Re: Use and Management of the Larchmont Village Center
Date:April 29, 2017
This past week the Supervisor and I met with the Village Mayor and Library
representatives regarding the ongoing discussion as to whether the Larchmont Library
should assume responsibility for the managing and maintenance of the Village Center.
Currently the Center is maintained by the Village of Larchmont. The Library runs a
large number of programs in the Center. The Village uses the center as a polling place
and extra meeting room for larger meetings of the Planning and Zoning Board. It would
appear that the Library has become the majority user of the Center. On an annual basis
the estimated cost for the operation of the center is $12,000 for cleaning, general
maintenance and utilities.
The proposal being forwarded by the Village and the Library is that the Library would
assume responsibility for all aspects of the Center's operation including scheduling,
maintenance and utilities. The Village of Larchmont would pay for 10% of the operating
costs for the Center which at this time is about$1,200 to cover their use of the building.
The balance of the expense would become a budget item for the library of which the
Town would pay approximately 60%of the cost based upon library card registrations.
Throughout the discussions on this matter the issue for the Town has been recognition
of the fact that the Village does use the facility and that expense for their use should not
be borne by the Town. This matter does require the approval of the Town Board.

Subject: Local law increasing the fines for the illegal operation of leaf blowers

I attach a proposed law which, if enacted, will increase the fines for the illegal operation
of leaf blowers. Please note that the escalating fees are based upon successive violations
in a given year, and not upon violations occurring in twelve month intervals that are not
calendar years. It is anticipated that the proposed time line will make it easier for both
the Court and the Town prosecutors to keep track of recidivism.
I also attach a copy of the current law. I did not redline the proposed law into the current
one because of the law's brevity.
If the Town Board considers the proposal ready for a public hearing, it can set the date
for such a hearing at one of its upcoming meetings.

Local Law No. - 2017
This local law shall be known as the "Increase in Fines for the illegal Operation of Gasoline -
Powered Leaf Blowers" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1— Purpose:
The Town Board has determined that it is appropriate to increase the fines for illegal operation of
gasoline -powered leaf blowers as a means for deterring violations of the law.
Section 2 —Amendment of a current section of the Mamaroneck Code:
Section 141-13 of the Code of the Town of Mamaroneck hereby is repealed and the following
substituted in its place:
§ 141-13 Penalties for offenses.
Any person, firm, association or corporation who violates any provision of this Article shall be
guilty of an offense and upon conviction shall be punished as follows:
For the first offense during a calendar year, with a fine of not less than one hundred twenty five
($125.00) dollars and not more than two hundred fifty ($250.00) dollars,
For a second offense during the same calendar year, with a fine of not less than two hundred fifty
($250.00) dollars and not more than five hundred ($500.00) dollars, and
For a third offense during the same calendar year, with a fine of not less than five hundred
($500.00) dollars and not more than one thousand ($1,000.00) dollars.
Section 3 — Severability:
Should any provision of this Local Law be declared invalid or unconstitutional by any court of
competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any
other provisions of this Local Law, which may be implemented without the invalid or
unconstitutional provisions.
Section 4 — Effective Date:
This Local Law shall become effective upon filing with the Secretary of State.

