The method for doing this is to have the Assessor's office regularly conduct a systematic review of the individual neighborhoods established in the Town. Sales volume along with sales values in each neighborhood are evaluated to develop an aggregate ratio to determine our relative proximity to market value. It is at about this time of the year when our process for assessment review would begin. So we would like to review with the Town Board the data accumulated between 1-1-16 and 12-31-17. Attached is a chart prepared by the Assessor that identifies each of the neighborhoods and activity in each neighborhood. The second to last column on the right lists the ratio of assessment to market value. With two exceptions the ratios for each neighborhood are at 99% or 100% of market value. This is an indicator that our annual review is effective. The information also tells us that as we go into the 2018 review that it is likely that additional adjustments in will be minimal except for properties that have experienced inventory changes or renovations. I have asked the Assessor to join us at the work session to discuss the findings further. Stephen V. The first step in the process is for those communities interested in re-joining the consortium to execute the Urban County Cooperation Agreement. Attached is a copy of the proposed agreement. We would like to have an initial discussion on the agreement at the May 2 Work Session to determine whether the Town should move forward to re-join the consortium. If the Town decides to move forward the executed agreements are due back to the County by June 1, 2018. Stephen V. Altieri Town Administrator URBAN COUNTY COOPERATION AGREEMENT— FY 2019 - 2021 This Cooperation Agreement entered into this (1) day of (2) , 20 (3) , between the County of Westchester (the "County") and (4) (the "Cooperating Municipality") WITNESSETH: WHEREAS, the County may qualify as an applicant under Title I of the Housing and Community Development Act of 1974, as amended, (the "Act") by entering into cooperation agreements with municipalities having a combined population of at least two hundred thousand which agree to undertake essential community development and housing assistance activities pursuant to the Act: and WHEREAS, on (5) , 20 (6) , the governing body of the Cooperating Municipality adopted Resolution # (7) authorizing the execution of a Cooperation Agreement for the purposes specified herein; and WHEREAS, on , the Board of Legislators of Westchester County adopted Resolution # , authorizing the execution of a Cooperation Agreement for the purposes specified herein; and WHEREAS, this Agreement covers the Community Development Block Grant ("CDBG") Entitlement Program, the HOME ("HOME") Investment Partnership Program, and the Emergency Solutions Grant ("ESG") Program (collectively the "Grants") authorized under Title II of the National Affordable Housing Act of 1990 as amended; and NOW, THEREFORE, IT IS AGREED BETWEEN THE COUNTY AND THE COOPERATING MUNICIPALITY AS FOLLOWS: 1. The County and the Cooperating Municipality will cooperate in developing a Community Development Program and application for Grants which will be designed primarily for the purpose of meeting the priority needs and objectives of the participating localities based upon an inventory of housing and community development needs developed mutually by local and County officials, and the County will have the authority to carry out activities which will be funded from annual Grants for Federal Fiscal Years 2019 - 2021 appropriations and from incomes generated from the expenditure of such funds, including such additional time as may be required for the expenditure of such funds granted by the County to the Cooperating Municipality. 2. The County and Cooperating Municipality will cooperate to undertake or assist in undertaking, community renewal and lower income housing assistance activities. 3. Nothing contained in this Agreement shall be construed as permitting either party to veto or otherwise obstruct the implementation of the approved Consolidated Plan during the period covered by this Agreement. The County has final responsibility for selecting activities and annually filing the Consolidated Plan - Action Plan to the United States Department of Housing and Urban Development (" HUD".) 4. If any application for housing assistance payments by private developers is referred to the County for review and comment, the County will immediately refer such application to the Chief Executive Officer of the affected participating municipality for review. If the local Chief Executive Officer finds that such proposal is not consistent with the portions of the Urban County Consolidated Plan pertinent to his locality, he shall inform the County Executive thereof. 5. Pursuant to 24 CFR 570.501(b), the Cooperating Municipality is subject to the same requirements applicable to subrecipients, including the requirement of a written agreement set forth in CFR 570.503. Urban County Cooperation Agreement Page 2 6. The County and Cooperating Municipality will take all required action to comply with the provisions of Title VI of the Civil Rights Act of 1964, the Fair Housing Act of 1968 and the Americans with Disabilities Act of 1990 to assure compliance with the certification required by Section 104(b) and 109 of Title I of the Housing and Community Development Act of 1974 as amended, which incorporates Section 504 of the Rehabilitation Act of 1973 and the Age Discrimination Act of 1975, and other applicable laws (the "Acts"). Accordingly, the Cooperating Municipality agrees to do what is necessary, as determined by the County, to comply with each of the above referenced Acts, the rules and regulations thereunder, and the undertakings and assurances in the application form insofar as they relate to the