Fire Headquarters Apparatus Floor Reinforcement
Date: December 15, 2017
On Wednesday, November 29, 2017 the Town publicly opened and read bids for the fire
house project. The original scope of this project included the reinforcement and
reconstruction of the apparatus floors at the fire house and restoration of the basement
level of the firehouse. The Town received two bids:
➢ Specialty Construction $1,135,000
➢ Sisca N.E. Associates $1,398,923
Capital Project #2017 -29- Fire House Improvements was established for this project
with a total budget of $1,148,209. The project budget included not only the restoration
of the apparatus floors but also the renovations to the basement level of the fire house.
Based upon the bids received the project budget would now fund only the repairs to the
apparatus floors.
Attached is a letter prepared by the District's consulting engineers Grigg and Davis
Engineers. The letter provides a side by side comparison of the two bids received and
some of the factors that drove the pricing of the project. As the letter states, it would
appear that we must move forward with the project to reconstruct the apparatus floors.
The weight of the apparatus used by the Fire Department is far heavier than the
equipment used when the main apparatus floor was constructed in 1936. With regard
to the two exterior equipment bays, the concrete floors show severe cracking which is
allowing water and moisture to penetrate the floor and rust the pans under the
concrete. Delaying the project would only exacerbate the conditions of the floors and
increase the cost of repairs in the future.
We did discuss re- bidding the project. However it appears that we will see 2018 pricing
in a new set of bids, which will likely be higher than the current pricing based upon 2017
costs.
In terms of the renovation of the basement level after construction of the floors, we will
immediately seek cost estimates for this component of the project. Depending upon the
costs received, we can determine whether additional financing through a referendum is
necessary. Alternatively if the renovation costs are lower, financing may be possible
through the use of surplus funds and an existing capital project for other firehouse
repairs.
ACTION REQUESTED: THAT THE BOARD OF FIRE COMMISSIONERS ACCEPT THE BID
SUBMITTED BY SPECIALTY CONSTRUCTION SERVICES, $1,135,000, TO REINFORCE
THE APPARATUS FLOORS AT FIRE HEADQUARTERS AND THAT THE TOWN
ADMINISTRATOR BE AUTHORIZED TO EXECUTE A CONTRACT WITH SPECIALTY
CONSTRUCTION SERVICES.

Attached to this Letter is the side by side comparison of the two Bids received on 11/29/17 for the
Fire Headquarter Apparatus Bay Floor Reinforcement/Replacement Project, Contract TA- 17 -07.
The Low Bidder is Specialty Construction Systems, Inc. with a Base Bid of $1,135,000.00. The
other Bid received is from Sisca Northeast Associates, LLC with a Base Bid of $1,398,923.00.
Grigg & Davis Engineers, P.C. had estimated the Budget Construction Cost of this Project to be
$564,000.00.
Grigg & Davis Engineers, P.C. apologizes for the significant difference between the Budget
Construction Cost and the Base Bid of the Low Bidder. The Budget Construction Cost was
provided to Grigg & Davis Engineers, P.C. by Specialty Construction Systems, Inc. in November,
2015. The line items of the Budget Construction Cost estimate reflected the scope of work and the
square footage for this Project however the cost factors used were only half of what they should have
been. Specialty Construction Systems, Inc. was also aware that this was a Municipal Project that
needed to be completed using Prevailing Wages. That was the only time Specialty Construction
Systems, Inc. was provided information about this Project. As the Project evolved Grigg & Davis
Engineers, P.C. alone modified the Budget Construction Cost estimate to suit the scope of work.
Moving forward, the Apparatus Bay Floor Reinforcement/Replacement Project needs to be
completed. The Original Firehouse Apparatus Bays were not designed to support the weight of
today's Fire Apparatus and requires the specified reinforcement. The Apparatus Bay floor of the two
Additions is cracking due to a lack of top reinforcement in the floor slab and water is entering the
cracks and causing the metal deck below to corrode. The only way to correct these deficiencies is to

replace the Apparatus Bay floor of the two Additions as specified.
When comparing the two Bids some line items are very close and others are not. I attribute that
difference to the use of Sub - Contractors. Work performed in -house is more economical than work
performed by Sub - Contractors.
Grigg & Davis Engineers, P.C. recommends that Specialty Construction Systems, Inc. be awarded
this Contract.
Grigg & Davis Engineers, P.C. looks forward to proceeding with this Project as determined by the
Town of Mamaroneck.

