TOWN OF MAMARONECK
held December 9,1925.
The meeting was called to order by Supervisor
Burton at 10 o' clock P.M.
PRESENT : Supervisor Burton
Justices Boyd, Collins and Shafer

Upon motion duly seconded it was voted that the
minutes of meetings of September I1, September 16,October
7 , October 28 and November 5, 1925, be and the same
hereby* are approved.
A comm=unication from the Board of Appeals was
received and read, stating that at their meetings held
on December 3rd and 4th, 1925, resolutions were adopted
recommending to the Town Board the adoption of amendments
to the Zoning May and Zoning Ordinance of the unincorporated
parts of the Town of Mamaroneck reclassifying certain
Residence A Districts and Business C Districts into
Residence B Districts; and also reclassifying Residential
A Districts and Residential B Districts into Business C
Districts.
The Board of Appeals also recommended that
Section 14 of the Ordinance be amended so that in all
Residence B Districts , a set-back of five feet from the
street line shall be permitted, except upon such streets as
are 50 feet or less in width, from which streets a, eetsback
of 15 feet shall be required.
They a lso recommended that Section 20 of the
Zoning Ordinance be amended to read that apartment buildings
of an extreme height of 70 feet shall be allowed.
A delegation representing the Mahlstedt Steal
Corporation and Hillside Holding Company were present and
spoke before the Board in relation to the amendments of the
Zoning Ordinance.
The matter was fully discussed and upon the written
recommendation of the Board of Appeals , established and
appointed pursuant to the Zoning Ordinance of the Town of
Mamaroneck, it was, upon motion of Justice Shafer, seconded
by Justice Collins , unanimously
RcSOhVZD , that the Zoning Ordinance of
the Unincorporated Part of the Town of
Mamaroneck, 7estchester County, New York:
"An Ordinance adopted by the Town Board
of the Town of Yamaroneck,New York, at
a meeting held on June 21st , 1922 , by virtue
of the power vested in said Town Board
under the provisions of Chapter 322 of
the lams of 1922, to establish building
mines on any property fronting or
adjoining any public streets , and require
all buildings hereafter erected to be
within such lines , to regulate and restrict
the location of trades and industries and
the location of buildings , designed for
special uses , to regulate and limit the
height, and bulk of buildings hereafter
erected, to regulate and determine the
area of yards , courts and other open spaces
surrounding buildings , and to establish
the boundaries of districts for the said
purposes and to provide penalties for the
violation of its provisions , together with
the Zoning YIap which with the designations
shown thereon accompanies the aforesaid
Ordinance and which is therein declared
to be and is made a part thereof, together
with the amendments thereto and thereof,
respectively" - be further amended as follows :
1. That the aforesaid Zoning Yap together with the
designations shown thereon be and the same hereby is amended
so as to transfer to and reclassify as B Residence Districts
the following described portions of the Town of Yamaroneck
which have heretofore been classified either as A. Residence
Districts or as C Business Districts , viz . ,
"A- All the land lying between the
westerly side of Chatsworth Avenue on the
east , the easterly line of Honroe Avenue
on the west , a line drawn parallel with
and 100 feet north of the northerly side
of Yyrtle Avenue on the south, and the
southerly side of Jefferson Street on
the north.
1°B- All the land lying between the
westerly side of Murray Avenue on the
east , the northerly side of Myrtle Avenue
on the south, the easterly side of
Chatsworth Avenue on the wrest and by the
southerly side of Jefferson. Street and
a line which begins at the southwest
corner of lot 30 block 54 , section 1, as
shown on the assessment map of the Town
of Mamaroneck, and runs thence in a
northwesterly direction along the westerly
side of lots 30 , 29,28, 27 , 26 and 25 in
said block to the southwest corner of lot
24 in said block and thence along the
southerly side of lot 24 in said block to
the westerly side of Eurray Avenue, on
the north.
"C- All the land lying between the easterly
side of Murray Avenue on the west, a line
beginning at the intersection of the easterly
side of kiurray Avenue of lot 4, 'clock 61 ,
section. 1 , as shown or the assessment map of

the Town of Mamaroneck, and running thence
along the northerly side of said lot 4 to
the southerly side of Beech Street and
thence alongthe southerly side of Beech
Street to a point distant 100 feet northerly
from the northerly side of Dliyrtle Avenue
on the north, and by a line beginning on
the southerly side of Beech Street at a
point 100 feet northerly from the northerly
side of Myrtle Avenue and running thence
southwesterly parallel with Myrtle Avenue
and distant 100 feet northerly therefrom
between the southerly side of Beech Street
and the northerly side of Morale Street,
thence in a continuation of said line
across Maple Street and thence southerly
along the westerly side of Maple Street to
the northerly sideof Myrtle Avenue and
thence westerly along the northerly side of
Myrtle Avenue to its intersection with the
easterly side of Murray Avenue on the south. "
2. That the aforesaid Zoning Map together with the
designations shown thereon be and the same hereby is amended
so as to transfer to and reclassify as C Business Districts
the following described portions of the Town of Mamaroneck,
which have heretofore been classified either as A Residential
Districts or B Residential Districts :
"A- All the land lying between the
_ northerly side o£ Myrtle Avenue on the
south, the westerly side of Beech Street
on the east and a line drawn parallel
with Myrtle Avenue and 100 feet northerly
therefrom on the north and the easterly
side of Tfaple Street on the
west.
1,B All the land lying between the
easterly side of the New Town Bask on the
west, the southerly side of Myrtle Avenue
on the north, the westerly side of Wood
Street on the east and the lands of the
New York, New Haven and Hartford Railroad
Company on the sout'r .i°
3. That Section 14 of Article III . , Area Districts,
of the Zoning Ordinance be amended by adding a new paragraph
after Subdivision 6 of said Section, to be known as Sub-
division 7 and to read as follows :
187. In all B Residence Districts reclassi-
fied. as such by an Ordinance adopted by the
Town Board of Mamaroneck on the 9th day
of December,1925, a set-back of only five
feet from the street line shall be permitted
-- except upon such streets as are 50 feet or
less in width, upon which streets a set-back
of 10 feet shall be required. 0°
4. That Section 20 of Article I6'. , Height Districts ,
of the Zoning Ordinance be amended by adding a new paragraph
after Subdivision Fourth of said section to be known as
Subdivision Fifth and to read as follows :
"Fifth. In 1.11 B Residence Districts re-
classified by an Ordinance of the Town
Board dated the 9th day of Decem1ber,1925,
apartment buildings of an extreme height
of 70 feet shall be allowed. "
And be it
FURTHER RESOLVED, that this Ordinance
shall take effect immediately.
And be it
FURTFER RESOLVED , that the Town Clerk be
and he hereby is authorized and directed
to publish these resolutions in The
Larchmont Times and The Mamaroneck Para-
graph, newspapers published in the said
Town, and to post the same in at. least
three public places in said Town, all
in the manner provided in Chapter 322 of
the laws of 1922 and amendments thereto,
end the cost of publication and posting
is hereby made a proper Towne charge.
Upon motion the meeting adjourned at 1 :30 o ' clock