This Article shall be known as "Restrictions on Outdoor Power Tools and Gasoline -Powered Blowers"
§ 141-10 Purpose.
The purpose of this Article is to reduce noise which is disturbing to individuals in their homes, on their property and in
their workplaces. Noise from certain equipment, used out of doors, causes inconvenience to occupants of nearby
property when such equipment is used during certain hours. Further, gasoline -powered blowers originally designed for
leaf pickup for limited portions of the year are now utilized all year. Repeated statements by residents over a six-year
period demonstrate the year-round use of gasoline -powered blowers has expanded to the extent that the blowers cause
a nearly constant intrusion on the peace and quiet of the community, diminishing the quality of life in our community.
The unacceptable noise levels produced by the year-round use of gasoline -powered blowers is particularly disturbing
during the warmer weather, when residents spend longer periods out of doors and windows and doors are open. This
Town Board finds the noise from gasoline -powered blowers impacts adversely upon the health and welfare of the
community.
§ 141-11 Definitions.
As used in this Article, the following terms shall have the meanings indicated:
GASOLINE -POWERED LEAF BLOWER
Any device powered by an internal combustion engine which discharges a stream of forced air and which is used or
designed to move grass, leaves, clippings, dust, dirt or other matter by blowing them with air emitted by such device.
§ 141-12 Restrictions.
A. It shall be unlawful for any person to operate any power tool or equipment powered by an internal combustion
engine before the hour of 8:oo a.m. and after the hour of 9:oo p.m. on any weekday and before lo:oo a.m. and after
5:00 p.m. on Saturdays, Sundays and legal holidays; except for emergency repairs by municipalities, school districts
and/or utility companies and for a period of up to five days following storms for purposes of removing snow and
debris resulting from such storms.
B. The use of gasoline -powered leaf blowers shall be unlawful in the town during the period from June 1 through
September 30 of each year. This section shall not apply to utility companies, municipal and/or school district
emergency operations and for a period of up to five days following storms for purposes of removing debris resulting
from such storms.

§ 141-13 Penalties for offenses.
Any person, firm, association or corporation who violates any provision of this Article shall be guilty of an offense
punishable by a fine of not more than two hundred fifty dollars ($250.) and/or by imprisonment for not more than 15
days. Each violation of this Article shall be a separate offense.

DRAFT RESOLUTION OF SUPPORT GREEN LIGHT NEW YORK
RESOLUTION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK IN SUPPORT
OF ISSUING DRIVER'S LICENSES TO NEW YORK STATE RESIDENTS REGARDLESS OF
IMMIGRATION STATUS
WHEREAS, many New Yorkers are denied access to driver's licenses they urgently need in
order to drive legally to places such as work, buy groceries, take their children to school, travel to
appointments, attend religious worship, or take family members to hospitals in case of emergencies;
and
WHEREAS, many New Yorkers who cannot obtain drivers licenses because of their
immigration status live in fear that they will be arrested during a routine traffic stop, and because they
do not have a driver's license they will be vulnerable to deportation and being separated from their
families; and
WHEREAS, licensing drivers improves public safety by increasing the likelihood that those
driving on our roads are properly licensed, informed of our traffic laws, and operating a registered ,
inspected, and insured vehicle; and
WHEREAS, licensed drivers are more likely to stay at the scene of an accident to aid police
and emergency workers, exchange insurance information with other affected motorists, and licensed
drivers who witness crimes will be more comfortable reporting them to the police and cooperating in
investigations; and
WHEREAS, allowing immigrants to obtain a driver's license regardless of immigration status
would mean an increase in revenue for New York State from license and registration fees; and
WHEREAS, removing immigration status barriers to driver's licenses will reduce the number
of accidents involving uninsured motorists, leading to lower auto insurance premiums for all New
Yorkers; and
WHEREAS, there are twelve states across the United States that already provide access to
licenses for all residents, regardless of immigration status, including our neighboring states of
Connecticut and Vermont.
NOW, THEREFORE, BE IT RESOLVED, that the Town Board of the Town of
Mamaroneck expresses our collective desire for safety and security for all of our residents and, further,
our commitment to pursuing the common good by ensuring shared resources such as roads and
highways be accessed and utilized responsibly and safely; and
BE IT FURTHER RESOLVED, that the Town Board of the Town of Mamaroneck
recognizes immigration law to be a federal concern; and
BE IT FURTHER RESOLVED, that the Town Board of the Town of Mamaroneck calls
upon the New York State legislature and Governor Cuomo to promptly ensure the issuance of driver's
licenses to all New York State residents, regardless of immigration status; and
BE IT FURTHER RESOLVED, that the Town Clerk forward a true copy of the Resolution,
duly endorsed to reflect its enactment by the Town Board of the Town of Mamaroneck to Governor
Andrew Cuomo, Senator George Latimer and Assemblyman Steve Otis.

