MINUTES OF THE REGULAR MEETINGS OF
THE TOWN BOARD AND BOARD OF FIRE COMMISSIONERS
OF THE TOWN OF MAMARONECK, HELD ON
THE 1st DAY OF OCTOBER, 1986 IN'
THE CONFERENCE ROOM AND THE COURT ROOM OF
THE TOWN CENTER, 740 WEST BOSTON POST ROAD

CONVENE REGULAR MEETING
The Regular Meeting of the Town Board was called to order
by Supervisor Battalia at 6:45 P.M. in the Court Room.
Present were the following members of the Board:
Supervisor Dolores A. Battalia
Councilman Thomas R. Amlicke
Councilwoman Caroline Silverstone
Councilman Lawrence A. Lerman
Councilman Stephen C. Chapin
On motion by Councilman Chapin, seconded by Councilman
Lerman, it was unanimously
RESOLVED, that this Board recess into
Executive Session in the Conference Room
to discuss contract matters.
Thereafter, on motion by Councilman Amlicke, seconded by
Councilman Chapin, it was unanimously resolved to adjourn
the Executive Session at 8:25 P.M.
CALL TO ATTENTION - Location of Exits
Supervisor Battalia pointed out to those assembled, the
location of exits as required by law for public gatherings.
At this time, Supervisor Battalia delivered the following
statement:
"According to reports published in the Daily Times last
week, Joseph Messina, attorney for Chief of Police
Charles Baumblatt, distributed a packet of materials
which make serious allegations concerning the Police
Commissioner.
"The Town Board is deeply concerned about these
allegations. The Police Commissioner has denied the
allegations in reports published in the newspaper.
"In order to investigate these allegations further, we
require more information and we believe the information
must come from the source of the allegations.

"We are therefore inviting Mr. Joseph Messina to a
special executive session on October 7, 1986 at 8:00
P.M. to present whatever evidence he has to support the
allegations and innuendo contained in the materials
distributed on September 22, 1986.
"We also invite anyone else who may have information
concerning these matters to contact the Town Adminis-
tration.
III "As reported, there will be a full and complete
investigation of not only these allegations but the
nature of the document itself, the contents, its
distribution, and the individuals who made the
allegations and will seek the cooperation of all
involved.
"Since this is a personnel matter, this investigation,
including the meeting on October 7, 1986, shall be
confidential so as to protect all of the members of the
Town Staff involved.
"While we will make no judgment until this investiga-
tion is completed, we must state publically that the
Police Department has, during the Commissioner's
tenure, shown an increase in efficiency, morale and
professionalism. The outstanding quality of our new
recruits is only one example of this professionalism.
"This inquiry will be conducted by Edward Lieberman,
Esq. rather than by Town Staff in order to insure
impartiality."

BOARD OF FIRE COMMISSIONERS
On motion by Commissioner Amlicke, seconded by Commissioner
Silverstone, the meeting was called to order by Commis-
sioner Battalia at 8:30 P.M. in the Court Room.
Present were the following members of the Commission:

1. FIRE CLAIMS
Commissioner Chapin presented the following fire claims for
authorization of payment and, on his motion, seconded by
Commissioner Silverstone, it was unanimously

Commission, on motion by Commissioner Lerman, seconded by
Commissioner Amlicke, it was unanimously declared that this
meeting be adjourned at 9:40 P.M.
ADJOURNED PUBLIC HEARING - NOISE ORDINANCE
At this time, on motion by Councilman Lerman, seconded by
Councilman Chapin, it was unanimously
RESOLVED, that the Adjourned Public
Hearing be, and it hereby is, declared
open.