Re: Update Community Solar Project
Date: December 15, 2017
Previously we have discussed a proposed project to provide community solar benefits
to the Hommocks Park Apartments to enhance the mission of the housing development
to provide affordable lower cost housing in the community. This project would help by
reducing the monthly electric expenses for the tenants. Mr. Frank Owens, a volunteer
on the Sustainability Collaborative has indicated that he would assist the Town in
exploring the feasibility and implementation of a community solar project.
The concept plan would be for the Town to prepare a request for proposals to identify
qualified solar power developers. Under the plan, solar panels would be installed on
the Hommocks Ice Rink roof and the solar developer would pay rent to the Town for the
solar panel installation. Electric power generated from the solar panel array would be
credited to the electric bills of the tenants of the Hommocks Park Apartments.
I have contacted the Chairman of the Town of Mamaroneck Housing Authority Board
and requested a meeting with the Board in January to review the plan and answer any
questions they may have.
In terms of next steps the process would be to:
A. Establish a framework to determine the type of RFP to be utilized for this process
B. Resolve any legal issues that must be resolved
C. Determine what, if any costs would the Town incur for the development of this
project.
D. Identify possible solar developers
E. Establish the optimum rental income for the Town that provides the greatest
electric expense benefit to the Hommocks Park residents.
At this point there is no specific action required of the Town Board. When we have
vetted the issues, the plan would be to come back to the Town Board with information
that will allow for a decision to go forward with the issuance of an RFP.

Re: Sewer Rent Rate — 2018
Date: December 15, 2017
Local Law #7 adopted in 2014 provides for establishing a sanitary sewer rent as an
alternative to the ad valorem tax to fund the operation and maintenance of the sanitary
sewer system. Section 174 -3 of the legislation requires that the Town Board annually
set the sewer rent rate per gallon based upon water consumption. The rate is
calculated by dividing the revenue required to operate the sanitary sewer system by the
adjusted water consumption of all system users. A public hearing must be held by the
Town Board to consider the sewer rent rate. A hearing is scheduled for December 20,
2017.
There are 3,150 billed water customers in the unincorporated Town. There are 87
properties in the unincorporated area that utilize septic systems and therefore not
connected to the sewer system. Below is a listing of water sales in the unincorporated
area for the last three full years:

Average annual water use for a residential property is 114,000 gallons
Based upon 87 properties not being connected to the sanitary sewer system and an
average water consumption of 114,000 gallons; 9,918,000 gallons of water is deducted
from the average water sales for purposes of the calculation of the sewer rent. Also,
the law provides that the sewer rent to be charged be based upon 90% of the actual
water consumed. Therefore for rate calculation purposes the adjusted annual water
sold is determined as follows:

The Sewer District Budget for 2018 is $289,005. Therefore the rate calculation is
$ 289, 005/435,862,200 = $.00066 /gallon, an increase of $.00001 /gallon over 2017.
For an average residential consumer of water using 114,000 gallons a year the property
owner will be billed for 90% of the consumption or 102,600 gallons. As a result the
average annual sewer rent for 2018 will be $67.72, an increase of $1.03 over 2017. For
a point of comparison, a home with an average assessment of $1,250,000 would have
incurred a property tax bill of $87.50 for Sewer District expenses in 2018 had the ad
valorem tax been applied.
ACTION REQUESTED; THAT THE TOWN BOARD, FOR 2018, APPROVE A SEWER RENT
RATE OF $.00066 /GALLON.

