HomeMy WebLinkAbout2020_03_18 Town Board Minutes March 18, 2020 MINUTES OF THE REGULAR MEETING AND WORK SESSION OF THE TOWN BOARD OF THE TOWN OF MAMARONECK HELD ON MARCH 18, 2020, BEGINNING AT 5:00 PM CONFERENCE ROOM D AND CONTINUING AT 8:00 PM IN CONFERENCE ROOM C OF THE TOWN CENTER, 740 W. BOSTON POST ROAD, MAMARONECK, NEW YORK PRESENT: Supervisor Nancy Seligson Councilwoman Abby Katz Councilwoman Jaine Elkind Eney Councilwoman Sabrina Fiddelman Councilman Jeffery L. King ALSO PRESENT: Christina Battalia, Town Clerk Stephen V. Altieri, Town Administrator Connie Green O’Donnell, Deputy Town Administrator William Maker, Jr., Town Attorney CALL TO ORDER - WORK SESSION On motion of Councilwoman Fiddelman, seconded by Councilwoman Katz, the Work Session was unanimously opened at 5:00 p.m. Update – Sidewalk – Hickory Grove Drive East Additionally Present: George Alt The Town Board reviewed a memo from Rob Wasp the Town Engineer outlining the project. Attached were “schematic drawings that show the construction of a new five foot wide concrete sidewalk following the northbound travel lane. New proposed sidewalk commences at the limit of current walk in front of #194 Hickory Grove Drive East and terminates at the intersection with Rockland Avenue in front of #808 Hickory Grove Drive East.” Mr. Alt asked if the Town could reduce the sidewalk to three (3) feet and Mr. Altieri responded, no due to ADA compliance. The Town will be sending these schematics to the neighbors on both sides of the street, along with mark up for any trees that are proposed for removal. Rock Removal Law Mr. Maker issued a summary chart with suggested revisions to the law. The chart also included comments to those revisions from the Building Inspector, Rich Polcari. Requests have been made to halt rock removal. The Town Board discussed their ability under the Governor’s Executive Order to suspend laws. The Town Board asked how many rock removal permits have been issued, and Supervisor Seligson added that there is one pending for 30 Greystone. Mr. Maker responded that the Town Board has the ability to suspend laws for five days, and then can renew for another five days, and so on. The Town Board agreed to suspend rock removal until the next Town Board meeting. The Town Board then discussed in detail the chart prepared by Mr. Maker. Kate Beebe a resident from Colonial Avenue stated that residents are under an enormous amount of stress right now and will begin to be very vocal in opposition of rock chipping. Ms. Beebe continued stating that the current FAR law does not include basements, and developers are building out completely to include large-scale basements, some even with complete ‘Nanny Suites’. Supervisor Seligson stated that the FAR law will be addressed by the Comprehensive Plan. ADDED ITEMS Comprehensive Plan The Town Board will postpone the launch of the public outreach due to the Coronavirus. Coronavirus Update The current statistics are 2,382 cases in New York State, 538 in Westchester County and 4 in Larchmont. The Governor is utilizing his power and has issued Executive Orders. 1 March 18, 2020 Mr. Altieri noted the changes the Town is making, specifically, an A and B employee schedule, and an attendant at the front door to limit public access. The County Executive would be coming this evening to address the Town. Mr. Altieri informed the Town Board that the Sanitation Commission has discussed with the Village of Larchmont initiating a once a week curbside pickup. The Peddler’s Law Deferred Town Supervisor - Law Suspensions The Town Board will suspend the no overnight parking from 3:00 to 6:00 am and the alternate side of the street parking in Washington Square. The Town will section off a part of Lot A for overflow from street parking. EXECUTIVE SESSION On motion of Councilwoman Elkind Eney, seconded by Councilman King, the Board unanimously agreed to enter into an Executive Session to discuss Litigation regarding the Board of Harbor View Condominiums v/ Paul Goodman. On motion of Councilwoman Katz, seconded by Councilwoman Elkind Eney, the Board unanimously agreed to resume the Meeting. On motion Councilwoman Fiddelman, seconded by Councilwoman Elkind Eney, it was RESOLVED, that the Mamaroneck Town Board does hereby authorize the Town Attorney, William Maker Jr., to utilize the litigation strategy as discussed during worksession. The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye CALL TO ORDER - REGULAR MEETING The Regular Meeting of the Town Board was called to order by Supervisor Seligson. Supervisor Seligson noted that the Town Board met for a worksession beginning at five o’clock this evening. She then introduced the County Executive. County Executive George Latimer The County Executive addressed the Town Board regarding Coronavirus and the increasing number