period prior to the last day prescribed by law that taxes may be paid without interest or penalties in order to be eligible for a tax credit in a given year. Do tax collecting officers have to accept these tax credits as payment? Yes. If a local government or school district has opted to provide a tax credit, the tax collecting officer that collects that local government's or school district's taxes must accept the credit as payment. Attached is the memorandum that lists the proposed improvements. The Committee approved all of the recommendations but did add a proposal to amend the current school zone regulation. The Committee proposed that the school zone regulation be amended as follows: • The school zone speed limit would remain at 20mph • The school zone regulation would be in effect from 7:OOam-6:OOpm school days between September 1 and June 30. The change in the school zone regulation will require legislation to be considered by the Town Board at a future meeting and will require a public hearing. Other recommendations will be implemented by the Highway Department over the summer in preparation for the new school year beginning this September. With regard to the speed radar sign, provisions were made in the 2018 Town Traffic Control budget to purchase this type of sign. Stephen V. Sincerely, 267.—}4"7— Nancy Seligson 14 North Chatsworth Avenue Larchmont, New York 10538 June 25, 2018 RECEIVED Town Board Town of Mamaroneck 740 West Boston Post Road JUN 2 $ 2018 Mamaroneck, New York 10543 Attention: Supervisor Nancy Seligson TOWN OF MAMARONECK SUPERVISOR'S OFFICE Re: Washington Square parking Dear Ms. Seligson: Despite the residential parking ordinance, parking for residents of the Washington Square neighborhood continues to be very challenging, however I just learned of one of the reasons why and I believe it is fixable. Despite the ordinance, I still see commuters walking from Murray Avenue to the train in the morning. In the evening I see them get into their cars and drive away, which is just what was happening before the parking ordinance was passed. Granted, there are fewer people doing that now, but when I see commuters drive away from Murray Avenue, it appears they have not been ticketed. This week I discovered the reason. Evidently, there are numerous residents of Washington Square whose children live nearby and commute to the city from Larchmont Station by registering their station cars in their parents' names. With permits based on their parents' Washington Square addresses, they park here all day without being ticketed. This is currently legal but it defeats the purpose of the ordinance. I heard this from a Washington Square resident who is doing it for his son who lives in New Rochelle and commutes to Manhattan. I also learned that New Jefferson Street is a favorite parking area for New Rochelle residents. The man who told me this (who shall remain nameless) did not know my name but was just trying to be helpful in the event that I wanted to do this for a family member. (He had gotten the idea from friends who are doing it, too.) It is unlikely that he would have shared this information with me if he knew that I would share it with the Town Board. However, this conversation also explained to me why some Washington Square residents were such vocal critics of the proposed ordinance at the public hearings. While reciting concerns about caregivers and contractors, many were actually protecting their children's ability to park in Washington Square and commute from Larchmont Station without buying a station permit. I imagine that the Town Board is just as weary of the Washington Square parking problems as I am, but this neighborhood is not fixed yet. Our streets will always be a commuter magnet and, as I discovered this week, the wording of the Re: Washington Square Parking June 25,2018 Page 2 of 2/ current parking ordinance creates a loophole that is just too tempting for a neighborhood full of seniors who want to help their children. However, if the ordinance were amended to require that the Washington Square resident applying for the permit must certify that the permit is not being obtained to facilitate a non- resident commuter to park in Washington Square, the number of parking spaces available to residents would substantially increase. As I mentioned in my recent letter about Old Jefferson Street, adding even a dozen parking spaces in this neighborhood is very meaningful. Tonight when I arrived home from work, there was no parking space for me on Murray but all I had to do was wait for the next train. Please give this suggestion serious consideration. We need all the help we can get. In order to pay the expenses of the tournament, funds are transferred from the trust fund into the operating budget of the ice rink. To improve upon this situation and offer greater security for the building, the plan is to install an intercom system at the main entrance that would permit the tenants and Town Departments to let clients and visitors enter the building during off hours. The system as designed would be used initially by LMCTV, the Law Offices on the third floor, Southeast Consortium, the Town's IT Office and the Recreation Department. We can also expand the system to other departments if necessary. The system incorporates a video component that will allow the user to speak to the visitor but also see the person seeking access to the building. This system will be integrated into the Town's card reader access system. The cost of the system including necessary electric work is $18,350. Funding for the system is