There are 12 STATES across the United States that ALREADY provide

including California, Illinois, and our neighboring states of Connecticut and
Vermont. It is time for New York to lead.
ALL NEW YORKERS NEED ACCESS TO LICENSES

properly licensed, informed of our traffic laws, and is operating a registered, inspected and
insured vehicle, which is not possible now.
O Licensed drivers who witness crimes will be more comfortable reporting them to the police and
cooperating in investigations.
LICENSING IMMIGRANTS IS GOOD FOR NEW YORK'S ECONOMY
O Allowing immigrants to obtain a driver's license regardless of immigration status would mean
millions of dollars in revenue for New York from license and registration fees.
O Removing immigration status barriers to drivers' licenses will lead to lower auto insurance
premiums for all New Yorkers. As more drivers get insured, the number of accidents involving
uninsured motorists will decline. The costs of such accidents - and the premiums to cover them -
will decline, and insurance rates will fall for everyone.

Esteemed Governor Cuomo and Members of New York State Senate and Assembly:
I fully support the mission of Green Light NY: Driving Together Coalition and urge New York State to
pass legislation that provides equal access to driver's licenses for all residents of New York State,
regardless of immigration status.
Currently twelve states and two territories have expanded access to driver's licenses to motorists
regardless of immigration status. However, New York bars over 800,000 undocumented immigrants
from obtaining drivers licenses. I join with elected leaders from across New York and the country who
have recognized that providing access to driver's licenses is an important matter of public safety,
community integration, and economic growth that will strengthen New York communities.
ACCESS TO DRIVERS LICENSES IS GOOD PUBLIC SAFETY POLICY
Licensing undocumented immigrant drivers ensures that they are properly licensed, informed of traffic
laws, and operating a registered, inspected and insured vehicle, which is not possible now. Allowing
access will build trust between law enforcement and immigrant communities. With proper and legal
identification, witnesses and victims of crimes will more readily report and cooperate with police. Police
will be able to use licenses to verify the identity of motorists during stops and review their traffic
records. Other first responders and health care providers will be able to identify the individuals they
assist.
ACCESS TO DRIVERS LICENSES IS GOOD COMMUNITY INTEGRATION POLICY
Where robust public transportation is lacking, access to drivers licenses is essential to meeting basic
daily needs and participating in community life. Expanding access to driver's licenses will allow
undocumented immigrants to drive to work, worship, and the doctor. Parents' will be able to show
identification to visit their child's school and safely take their family to worship. With State issued
identification, unbanked immigrant New Yorkers will have the opportunity to financially integrate and
build their family's savings and economic security.
ACCESS TO DRIVERS LICENSES IS GOOD ECONOMIC POLICY
Allowing access to driver's licenses will help lower insurance premiums for all residents and save New
York motorists millions of dollars a year. In addition, New York State government will receive millions of
dollars in revenue in new fees for licenses and registration, which will allow the expanded program to
pay for itself. New York State's economy will receive a boost as consumers and workers gain increased
mobility and reach better job opportunities.
Once again I urge you to give a green light to driver's license legislation for undocumented immigrants in
our state!

Local Law No. - 2017
This local law shall be known as the "Stop Sign at the intersection of Rockingstone Avenue and
Forest Avenue" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1— Purpose:
For safety reasons, the Town Board finds that there should be a stop sign stopping eastbound
traffic on Rockingstone Avenue where Rockingstone Avenue intersects with Forest Avenue.
Section 2 — Regulation of Traffic on Rockingstone Avenue:
Vehicles traveling east on Rockingstone Avenue shall be required to come to a full stop at the
point where Rockingstone Avenue intersects Forest Avenue.
Section 3 — Sign(s) to be Erected and Painting to be Done:
An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted

This local law shall be known as the "Restriction on Parking on Sections of the North Side
of Palmer Avenue in the vicinity of 1299 Palmer Avenue" Law.
BE IT ENACTED by the Town Board of the Town of Mamaroneck
Section 1— Purpose:
The Town Board finds that there is a need to eliminate some of parking spaces in front of
the multi -family building known as 1299 Palmer Avenue, Larchmont, NY. This local law does that.
Section 2 — Regulation of Parkins on two sections of Palmer Avenue:
(A) No motor vehicle shall be parked on the section of the north side of Palmer Avenue
which begins at the boundary line between the Town of Mamaroneck and the Village
of Larchmont and extends seventy (70) feet east from that point of beginning.
(B) No motor vehicle shall be parked on the section of the north side of Palmer Avenue
which begins at the point that is one hundred fifty (150) feet east from the boundary
line between the Town of Mamaroneck and the Village of Larchmont and extends one
hundred seventy-five (175) feet east from that point of beginning.
Section 3 — Sign (s) to be Erected and Painting to be Done:
An appropriate sign or signs shall be erected on and/or above, and/or striping shall be
painted on the surface of Palmer Avenue indicating where parking is prohibited by this law.
Section 4 — Severability:

Town of Mamaroneck Fire Department Capital Projects
Date: May 12, 2017
The 2017 Capital Project Schedule for the Town includes two projects for the Town Fire
Department that will require borrowed funds for financing:
Apparatus Floor Repairs- Weaver Street Firehouse $1,150,000
Replacement of Turnout Gear $ 250,000
The $1.4 million dollars of borrowing for these Fire District projects will require the
District to hold a public referendum. The recommendation is to hold the referendum on
Tuesday, June 27, 2017.
In order to hold the referendum at that time the Board of Fire Commissioners must
adopt five specific resolutions:
1. Adopt the Bonding Resolution for $1.15 million for the apparatus floor repairs
2. Adopt the Bonding Resolution for $250,000 for replacement of the turnout gear
3. Adopt a Resolution Calling for a Special Fire District Election
4. Adopt a resolution appointing the Board of Elections for the Special Election
5. Adopt a resolution setting a meeting for the Board of Elections for the Special
Election.
All of the resolutions have been prepared by our bond counsel, Orrick and are in
compliance with both the States Fire District Law and Local Finance Law. Each of the
resolutions are attached in the order listed above. The bonding resolutions also include
acknowledgement that pursuant to the New York State Environmental Review Law
(SEAR) the actions proposed are Type II actions. This means that the actions will not
result in any significant adverse environmental impacts.

Section 3. The plan for the financing of such maximum estimated cost is by the
issuance of $1,150,000 serial bonds of said Fire District hereby authorized to be issued therefor
pursuant to the provisions of the Local Finance Law.

Section 4. It is hereby determined that the period of probable usefulness of the
aforesaid specific object or purpose is twenty-five years pursuant to subdivision 12(a)(1) of
paragraph a of Section 11.00 of the Local Finance Law.

Mamaroneck, Westchester County, New York, are hereby irrevocably pledged for the payment
of the principal of and interest on such bonds as the same respectively become due and payable.
An annual appropriation shall be made in each year sufficient to pay the principal of and interest
on such bonds becoming due and payable in such year. There shall annually be levied on all the
taxable real property in said Fire District, a tax without limitation as to rate or amount sufficient
to pay the principal of and interest on such bonds as the same become due and payable.
Section 6. Subject to the provisions of the Local Finance Law, the power to authorize
the issuance of and to sell bond anticipation notes in anticipation of the issuance and sale of the
serial bonds herein authorized, including renewals of such notes, is hereby delegated to the Fire
District Treasurer, the chief fiscal officer. Such notes shall be of such terms, form and contents,
and shall be sold in such manner, as may be prescribed by said Fire District Treasurer, consistent
with the provisions of the Local Finance Law.
Section 7. All other matters except as provided herein relating to the serial bonds
herein authorized including the date, denominations, maturities and interest payment dates,
within the limitations prescribed herein and the manner of execution of the same, including the
consolidation with other issues, and also the ability to issue serial bonds with substantially level
or declining annual debt service, shall be determined by the Fire District Treasurer, the chief
fiscal officer of such Fire District. Such bonds shall contain substantially the recital of validity
clause provided for in Section 52.00 of the Local Finance Law, and shall otherwise be in such