CONTRACT OF SALE

THIS AGREEMENT is dated the day of , 2018 and is between
THE TOWN OF MAMARONECK, NEW YORK whose address is 740 WEST BOSTON
POST ROAD, MAMARONECK, NY 10543 ("Seller")
and
16 N. CHATSWORTH AVE. CORP. whose address is 16 NORTH CHATSWORTH
AVENUE, LARCHMONT, NY 10538 ("Purchaser").
1. Seller shall sell and Purchaser shall buy the real property hereinbelow described
for the sum of TWENTY THREE THOUSAND ($23,000) DOLLARS, payable as follows:
On the signing of this Contract, the sum of $0, the receipt of which is hereby
acknowledged and which is subject to collection
At closing, by bank or certified check, the sum of$23,000.
2. The real property is described as follows: A PORTION OF JEFFERSON STREET,
IN LARCHMONT, NEW YORK ADJACENT TO THE PROPERTY OF THE PURCHASER,
AS FURTHER DESCRIBED ON SCHEDULE A ANNEXED HERETO AND SUBJECT TO
THE COVENANTS AND RESTRICTIONS PROVIDED FOR ON SCHEDULE B
ANNEXED HERETO.
3. Upon receipt of the purchase price at the times and in the amounts set forth in "1"
above, Seller shall execute and deliver to Purchaser, a Quitclaim Deed in recordable
form, so as to convey whatever title the Seller has to the real property described in "2"
above, subject to the encumbrances except as to those set forth in this Contract. Seller
shall pay all transfer tax due as a result of the sale of the real property. The deed shall
contain a clause which complies with Section 13 of the Lien Law.
4. All adjustments of real estate taxes, assessments and water/sewer charges, if any,
shall be conducted in the normal manner for real estate transaction in the locality in which
the real property is situated.
5. The Purchaser shall have possession of the real property on the date of the
transfer of title unless otherwise agreed to, in writing, by the parties hereto or their
attorneys, in which event, all adjustments shall be calculated from the date that the
Purchaser took possession of the real property and Purchaser shall be obligated to
maintain the real property from said date.
6. In the event that the Purchaser shall fail to perform any of the terms, conditions
and provisions of this Contract on its behalf to be performed, Seller shall give Purchaser
written notice of such default. If the default is for nonpayment, Seller shall have ten (10)
days from the date of said notice to cure the default. If the default is for any other reason
other than nonpayment, Purchaser shall have twenty (20) days to cure said default.
Notice of default shall be made by personal service or overnight courier service and shall
be deemed given when personally delivered or delivered to the overnight courier service.
In the event that the Purchaser shall fail to cure the default after notice has been
duly given, Seller may DEMAND IMMEDIATE PAYMENT; terminate this Contract by
giving written notice in the same manner that the notice of default may be given and upon
doing so, Seller may retain all moneys paid by the Purchaser pursuant to this Contract.
If purchaser shall be in passion of the real property, Purchaser shall immediately
relinquish same to Seller. Upon written request by either party, the parties shall execute
a formal termination contract. Purchaser hereby expressly appoints Seller as Purchaser's
attorney-in-fact for the execution of the formal termination of contract if Purchaser fails to
or refuses to execute same within fifteen (15) days and any improvements made to the
real property, whether by Seller and/or Purchaser shall be Seller's. The rights afforded
Seller hereunder shall be in addition to those afforded Seller by law.
7. This Contract may only be changed or amended in writing signed by the parties
hereto.
8. This Contract shall be binding upon the distributees, executors, administrators,
successors and assigns of the parties hereto.
9. The words "Purchaser"and Seller shall include the plural thereof where applicable.
10. Riders attached to this Contract are SCHEDULE A AND SCHEDULE B.

