Except for the changes noted, the policy follows very close to form of that of the Town Center Building Use Policy. The policy was prepared with the Senior Center Director and Director of Community Services and has been reviewed by Counsel to the Town. Altieri Town Administrator BUILDING USE POLICY TOWN OF MAMARONECK—SENIOR CENTER 1288 BOSTON POST ROAD LARCHMONT, NY 10538 - (914) 834-8840 1. The Town of Mamaroneck ("Town") recognizes that the Senior Center belongs to the people of the Town &since the building was established, maintained &operated by funds provided by local taxes, the Town recognizes & accepts the responsibility for making the Senior Center available to responsible local, non-profit educational organizations & associations. The Town may also permit the use of the Senior Center by other responsible organizations not located in the Town. The Town also recognizes that it is bound by law & must prohibit certain activities. Those prohibited activities include: a. Any activity that may be injurious to the building,grounds or persons. b. Any activity in conflict with any Federal, State, local laws or regulations. 2. It is the Town's intention to grant the use of the Senior Center under the Town's regulations, for activities of an educational, cultural, civic, social, recreational, governmental or general political nature which are sponsored by responsible, recognized local persons, organizations or agencies. The Town reserves the right to cancel any scheduled use of the building if a conflict occurs with necessary Town Activities,weather emergencies and building emergencies. Such cancellations shall be rescheduled at the earliest possible convenience. The Town authorizes the Senior Center Coordinator to approve & arrange for scheduling the use of the Senior Center by applicants satisfying the limitations listed above. 3. The Town, because of its responsibility for protecting the buildings & property therein, may restrict use of space within the Senior Center to certain times & areas. The Town & its representatives must have free access to facilities at all times. 4. Smoking is prohibited in the Senior Center and on the grounds at all times. Alcoholic beverages are prohibited in the public meeting rooms of the Senior Center without expressed written permission from the Town. Nothing shall be sold, affixed or attached to any part of the interior or exterior of the building without prior permission in writing from the Town. 5. Organizations receiving permission to use the Senior Center are responsible for the conduct of both participants & spectators. Adequate adult supervision must be available to handle anticipated crowds. Minors must have adult supervision at all times. 6. Violation of safety regulations or improper use of the Senior Center will be cause for the revocation of permission to use of the building. Unless otherwise erwise permitted by the Town, all events and activities must end at 10:OOpm: 7. When the service of a Town employee is required, in addition to their normal working hours, there will be a charge according to the building use fees. Payment should be made by check payable to the Town of Mamaroneck&forwarded to the Town Comptroller's Office. 8. Non Discrimination: All individuals & organizations requesting the use of the Senior Center are advised that permission to use the building will be given only with the understanding that all activities taking place in their facilities are open to all individuals regardless of race, color, creed, sex or national Origin.. Discrimination against any individual or group because of race, color, creed, sex or nation_al origin will be grounds for revocation of permission to use the Senior Center.building. BUILDING USE POLICY 9. Liability: The Town,in its discretion, may require a Certificate of Insurance in the amount of one million dollars naming the Town of Mamaroneck as an additional insured and the Town will be held harmless for claims arising from the use of the building by the applicant. The Town may also require an additional fee for the purpose of purchasing insurance for the use of the Senior Center building. It is the responsibility of any person or organization using the Senior Center to maintain the original order & cleanliness of such facilities. Such person or organization will be responsible for damages relating to its use of the facility. 10. For such use, the Town has established a schedule of fees to defray expenses relating to the operations of the building..The Town, at its discretion, may waive building use fees for local community, groups & organizations for non-revenue generating events except when the event or_activity requires the services of a Town employee." 