CALL TO ORDER The Chairman called the meeting to order at 8:30 p. m. PRESENT: Mr. Fred Maggini, Chairman Mr. Joseph Rigano Mr. G. Norman Blair Mr. Lee Bloom Mr. Henry Mullick ALSO PRESENT: Mr. Maurice Friedlander, Town Engineer and Building Inspector Councilman Peter Kane APPROVAL OF MINUTES The minutes of the meeting of March 2, 1959, were approved as presented. OLD BUSINESS---SECTION ONE MURDOCK WOODS Mr. Harold Blass, agent for Split Tree Realty Corp, appeared and stated that he had new plans to submit as had been requested at the meeting of the Board on March 2, 1959. The Board examined the plans and drawings which Mr. Blass submitted and Mr. Friedlander said that they seemed to be in order. 217 Following some further discussion upon motion by Mr. Blair seconded by Mr. Bloom, the following resolution was unani- mously adopted: WHEREAS, Harold Blass, agent for Split Tree Realty Corp. , owners of a subdivision known as Section One, Murdock Woods, found on a certain map entitled "Section One, Subdivision Map of Murodck Woods, Property of Theresa Berne, Town of Mamaroneck, Westchester County" filed in the County Clerk's Office as Map #6528 on Feb. 16, 1948 and a map entitled "Amended Map of Part of Section One, Murdock Woods, Town of Mamar- oneck, Westchester County" known as Map #7767 filed in the County Clerk's Office July 11, 1952, has filed with this Board an application for the approval of plans and specifications for the construction of im- provements of streets and sewers, drains, etc. on the following part or portion of Murdock Road and Salem Drive which is in Block 304, Parcels 443 and 774 on the Tax Assessment Map of the Town of Mamaroneck and which is described as follows: Description of a portion of Murdock Road and the southerly end of Salem Drive: All that certain parcel of land, 50 feet wide, being in the Town of Mamaroneck, County of Westchester and State of New York, and more particularly bounded and described as follows: Beginning at a point on the easterly side of Murdock Road as shown on the map entitled "Section One, Sub- division Map of Murdock Woods, Property of Theresa Berne, Town of Mamaroneck, Westchester County, N. Y. " made by Guy Vroman C. E. December 27, 1947 and filed in the Office of the County Clerk of West- chester County (Division of Land Records) February 16, 1948 as Map #6528, said point of beginning being distant in a southerly direction 627. 50 feet from the southerly end of a curve having a radius of 15 feet connecting the northeasterly side of Murdock Road with the southerly side of Griffen Avenue, said point of beginning also being the southeasterly end of Murdock Road as described and deeded to the Town of Mamaroneck in Liber 5339, Page 475 of deeds recorded in the Office of the Clerk of the County of Westchester (Division of Land Records) on June 16, 1954., Running thence along the easterly side of 218 Murdock Road south 32 degrees-20' east, 369. 00 feet to a point running thence southerly on a curve to the right having a radius of 350. 00 feet a distance of 163. 91 feet to a point of tangency; thence south 5 degrees-30' east 150. 00 feet to a point, running thence southwesterly on a curve to the right having a radius of 470. 00 feet a distance of 478. 49 feet to a point; thence running across Murdock Road in a southwesterly and northwesterly direction on a curve to the right having a radius of 80. 00 feet a distance of 125. 16 feet to a point on the easterly side of lot 18 as shown on said map, thence northwesterly along the easterly side of lot 18 and lands now or formerly of Beringer on a curve to the right having a radius of 400. 00 feet a distance of 164. 32 feet to the southerly end of Salem Drive as shown on "Section Three, Subdivision Map of Murdock Woods" in the Town of Mamaroneck, Westchester County, N. Y. , made by Sal Spinelli, L. S. N. Y. S. 23043 dated and filed in the Office of the County of Westchester (Division of LandRecords) on May 27, 1955 as Map 9919, thence northeasterly along the southerly end of Salem Drive as shown on said map north 76 degrees-00' east a distance of 50. 00 feet to the easterly side of Salem Drive and lot 16 as shown on Map #6528; thence in a southeasterly direction along the westerly side of lot 16 on a curve to the left having a radius of 350. 00 feet a distance of 143. 78 feet to a point of compound curve connecting the westerly side of Murdock Road and the easterly side of Salem Drive; thence on a curve to the left having a radius of 30. 00 feet a distance of 46, 93 feet, to a point of compound curve; thence in a northeasterly direction along a curve to the left having a radius of 420. 00 feet a distance of 427. 57 feet to a point of tangency; thence north 5 degrees-30' west a distance of 150. 00 feet to a point; thence on a curve to the left having a radius of 300. 00 feet a distance of 140. 50 feet to a point of tangency; thence north 32 degrees-20' west a distance of 299. 29 feet to a point said point being the north east corner of lot #6 as shown on "Amended Map of part of Section One, Sub- division Map of Murdock Woods, property of George R. Bishop, Town of Mamaroneck, Westchester County, N. Y. " made by Sal Spinelli, L. S. N. Y. S. 23043, June 21, 1952 and filed in the Office of the County Clerk of 219 Westchester County (Division of Land Records) on July 11, 1952 as Map #7767, thence on a curve to the left having a radius of 16. 