11. The deed to be delivered to the Purchaser pursuant to this Contract will contain the
following definitions, covenants or reservations:
Definitions
(a) Prohibited Area means the side of the property described in Schedule"A"that lies
within thirty (30) feet of the intersection of North Chatsworth Avenue and the side of the current
Jefferson Street that abuts the Seller's park.
(b) Prohibited Objects means any item that might be an obstacle, whether permanent
or temporary,to motor vehicles or other forms of equipment attaining access to the Seller's park.
Prohibited Action
The Purchaser shall not install any Prohibited Object in the Prohibited Area.
The Purchaser's Affirmative Obligations
(a) The Purchaser shall prevent any Prohibited Object from being installed in the
Prohibited Area.
(b) At its sole cost and expense,the Purchaser shall remove any Prohibited Object that
is installed in the Prohibited Area.
(c) The Purchaser shall prevent motor vehicles from being parked in the Prohibited
Area.
(d) At its sole cost and expense,the Purchaser shall remove any motor vehicle parked
in the Prohibited Area.
(e) The Purchaser shall install and maintain adequate striping on the pavement
denoting the Prohibited Area and adequate signage along the sides of the
Prohibited Area.
(f) If the Purchaser does not remove a Prohibited Object from the Prohibited Area
within two (2)business days after the Seller gives the Purchaser notice to remove
it, the Seller shall have the same right, but not the obligation, to enter upon the
property described in Schedule "A" to remove the Prohibited Object from the
Prohibited Area. The Purchaser shall reimburse the Seller for all of the"soft"and
"hard" costs incurred in connection with removing Prohibited Objects, including
the pro-rated portion of the salaries(including overtime)of Town employees who
perform or supervise all or some of the removal. If not paid,the Seller shall have
the right to add that cost to the tax imposed by the Seller pursuant to section 102
(20)of the Real Property Tax Law on the property currently known on the Seller's
assessment map as Section 1,Block 27, Lot 108 . In addition, the Purchaser shall
reimburse the Seller for any costs the Seller incurs in attempting to collect the cost
of performing the removal (e.g. attorney's fees, fees paid to a collection agency,
court costs,etc.). If not paid,the Seller shall have the right to add such collection
costs to the tax imposed by the Seller pursuant to section 102 (20) of the Real
Property Tax Law on the property currently known on the Seller's assessment map
as Section 1,Block 27,Lot 108.
Permanent Delegation to the Town
The Purchaser shall sign the deed conveying the Seller's interest in the property
described in Schedule "A" and its signature thereto shall be the Purchaser's irrevocable
request,pursuant to Vehicle and Traffic Law section 1660-a(or any other statute regarding the
same subject matter), of the Seller's Town Board to adopt local laws or ordinances that will
allow the Seller to regulate traffic within the Prohibited Area in ways permitted by Vehicle
and Traffic Law section 1660-a(or any other statute regarding the same subject matter).
The Seller's Reservation of Rights
(a) The Seller reserves the right to travel across the property described in Schedule
"A" to attain access to the Seller's park for any reason whatsoever. If the Seller
disturbs or damages any of the property described in Schedule "A", it, at its sole
cost and expense, will restore the area disturbed or damaged as soon as possible
(weather permitting)to a condition that will be as close as possible to the condition
that will have existed prior to the disturbance or damage. The Seller may delegate
the rights reserved by it in this paragraph to any contractor it engages, any other
municipal authority or any utility company; provided that such entity agrees to
comply with the obligations imposed upon the Seller hereunder and provided
further that the Seller continues to be responsible to perform those obligations if
that entity fails to do so.
(b) The Seller reserves the right to install such facilities underneath the property
described in Schedule "A" that will allow the Seller to provide such municipal
services that at the time of the Seller plans the installation are services that are
usual or customary for a municipal government to provide. The Seller shall be
responsible for paying all of the costs incurred in connection with work performed
pursuant to this paragraph. As soon as possible (weather permitting), the Seller
will restore areas that will be disturbed by the work to a condition that will be as
close as possible to the condition that will have existed before work commenced.
The Seller and its contractors shall use their best efforts to perform the work
expeditiously and with the least possible interference with the Purchaser's
enjoyment of the property described in Schedule "A" and the building known as
16 North Chatsworth Avenue. The Seller shall be responsible for making sure that
the areas disturbed by the work performed pursuant to this paragraph will not be
left in a hazardous condition when work ceases at the end of the day. The Seller
may delegate the rights reserved by it in this paragraph to any contractor it
engages,any other municipal authority or any utility company;provided that such
entity agrees to comply with the obligations imposed upon the Seller hereunder
and provided further that the Seller continues to be responsible to perform those
obligations if that entity fails to do so.
12. This Contract of Sale is subject to a permissive referendum.
13. The closing shall occur on or about the 14th day after the date that the time to petition
for a permissive referendum shall have expired.
14. The acceptance of the deed by the Purchaser shall be deemed to be the full performance
and discharge of every agreement and obligation on the part of the Seller to be
performed pursuant to the provisions of this Contract of Sale.
15. The signatories to this Contract represent to each other that each has the authority from
the entity he represents to enter into this Contract on that entity's behalf.