available from the Town's General Fund unexpended balance. We discovered that there were significant encroachments onto the Conservation area including two patios, stonewalls and a small fish pond. All of our conservation areas are dedicated parkland and the Town wherever possible looks to remove any and all encroachments when discovered. Therefore we entered into discussions with the property owner to remedy the encroachments from 11 West Drive. The encroachments that were discovered pre-date the current property owner. Attached is a proposed easement agreement between the Town and the owner of 11 West Drive. If you again look at Exhibit A, the property owner is required under the agreement to remove all of the encroachments except the patio and pathway that are highlighted in yellow. Since this patio was so close to the house and the pathway is partially on the private property we thought it reasonable to allow it to remain. All removal expenses for the other encroachments will be borne by the property owner. The work to remove the encroachments is significant since it will require some construction equipment for the removal of the patio and the wall. In addition, on the patio that will remain in place the property owner may not construct any permanent fixture onto the patio. The property owner may place chairs, grills and other portable items on the patio. REQUESTED ACTION: THAT THE TOWN BOARD APPROVE THE EASEMENT BETWEEN THE TOWN OF MAMARONECK AND MR. This Easement shall run with the land and shall be binding upon the Grantor and the Grantee, and in the case of the Grantor,its successors or assigns and in the case of the Grantee,his distributees,legatees,devisees,executors,administrators,successors,and assigns. The Grantee hereby agrees to remove at his sole cost and expense all improvements from the Town Property,other than the aforementioned Patio.The improvements to be removed include the koi pond and the pipes that supply water to it or discharge water from it,the patio adjacent to the koi pond and the walkway leading to it, the stone wall, all lighting and electrical installations and the pipes and the irrigation system on the Town property. 6. a. Equipment used for removal of these improvements must access the area of work(the "Restoration Area")via the Property. No equipment may access the Restoration Area via the Town Property;and b. All sod and fill shall be removed from the Town Property and a native plant seed mix shall be planted in the disturbed areas to the reasonable satisfaction of the Town of Mamaroneck Environmental Planner. 7. Ownership of the Town Property remains and will in perpetuity remain in all respects vested in the Grantor,its successors and assigns. 8. Based upon the placement of the existing no parking sign near Lafayette Road, it would appear there was sufficient space for one car to park between the sign and the corner of Lafayette Road and North Chatsworth Avenue. Cars parked at this location do present a visual obstruction and a potentially dangerous condition due to the slight curve on North Chatsworth Avenue near Lafayette Road. Our first action on this matter was to determine whether or not the sign had been misplaced when initially installed. We discovered, however, there was no evidence in our records of any no parking restriction ever having been adopted by the Board. Therefore, to correct the problem, the suggestion is to set a public hearing to adopt a no parking ordinance on the west side of North Chatsworth Avenue from Lafayette Road to the entry driveway of North Chatsworth Avenue. Attached is a copy of the proposal of the law. I have spoken with the Chairman of the Traffic Committee, and since this matter was discussed at the Traffic Committee Meeting, no further review by the Committee is necessary. ACTION REQUESTED: THAT THE TOWN BOARD SET A PUBLIC HEARING FOR AUGUST 22, 2018 TO CONSIDER A PARKING RESTRICTION ON NORTH CHATSWORTH AVENUE. Stephen V. Altieri Town Administrator Local Law No. -2018 This local law shall be known as the "Restriction on Parking on the Portion of the West Side of North Chatsworth Avenue from Lafayette Road to the Driveway Entrance to 35 North Chatsworth Avenue" Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1-Purpose: The parking of automobiles on the west side of North Chatsworth Avenue from the corner formed by the intersection of the west side of North Chatsworth Avenue and the south side of Lafayette Road to the driveway entrance to 35 North Chatsworth Avenue creates visual obstructions for automobiles. Preventing parking along this length of the west side of North Chatsworth Avenue will improve safety for automobiles and pedestrians. Section 2-Restriction on Parking on a Portion of the West Side of North Chatsworth Avenue from its Intersection with Lafayette Road to the Driveway Entrance to 35 North Chatsworth Avenue No motor vehicle shall be parked on the west side of North Chatsworth Avenue from the corner formed by the intersection of the west side of North Chatsworth Avenue and the south side of Lafayette Road to the driveway entrance to 35 North Chatsworth Avenue. Section 3-Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on the surface of North Chatsworth Avenue indicating where and when parking is prohibited by this law. Section 4-Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Mr. DiBuono has been employed as a sworn Police Officer for the City of New York Police Department since 2014. Mr. DiBuono will be hired as a resignation reinstatement and therefore will not be required to attend the academy for this position.