of infections, stating that information is changing hourly. Yesterday in New York State, there were 2,382 cases up from the day before of 1,374. The County Executive outlined Executive Orders being issued by the Governor. SUPERVISOR’S REPORT Our community, like every other community in the area and maybe the country, have been dealing with the Coronavirus and managing our communication and responses to it. It is an unprecedented and unnerving situation, but the community has been wonderful in managing its level of concern and the Town of Mamaroneck government has been running smoothly. Town Administrator Steve Altieri and I have been participating in conference calls with the Governor’s 2 March 18, 2020 office, the County Executive and our Town, Village School leaders on a regular frequent basis. Here th is the updated information for March 18:  As many other communities have done, we are beginning to restrict public access to the Town Center tomorrow. Residents will now have to make an appointment to enter the Town Center. We will have department phone numbers posted on the Town website and Town Center door.  The Governor has requested that all municipal governments decrease their staffing by 50% and the Town has instituted a rotating schedule whereby half of each department will work Monday, Wednesday, Friday and the other half will work Tuesday, Thursday and then reverse the next week. Employees will be asked to work from home as much as possible on their home days. This does not apply to the Police Department, Fire Department and Ambulance Service. All emergency services will remain at full staff.  Due to the changes, it is possible that administrative responses could be slower than usual.  The Building Department will only conduct exterior building inspections. There will be no interior building inspections.  Beginning April, Town Board meetings will go online with public access through a telephone line.  All meetings of boards and commission are cancelled for the months of March and April.  Stop N Shop and DeCiccos supermarkets have instituted shopping times exclusively for senior citizens and people with compromised immune systems. DeCiccos is from 8:00 to 8:30 am and Stop N Shop is from 7:00 to 7:30 am.  We declared a State of Emergency in the Town yesterday as a precautionary measure.  The Town Board is waiving certain parking regulations so there will be no enforcement effective this Friday, March 20, 2020. o Overnight prohibition o Alternate side of the street parking in the Washington Square area o The newly implemented commuter parking prohibition. The details will be available on the Town website. Please take care and respect the changes in our lifestyle to protect the health of all of us in the community. BOARD OF FIRE COMMISSIONERS The Meeting was called to order by Commissioner Seligson, and then on motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, the Board of Fire Commissioners was unanimously declared open. Authorization- Amendment – 2020 Capital Projects On motion of Commissioner Elkind Eney, seconded by Commissioner King, it was RESOLVED, that the Mamaroneck Board of Fire Commissioners does hereby approve the amendment to the 2020 Capital Project Plan to purchase a utility vehicle for the Fire Department and exclude from the 2020 Capital Project Plan the replacement of a Fire Chief Vehicle. There being no further business to come before the Commission, on motion of Commissioner Elkind Eney, seconded by Commissioner Fiddelman, the Commission unanimously adjourned and the Town Board reconvened. AFFAIRS OF THE TOWN 1. Authorization – Purchase of Sewer Camera Truck On motion of Councilwoman Elkind Eney, seconded by Councilwoman Katz, it was RESOLVED, that the Mamaroneck Town Board does hereby approve the purchase of a Sewer Camera Truck at a cost not to exceed $165,000 in accordance with the 2020 Capital Project Plan. 4 March 18, 2020 The above resolution was put to a roll call vote: King Aye Fiddelman Aye Elkind Eney Aye Katz Aye Seligson Aye 3. Set Public Hearing - Emergency Extension for Filing of an Application for a Senior Citizen Exemption” Law On motion of Councilwoman Elkind Eney, seconded by Councilwoman Fiddelman, it was unanimously RESOLVED, that the Mamaroneck Town Board does hereby set the date for a Public Hearing on an “Emergency Extension for Filing of an Application for a Senior Citizen Exemption” Law, for April 1, 2020 at 8:00 p.m. at the Town Center, 740 West Boston Post Road, and BE IT FURTHER, RESOLVED, that the Town Clerk is hereby authorized to publish the notice of said hearing in a newspaper appointed as an official newspaper, and that said Notice, be posted. 5 March 18, 2020 REPORT OF COUNCIL The Town Board Members reported on their various activities and meetings since the last Town Board Meeting.