RESOLUTION SETTING THE TIME AND PLACE OF A MEETING OF THE
INSPECTORS OF ELECTION OF MAMARONECK FIRE DISTRICT IN THE
TOWN OF MAMARONECK, WESTCHESTER COUNTY, NEW YORK, FOR
THE PURPOSE OF PREPARATION OF THE FIRE DISTRICT ELECTION
REGISTER.
WHEREAS, the Board of Fire Commissioners of Mamaroneck Fire District in the Town of
Mamaroneck, Westchester County, New York, heretofore resolved on May 17, 2017 to call a
special election of said Fire District, such special election to be held at the Firehouse, 205 Weaver
Street, in Larchmont, New York, in said Fire District, on the 27th day of June, 2017, between the
hours of 3:00 o'clock P.M., and 9:00 o'clock P.M., Prevailing Time; and
WHEREAS, pursuant to Section 175-a of the Town Law, only persons registered with the
Westchester County Board of Elections on or before June 5, 2017, the date 23 days prior to the date
of the election (pursuant to General Construction Law treatment of Sundays) , shall be entitled to
vote in such special election; and
WHEREAS, such Section 175-a requires that a resolution setting the time and place of the
meeting of the election inspectors appointed by said Board of Fire Commissioners of said Fire
District for the aforesaid special election be adopted at least thirty days prior to such special
election; NOW, THEREFORE,
BE IT RESOLVED, by the Board of Fire Commissioners of Mamaroneck Fire District in
the Town of Mamaroneck, Westchester County, New York;
Section 1. The inspectors of election approved by resolution duly adopted by said
Board of Fire Commissioners on May 17, 2017, shall meet at

Date: May 11, 2017
The Town of Mamaroneck has, for the last four years, received internet service through the
Cablevision Lightpath System. More recently, the Lightpath service was expanded to include
telephone service. In July of 2016, Westchester County renewed its agreement with
Cablevision for Lightpath high speed telecommunication services.
As a result of the new agreement between the County of Westchester and Cablevision, the
agreements between the County and the various local governments must also be renewed.
Attached is a proposed renewal agreement with Westchester County for the term of January
1, 2017 through December 31, 2021.

AGREEMENT made the day of , 201 _ by and between
THE COUNTY OF WESTCHESTER, a municipal corporation of the State of
New York, having an office and place of business in the Michaelian Office
Building, 148 Martine Avenue, White Plains, New York 10601 (hereinafter
referred to as the "County")
THE TOWN OF MAIVIARONECK, a municipal corporation of the State of
New York, having an office and place of business at 740 West Boston Post Road,
Mamaroneck, New York 10543 (hereinafter referred to as the "Municipality")
WHEREAS, on July 26, 2016, the County entered into an agreement with
Cablevision Lightpath, Inc. ("Cablevision") for the provision of full voice, video and data
transmission services along a high-speed telecommunications network for a five year term
commencing on January 1, 2016, and subject to two five-year renewals (the "Cablevision
Agreement"); and
WHEREAS, the Cablevision Agreement also provides that Cablevision will
allow other municipalities in Westchester County to avail themselves of these services under the
same terms and conditions; and
WHEREAS, the Municipality is desirous of receiving the aforementioned
services from Cablevision under the terms and conditions of the Cablevision Agreement.
NOW, THEREFORE, in consideration of the mutual representations, covenants
and agreements herein set forth, the County and the Municipality, each binding itself, its
successors and assigns, do mutually promise, covenant and agree as follows:
FIRST: The Municipality shall receive voice, video and data transmission
services from Cablevision pursuant to the terms of the Cablevision Agreement, which is
incorporated herein and made a part hereof by reference.
The Municipality may also request other services from the County (e.g. technical
services for telecommunications or data networking) which will be provided at rates published
on the County Department of Information Technology website.
The Municipality acknowledges that for any services to be provided over the
Internet or the County's network, or which rely on the Internet or the County's network, the
County's provision of those service is subject to i) the County having an agreement in place with
Cablevision, pursuant to which it receives network services from Cablevision, and ii) Force
Majeure as herein defined.
In the event the County and the Municipality entered into a separate agreement for
the provision of similar services, the term of which is still in effect, the County and the
Municipality mutually agree that such agreement is hereby terminated and superseded by this
Agreement.