The Town Clerk presented Affidavits of Publication and
Posting of the Notice of Hearing.
Attorney Silverberg explained that at the Public Hearing
held two weeks ago on the proposed Noise Ordinance, it was
the consensus that most residents were in favor of the
restrictions regarding the operation of mechanical devices
at certain hours of the day and the Board suggested that
Section 51-3A of the Town Code be altered to include this
restriction.
Councilman Lerman stated that he thought this proposal
would handle the problem best and that sound pressure
levels during the day would have to be looked into but that
this was a good start with perhaps further amendments in
the future.
Councilman Amlicke questioned whether the Town was excluded
from this ordinance to which Attorney Silverberg stated
that there was no specific exemption for the Town in the
proposed ordinance.
Councilman Amlicke then questioned the restrictions
regarding garbage trucks to which Attorney Silverberg
stated that the trucks could be driven but not operated.
An interested resident questioned the language regarding
multiple dwellings and Attorney Silverberg explained that
if noise carried into other apartments, it would constitute
a violation.
A local resident inquired about the enforcement and
penalties regarding this proposal and Attorney Silverberg
replied that there would be a $250 fine and it would be
enforced by the Police Department.
Councilman Lerman suggested that local concerns be informed
that a new law has been passed in order that they are made
aware and so that they will not be in violation.
A local resident questioned what constituted noise to which
Attorney Silverberg replied any device or construction
equipment which emitted sound.
Another local resident inquired if the Sanitation Dept.
would be prohibited from making noise at 7:00 A.M. to which
Attorney Silverberg said no.
Councilman Amlicke stated that "other device" as written in
the proposed law was not specific enough and suggested that
it be clarified.
Councilman Lerman stated that all of the noise problems
could not be covered in one law; only the main ones such as
private carters picking up garbage or construction in the
wee hours of the morning could be addressed. He added that
this law was not intended to solve every problem.

A concerned resident stated that enforcement was the
question to which Supervisor Battalia stated that the
Police Dept. would respond to complaints made by residents.
The question of possibly handling enforcement through the
Building Dept. was raised by Mr. Richard Mari to which
Supervisor Battalia replied that it would be enforced by
the Police Department.
Mrs. Powers stated that she was in favor of the decible
readings because trucks make a lot of noise just driving
down the street to which the Supervisor replied that the
measurement of noise was a very, very difficult problem to
address.
Councilman Chapin stated that he was in favor of the
proposed ordinance until a more comprehensive law could be
adopted and Councilman Lerman stated that he was in agree-
ment with Councilman Amlicke regarding the use of the vague
term "other device."
Thereafter, on motion by Councilman Amlicke, seconded by
Councilwoman Silverstone, it was unanimously
RESOLVED, that the Public Hearing be,
and it hereby is, declared closed.
After which, Councilwoman Silverstone moved the adoption of
the proposed local law with the further clarification of
the word "similar" being added to "other device." The
motion was seconded by Councilman Lerman, and the following
resolution was adopted by a unanimous vote of the Board:
WHEREAS, this Town Board has met on this
date, at the time and place specified in
the Notice of Public Hearing to consider
the adopting of proposed Local Law No.
of 1986 and has heard all persons
desiring to be heard thereon:
NOW, THEREFORE, BE IT
RESOLVED, that this Board does hereby
adopt Local Law No. 10 of 1986 entitled
"Noise Regulation - A Local Law to Amend
Chapter 51 - Noise Regulation of the
Town Code of the Town of Mamaroneck,"
and orders that said Local Law, as so
amended, adopted and herewith inserted,
be made a part of the minutes of this
meeting:

NOISE REGULATION
A Local Law to Amend Chapter 51 -
Noise Regulation of the
Town Code of the Town of Mamaroneck

Section I - Purpose:
The purpose of this amendment is to clarify the time
periods during which it would be unlawful to engage in
certain types of activities which cause disturbances to
individuals in their homes and thus affect the public
health, safety and welfare.
Amendment:
Chapter 51, entitled "Noise Regulation of the Town Code of
the Town of Mamaroneck" be and hereby is amended by adding
Section 51 - 3A which shall read as follows:
51 - 3A - Time Limitations:
Under no circumstances shall any person, firm or
corporation operate any machine, construction equipment or
other similar device that makes noise which carries beyond
the boundaries of the property on which it is located; or
if a part of a multi-family dwelling, the confines of the
dwelling unit, between the hours of 8:00 P.M. and 8:00
A.M. Nor may such device be operated on a public road,
except for the purposes of transporting same from one place
to another.
Section III - Severability:
Should a court of competent jurisdiction declare any
provision of this local law illegal, then such declaration
shall not effect any other provision of this local law.
Section IV - Effective Date:
This local law shall take effect immediately upon filing
with the Secretary of State.
The question of the adoption of the foregoing Local law was
duly put to a vote which resulted as follows:

PRESENTATION - LIBRARY COMPUTERIZATION
Councilwoman Silverstone stated that she received a letter
from Donald Oresman, Chairman of the Library Board of
Trustees, wherein it was suggested that Councilman Amlicke,
liaison, might be able to answer any questions and
Councilman Amlicke stated that he did not know why a
representative from the Library Board was not present
tonight because a personal invitation had been extended.
He also stated that he felt that their expertise was
necessary to answer any questions the Town Board might
have.