11 : Reservation/Application Procedure. To reserve a meeting room,_a completed building_use 'application shall be submitted to the Coordinator of the Senior Center.. Applications are available at the Senior Center and Town Center and the date must be reserved/approved prior to submission of application. The application may also be down loaded from the. Town website www.townofmarnaroneckny.org Applications must be submitted at least fifteen (15) days prior to the scheduled event. The Town shall respond to the submitted building use application in no more than five (5) business days from the date of receipt. Any additional fees or documentation shall be due two 2) 'business days prior to the event. The Town, at its discretion, may cancel any event for which fees and documentation have not been properly submitted: • 12. In addition, a refundable deposit of $100.00 is required at the time of approval for use of the building. The deposit shall be used to defray any expense the Town may incur for cleanup or damage resulting from the use of the building. All checks should be made out to "Town of Mamaroneck" and forwarded to the Town Comptroller's Office. There May be no food preparation on site. Organizations may NOT use any supplies that belong to the Senior Center. All necessary supplies should be brought in by the organization.Stove/oven/steam table may not be used Organizations may bring in chafing dishes to keep food warm. It is the responsibility of any organization or persons using the Senior Center to maintain original order'& cleanliness of Town Property. A fee will be charged for any damages to property or equipment used during event. The anticipated completion of the field work on the project is April 28, 2017. Draft reports are to be filed with the consortium by August 18, 2017 and final completion November 17, 2017. Attached is a copy of the status report filed by GHD Engineering on January 17, 2017 that details the work completed as of that date. As you will see, most of the work in terms of cleaning, smoke testing and televising of the sanitary sewer,lines has occurred in the City of New Rochelle and Village of Larchmont. Since the date of the report however, work has begun in the Washington Square and Fifth Avenue section of the Town. As part of the SSES project we have been exploring grant opportunities for the repairs and improvements that will likely be identified in the evaluation program. Currently the New York State Environmental Facilities Corporation is offering,Clean Water Grants for improvements to water and sanitary sewer systems. The consortium has been working with EFC on the potential of a grant for our project. At this point there is some concern over the timing to file the grant which is in June of 2017 and the availability of sufficient data from the SSES project based upon the project schedule that was agreed to when the contract with GHD Engineering was approved. The data will be necessary to make the case for a grant. Currently we are working with GHD Engineering to determine if changes can be made to the project schedule to have sufficient data in order to file a joi - t application. /11..e. ...---- Stephen V. Altieri Subject: Authorization—Renewal—South East Consortium Inter-Agency Agreement Date: February 10, 2017 Attached is the proposed renewal agreement between the Town of Mamaroneck and the South East Consortium for the Town's continued participation in this program. As a brief reminder, the South East Consortium is an organization of eleven municipal governments that have come together for the purpose of providing collective programs and special recreation services for citizens with developmental disabilities and special needs. The Town has been a participant in this program since its original organization in 1981. This is but yet another wonderful example of shared service activities by local governments in Westchester County. The fee for our participation in 2017 is $25,415.00. There is no increase in the rate from 2016. Inter-Agency Agreement for 2017 This agreement made on the 1st of January 2017 by and between the South East Consortium for Special Services,Inc.,a not-for-profit corporation of the State of New York;Town of Harrison/Village of Harrison, a municipal corporation of the State of New York; Town of Mamaroneck,a municipal corporation of the State of New York; Town of Pelham,a municipal corporation of the State of New York;Town of Eastchester,a municipal corporation of the State of New York;City of Rye,a municipal corporation of the State of New York;Village of Rye Brook,a municipal corporation of the State of New York;Village of Scarsdale,a municipal corporation of the State of New York;Village of Port Chester,a municipal corporation of the State of New York;and the Village of Mamaroneck,a municipal corporation of the State of New York shall enable said component municipalities the opportunity to provide collective programs of special recreation services and respite opportunities for citizens with various developmental disabilities and special needs through participation in the South East Consortium for Special Services,Inc. as appropriate and available. Now,therefore,the parties hereto agree as follows: FIRST: The parties shall jointly operate a special recreation program for citizens with various developmental disabilities and special needs residing or domiciled within the corporate limits of their respective municipalities to the best of its capabilities and available resources. SECOND: The program shall be funded through each municipality in accordance with schedule of attached hereto and made part