SECOND: The Municipality shall pay Cablevision directly for any services it
may receive. In no event shall the County have any liability for amounts due from the
Municipality to Cablevision or for damages, direct or indirect, arising out of the provision of
services by Cablevision to the Municipality.
In the event the Municipality requests other services directly from the County, the
Municipality shall pay the County pursuant to the rates published on the County Department of
Information Technology website.
THIRD: The Municipality agrees
(i) that except for the amount, if any, of damage contributed to, caused by
or resulting from the sole negligence of the County, the Municipality shall indemnify and hold
harmless the County, its officers, employees and agents from and against any and all liability,
damage, claims, demands, costs, judgments, fees, attorneys' fees or loss arising directly or
indirectly out of this Agreement; and
(ii) To provide defense for and defend, at its sole expense, any and all
claims, demands or causes of action directly or indirectly arising out of this Agreement and to
bear all other costs and expenses related thereto.
FOURTH: The term of this Agreement shall commence on January 1, 2017 and
expire on December 31, 2021.
FIFTH: The County reserves the right to cancel this Agreement upon thirty (30)
days written notice to the Municipality.

SIXTH: Confidential Information means all or any part of, and originals or
copies of, any information, in whatever form embodied (e.g. oral, written, electronic) that the
County has identified in writing as confidential at the time of disclosure. Specifically excluded is
information (a) that at the time of disclosure was, or becomes, part of the public domain (through
a source other than the Municipality); (b) lawfully obtained from a third party that was not under,
and did not impose, an obligation of confidentiality with respect to such information; (c) that is
independently developed by the Municipality; or (d) that was known by the Municipality prior to
disclosure by the County. Confidential Information does not include any ideas, concepts or
know-how.
The Municipality shall not disclose Confidential Information to third parties
without the express written consent of the County. The Municipality agrees not to remove or
obscure proprietary rights notices that appear on Confidential Information and copies thereof;
and shall return or destroy, as the County may direct, all Confidential Information upon demand.
The Parties acknowledge that nothing in this Agreement shall be construed to change the
Municipality's obligations under the applicable Freedom of Information Law or any other
disclosure obligation imposed upon the Municipality by any applicable local, state, or federal
law, rule or regulation that currently exists or is enacted or promulgated during the term of this
Agreement, or by the judgment or order of a court or administrative agency or body having
jurisdiction over the Municipality.
SEVENTH: Force Majeure. Neither party shall be deemed in violation of this
Agreement if it is prevented from performing any of its obligations hereunder by reason of labor

disputes, acts of God, acts of the public enemy, acts of superior governmental authority or other
circumstances for which it is not responsible or which is not in its control, including any event
that might cause the County to not receive services from Cablevision for any period of time.
EIGHTH : This Agreement shall not be enforceable unless signed by the parties
and approved by the Office of the County Attorney.
NINTH: All notices given pursuant to this agreement shall be in writing and
effective on mailing. All notices shall be sent by registered or certified mail, return receipt
requested and mailed to the following addresses:

TENTH: This Agreement constitutes the entire agreement between the parties
hereto with respect to the subject matter hereof and shall supersede all previous negotiations,
comments and writings. It shall not be released, discharged, changed or modified except by an
instrument in writing signed by a duly authorized representative of each of the parties.
ELEVENTH: This Agreement is entered into solely between, and may be
enforced only by, the County and the Municipality. This Agreement shall not be deemed to create
any rights in third parties, or to create any obligations of a Party to any such third parties.
TWELFTH: Any delegation of duties or assignment of rights under this
Agreement, without the prior express written consent of the County, is void.