Supervisor Battalia requested that Councilman Amlicke once
again extend another invitation to.the Larchmont Library
Board of Trustees in order to have their input regarding
the proposed computerization of the Library.
III AFFAIRS OF THE TOWN
1
FINAL ORDER EXTENSION OF SEWER DISTRICT
William Maker, Esq. stated that the thirty-day time period
for the permissive referendum had been satisfied and then
requested that the Board consider the adoption of the Final
Order for the Maloney/Beringer Subdivision and, on motion
by Councilman Lerman, seconded by Councilwoman Silverstone,
with Councilman Amlicke abstaining, the following resolu-
tion was adopted:
WHEREAS, On May 2, 1986 a map, plan and
report prepared by William Morgenroth,
P.E. regarding the extension of Section
"K" of the Mamaroneck Sewer District #1
("The Sewer District") was filed in the
Office of the Town Clerk pursuant to
Section 209-c of the Town Law; and
WHEREAS, on May 7, 1986 the Town Board
III adopted an order (i) reciting a
description of the boundaries of the
proposed extension of the sewer
district, the proposed improvements, the
maximum amount proposed to be expended
for the improvements, the proposed
method of financing to be employed and
the fact that a plan, map and report
describing the same were on file in the
Town Clerk's Office for public inspec-
tion and (ii) specifying that the Town
Board would meet at the Town Center,
located at 740 West Boston Post Road,
Mamaroneck, New York, on May 21, 1986,
for the purpose of conducting a public
hearing on the proposal to extend the
Sewer District with the specified
improvements and to hear all persons
interested in the matter; and
WHEREAS, copies of the order were
published and posted in accordance with
Section 209-d of the Town Law, and the
Town Board at the time and place speci-
fied in the order, did conduct a public
hearing to consider such proposal and
III did hear all persons interested therein;
and
WHEREAS, after the public hearing, the
Town Board made the following determi-
nations in its resolution:
"(1) Notice of the public hearing was
published and posted as required by law
and is otherwise sufficient.

"(2) All of the property and property
owners, within the proposed extension of
the sewer district are benefited
thereby.
"(3) All of the benefited property
owners are included within the proposed
extension of the sewer district.
"(4) It is in the public interest to
extend the sewer district as hereinafter
described," and
WHEREAS, in addition to the foregoing
determinations, the Town Board's
resolution included the following:
"RESOLVED, that the Town Board does
hereby approve the extension of the
sewer district by including therein the
area described in Schedule "A"; and be
it further
"RESOLVED, that the improvements in the
extended area of the sewer district may
be constructed by Fenbrook Associates
Limited Partners or its assignee in
accordance with the resolution of the of
the Town of Mamaroneck Planning Board;
and be it further
"RESOLVED, that the Town of Mamaroneck
shall incur no cost in connection with
the construction of these improvements;
and be it further
"RESOLVED, that this resolution be
subject to a permissive referendum in
the manner provided in Article 7 of the
Town Law and Subdivision 3 of Section
209-e of the Town Law; and
"WHEREAS, the Town clerk executed a
certificate on June 25, 1986, certifying
that (a) within 10 days after adopting
this resolution, she posted and publish-
ed, in the manner prescribed by Article
7 of the Town Law, a notice setting
forth (i) the date of the resolution's
adoption; (ii) an abstract thereof
concisely stating its purpose and
effect, and (iii) that it was adopted
subject to a permissive referendum, and
(b) no petition was filed protesting
against the resolution and requesting
that it be submitted to a permissive
referendum; and
"WHEREAS, the permission of the State
Comptroller for this action is not
required under Section 109-f of the Town
Law because the Town of Mamaroneck is
incurring no cost in connection with-the
construction of these improvements"; it
hereby is

