PRESENT: Mr. Fred Maggini, Chairman Mr. Henry Mullick Mr. Joseph Rigano ABSENT: Mr. G. Norman Blair Mr. John O'Conor ALSO PRESENT: Mr. Maurice Friedlander, Town Engineer and Building Inspector MURDOCK WOODS SECTION 4 Mr. Friedlander reported that Murdock Woods Section 4 had been purchased from Split Tree Realty Co. by Mr. Gabriel Vitro of Rockland Avenue, Mamaroneck. He stated that Mr. Vitro was prepared to develop the subdivision in accordance with the res- olution adopted by this Board on May 5, 1958. The engineer also reported that further investigation had revealed that the requirement for a bond in the amount of $11, 090. 00 was in error and that a bond in the amount of $5, 500. 00would be sufficient to cover the required improvements. However, he stated that an easement for storm drains and water pipelines would be required thru land not lying in streets and that the plans and specifications and construction drawings had been corrected accordingly. Following further discussion upon motion by Mr. Rigano, seconded by Mr. Mullick, the following resolution was unanimously adopted: RESOLVED that the resolution adopted by this Board on May 5, 1958, be rescinded and the following resolution be adopted. 204 RESOLVED that the application of Gabriel Vitro for subdivision map or plat entitled "Subdivision Map of Section 4, Murdock Woods, Town of Mamaroneck, Westchester County, New York made by Sal Spinelli, Land Surveyor, New York State License #23043 and dated March 31, 1958, be and same is hereby granted subject to the following conditions: 1. That the applicant shall install all street improvements in accordance with the plans and specifications filed with this application and in accordance/with the standard and specifica- tions and procedure acceptable to the appropriate Town de- partments or alternatively, that a preformance bond sufficient to cover the full cost of the same as estimated by the Town Engineer shall be furnished to the Town by the applicant. 2. That in the event the performance bond be given, such performance bond shall be issued by a bonding or surety com- pany approved by the Town Board as to form, sufficiency and amnner of execution for the term not to exceed three years. 3. That formal offers or deeds of cession to the public of all streets, highways or public places not marked with such notation on the plat including a deed or grant of an easement for storm drains and water pipes as shown in said plans and specifications be filed with the Planning Board in form sat- isfactory to the Town Attorney to be held until such streets and easement are formally accepted by the Town Board, pro- vided that such delivery of such orrers or deeds shall not constitute an acceptance by the Town of the dedication of any such street or highway nor waive the payment of necessary title charges and recording fees; but such acceptance shall be based solely upon the adoption of a resolution by the Town Board. FURTHER RESOLVED that upon compliance with the above con- ditions, the Chairman of the Planning Board is hereby authorized to sign such subdivision map as evidence of the approval of the same by the Town Board.