NOTICE OF PUBLIC HEARING
LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the
State of New York, and pursuant to a resolution of the Mamaroneck Town Board adopted
on December 6, 2017 a Public Hearing will be held on Wednesday, December 20, 2017
at 8:00 PM or as soon thereafter as is possible at the Town Center, 740 W. Boston Post
Road, Mamaroneck, New York to consider the 2018 Sewer Rent Rate.
Section 1—Purpose.
Article 14-F of the General Municipal Law authorizes the imposition of sewer rents as a means of
raising funds(a)to operate, maintain and repair a municipal sanitary sewer system, and (b)
where not prohibited by General Municipal Law §453 (3), to expand such system. This law
creates a sewer rent to be imposed upon the properties that discharge sewage into the Town of
Mamaroneck's sanitary sewer system. The rents will be used to operate, maintain and repair
that sewer system and if deemed appropriate by the Town Board and not prohibited by General
Municipal Law §453 (3), to expand such system. The Town Board finds that a sewer rent more
equitably distributes the cost of the sanitary sewer system because it is a function of usage
computed based upon water consumption and is charged to all the users of that system,
including tax exempt properties.
PLEASE TAKE FURTHER NOTICE that at the Public Hearing all persons interested will be
given an opportunity to be heard and that all persons are invited to submit written
comments at or prior thereto.

Attached is a proposed renewal agreement between the Town of Mamaroneck and GAR
Associates to continue having GAR assist the Town with the maintenance of our
assessment roll. The scope of the agreement includes maintaining our assessment roll
to insure certification by the State of New York of 100% full market value. To accomplish
this task, GAR will conduct sales trending analysis and in some cases reappraisals in
each of the neighborhoods established for monitoring the assessment roll.
The agreement sets forth the tasks to be completed in 2018 through 2020. 2020 will be
the next year four cycle re- assessment update for the entire Town. The agreement lists
tasks in 2017 which have been completed. In terms of the fee proposal listed for 2017,
this was previously approved by the Town Board.
For the meeting on December 20, 2017, the matter before the Board is approval of the
agreement and fee for 2018. The fee proposal for 2018 is $75,000. This is a decrease
of $50,000 from 2017.
ACTION REQUESTED: THAT THE TOWN BOARD APPROVE THE AGREEMENT WITH
GAR ASSOCIATES TO PROVIDE ASSESSMENT ROLL MAINTENANCE SERVICES AT A
FEE FOR 2018 OF $75,000 AND THAT THE TOWN ADMINISTRATOR BE AUTHORIZED
TO EXECUTE THE AGREEMENT WITH GAR ASSOCIATES.

It is hard to believe it hard to believe the Town just completed its first reassessment update project since the initial
reassessment in 2013. Congratulations!
GAR is appreciative to have been able to assist you and your staff with creating and maintaining equity.
We have put together a plan to continue to maintain assessment equity at l00% full market value in compliance
with the NYSORPTS ACR (Aid for Cyclical Reassessment) program. Now that the Town has completed its first
update and there is stability in your assessment office, cost savings can begin to be realized.
Annually, modifications to specific services may need to be necessary depending on NYSORPTS ACR program
changes, staffing situations in the assessment office and market changes.
GAR recommends attempting to maintain full value (loo %) on an annual basis to ensure proper distribution of the
tax burden is maintained. The proposed plan assumes annual adjustments based on market changes with a town
wide update in 2020.

While the ACR plan requires inventory collection at least once every six years, GAR believes all parcels' inventory
should be verified prior to the next Town -wide reassessment. Aerial imagery and street level photographs can be
utilized in the data collection /verification process, if ORPTS parameters are met (see plan information attached).
This plan helps maintain the recent investment in the Town -wide reassessment and helps minimize the work
effort required for the next reassessment. GAR recommends utilizing both desk and field visits to complete the
data verification /collection requirement. Clarification from ORPTS is recommended.

COA Notices:
As long as the municipalities equalization rate does not fall below 85 %, the plan for ACR allows Towns to mail
Change of Assessment Notices (COA 510) in place of Assessment Disclosure Notices (511). Since the Town
intends to maintain 100% each year this should be anticipated.
The elimination of the Assessment Disclosure Notices (511), will assist to reduce potential questions /concerns
about taxes and keep residents focused on the value of their properties. Although Real Property Tax Law 510
requires that COA notices only be mailed in cases of increases in assessed values, GAR recommends that one
be issued to all property owners regardless of the change in value (no change, increase or decrease). This
policy will reinforce to taxpayers that all parcels were reviewed and provide the Town with a good opportunity
to inform residents of the public education programs and the informal review process available to everyone.