ORDERED, that the boundaries of the
sewer district be extended to include

ORDERED, that the improvements in the
III extended area may be constructed by
Fenbrook Associates Limited Partners or
its assignee in accordance with the
resolution of the Planning Board of the
Town of Mamaroneck; and it is further
ORDERED, that the Town of Mamaroneck
incur no cost in connection with- the
construction of these improvements; and
it is further
ORDERED, that the Town Clerk cause a
certified copy of this order to be
recorded in the Office of the Clerk of
the County of Westchester, within 10
days after its adoption, and it is
further
ORDERED, that the Town Clerk file a
certified copy of this order in the
Office of the State Department of Audit
and Control, within 10 days after its
adopted.
III The question of the adoption of the foregoing Order
was put to a vote which resulted as follows:

2. DISCUSSION RE: LARCHMONT RAILROAD TUNNEL
Administrator Altieri stated that several instances of
vandalism in the Larchmont Railroad tunnel have been
experienced and, in an attempt to deal with the problem,
representatives of the Village of Larchmont and the Town
had discussions on how best to control it. He added that
it had been determined that one way to control the vanda-
lism was through the control of its use which could be
accomplished by installing gates at either end of the
tunnel at a cost of approximately $2,146, of which the
Town's share would be half.
Councilman Amlicke stated that he observed further vanda-
lism at that location last night and he then questioned the
location of the proposed gates.

Following Administrator Altieri's description as to where
the gates would be located, Councilman Amlicke stated that
he would be in favor of the installation of gates only if
something was also done concerning the existing stagnant
rainwater problem in the tunnel.

Councilwoman Silverstone stated that the Village of
Larchmont was supposed to take care of the problem with the
use of pumps.
Thereafter, on motion by Councilman Amlicke, seconded by
Councilwoman Silverstone, it was unanimously
RESOLVED, that the Town Administrator
be, and he hereby is, authorized to
execute said agreement with the Village
of Larchmont provided that the Village
also agreed to correct the stagnant
water situation at the same time.
3. PARKING ON'ALDEN ROAD
Administrator Altieri stated that the Traffic Committee met
on July 21, 1986 and discussed the street parking situation
on Alden Road. He stated that it was suggested that the
existing "No Parking From Here to Corner" sign be extended
III from,the lower portion of Alden Road to the crest of the
hill.
Councilman Amlicke questioned the exact location that was
being proposed and Supervisor Battalia stated that that
information was not available and that she wanted definite
measurements in footages for further clarification and she
then stated that the matter would be discussed further when
this information was obtained.
4. SALARY AUTHORIZATION - SCHOOL CROSSING GUARDS
RECREATION DEPARTMENT
POLICE DEPARTMENT
School Crossing Guards
Administrator Altieri stated that two persons retired as
School Crossing Guards and he requested authorization to
hire Maria Colandonio and also that Dominick Forte be moved
to full-time status as a crossing guard and, on motion by
III Councilman Amlicke, seconded by Councilman Lerman, it was
unanimously
RESOLVED, that Maria Colandonio be, and
she hereby is, hired as a School Crossing
Guard at the daily rate of $29 effective
October 2, 1986; and
BE IT FURTHER
RESOLVED, that Dominick Forte be, and he
hereby is, moved to full-time status as a
School Crossing Guard at the daily rate
of $29 effective October 2, 1986.

