HomeMy WebLinkAbout2021_02_03 Town Board Minutes February 3, 2021 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD FEBRUARY 3, 2021 BEGINNING AT 7:00 PM. PURSUANT TO THE GOVERNOR’S EXECUTIVE ORDER NO. 202.1, SUSPENSION OF LAW ALLOWING THE ATTENDANCE OF MEETINGS TELEPHONICALLY OR OTHER SIMILAR SERVICE: Article 7 of the Public Officers Law, to the extent necessary to permit any public body to meet and take such actions authorized by the law without permitting in public in-person access to meetings and authorizing such meetings to be held remotely by conference call or similar service, provided that the public has the ability to view or listen to such proceeding and that such meetings are recorded and later transcribed; PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson, then on motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Town Board Meeting was unanimously opened at 7:00 pm. Additionally Present: Lindsey Luft Assistant to the Town Administrator Supervisor Seligson announced that the County Executive, George Latimer may stop in to the meeting and address the Town residents. SUPERVISOR’S REPORT We had a significant snowfall this past week and I want to commend the Town Highway Department for their great work clearing the roads, Town parking lots and making it safe for us to drive. They began working Sunday night and worked through Monday and Tuesday non-stop. They will be clearing the Washington Square area tonight, so if you live in that area, please move your car to allow for plowing. We expect County Executive George Latimer to join us in a few minutes to give a Coronavirus update so I will not talk about that. Longtime Sanitation Foreman, Clarence Gaddis, retired this past week. I’m pleased to announce that the Sanitation Commissioners, Larchmont mayor Lorraine Walsh and myself, promoted Deputy Foreman, Frank Giordano to Foreman. Frank has worked almost every job in the Sanitation Commission and has proven himself to be a leader and one of the hardest working people I know. Congratulations to Frank. The Search Committee for the replacement of Steve Altieri, Jaine, Sabrina and myself are pleased to announce that the job announcement for the position has been finalized by our consultant, GovHR, and will be posted nationwide shortly. The announcement will also be on the homepage of the Town website. The job will be posted until the first week of March when the consultant will begin the review process. 1 February 3, 2021 COUNTY EXECUTIVE GEORGE LATIMER The County Executive gave an update on the Coronavirus. Additionally, he stated areas where the Town could be of help in the efforts to distribute the Coronavirus vaccine. Specifically, the County is seeking areas in the Town where a ‘pop up’ vaccine site could be located, seeking updated lists of vaccinated first responders, and a list of homebound residents. Supervisor Seligson responded that the Town has already offered the Senior Center as a vaccination site. PUBLIC HEARING – “Addition of Stop Sign on Maxwell Avenue” Law The following Notice of Public Hearing is entered into the record as follows: NOTICE OF PUBLIC HEARING LEGAL NOTICE IS HEREBY GIVEN that pursuant to Section 130 of the Town Law of the State of New York, and further pursuant to Executive Order No. 202.1 Suspension of Article 7 Public Officers Law, a Public Hearing will be held on February 3, 2021 at 7 PM or as soon thereafter as is possible, to consider “Addition of Stop Sign on Maxwell Avenue” Law, telephonically from the Town Center, 740 W. Boston Post Road, Mamaroneck, New York. Join the Zoom webinar meeting via the link provided on the Meeting Agenda and on the Town Board meeting notice issued prior to the meeting, both of which are located on the Town’s website. The public may comment by writing to publicqc@townofmamaroneckny.org while viewing from LMC Media’s website https://lmcmedia.org/ or local municipal access television (Cablevision (Optimum) 75, 76, 77 or Verizon (Fios) 34, 35, 36), or by participating in the Zoom webinar and utilizing the “raise your hand” feature. Purpose: The Town Board finds that for safety purposes, traffic should be required to come to a complete stop at the point where Maxwell Avenue terminates at Madison Avenue. BY ORDER OF THE TOWN BOARD OF THE TOWN OF MAMARONECK Published: January 28, 2021 On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously opened. Supervisor Seligson asked Lindsey Luft, who is staffing the public comment this evening, if the Town has received any new emails as well as if any viewers had (virtually) raised their hand to speak, and Ms. Luft responded, no. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the Public Hearing was unanimously closed. On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, the following Local law was approved: Local Law No. 2 - 2021 This local law shall be known as the “Addition of Stop Sign on Maxwell Avenue” Law. BE IT ENACTED by the Town Board of the Town of Mamaroneck Section 1 – Purpose: The Town Board finds that for safety purposes, traffic should be required to come to a complete stop at the point where Maxwell Avenue terminates at Madison Avenue. 