hereto establishing respective local shares which shall be in addition to any third party sources of funding. Said local shares shall be paid to South East Consortium at the municipalities' earliest convenience in the current calendar year unless otherwise mutually agreed upon. THIRD: The substantive program policy shall be the joint responsibility of all the parties, but shall be carried out administratively by the South East Consortium in the same manner as any other programs for which said council would otherwise individually be responsible. Administrative services include,but not limited to accounting,payroll,legal,personnel, insurance and risk management. In addition,the South East Consortium,on behalf of the program,may apply and receive grants and other third party sources of revenue,and may further enter into agreements on behalf of the program with other governmental agencies and not-for-profit organizations providing partial or full support of any program or activity to be provided hereunder. FOURTH: The Board of Directors consisting, in part,of a designee from each component municipality shall have policy-making power for the program,and which shall further have the power to adopt rules,regulations,and procedures for the governing of the program affairs in a manner consistent herewith. FIFTH: The South East Consortium shall procure and maintain liability insurance at its own cost and expense relating to all activities sponsored by and performed by the program,which insurance shall protect the interests of the parties hereto as named insured's. Said insurance limits and amounts will be determined by resolution by the Board of Directors. SIXTH: The Chief Fiscal Officer of the South East Consortium shall be the Treasurer. SEVENTH: Programs shall be held throughout the component municipalities,utilizing existing and available municipal/community facilities and resources. EIGHTH: The South East Consortium shall provide special recreation and respite programs for component municipalities and will accommodate participants from non-component municipalities in accordance with agency guidelines currently enforced. NINTH: This agreement shall be effective for the calendar:year 2017 and upon further agreement of the parties,may be amended and/or extended from year to year thereafter. TENTH: The South East Consortium shall deliver to each component municipality a current Certificate of Insurance verifying the existence of such insurance and naming said municipality as Additional Insured. The South East Consortium shall hold harmless,indemnify, and defend the Town of Mamaroneck/Village of Larchmont,its employees,officials and agents from any and all claims,suits and actions arising out of the activities of the special recreation and respite programs provided by the South East Consortium. The South East Consortium shall provide the Town of Mamaroneck/Village of Larchmont a copy of the Certificate of Insurance naming the Town of Mamaroneck/Village of Larchmont as Additional Insured. In several cases there is a minimal decrease in participation which I will attribute to families not willing to"attempt"to comply with the new OPWDD regulations,therefore, not enrolling their child or family member. Hopefully the work we put forth in 2016 to assist with this process will prove successful and we can move forward. It also should be noted that in some cases we needed to suspend programs for a period of time due to venue issues and staff issues and that would affect the program hours provided. Our biggest effort,which has always been our biggest concern,is the low productivity in the Village of Port Chester. We have geared up our efforts at the Carver Center by continuing the Thursday Night Swim Program and introducing a Computer Skills program which hopefully will generate interest. The stated salary is in accordance with the CSEA Agreement that expired on December 31, 2016. Therefore, the salary may increase depending upon the terms of the stipulation resulting from negotiations with the CSEA. The position is reflected in the 2017 budget. Ms. Epps provided services to the Town of Mamaroneck PHA as an independent contractor for a number of years. In that role Ms. Epps performed HUD Housing Quality Standards Inspections. In September 2016, Ms. Epps was hired as a full-time seasonal employee in the Community Services Department primarily assisting applicants in the process of determining eligibility for housing offered through the Housing Choice Voucher Program. In addition, Ms. Epps has performed and successfully executed other job duties that are required of a Staff Assistant. Ms. Epps' professionalism, skills, work ethic and experience has had a positive impact on the Community Services Department's overall performance. If approved to fill the position, Ms. Epps will be classified as a provisional employee in that title and will be required to take a test for that position when offered by Westchester County Civil Service. In order for her to be appointed to the position, Ms. Epps will need to attain a score equal to or higher than the third highest ranking eligible on the list willing to accept the position.