activities and programs conducted by the Cooperating Municipality pursuant to said Grants. Further, the County is prohibited from expending Urban County funding for activities in or in support of any local government that does not affirmatively further fair housing within its own jurisdiction or that impedes the County's action to comply with its fair housing certifications. In addition, the Cooperating Municipality agrees to indemnify and hold the County harmless against all losses, damages, penalties, settlements, costs, charges, fees, and other expenses or liabilities relating to or arising out of the failure of the Cooperating Municipality to comply with the Acts, the rules and regulations thereunder, and the undertakings and assurances in said application form. 7. The County of Westchester is authorized to enter into contracts and do whatever else may be necessary to receive and expend the Grants and to employ such personnel for such purpose as may be necessary. 8. The Cooperating Municipality will inform the County of any income generated by the expenditure of CDBG funds. Any such program income must be paid to the County or may be retained by the Cooperating Municipality subject to contractual agreement, with approval of the County. Any program income retained by the Cooperating Municipality may only be used for eligible activities in accordance with all the Grants requirements, as may apply. 9. The County has the responsibility for monitoring and reporting to HUD on the use of such program income, therefore requiring appropriate recordkeeping and reporting by the Cooperating Municipality as may be needed for the purpose. 10. In the event of closeout or change in the status of the Cooperating Municipality, any program income that is on hand or received subsequent to the closeout or change in status shall be paid to the County. 11. With regards to the acquisition or improvement of real property acquired or improved, in whole or in part, with CDBG or HOME funds, the Cooperating Municipality will notify the County of any modification or change in the use of the real property from that planned at the time of acquisition or improvement needing disposition. 12. The Cooperating Municipality will reimburse the County in an amount equal to the current fair market value (less any portion thereof attributable to expenditure of non-CDBG funds) of property acquired or improved with CDBG or HOME funds that is sold or transferred for a use which does not qualify under the Grants' regulations; and 13. Program income created from the disposition or transfer of property acquired in whole or in part with CDBG or HOME funds prior to or subsequent to the closeout, change of status, or termination of the Cooperation Agreement between the County and the Cooperating Municipality shall be paid to the County. 14. The Cooperating Municipality has adopted and is enforcing: I. A policy prohibiting the use of excessive force by law enforcement agencies within its jurisdiction against any individuals engaged in non-violent civil rights demonstrations; and II. A policy of enforcing applicable state and local laws against physically barring entrance to or exit from a facility or location which is the subject of such non-violent civil rights demonstrations within its jurisdiction. 15. If the Cooperating Municipality accepts any Grants through the County, the Cooperating Municipality agrees to abide by the County's Discretionary Funding Policy, as adopted in January 2012. By executing this Agreement, the Cooperating Municipality may not (a) apply for grants under the small cities or State CDBG programs for appropriations for the fiscal years covered by the Agreement; or(b) participate in a HOME Consortium except through the Urban County, regardless of whether the Urban County receives a HOME formula allocation. This does not preclude the County or Cooperation Municipality from applying to the State for ESG funds, if the state allows. 17. The Cooperating Municipality may not sell, trade, or otherwise transfer all or any portion of the Grants to another such metropolitan city, urban county, unit of general local government, or Indian tribe, or insular area that directly or indirectly received CDBG funds in exchange for any other funds, credits or non-Federal considerations, but must use such funds for activities eligible under Title I of the Act. 18. This Agreement shall remain in full force and effect during the three program years covered by each three-year application and until the Grants and income received with respect to the three year qualification period are expended and the funded activities completed, Fiscal Year 2019 - 2021, provided such application is approved by HUD and provided it is not otherwise terminated pursuant to the requirements of eligibility under federal law. If the application is not approved by HUD, this Agreement shall automatically terminate. Neither the County nor the Cooperating Municipality may terminate or withdraw from this Agreement while it remains in effect. 19. This Agreement will be automatically renewed for participation in successive three year qualification periods, unless the County or the Municipality provides written notice that it elects not to participate in a new qualification period. With respect to automatic renewal periods, the County shall notify the Cooperating Municipality in writing by the date specified in HUD's Urban County Qualification Notice for the next qualification period of the Cooperating Municipality's right not to participate in the new qualification period. The County shall send a copy of the notice to the Cooperating Municipality to the HUD Field Office by the date specified in the urban county qualification schedule. 