2 February 3, 2021 Section 2 - Amendment of a current section of the Mamaroneck Code: Section 219-11 of the Code of the Town of Mamaroneck hereby is amended to insert the following in the proper alphabetical order Stop sign on Direction of travel At intersection of Maxwell Avenue East Madison Avenue Section 3 – Sign(s) to be Erected and Painting to be Done: An appropriate sign or signs shall be erected on and/or above, and/or striping shall be painted on Maxwell Avenue indicating where a motor vehicle is required to come to a complete stop. Section 4 – Severability: Should any provision of this Local Law be declared invalid or unconstitutional by any court of competent jurisdiction, such declaration of unconstitutionality or invalidity shall not affect any other provisions of this Local Law, which may be implemented without the invalid or unconstitutional provisions. Section 5 – Effective Date: This Local Law shall become effective upon filing with the Secretary of State. January 15, 2021 The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye CITIZEN’S COMMENTS Supervisor Seligson asked Lindsey Luft, who is staffing the public comment this evening, if the Town has received any new emails as well as if any viewers had (virtually) raised their hand to speak, and Ms. Luft responded, yes, there is an email from Gloria Phinsee. Ms. Luft read the email which addressed the question of a Racial Equity Committee, and her interest in getting involved. Supervisor Seligson responded, that, yes, the Town has a Racial Equity Task Force, and then asked Councilman King if he would reach out directly to Ms. Phinsee. George Roniger addressed the Town Board, notifying them of the continued issue with parking along the Brook, directly on the grass embankment. Mr. Altieri responded that the Town is looking at the current legislation and will address any needed amendment to curtail this behavior. BOARD OF FIRE COMMISSIONERS Commissioner Seligson called the Meeting to order, then on motion of Commissioner Katz, seconded by Commissioner King, the Board of Fire Commissioners was unanimously declared open. 3 February 3, 2021 Present were the following Members of the Commission: Commissioner: Nancy Seligson Commissioner: Abby Katz Commissioner: Jaine Elkind Eney Commissioner: Sabrina Fiddelman Commissioner: Jeffery L. King 1. FIRE CLAIMS On motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, it was RESOLVED that this Commission does hereby authorize payment of the following Fire Department Claims as approved by the Fire Chief and audited by the Comptroller’s Office: ATTACHMENT A The above resolution was put to a roll call vote: Commissioner King Aye Commissioner Fiddelman Aye Commissioner Elkind Eney Aye Commissioner Katz Aye Commissioner Seligson Aye 2. Other Fire Department Business Commissioner Elkind Eney that at the last Fire Council meeting she had the privilege of swearing in the remainder of the Firefighters who were unable to virtually attend the previous meeting. The Fire Department requests that if you are able, to please clear snow from any fire hydrants in front of your home. There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner King, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. License Agreement – Billy & Pete’s Restaurant On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the license agreement between the Town of Mamaroneck and Billy and Pete’s Restaurant, to use a 900 square foot portion of Memorial Park for outdoor dining for a one-year period starting on the date that a certificate of occupancy or compliance is issued in exchange for payment of a fee of $10,800.00. Salary Authorization – Section 8 Housing Program On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was 4 February 3, 2021 RESOLVED, that the Mamaroneck Town Board does hereby appoint Nubia Weekes-Brooks to the full-time position of Staff Assistant – Section 8 Rental Assistance Program at an annual salary of $53,710, effective no later than March 1, 2021. Update - Sanitation Commission Budget Supervisor Seligson stated that the Sanitation Commission met yesterday to continue discussions of allocations, the refinement of tonnage for certain routes, and the finalizing of the 2021 Budget. The next steps are to prepare additional information on these items and discuss them further at the February 9 Town Board Worksession. APPROVAL OF MINUTES On motion of Councilwoman Elkind Eney, seconded by Councilman King, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby approve the Board Minutes from the Executive Sessions of December 11, 21 and 5 February 3, 2021 23, of 2020, the Regular and Worksession Meetings of January 6, 9 and 20, of 2021. REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting.