Recreation Department
Administrator Altieri submitted a memo for salary
authorization from William Zimmermann, Superintendent of
Recreation and, on motion by Councilwoman-Silverstone,
seconded by Councilman Amlicke, it was unanimously
■ IIIRESOLVED, that as provided for in the
1986 Town Budget, this Board hereby
authorizes the hiring of the following
individuals at the salaries so stated:
Cathy Cilento, Women's Fitness, $45 per
session, effective October 7, 1986 and
Cindy Owen, Women's Fitness, $35 per
session, effective October 7, 1986.
Police Department
Administrator then presented a salary authorization request
from Police Commissioner Arthur T. Dallas and, on motion by
Councilman Lerman, seconded by Councilman Chapin, it was
unanimously
RESOLVED, that Detective Michael Nardelli
be, and he hereby is, promoted to the
III Civil Service rank of Probationary
Sergeant of Police, at an annual salary
of $37,115, effective October 2, 1986.
TOWN COUNSEL'S REPORT
Attorney Silverberg reported that, in the tax certiorari
matter of Hampshire Country Club, Inc. v. The Town and
Village of Mamaroneck, a decision was rendered by the Hon.
Timothy J. Sullivan, Justice of the Supreme Court, wherein
he dismissed the petition. Mr. Silverberg said the Town
was completely successful and there was no reduction in the
taxes for the years 1981 through 1984.
APPROVAL OF MINUTES
The Minutes of September 4, 1986 were presented and, on
motion by Councilwoman Silverstone, seconded by Councilman
Amlicke, with Supervisor Battalia abstaining because she
was not in attendance at that meeting, were approved as
amended.,
WRITTEN COMMUNICATIONS
There were no written communications to come before the
Town Board at this time.

ORAL COMMUNICATIONS
Dr. Siconolf1 stated that there were potential problems
regarding dumping at the Garfield Housing construction site
and that the agreement the residents have with the builders
regarding certain rules and regulations to be adhered to
during the construction period was not being complied
with. He added that since the area was being used as a
dumping site, the rat population has increased.
Attorney Silverberg stated that the Town was not a party to
that agreement but the dumping problem should be addressed
by the Town and Supervisor Battalia stated that the'builder
was notified in writing regarding the removal of items but
he said that what was dumped was to be used as fill.
Councilman Lerman recommended that the Town Administrator
check out the entire area to make certain everything is
being done properly and legally and, if it isn't, then
appropriate action regarding these matters be taken.
George Januzzi, 9 Parkland Avenue, stated that he was
concerned about the safety of the children who play in the
area near Dillon Road because of the speed that cars travel
down the narrow street. He also stated that the road has
terrible 90 degree bends in it and that he would like to
see a "Caution - Children at Play" sign installed in order
to try to slow down the traffic.
IIISupervisor Battalia stated that this matter would be
referred to the Traffic Committee for its October 20th
meeting.
Councilman Lerman stated that a "For Exit Only" sign at the
Northville Gas Station was removed and he recommended
canceling their Special Permit and Attorney Silverberg
suggested that the gas station be notified of the
continuing violation and Supervisor Battalia requested
Counsel to draft an appropriate letter regarding this.
Mr. Januzzi stated that the street sweeper could not clean
on Parkland Avenue because of all the cars parked there and
Supervisor Battalia stated that she would check the
schedule for the street sweeper in that area.
Mrs. Ruth Hoffman, 21 North Chatsworth Avenue, stated that
there are many "No Smoking" rules but none about the way
the incinerator in Larchmont is still burning away like
crazy. She added that she has called the County and that
IIIthey do come but that nothing is done.
Mrs. Dimetradis thanked the Town Attorney for his letter
and then stated that she had been in touch with County
Legislator, Diane Keane, who was unaware of the problems
caused by the incinerator. Supervisor Battalia then
outlined all the steps she had taken with other levels of
government on behalf of Mrs. Dimetradis and others
regarding this issue.