Authorization is requested to appoint Richard Polcari as the Building Inspector effective, no
later than January 31, 2018, at an annual salary of$113,000. Since he currently holds the
title of Building Inspector at the Town of New Castle, it will be necessary to obtain approval
from Westchester County for the transfer. As of his start date, he will be required to serve a
probationary period of fifty-two (52) weeks.
Mr. Polcari, having worked in the Town of New Castle's Building Department since 2003,
has an extensive background in municipal Building Department operations. He started as
the Code Enforcement Officer and then was promoted to Assistant Building Inspector; a
position he held for ten years. In 2016 he was promoted to Building Inspector. While
serving as the Building Inspector and Assistant Building Inspector he also performed the
duties of the Fire Marshall for the Town of New Castle. He is very knowledgeable of
residential and commercial construction, including excavation, framing, plumbing, electrical
and heating.
Mr. Polcari having a broad background in the enforcement of building regulations and town
codes and having worked with Municity software, will be an asset to the operations of the
Building Department.
ACTION REQUESTED: That the Town Board approve the appointment of Richard Polcari as
the Building Inspector, no later than January 31, 2018, at an annual salary of $113,000 and
authorize the Town Administrator to sign the employment agreement.

Dear Mr. Polcari,
As discussed, following are the terms and conditions of your employment offer to serve as
the Building Inspector for the Town of Mamaroneck. Your appointment will be subject to
Town Board approval. In addition, the appointment is contingent upon Westchester
County Department of Human Resources' approval of the transfer. As of your hire date
you will be required to serve a fifty-two (52) week probationary period.
Following are the terms and conditions of the employment offer:
Salary: Your starting annual salary will be $113,000 which will be paid bi-
weekly. Salary review for management employees is conducted each year.
Health Insurance: You will be eligible to participate in the New York State
Health Insurance Program (NYSHIP). Coverage would be effective the first
of the month following your hire date. If elected, you will be required to
contribute ten percent (10%) of the premium on a pre-tax basis. The
contribution is adjusted each calendar year and is based on NYSHIP's
premium. If you retire through the NYSLRS and have completed ten (10)
years of continuous service with the Town of Mamaroneck, you and your
eligible dependents will be entitled to receive healthcare coverage in
retirement. If elected, you will be required to pay ten percent (10%) of the
premium. The cost for retiree healthcare coverage may be paid by accrued
health insurance credits as explained in the attached "CSEA Retiree Health
Care Contribution System" statement. In the event you predecease your
eligible dependents, the Town, at its expense, will continue to provide
healthcare coverage for your eligible dependents for three (3) months
commencing the first of the month following your death. At the end of the
three (3) month period, your dependents' eligibility to continue coverage will
be in accordance with the NYSHIP provisions.
Health Insurance "Buy-out": If you decide not to elect the NYSHIP coverage,
you will be eligible for the "buy-out" payment provided you are not covered
by the NYSHIP for a period of twelve(12) consecutive months. The payment
would be $5,000 if you are eligible for a family health insurance plan or$4,000
if you are eligible for an individual plan, both of which would be subject to
applicable taxes.
Dental Plan & Optical Plan: You will be eligible to participate in the Town's
Dental Plan and Optical Plan effective the first of the month following your
hire date at no cost to you.
Life Insurance &Accidental Death & Dismemberment Insurance: You will be
covered by a ten thousand dollar ($10,000) Life Insurance Policy and a ten
thousand dollar ($10,000) Accidental Death and Dismemberment Policy at
no cost to you.
Voya 457(b) Deferred Compensation Plan: You will be eligible to participate
in the Voya 457(b) Plan which permits salary deferrals on a pre-tax basis
subject to annual contribution limits.
` Sick Leave: The Town has agreed to credit a portion of your sick leave
balance with your prior employer, for which you did not receive compensation
upon resignation. Therefore, twenty-eight (28) days will be added to your
annual allotment of twelve (12) sick days for 2018, resulting in a beginning
balance of forty (40) sick days. On January 1, of each succeeding year you
will receive twelve (12) sick days. An additional day will be earned if you
have not taken a sick day in a consecutive four(4) month period in a calendar