Sanitary Sewer Evaluation Study and Sewer Repairs
Date: May 12, 2017
The State of New York's Clean Water Infrastructure Act is intended to provide financial assistance in
the form of grants and low interest financing for improvements and repairs to sanitary sewer and
potable water systems. The Town of Mamaroneck working with the City of New Rochelle, Village of
Larchmont and Village of Pelham Manor previously executed an inter -municipal agreement with
Westchester County to evaluate our sanitary sewer systems and conduct repairs identified in the
study. These activities are eligible for grant funding. GHD Consulting Services Inc. was retained to
conduct the analysis.
The communities have begun to receive preliminary data from the study and are now prepared to
submit a grant application for funding. Attached is a draft resolution that would authorize the
submission of the grant.

Town of Mamaroneck Participation- Clean Water Infrastructure Grant Program
Whereas, the Town of Mamaroneck, City of New Rochelle, Village of Larchmont and Village of
Pelham Manor have previously entered into an inter -municipal agreement to work together on
completing a Sewer System Evaluation Study and the subsequent sewer system repairs as a
condition of an inter -municipal agreement with the County of Westchester and;
Whereas, the Town of Mamaroneck has previously adopted a resolution to contract with GHD
Consulting Service Inc. to perform a sanitary system evaluation survey of Town owned
sanitary sewer pipes and manholes;
Whereas, GHD Consulting Service Inc. has presented preliminary sanitary system evaluation
survey data that shows sanitary sewer pipes and manholes defects and;
Whereas New York State passed The Clean Water Infrastructure Act of 2017 that provides at
least $150 million to fund an Inter -municipal Grant, with $30 million available in 2017 for the
evaluation and repair of sanitary sewer systems,
Now, Therefore be it,
RESOLVED that, the Town of Mamaroneck Town Board does hereby authorize GHD Consulting
Service Inc. to prepare on behalf of the Town of Mamaroneck a joint grant application for grant
funding under the Clean Water Infrastructure Act for the evaluation and repair of sewer
system defects identified in the Sewer System Evaluation Study and be it,
FURTHER RESOLVED,
That the Town Administrator is hereby authorized to submit such grant application and serve
as the Town's representative to execute any and all documents relating to the grant
application.

Services Agreement

Previously, the Town Board authorized an agreement between the State Department of
Transportation and the Town for the State to provide emergency assistance with a value of
not more than $10,000.00. That agreement has expired and the State has invited the Town
to execute a renewal agreement for a period of up to 4 years under the same terms and
conditions.
Schedule A of the agreement describes the services to be provided by the State Department
of Transportation. The services will primarily be for emergency assistance including snow and
ice control. It would appear to be in the Town's best interest to execute this agreement.
Certainly, it is conceivable that circumstances would arise where the Town would be unable
to handle a storm or emergency situation with its own equipment and staff.
ACTION REQUESTED: THAT THE TOWN BOARD APPROVE THE NEW YORK STATE
DEPARTMENT OF TRANSPORTATION SHARED SERVICES AGREEMENT AND THAT THE TOWN
ADMINISTRATOR BE AUTHORIZED TO EXECUTE THE AGREEMENT ON BEHALF OF THE
TOWN.

