HomeMy WebLinkAbout1925_04_01 Town Board Minutes MEETING OF THE TOWN BOARD TOWN OF MAMARONECK held April 1, 3.925 The meeting was called to order by Supervisor Burton at 5.45 o' clock P.M. PRESENT : Supervisor Burton Justices Boyd and Collins Town Clerk Sherman Counsellor Gamble The minutes of the meeting of March 4th, were read and upon motion duly seconded, approved. A committee representing the Hillside Holding Corporation appeared before the Board relative to changes in the Zoning Ordinance and also in the matter of the widening of streets in the section of Jefferson Street and Chatsworth Avenue. After consideration and discussion of the fore- going questions, the matter was laid over to be taken up at a ;special meeting on Saturday, April 4th, at 2:30 P.M. A communication. from Mr. Julian L. Franck was received and read, relating to an accident at the Weaver Street Police Headquarters on Thursday, March 25th. The communication was ordered received, placed on file and the matter referred to Counsellor Gamble. Messrs. Shongut and Goodwin appeared before the Board as a committee from the Chamber of Commerce, requesting that certain changes and alterations be made in the Town Hall for the purpose of making said place suitable for public meetings. After due consideration the matter was referred to a committee which consisted of Justices Collins and Boyd and Town Clerk Sherman. The Clerk presented the Abstract of town accounts for the year 1924, duly certified by the Town Board of Audi tors. Upon motion duly seconded, it was, upon Roll Call unanimously RESOLVED, that the Supervisor be and he hereby is authorized and empowered to have the abstract of town accounts published in accordance with section - 98 of the Town Law and that the same be made a Town charge. A communication from the New York Inter®Urban Water Company was received and read, advising that the extension of water mains on Rockland Avenue as requested by the Town Board on December 26th last had been authorized and work on this alteration will be commenced as soon as possible. The communication was ordered noted in the minutes and placed or, file. 255 The following communications from the Board of Appeals were received, read, ordered spread upon the minutes and are as follows: RESOLVED, that the Board of Appeals recommend to the Town Board that the application. of Michael Doherty to - erect an apartment house on the south- east corner of the Boston Post Road and Premium River Road (Dillon, Park) in an unclassified section, be grant- ed and that the decision of the Build- ing Commission be reversed provided that the said building complies in all respects with the requirements of the Zoning Ordinance as to Use, Area and Height Districts C . RESOLVED, that the Board of Appeals recommend to the Town Board that the application of the Harimo Corporation to erect a one family dwelling on the east side of Harmony Drive about 310 feet southeast of Kenmare Road within 6 feet of the side lines on both sides, be granted and the decision of the Build- ing Commission reversed, provided that the nearest point of the said dwelling be not less than 30 feet from the street line nor less than 5 feet from either side line. RESOLVED, that the Board of Appeals recommend to the Town Board that the application of Ida M. Parent to alter a two family dwelling on the northwest corner of Weaver Street and Fernwood Road be granted and the decision of the Building Commission reversed. RESOLVED, that the Board of Appeals recommend to the Town Board that the application of 11illiam Monk to erect a one story frame store on southwest corner of Deane Place and Boston Post Road in the unclassified section, be ' granted and the decision of the Build- ing Commission reversed. RESOLVED, that the Board of Appeals recommend to the Town Board that the application of Monroe Stiner to erect a one family dwelling on the southeast corner of Edgewood Avenue and Edgewood Terrace within 30 feet of Edgewood Terrace, be granted and the decision of the Building Commission reversed, pro- vided no part of said building be nearer than 25 feet of Edgewood Terrace, whereupon the following resolutions were presented by Justice Collins, seconded by Justice Boyd, and the question being taken they were unanimously adopted: WHEREAS, the Board of Appeals has re- commended to the Town Board that the application of Michael Doherty to erect an apartment house on the south- east corner of the Boston Post Road and Premium River Road (Dillon Park) in the unclassified section, be granted and that the decision, of the Building Commission be reversed, provided that the said building complies in all res- pects with the requirements of the Zoning Ordinance as to Use, area, and Height Districts C, THEREFORE, BE IT RESOLVED, that the Town Board, pur- suant to article 5 section. 