year. Upon retirement, if you have not reached the maximum years of service
pursuant to the NYSLRS, the Town will pay you at the rate of eighty dollars
($80) per day for any accumulated sick leave in excess of one hundred and
sixty-five (165) days to a maximum of two hundred and forty (240) days. The
maximum number of days for which you will be paid is seventy-five (75).
Vacation: You will be entitled to twenty (20) vacation days in 2018 and in
each subsequent calendar year you will receive twenty (20) days. Vacation
days may not be carried over from year-to-year without the prior approval of
the Town Administrator or his/her designee. Upon retirement, resignation or
separation from service, other than cause, you will be paid for unused
vacation to a maximum of one(1) year's vacation entitlement.
Workers' Compensation: You will be entitled to Workers' Compensation
insurance pursuant to the applicable requirements of the laws of New York
State. If you are necessarily absent from work because of a job related injury
as defined by the law, you shall be granted leave with full pay for a period not
to exceed nine (9) months exclusive of accumulated sick leave and vacation
leave. During such absence, you shall not accrue sick leave and vacation
leave credits.
Personal Time: You will be entitled to personal leave for appointments and
personal business that cannot be otherwise completed during non-working
hours. Personal leave is subject to the approval of the Town Administrator or
his/her designee.
Longevity Pay: You will be entitled to longevity payments based on your
years of service with your prior employer. Since you will be credited with
nineteen (19) years as of your hire date, in November 2018 you will receive
a longevity payment of one thousand fifty($1,050.)The schedule of longevity
payments is in accordance with the collective bargaining agreement between
the Town and the Civil Service Employees Association.
Holidays: You will be entitled to the paid holidays listed in the collective
bargaining agreement between the Town and the Civil Service Employees
Association.
Professional Development: The Town recognizes the benefits of maintaining
memberships in professional organizations. The Town will therefore
reimburse you for reasonable expenses in the New York State Buildings
Officials Association and the Westchester County Building Officials
Association. You will also be reimbursed for reasonable expenses to attend
conferences of the associations. Attendance at these conferences will be
subject to the approval of the Town Administrator or his or her designee.
Town Vehicle: As the Building Inspector you will be required to attend
meetings and be available to the Town at times outside the normal workday.
Therefore, the Town will provide a vehicle to be used for Town business and
commuting to work from your home. The vehicle is to be used in accordance
with the rules and regulations of the Town.
The offer for you to serve as the Building Inspector is made with the understanding that there
is no personal conflict of interest pertaining to you that will adversely affect your ability to
perform the duties of this position. You agree that you shall not conduct any private work
that would be in conflict with your duties in the Town of Mamaroneck.

Paul Creazzo has been serving as the Acting Police Chief since June 30, 2017. He was
hired in May 1986 as a Patrolman and was later assigned to the Detective Division. In
1993 he was promoted to Sergeant and in 1998 he was promoted to the rank of
Lieutenant.
While serving as the Acting Police Chief, he has exhibited his ability to effectively manage
the day -to -day operations of the Police Department. He has been very responsive to
emergency situations and is very proactive in providing additional training for Police
Officers to enhance their skills.
As the Police Chief, his base salary would be increased to $170,000 effective January 1,
2018. This salary would remain in effect through December 31, 2018. Any future salary
increases would be determined at the time management and non -union salaries are
reviewed. Also, as required of other management staff, he would contribute towards his
health insurance coverage. He would continue to receive specific benefits stipulated in the
Collective Bargaining Agreement between the Town and the Police Benevolent Association.
This would include, but not limited to, holiday pay, longevity pay, sick leave incentive,
wellness benefit and a clothing allowance. However, he would not be entitled to receive
compensation for work performed outside of normal working hours.
ACTION REQUESTED: That the Town Board approve the appointment of Paul Creazzo to
the position of Police Chief effective January 1, 2018 at an annual salary of $170,000 and
authorize the Town Administrator to sign the employment agreement.