20. If additional time is needed, an applicant may apply for up to two (2) six (6) month extensions. The current fee schedule reads "Permit Renewals: A fee equal to the now currently charged fee shall be paid for each renewal". This fee is paid for each six (6) month renewal. It is my recommendation that the fee schedule be amended to read as follows: "Permit Renewal: A fee of fifty percent (50%) of the original permit fee be paid for each six (6) months extension". The rationale for charging half of the original permit fee is due to the fact that the renewal is only valid for six (6) months and the Town code allows for up to two (2) six (6) month renewals. In actuality, it has been the practice of the Building Department to charge the applicant, who is requesting an extension, fifty percent (50%) of the original permit fee versus the full cost for the permit renewal. REQUEST FOR QUALIFICATIONS (RFQ) for the Town of Mamaroneck for the preparation of a Comprehensive Plan A. Introduction The Town of Mamaroneck is seeking proposals from qualified planning individuals and consultant firms to prepare a comprehensive plan for the Town. The Comprehensive Plan (the Plan) should provide a vision and establish policies that will guide the Town's future land use while providing a blueprint for preserving the character of the community. The plan will be a critical guide for the Town Board, Town staff and Town land use boards to chart the direction of the community. When completed the Plan must provide guidance to the Town for meeting the community's needs both now and in the future. The Town has a strong record of stewardship of the environment. Therefore the expectation is that the Plan will build upon that record by reviewing existing policies and where applicable developing new policies and tools for sustainability. B. Background and Community Description The Town of Mamaroneck is a suburban community located in Southern Westchester County on the shores of the Long Island Sound approximately 20 miles from New York City. The Town is comprised of its unincorporated area serviced by the Town government. Within the boundaries of the Town lies the entire Village of Larchmont and a majority of the Village of Mamaroneck. Although the Villages have their own autonomous governments, the Town does provide a select menu of services to Village residents. The population of the entire Town including the Villages is 29,156. The unincorporated Town population is 11,977. These figures are according to the 2010 Federal Census The Town is serviced by Metro-North Railroad with stations in the Village of Mamaroneck and Village of Larchmont. Residents in the unincorporated area utilize both railroad stations. In addition to Metro-North Railroad public transportation is available from Westchester County Bee-Line Bus service operating three bus routes in the Town. The Town is served by Interstate Route 95 which is easily accessible for Town residents as it divides the unincorporated area. Other major automobile routes in the Town include Route 1 (Boston Post Road), Weaver Street (NYS Route 125), 1 � Pa Palmer Avenue (Westchester County Roadway) and Murray Avenue (Westchester County Roadway) The Town of Mamaroneck is a residential community comprised primarily of single family homes. Other residential development in the Town consists of multi-story rental apartments, condominiums and cooperative apartments in two separate areas of the Town. What is known as the Washington Square neighborhood is comprised of seven multi-story multi-family buildings. The oldest of the buildings date back to before WWII. The newest, a condominium development is still under construction. This neighborhood is located near 1-95 at the unincorporated areas border with the Village of Larchmont. The other multi-family district is located on Richbell Road at the Town's border with the Village of Mamaroneck between the Boston Post Road and Palmer Avenue. Although the Town does not have a defined downtown, the Boston Post Road corridor serves as the Town's major commercial district. Residents of the unincorporated area utilize this commercial district as well as the downtown business districts of the Villages of Larchmont and Village of Mamaroneck. A second smaller commercial district is located at the southwest section of the Town near the New Rochelle border. This second district is located on Myrtle Boulevard, Madison Avenue and Fifth Avenue. Within the unincorporated area are the Winged Foot Golf Club and Bonnie Briar Golf Club that together comprise over 427 acres of land. In1994 the golf course properties were re-zoned in a new district entitled the Recreation Zone. These properties cannot be developed for residential or commercial purposes. There is also 310 acres of dedicated parkland including approximately 7 miles of conservation trails. Most of the Town including the two Villages are served by the Mamaroneck Union Free School District. There are however approximately 260 homes in the northern part of the unincorporated Town that is served by the Scarsdale Union Free School District. C. Scope of Work The Plan is intended to become the document affecting physical development and redevelopment within the Town's unincorporated area. The Plan should develop sustainable practices that balance social, economic and environmental considerations to prepare for smart growth. However, the Town's housing stock is comprised of widely diverse architecture. Therefore the Plan must also set criteria for preserving the Town's character. As an official document of the Town, it will be used for evaluating proposed projects, amendments to land use codes and the Town Code. The Plan is also intended to take a hard look at transportation within the Town; specifically vehicular, pedestrian and bicycle traffic. 