26 of the Town Law hereby consents to and con- firms the action of the Board of Appeals in reversing the decision of the Building Commission WHEREAS, the Board of Appeals has recommended to the Town Board that the application of Harimo Corporation to erect a one family dwelling on the east side of Harmony Drive about 319 feet southeast of Kenmare Road within 6 feet of the side lines on both sides, be granted and the decision of the Building Commission reversed, provided that the nearest point of the said dwelling be not less than 30 feet from the street line nor less than 5 feet from either side line, THEREFORE, BE IT RESOLVED, that the Town Board, pursuant - to article 5 section, 26 of the Town Law hereby consents to and confirms the action of the Board of Appeals in - - reversing the decision of the Building Commission WHEREAS, the Board of Appeals has recommended to the Town Board that the application of Ida M. WHEREAS, the Board of Appeals has re- __ commended to the Town Board that the application of 'Rilliam Monk to erect a one story frame store on southwest corner of Deane Place and Boston Post Road in the unclassified section, be granted and the decision of the Build- ing Commission reversed, THEREFORE, BE IT RESOLVED, that the Town Board,pursuant to article 5 section 26 of the Town Law hereby consents to and confirms the action of the Board of Appeals in rever- 5 sing the decision of the Building Commission WHEREAS, the Board of Appeals has recommended to the Town Board that the application of Monroe Stiner to erect a one family dwelling on the -- southeast corner of Edgewood Ave- nue and Edgewood Terrace within 30 feet of Edgewood Terrace, be granted and the decision of the Building Commission be reversed provided no part of said building be nearer than 25 feet of Edgewood Terrace, THERE- FORE, BE IT RESOLVED, that the Town Board, pursuant to article 5 section 26 of the Town Law hereby consents to and confirms the action of the Board of Appeals in reversing the decision of the Building Commission. A communication from F. G. Hausman was received and read, stating that he had received a tax hill from the Receiver of Taxes for the unpaid taxes of 1918, State, County, Town and School taxes affecting section 2:_» bloek3l, lots 19 2, 3 and 4; and further stating that the above mentioned items were paid on June 18, 1919 to the Receiver of Taxes The matter was referred to Counsellor Gamble for report. A communication from the Lawyers Title & Guaranty Company was received and read, stating that there appears to be a double assessment for the 1918 sale of taxes affecting section 1, block 82, lots 11 and 12. The matter was referred to Counsellor Gamble for report. Counsel reported that the Board of Sewer Commiss- ioners of Sewer DistrictNo. 1 of the Town of Mamaroneck had heretofore purchased from Mary Mulcahey certain property located on the south side of Palmer Avenue, easterly of Weaver Street, described on the assessment roll of 1923am Lot 4, Block 20, Section 4, He stated that the title tosaid property had been taken in the name of the Town of Mamaroneck and that it had been agreed in connection with said sale that the seller would not be liable for any taxes subsequent to March 31, 1924. He further stated that inasmuch as the 1924 taxes were made up from the assessment roll of 19239 the State, County and Torn taxes fob 1924, as well as:rschool taxes for 1924, were outstanding as unpaid, and he recommended that the aforesaid taxes be marked 01Cancelled. /9 Upon motion duly seconded, it was RESOLVED, that the Supervisor be and hereby is authorized and empowered to cancel State, County and Town taxes for the year 1924 and school taxes for the year 1924 on Lot 4, Bloci 20, Section. 4, as shown on the assessment roll of 1923. It was FURTHER RESOLVED, that the Supervisor be and hereby is authorized and empow- ered to direct the Receiver of Taxes and the Board of Assessors to note the aforesaid cancellation of taxes upon their books of record. The question being taken upon the foregoing resolution, the same was, upon Roll Call, unanimously* adopted. Upon the recommendation of Tyr. Gagliardi , who appeared on behalf of the Board of Park Commissioners, the following; resolution was presented by Justice Boyd, seconded by Justice Collins, which, upon Roll Call, was unanimously adopted: INHEREAS, the Town, of Mamaroneck, acting~ by and thru the Board of Park Commission- ers of the Town Park District No. 1 of the Town. of Mamaroneck, New York, has acquired and is now the owner of certain premises described as Lots 1, 2, 3, 4, 5 and 23, Block 82, Section. 1, on the Assessment Map of the Town of Mamaroneck; and 7HEREAS, the said premises were acquired for park purposes pursuant to the provis- ions of Chapter 574 of the Laws of 1924; and REAS, title to said premises was taken by said Town of Mamaroneck subject to the 1924 town and school taxes affectinE the same; and WHEREAS, the Board of Park Commissioners have applied to have said taxes cancelled, now, therefore, be it RESOLVED, that the Receiver of Taxes be and he hereby is authorized and empowered to cancel the 1924 school and town taxes affecting, said Lots 1, 2, 3, 4, 5 and 23, Block E2, Section 1, on the Assessment Roll wherever the same may appear, by making a reference thereon to this resolut- ion. Be-, it further RESOLVED, that the Town Clerk be requested to furnish the Receiver of Taxes with a certified copy of the foregoing; resolution. A communication from the 7oman'QS Club of Larchmont was received and read, requesting; permission to use the -- Community Room of the `Weaver Street Fire House for their meetings. The communication was ordered received, placed on file and the matter referred to the Fire House Committee of this Board. A communication from the Harimo Corporation was received and read, requesting; the installation of electric lights on Kenmare Road. The communication was ordered received, placed on file and the matter referred to the Superintendent of High- ways for report. 253 A communication from Howell C . Perrin was receivedand read, stating that the Howell Park: Association had expressed itself as being eager to have some short-cut direct from Howell Park to Larchmont village and to the Chatsworth Avenue school. The communication was ordered received, placed on file and the matter referred to the Superintendent of Highways for report. Upon motion, the meeting adjourned at 11:20 o*clock P.M. Own Clark.