Supervisor Battalia suggested that calls be continued to
the Westchester County Board of Health and perhaps some
legislation would be drawn up by them increasing the
fines. She added that the Town is attempting to address
the situation in addition to what the County is the agency
responsible for enforcement at this time. Mrs. Battalia
further stated that Counsel would be drafting a proposed
local law regarding this and even though his list was long,
Illthis was one of the items on it.
THE SUPERVISOR
Reports
Supervisor Battalia extended her thanks to everyone who was
involved with the Town's 325th Anniversary Celebration. -
She then specifically thanked Paulette Gabbriellini, Clara
Tracy, Steve Altieri and Bill Zimmermann for the many hours
they devoted to making the celebration so successful.
Supervisor Battalia also expressed her sincere gratitude to
Linda and Stephen Kates, and Janet and Rudy Demasi, the
Chairpeople of the 325 Anniversary Committee and, on motion
by Councilman Amlicke, seconded by Councilwoman Silverstone
the following resolution was unanimously adopted:
WHEREAS, the Town of Mamaroneck cele-
brated its 325th Anniversary during the
weekend of September. 20-21, 1986 and
Linda & Stephen Kates and Janet & Rudy
Demasi were chosen as the Anniversary
Chairmen; and
WHEREAS, the tremendous task of planning
and coordinating the festivities which
included a race, regatta, parade and
dinner-dance was taken on cheerfully by
the Kates and Demasi families; and
WHEREAS, Linda and Steve worked day and
night organizing the parade and Janet
and Rudy labored night and day
organizing the dinner-dance; and
WHEREAS, despite minor setbacks, these
events were very successful and everyone
had a wonderful time;
NOW, THEREFORE, BE IT RESOLVED,
that I, Dolores A. Battalia, Supervisor
of the Town of Mamaroneck hereby extend
to
Janet & Rudy Demasi
Linda & Steve Kates
my deep appreciation and gratitude for
their hard work and countless hours
given to the 325th Anniversary
Celebration.

REPORTS OF THE COUNCIL
Councilman Amlicke reported:
1. that he has received many complaints regarding the
traffic light at the intersection at Murray, Myrtle and
North Chatsworth Avenues. He stated that the light is
too brief for making a left-hand turn after making a
III right, and strongly urged that an adjustment be made to
lengthen it.
Administrator Altieri replied that the request has been
submitted to the State and a new phasing schedule will take
into account the pedestrian crossing as well as vehicular
traffic.
2. that on the advice of the Larchmont-Mamaroneck Cable TV
Board of Control, nothing should be signed with the
local cable company until the Town gets an agreement
from them stating that they will maintain the same
local access service as was received from UA Columbia.
Councilwoman Silverstone reported:
1. that she attended a CAC (Conservation Advisory
Commission) meeting and they are in the process of
preparing a division of labor between the (Z M (Coastal
'Zone Management Commission) and CAC because of the
IIItremendous overlapping.
Councilman Amlicke suggested that the CAC start looking
into a compost area in the Town because federal funding has
been obtained for senior citizen housing and that might
have an effect the Taylor Lane compost area.
2. that she and Susan Amlicke, an emeritus member of CAC,
attended a meeting with the Westchester County Refuse
Disposal Advisory Board and that the Taylor Lane
compost area was discussed as well as the issue of
construction debris.
Administrator Altieri stated that Mamaroneck Village was
preparing a site for the upcoming leaf season but that
complaints from residents stopped them from proceeding
further with it. He added that as of today, they planned
to continue with the site and that the Town should have
available space.
3. that she requested the Deputy Town Clerk to send out
letters to the Democratic and Republican Headquarters
stating that no political signs or stickers endorsing
any candidates are to be placed around the Town.
4. that donations can be accepted for the Town of
Mamaroneck Tree Fund in memory of someone or in honor
of them and that a suitable plague will be placed near
the tree. She added that donations are tax deductible
and any checks would be most welcomed.

5. that she has been asked by several residents why the
flag was not flying in Memorial Park.
Supervisor Battalia stated that the V.F.W. would be pro-
viding the Town with a POW (Prisoner of War/Missing in
Action) Flag to be flown in Memorial Park in response to
the request of the Vietnam Veterans Association.
6. that some commuters were parking for an entire day in.
the Washington Square area and suggested that the Town
consider purchasing a small scooter and having a
crossing guard ride around enforcing the parking
regulations.
Councilman Lerman reported:
1. that the CLM Commission has met twice already and that
they usually meet on the third Tuesday of the month.
2. that regarding the Town's sewer connection with the
Fenbrook Subdivision, the CZMC found it was consistent
with their policies and they are recommending it to the
Planning Board.
3. that the Village of Larchmont was considering the
development of an R-40 zone and that the CL MC was
looking into it.
4. that individual places of business, who have been
offenders in the past, should be notified of the new
Noise Ordinance in order for them to comply with it.
ADJOURNMENT
On motion by Councilwoman Silverstone, seconded by
Councilman Lerman, it was unanimously resolved that the
meeting be adjourned at 10:05 P.M. and that the Board
recess into Executive Session to discuss personnel matters.