The Town Board at its meeting on August 23, 2017, adopted a resolution hereby appointing you
to the position of Police Chief of the Town of Mamaroneck. As of that date, you will be required to
serve a probationary period of fifty-two (52) weeks.
Following are the terms and conditions of the employment agreement:
Salary: Your annual salary will be increased to $170,000 effective January 1, 2018
and will remain in effect through December 31, 2018. Salary review for
management staff is conducted each year at which time a determination is made
with respect to compensation.
New York State & Local Police and Fire Retirement System: You will continue to
participate in the retirement system as a member of Tier 2. The Town will continue
to offer the following retirement plan provisions:

Section 384-d 20 Year Half Pay Retirement Plan

dependents will be entitled to receive healthcare coverage in retirement at no cost.
In the event you predecease your eligible dependents, the Town at its expense, will
continue to provide healthcare coverage for your eligible dependents.

Wellness Benefit: You will be reimbursed for the cost of an annual physical up to a
maximum of five hundred dollars ($500) each calendar year. All or a portion of this
amount may be applied toward an eye examination, purchase of eyeglasses,
membership at a gym or fitness center or a total body scan.
Dental Plan: You will be eligible to continue participation in the Dental Plan offered
through the Police Benevolent Association at no cost to you. In the event that plan
is no longer available, you may participate in the Town's MetLife Dental Plan or a
plan providing comparable benefits.
• Life Insurance & Accidental Death & Dismemberment Insurance: You will be
covered by a ten thousand dollar ($10,000) Life Insurance Policy and a ten
thousand dollar ($10,000) Accidental Death and Dismemberment Policy at no cost
to you.

% Vacation: You will be entitled to six (6) weeks of vacation each calendar year.

the Town Administrator or his/her designee. Upon retirement, resignation or

memberships in professional organizations. Therefore, the Town will reimburse you
for reasonable expenses for memberships and attendance at conferences relating
to your responsibilities as Police Chief. All expenses require prior approval of the
Town Administrator or his/her designee.
Tuition Reimbursement: You will be entitled to tuition reimbursement for
coursework in Public Administration, which is subject to prior approval of the Town
Administrator or his/her designee, upon submission of appropriate documentation
verifying course completion.
Personal Vehicle Use: You will be assigned a Town vehicle to be used in
connection with your responsibilities as Police Chief, including commuting to and
from your residence. In addition, the vehicle may be used for personal reasons
provided the vehicle is not driven beyond a sixty (60) mile radius of the Town
Center.
Indemnification: You will be afforded the benefits as stated in the Town Code,
Chapter 26 - Officers and Employees, Article 1 - Defense and Indemnification.
The offer for you to serve as the Police Chief is made with the understanding that there is no
conflict of interest pertaining to you that will adversely affect your ability to perform the duties of
this position. You agree that you shall not conduct any private work that would be in conflict with
your duties as the Police Chief.
This letter will serve as your employment agreement with the Town of Mamaroneck. The terms
and conditions set forth in this agreement will remain in effect while serving as the Police Chief
for the Town of Mamaroneck. If you concur with the aforementioned terms and conditions, please
sign and date where indicated below.

During the budget review process, the Town Board was advised of potential savings if eligible
employees of the Civil Service Employees Association (CSEA) were to elect to participate in the
2018 Retirement Incentive.
In order to comply with the mandated minimum forty -five (45) day election period, the earliest
retirement date for the Retirement Incentive would be February 28, 2018. Based on this date, the
election period would commence January, 1, 2018 and end on February 15, 2018. If an eligible
employee submits their election during this period, they will be given an additional seven (7)
calendar days to revoke their election.
Noted below are the eligibility criteria and payments offered as part of the CSEA Retirement
Incentive.
➢ Employees must have a minimum of fifteen (15) years of service as of February 28, 2018
and be eligible for New York State and Local Retirement System benefits
➢ For each full year of service the employee would receive an incentive benefit of $1,250;
maximum twenty (20) years /$25,000
➢ Additional payments would include; longevity and prorated vacation pay
Attached is the list of CSEA employees who meet the eligibility requirements for participation in the
2018 Retirement Incentive. Also, indicated are the anticipated savings, as well as the costs
associated with the Retirement Incentive.
