MINUTES OF A SPECIAL MEETING OF THE
TOWN BOARD OF THE TOWN OF MAMARONECK,
HELD ON THE 24TH DAY OF AUGUST 1982
IN THE AUDITORIUM OF THE WEAVER STREET
FIREHOUSE, TOWN OF MAMARONECK
The meeting was called to order by Deputy Supervisor Bloom at
7:30 P.M.
Present were the following:
Deputy Supervisor Lee H. Bloom
Councilman Stewart J. McMillan
Councilwoman Caroline Silverstone
Supervisor Leo Goldsmith, Jr. was not in attendance at this meeting
due to illness and Councilman Thomas R. Amlicke did not attend as
he was out of Town.
Dorothy S. Miller, Town Clerk, also attended this meeting.
Deputy Supervisor Bloom at this time pointed out to those assembled
the location of the exits as required by law for public gatherings.
PUBLIC HEARING: Increase of Income Limit for Partial Tax Exemption
for Senior Citizens.
Mr. Bloom explained that the urgency in calling this Special Meeting
was due to the fact that the regular September meeting date would
be too late for the change to be reflected in the 1982 Assessment
Roll, and thereupon, on motion by Councilwoman Silverstone, seconded
by Councilman McMillan, it was unanimously
RESOLVED, that the Public Hearing be,
and it hereby is, declared open.
The Town Clerk presented the Affidavits of Publication and Posting
of the Notice of Hearing for the record.
An in-depth explanation of the provisions of the proposed resolution
was given by Deputy Supervisor Bloom in answer to Mrs. Frances
Madey's inquiry.
Thereupon, since there was no further discussion on the matter, on
motion by Councilwoman Silverstone, seconded by Councilman McMillan,
it was unanimously
RESOLVED, that this Public Hearing be,
and it hereby is, declared closed.
Thereafter, on motion by Councilwoman Silverstone, seconded by
Councilman McMillan, the following resolution was unanimously
adopted:
A RESOLUTION TO PROVIDE FOR A PARTIAL EXEMPTION FROM TOWN TAXES, OF
REAL PROPERTY OWNED BY CERTAIN PERSONS WITH LIMITED INCOME WHO ARE
SIXTY-FIVE YEARS OR OVER.
Be it enacted by the Town Board of the Town of-Mamaroneck as
follows:

Section 1. Pursuant to the provisions of Section four-hundred
sixty-seven of the Real Property Tax Law, as amended by Chapter
475 Laws of 1982, the purpose of this resolution is to grant a
partial exemption from taxation to the extent of fifty per
centum of the assessed valuation of the real property which is
owned by certain persons with limited income who are sixty-five
years of age or over, meeting the requirements set forth in
such section as amended.
Section 2. Real property owned by persons sixty-five years of age
or over shall be exempt from Town taxes, except district taxes, to
the extent of fifty per centum of the assessed valuation, subject
to the following conditions:
a. The owner or all of the owners must file an
application annually in the Assessor's Office
of the Town in which real property is located.
Applications must be filed in the Assessor's
Office on or before the taxable status date of
the Town Assessment Roll which is June 1, 1982.
As a result of this resolution the Town's
tentative roll is reopened and applicants may
now file for such exemption until September 15, 1982.
b. The income of the owner or the combined income of
the owners must not exceed $10,500 from all
sources as set forth in such section four-hundred
sixty-seven, for the twelve consecutive months
prior to the date that the application is filed.
Where title is vested in either the husband or wife,
the combined income may not exceed such sum.
c. Title to the property must be vested in the owner,
or, if more than one, in all the owners for at
least twenty-four consecutive months prior to the
date that the application is filed.
d. The property must be used exclusively for
residential purposes, be occupied in whole or
in part, by the owners and constitute the legal
residence of the owners.
Section 3. This Resolution shall take effect immediately after
its adoption and shall be applicable to Town taxes, except district
taxes for the year nineteen-hundred eighty-two and for subsequent
years;
and be it further
RESOLVED, that Paragraph B. of Section 74-7 of Article II of Chapter
74 of the Code of the Town of Mamaroneck be, and it hereby is amended
to delete therefrom the words nine-thousand two-hundred dollars
($9,200) , and to insert in place thereof the words ten-thousand
five-hundred dollars ($10,500) , so that the first sentence of said
Paragraph B reads:
"The income of the owner or the combined income
of the owners must not exceed ten-thousand five-
hundred dollars ($10,500.) from all sources, as
set forth in such Section 467, for twelve (12)
consecutive months prior to the date that the
application if filed."

and be it further
RESOLVED, that this resolution shall apply to the assessment
roll prepared on the basis of taxable status occurring on June 1,
1982 and to all succeeding rolls prepared on the basis of their
applicable taxable status dates;
and be it further
RESOLVED, that the Town Clerk of the Town of Mamaroneck is
hereby authorized and directed to post and publish this resolution
as required by law.
Thereafter, on motion duly made and seconded, the meeting was
declared adjourned at 7:46 P.M. and the Board members prepared
for an 8:00 P.M. Joint Working Session with the Mamaroneck Village
Board of Trustees to discuss arrangements relative to the
Mamaroneck Senior Citizen Nutrition Center being housed in the
Town Center at 740 West Boston Post Road, Mamaroneck Village.