23 feet a distance of 35. 02 feet to a point on the southerly side of Split Tree Road as shown on said map thence north 20 degrees-44'15" east 94. 10 feet to the easterly side of Murdock Road and the point or place of beginning. WHEREAS, a public hearing was duly held pursuant to the provision of Section 276 of the Town Law after notice published in the official newspaper of the Town of Mamaroneck, The Daily Times of February 25, 1959; and WHEREAS, this Board has examined the plans and specifi- cations and has determined that same are all satisfactory subject to the conditions hereinafter recited, NOW, THEREFORE, BE IT RESOLVED that the application of Harold Blass, agent for Split Tree Realty Corp. , for the approval of plans and spec- ifications for the construction and improvements of streets, sewers, drains, etc. on a certain portion of Murdock Road and Salem Drive, as above described, be and the same is hereby granted subject to the following conditions: 1. That the applicant will comply with all Rules and Regulations of the Town of Mamaroneck PlanninO3oard with respect to street improvements. 2. That no Building Permit shall be issued unless or until the applicant has furnished a bond in the amount of $37, 550. 00 for the completion of such improvements, such bond to run for a term of three years and to be issued by a bonding or surety company approved by the Town Board as to form, sufficiency and manner of execution. 3. That easements for sewer and drainage purposes be granted to the Town of Mamaroneck in accordance with the following descriptions: 10' DRAIN EASEMENT Beginning at a point on the easterly side of Murdock Road, said point being a distance of 10. 04 feet southerly from 220 r the division line of lots 15 and 17 as shown on Map of Murdock Woods, Town of Mamaroneck, Westchester County, New York , which is filed in the Westchester County Clerk's Office (Division of Land Records) as Map #6528, thence running through lot 17 and the property of now, or formerly Peysam Developers, Inc. , south 66 degrees, 43' 35" east 230 feet more or less to a brook, thence running along the said brook south 23 degrees, 16' 25" west 10 feet to a point; thence running through the property of now or formerly Peysam Developers, Inc. and lot 17 north 66 degrees 43' 35" west 230 feet more or less to the easterly side of Murdock Road; thence running along the easterly side of Murdock Road in a northerly direction on a curve to the left having a radius of 470 feet for a distance of 10 feet to the point or place of beginning. 10' SEWER EASEMENT BEGINNING at a point on the easterly side of Murdock Road, said point being a distance of 16. 04 feet southerly from the division line of lots 13 and 15 as shown on Map of Murdock Woods, Town of Mamaroneck, Westchester County, New York and filed in the Westchester County Clerk's Office in the division of Land Records as Map #6528; thence running through lot 15 south 83 degrees 10' 59" east 150 feet; thence running south 06 degrees 49'01" west 10 feet to a point thence running north 83 degrees 10' 59" west 150 feet to the easterly side of Murdock Road; thence running along the easterly side of Murdock Road in a northerly direction on a curve to the left having a radius of 470 feet for a distance of 10 feet to the point or place of beginning. 50' UTILITIES EASEMENT BEGINNING at a point on the easterly side of Murdock Road said point being on the division line of a proposed road and lot 5 as shown on a map of Murdock Woods (Section One) Town of Mamaroneck, Westchester County, New York and filed in the Westchester County Clerk's Office in the division of Land Records as Map #6528 thence running on a curve to the left in an easterly direction having a radius of 20 feet for a distance of 31. 42 feet to a point of compound curve; thence running on a curve to the left in an easterly direction having a radius of 600 221 feet for a distance of 150 feet; thence north 43 degrees 20'33" east 107. 16 feet to a brook; thence running south 24 degrees 25' 30" east 53. 95 feet and south 43 degrees 20'33" west 86. 89 feet to a point of curve thence running on a curve to the right in a southwesterly direction having a radius of 650 feet for a distance of 162. 42 feet to a point of tangency; thence running south 57 degrees 40' west 20 feet to the easterly side of Murdock Road, thence running along the easterly side of Murdock Road north 32 degrees 20' west 70 feet to the point or place of beginning. 4. That formal offers or deeds of cession to the public of the street known as Murdock Road as above described be filed with the Planning Board in form satisfacotry to the Town Attorney including a deed or grant of an easement as above described, to be held until such street is formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of the dedication of any such street or highway nor waive the payment of necessary title charges and recording fees; but such acceptance shall be based solely upon the adoption of a resolution by the Town Board. FURTHER RESOLVED that upon compliance with the above conditions, the Chairman of the Planning Board is hereby authorized to sign the plans and specifications as evidence of the approval of the same.
