HomeMy WebLinkAbout1925_04_13 Town Board Minutes SPECIAL MEETING= OF THE TOWN BOARD TOWN OF MAMARONECK held April 13, 1925. The meeting was called to order by Supervisor Burton at 9 .15 o°clock. P.M. PRESENT : Supervisor Burton Justices Boyd, Collins and Shafer Town Clerk Sherman Counsellor Gamble Upon motion, it was voted to dispense with the reading of the minutes of meetings not yet approved. Justice Shafer offered for adoption the follow® inf resolution : BE IT RESOLVED, that "The Building Code of the Town of Mamaroneck" adopt- ed by this Board at a meeting held on June 6, 1923, as amended ,bo and the same hereby is further amended by adding thereto a new article to be known as Article XIII , which shall read as follows ; ARTICLE XIII Section 1. A Fire District is hereby established. Section 2. The Fire District sho.11 consist of the lands and premises classified as C . District, shown and designated on the Zoning Map of the unincorporated part of the Town of Mamaroneck, annexed to the Zoning Ordinance of said Town and adopted by the Town Board of said Town on June 21, 1922. Section 3. No building or structure of any kind shall be built, erected or constructed within said fire district unless enclosing, interior and party walls thereof shall be of brick, concrete or other substantial and fire resisting material . Section 4. No beams, mirders, trusses or columns of wood shall be used upon any building- or structure within said fire district which are designed to support walls wr columns and if of iron or steal they shall be protdoted by at least metal lath and cement plaster. Wooden floors, roofs and partitions shall be fire stopped. Roof covering shall be of incombustible materials. Bays and projections shall be covered by incombustible materials. The Building Commission shall have the power to exempt any building from the operation of this section. Section 5. Nothing in this article shall prevent the restoration of a building destroyed by fire, explosion, act of God, or act of the public enemy to the extent of not more than 50' of its assessed. value, or prevent the continuance of the use of such building or part thereof or prevent a chanve of such existing use under the limitations of the Zoning Ordinance. But any building destroyed in the manner aforesaid to an extent exceeding 50% of its assessed 23,:7 value at the time of such destruction way be reconstructed and thereaftdr used only in such a manner as to conform to all the provisions of this ordinance. Section o. No building or other structure, im:a Class C District, as shown and designated on the Zoning Sdap of the unincorporated part of the Town of Yamaroneck annexed to the Zoning Ordinance of said Town adopted on June 21, 1922, shall be so placed or constructed as to have the floorl'.Ievel of the first floor thereof more than twelve (1211) inches atove the curb level of the Street upon which it fronts, as established by the Town Board. Section 7. This ordinance shall take effect immediately. Be it further RESOLVED, that the Town Clerk be and he hereby is authorized and empowered to publish said ordinance in the Mamaroneck Paragraph and Larchmont Times and post same according to law. Upon a vote being taken upon the foregoing resolut- ion, the same was declared unanimously .adopted. The Clerk was requested to communicate with the Board of Appeals requesting that its members appear before the Town Board at its meeting to be held .on Wednesday, April 15th, 1925 . The Supervisor reported that he had caused a search of title to be made affecting the Town property at the Town Hall because of the apparent uncertainty as to the actual holdings of the Town in that property, and he therefore re- quested the apnroval of his action. Upon motion, duly seconded, it was, upon Roll Call RESOLVED, that the action taken by the Supervisor in causing a search of title to be made affecting the Town property at the Town Hall ce and the some hereby is ratified, and approved, provided, however, that the expense incurred there- by does not exceed the sum of $200 .00 .