21Page There have been a number of significant studies prepared that have been the basis for much of the Town's land use legislation. The following is a listing of those studies: • 1986 Master Plan for the Boston Post Road and Palmer Avenue Corridors • 1986 Town of Mamaroneck/Village of Larchmont Local Water Front Revitalization Plan o Amended in 1994 and in 2018 • 2004 Town of Mamaroneck Hazard Mitigation Plan • 2014 Town of Mamaroneck Sustainability Plan One of the more significant objectives of this project is to develop a Plan that brings together the previously completed studies to make each more useful in the Town's planning process and for setting priorities for the Town government. Rather than a broad based comprehensive plan the Town seeks to focus the comprehensive plan on specific topics: • Land Use and Specific Land Use Regulations • Housing • Vehicular and Pedestrian Movement in the Town-Complete Streets Analysis • Recreational Facilities and Programs for the Community Land Use Maintaining the character of the Town is an important mission of the comprehensive plan. Like many communities the size of new homes and their overall mass has become an issue in some neighborhoods. Therefore the plan must include a review of the Town's current floor area ratio law to determine whether amendments are in order. In 2016 the Town Board adopted Chapter 178 of the Town Code entitled Site Plan Review of Residential Development. The law was enacted to ensure that proposed development and use of land will preserve and protect environmental features, have a harmonious relationship with existing or permitted uses of contiguous land. With the law now in effect for almost two years, the comprehensive plan is to include a review of the law to determine if it is meeting its intended purpose and whether amendments are necessary. In connection with the review of the land use regulations, the Town's current design guidelines are to be reviewed by the consultant. The intent of this review is to incorporate new green infrastructure techniques into both residential and commercial site plan reviews. 3 I F' Housing The Town has developed as primarily a single family residential community with some multifamily housing in Washington Square and on Richbell Road. The Developing affordable housing in the community is of importance to the Town government. In that regard the Town, in 2013, amended its zoning code to permit the development of residential housing in areas previously zoned exclusively for businesses and service businesses. The B-R and SBR zones were created along the Boston Post Road corridor and along Madison Avenue and Fifth Avenue near the Town's border with New Rochelle. As part of the comprehensive plan, an evaluation is to be made of vacant or underutilized parcels of land in the B-R and SBR zones as possible sites for housing. Vehicular and Pedestrian Movement in the Town & Parking There has been a noticeable increase in traffic volumes throughout the Town's unincorporated area. Much of the traffic is centered on the schools located in the unincorporated area. Currently the Mamaroneck School District is encountering an increase in student enrollment. The Murray Avenue School, Central School and Hommocks School are in the unincorporated area of the Town. The Plan should include alternatives for traffic mitigation including traffic calming measures on those streets adjacent to the schools Traffic congestion is also an issue at various intersections and tributary roadways leading to the schools. Therefore the Plan is to include recommendations for improved traffic flow and at the following intersections: • Palmer Avenue and Weaver Street • Myrtle Boulevard and Weaver Street • Hommocks Road/Weaver Street and Boston Post Road • Forest Avenue and Weaver Street • Forest Avenue and Murray Avenue In connection with the required traffic analysis the Plan should address opportunities for better circulation of bicycle and pedestrian traffic through the Town to improving the existing modes of travel and to promote more walkability and bicycle use in the unincorporated Town. The concept is to develop a more specific complete streets program for the Town. There is a greater and greater demand for commuter parking. With limited public commuter parking lots in the unincorporated area the Town is experiencing the use of residential streets for long term parking by commuters. Previously the Town has approached this issue on a street by street basis. The comprehensive plan is an opportunity to address this issue on a more global basis. Working with the Town, a suitable radius from the Larchmont train station will be established. Within that radius the consultant will identify all existing parking regulations and make recommendations on changes that will balance residential and commuter parking in these areas. 4IPa ; e Recreation Facilities and Programs The Town currently offers a wide variety of recreation programs for all age groups in the community. In terms of recreation facilities the Town offers: Hommocks Pool Facility-this is a facility that is owned by the Mamroneck School District with the Town sharing in the use Hommocks Ice Rink-A town owned facility used for ice related recreational programs, and public skating. During the summer the facility is used for our summer camp program Memorial Park- an open park with a playground facility and tennis courts. The park is also used for concerts and sports programs for young children Senior Center-the Town recently purchased a former Veteran's of Foreign War Post. The building is used primarily for senior citizen programming. The comprehensive plan is to analyze the optimum uses of these facilities and what alternatives are available for further recreation programming for our community. D. Specific Tasks to be Completed in the Developing the Plan I. Conduct preliminary visioning sessions with the Town Board and designated staff to initiate the preparation