SHARED SERVICES AGREEMENT
Between
NYSDOT and Town of Mamaroneck
THIS AGREEMENT, dated , 201_, is between the People of the State of New
York, hereinafter referred to as "State" or "NYSDOT" and the Town of Mamaroneck, hereinafter
referred to as "Municipality." Pursuant to Section 99-r of the General Municipal Law, the State and the
Municipality wish to share services, exchange or lend materials or equipment which shall promote
and assist the maintenance of State and Municipal roads and highways and provide a cost savings by
maximizing the effective utilization of both parties' resources. Shared Services shall mean any service
provided by one party (Provider) to another party (Recipient). The State and the Municipality agree to
share services as follows:
1. Description and Cost of Services, Materials or Equipment to be shared: Provide details of the
services, materials or equipment to be shared in the attached standard Schedule A. The total
amount of the agreement shall not exceed ten thousand dollars ($10,000.00). If applicable,
indicate that the return exchange will be determined at a later date.
2. The Provider's employees shall remain under full supervision and control of the Provider. The parties
shall remain fully responsible for their own employees for all matters, including but not limited to,
salary, insurance, benefits and Workers Compensation.
3. If the borrowed machinery or equipment is damaged or otherwise needs repair arising out of or in
connection with the Recipient's use, the Recipient shall be responsible for such repairs.
4. The Municipality agrees to defend and indemnify the State for any and all claims arising out of the
Municipality's acts or omissions under this Agreement. Subject to the availability of lawful
appropriations and consistent with Section 8 of the State Court of Claims Act, the State shall hold
the Municipality harmless from and indemnify it for any final judgment of a court of competent
jurisdiction to the extent attributable to the negligence of the State or of their officers or employees
when acting in the course and scope of their employment.
5. The term of this Agreement shall be for two (2) 0 or four (4) 0 years from to
. The parties will endeavor to provide no less than thirty (30) days' notice of
its intent to extend the Agreement. Either party may revoke this Agreement by providing
sixty (60) days written notice of such revocation. Upon revocation, any outstanding
obligations of the parties must be satisfied within thirty (30) days of the date of such revocation.

Authorization is requested to appoint Eileen Phelan to the full-time position of Intermediate
Account Clerk in the Comptroller's Office effective May 22, 2017 at an annual salary of
$55,825. The funding for the position is reflected in the 2017 budget. Since this salary is
based on the CSEA Agreement that expired on December 31, 2016, she will be entitled to
any salary adjustment resulting from negotiations retroactive to her hire date. In
accordance with Civil Service, Ms. Phelan will be required to serve a fifty-two week
probationary period.
Ms. Phelan currently works in the Comptroller's office as a seasonal employee. In March she
was hired to assist with the April Town and County tax collection process. According to Tony
Siligato, the Town Comptroller, Ms. Phelan's performance during the past few months has
been exemplary. She has displayed the ability to multi -task, work efficiently in a fast- paced
environment and a willingness to execute new assignments. In addition, she is extremely
professional in her dealings with the public and has proven to be a team player in the
department.
The duties assigned to this position include, but are not limited to, assisting in tax collections
and billings, performing general bookkeeping and accounting tasks, assisting with projects
involving financial reporting and audit preparation and supporting the payroll and accounts
payable functions.
Ms. Phelan received her Bachelors in Accounting degree from Pace University and is a
Certified Public Accountant. She has worked as a senior auditor for a major accounting firm
and was employed as a private banking supervisor at a regional bank.
ACTION REQUESTED: THAT THE TOWN BOARD APPROVE THE APPOINTMENT OF

Authorization is requested to appoint Karen Orchanian to the part-time position of
Intermediate Clerk in the Police Department effective June 5, 2017 at an hourly rate of $22.
As required by Civil Service, Ms. Orchanian will serve a probationary period of fifty-two
weeks.
Previously this position had been full-time, however, after assessing the functions of the
position it was decided to redistribute a portion of the job duties to existing staff. If
approved, this will result in savings based on the fact funds for a full-time position ($81,060
plus benefits) are reflected in the Police Department's budget for 2017.
Ms. Orchanian's prior experience includes having worked for a major credit card company
as a senior tax accountant and as a teacher's aide in a neighboring public school. Currently
she works as an office manager/bookkeeper for a local garden center.
As the Intermediate Clerk in the Police Department, Ms. Orchanian will be responsible for
compiling bi-weekly payroll reports, printing and distributing various police reports, entering
traffic and parking summons information into the data base, answering phones, distributing
mail, responding to Freedom of Information Law (FOIL) requests, compiling information for
the Town Court Clerk, as well as other administrative duties.
In the interview Ms. Orchanian displayed enthusiasm to work in the Police Department and
the willingness to learn new tasks. Executive Lieutenant Koziak is confident she possesses
the skills required to perform the duties and anticipates she will be an asset to the
operations of the Police Department.
ACTION REQUESTED: THAT THE TOWN BOARD APPROVE THE PROBATIONARY