of the Plan and mutually agree upon the goals and objectives of the project. II. Prepare a comprehensive participation plan that will include the Town's land use Boards. III. Conduct an on-line opinion survey for residents of the unincorporated Town. IV. Prepare to hold three "Town Hall" style meetings in order to present to the community the first draft of the Plan and to receive public comment. V. The consultant will be responsible for preparing all documentation needed for compliance with the New York State Environmental Quality Review (SEQR) regulations. VI. Provide recommendations on strategies for the Town to address important goals and objectives for changes proposed to the Town's land use policies and regulations. VII. Identify remaining vacant or underdeveloped parcels of land and identify smart growth options consistent with the future needs of the Town for either housing or recreational programming VIII. Evaluate the Town's municipal parking lots to determine if any are viable for re-development. E. Selection Process Responses to this RFQ will be reviewed and ranked as most qualified to meet the Town's needs for preparation of a comprehensive plan. The selection process will include interviews with the Supervisor and Town Board and members of the Town Staff. The selection of a consultant will be based upon the technical skills and relevant experience of the candidates, as follows, with a maximum possible score of 100. I. Technical Capability-The relevant knowledge and ability to provide the planning services necessary to prepare a comprehensive plan. (25 points) 5 P II. Project Understanding and Approach-The consultant's understanding the scope of work required for this project and the approach to be used by the consultant to prepare the plan (25 points) III. Project Experience-The experience of the consultant to provide similar type services in similar type communities. (25 points) IV. References-Please provide at least five (5) references for comparable projects (25 points) The Town will commence contract negotiations with the most qualified planning firm or individual to establish a final scope of services, total fee and project schedule. The second phase of the project will be to restore the lower level for use by the Fire Department for their activities. In order to move forward proposals were requested from Calgi Construction Management and Smith and Pucillo Architects for the design phases of the project. This will include schematic design including cost estimates, design development and preparation of construction documents. Calgi Construction has previously been involved with construction at the firehouse and has a good working knowledge of the building. Smith and Pucillo Architects previously worked for the Town on the restoration of the Police Department facility and provided excellent service on that project. The fee structure for their work is as follows. Calgi's fee for the work listed in his proposal is $15,200.00. Assuming the project moves forward, the District will negotiate with Calgi Construction a fee for construction administration. That fee will be negotiated based upon the final scope of the project and the amount of time necessary for day to day administration of construction. Smith and Pucillo's fee will be 9.5% of estimated construction cost. This number will be refined once bids are accepted for the project. GENERAL SUMMARY Work includes, but may not be limited to, the complete restoration and reconfiguration of the basement floor areas. With respect to the locker rooms specifically, there is a growing number of female hockey players. As a result consideration must be given to have changing facilities for the female players. USA Hockey which is the governing organization for youth hockey has issued a guideline to encourage rink operators to establish separate changing facilities for female hockey players. The construction of additional facilities at the Hommocks Ice Rink might require re- arranging the existing service and maintenance facilities to accommodate new locker rooms and shower facilities. Therefore it appears prudent to have a professional engineering/architectural firm work with the Town to evaluate alternative designs that maintains the current functionality of the rink. Also we need to develop cost estimates for the designs. Attached is a proposal from Weston and Sampson to conduct the ice rink evaluation. The Town had previously worked with the firm when we thought we would be conducting a complete evaluation of the pool facility. The firm's headquarters are in Massachusetts but there are offices in Albany, New York and other northeast locations. Their background is comprised of a wide variety of facility design projects including aquatic facilities, fields and stadiums, DPW facilities and other similar project. They are currently working on projects in Greenwich, CT and Rye Brook, NY. The firm has proposed to conduct the analysis for a lump sum price of$13,685 not including certain reimbursable expenses which are common in these types of agreements. The estimated time for completion of the report is about 3 months. The Town has set up a separate trust fund for donations to finance the locker room project. For the last several years the annual Ice Breaker Hockey tournament has been held at the Hommocks Ice Rink to raise money for this project. The submission by Gotham Signs and Graphics has been reviewed by the Town's consultants on this project, Barton and Loguidice. Attached is their letter recommending that the Town move forward with Gotham. Procedurally, the Town, working with Barton and Logiudice will finalize the design specifications and installation details for the various signs. A final project budget will be set at an amount not to exceed $50,000 for all of the signs envisioned in the project.
