HomeMy WebLinkAbout1958_10_06 Planning Board Minutesr MINUTES OF A REGULAR MEETING OF THE PLANNING BOARD OF THE TOWN OF MAMARONECK, HELD OCTOBER 6, 1958, AT POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. CALL TO ORDER The Chairman called the meeting to order at 8:30 p.m. PRESENT: Mr. Fred Maggini, Chairman Mr. Joseph Rigano Mr. Henry Mullick Mr. G. Norman Blair ABSENT: Mr. John O'Conor ALSO PRESENT: Maurice Friedlander, Town Engineer and Building Inspector Peter Kane, Councilman APPROVAL OF MINUTES The minutes of the meeting of September 2, 1958 and the meeting of September 29, 1958, were approved as presented. MURDOCK WOODS SECTION 4 Mr. Irwin Oster, 3 Split Tree Road, Scarsdale, appeared and stated that Murdock Woods, Section 4 had been sold to Mr. Gabriel Vitro, Rockland Avenue, Mamaroneck. Mr. Maggini, chairman, advised Mr. Oster that the Board would appreciate a letter to this effect from Split Tree Realty Co. 193 r BOND---SUBDIVISION MURDOCK WOODS SECTION 3 Mr. Oster was asked by Mr. Maggini as to how the work on Split Tree Road was progressing, and added that if the work on this road was not completed the Planning Board would have to notify the bonding company to that effect. Mr. Oster stated that the contract for the work on Split Tree Road had been let and the work should be completed within a few days. Mr. Maggini instructed Mr. Friedlander, Town Engineer, to follow this work carefully and if it was not completed to advise the Board. PUBLIC HEARING--GLEN ROCK ESTATES, PORTION SECTION3 The secretary presented the affidavit of publication of notice of public hearing as published in the Daily Times on Oct. 1, 1958. The Chairman declared the hearing open and inquired whether any person present wished to be heard. Mr. Joseph W. Gleicher, representing Glen Rock Estates, appeared and explained in detail the map and construction drawings which had been submitted with the application. The members of the Board asked Mr. Friedlander if these plans met with his approval and Mr. Friedlander replied that they were satisfactory to him. Upon ascertaining that no other persons wished to address the Board, on motion duly made and seconded, it was unanimously RESOLVED that the Public Hearing on Glen Rock Estates, Portion of Section 3, be and it hereby is closed. After further discussion and consultation with the Engineer, on motion by Mr. Blair, seconded by Mr. Rigano, the following resolution was unanimously adopted: 194 i I WHEREAS, Glen Rock Estates has heretofore filed with this Board a map or subdivision plat entitled "Subdivision Map for a Portion of Section III, Glen Rock Estates in the Town of Mamaroneck, West- chester County, New York"made by T. J. McEvoy, New York State License #21387 and dated September 22, 1958, in accordance with the provisions of the Town Law and the specifications for street improvements contained in the "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, New York," adopted by this Board on Oct. 19, 1955, together with a final layout showing streets, drains, easements, pavements, curbs and water together with construction drawings prepared in accord- ance with the provisions of Section 6 of said "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, West- chester County, N.Y.," all of which have been approved by the Town Engineer; and WHEREAS, a public hearing was duly held on Oct. 6, 1958 pur- suant to the provisions of Section 276 of the Town Law after notice published in the Daily Times on Wednesday, Oct. 1, 1958; and WHEREAS, this Board has examined the subdivision map or plat together with other details submitted in accordance with the final layout and has determined that same are satisfactory subject to the conditions hereinafter recited, NOW, THEREFORE, BE IT RESOLVED that the application of Glen Rock Estates for final approval of subciivi'sion known as Glen Rock Estates "Subdivi- sion Mapfor a Portion of Section III, Glen Rock Estates in the Town of Mamaroneck, Westchester County, New York" amde by T. J. McEvoy, New York State License #21387 and dated September 22, 1958, be and the same is hereby granted subject to the following conditions: 1. That the applicant shall install all street improvements in accordance with the plans and specification filed with this ap- plication and in accordance with the standards and specifications and procedure acceptable to the appropriate town departments or alternatively, that a preformance bond sufficient to cover the full cost of the same as estimated by the Town Engineer shall be furnished to the Town by the applicant. 2. That in the event the performance bond be given, such per- formance bond shall be issued by a bonding or surety company 195 r approved by the Town Board as to from, sufficeincy and manner of execution for the term not to exceed three years. 3. That formal offers of deeds of cession to the public of all streets, highways or public places not marked with such notations on the plat be filed with the Planning Board in form satisfactory to the Town Attorney to be held until such streets are formally accepted by the Town Board, provided that such delivery of such offers or deeds shall not constitute an acceptance by the Town of the dedications of any such street or highway nor waive the payment of necessary title charges and recording fees; but such acceptance shall be based solely upon the adoption of a reso- lution by the Town Board. FURTHER RESOLVED that upon compliance with the above conditions the Chairman of the Planning Board is hereby authorized to sign such subdivision map as eveidence of the approval of the same by the Town Board. PUBLIC HEARING--SECTION 2 GLEN ROCK ESTATES LOTS 6 & 7 The secretary presented the affidavit of publication of notice of public hearing as published in the Daily Times on Oct. 1, 1958. The Chairman declared the hearing open and inquired whether any person present wished to be heard. Mr. Joseph W. Gleicher, representing Glen Rock Estates, explained in detail the map and construction drawings which had been submitted with the application. Mr. Firedlander stated that he had examined these plans and found them acceptable. Upon ascertaining that no other persons wished to address the Board, on motion duly made and seconded, it was unanimously RESOLVED that the Public Hearing on Glen Rock Estates Section II, Lots 6 & 7, be and it hereby is closed. After further discussion, on motion by Mr. Mullick, seconded by Mr. Maggini, the following resolution was unanimously adopted: WHEREAS, Glen Rock Estates has heretofore filed with this Board a map of subdivision plat entitled "Subdivision of Lots 6 & 7, Section 196 II, Glen Rock Estates in the Town of Mamaroneck, Westchester County, New York,"made by T. J. McEvoy, New York State License #21387 and dated Sept. 17, 1958, in accordance with the provisions of the Town Law and the specifications for street improvements contained in the "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, New York," adopted by this Board on Oct. 19, 1955, to- gether with a final alyout showing streets, drains, easements, pavements, curbs and water together with construction drawings prepared in accordance with the provisions of Section 6of said "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, N.Y.," all of which have been approved by the Town Engineer; and WHEREAS, a public hearing was duly held on Oct. 6, 1958 pur- suant to the provisions of Section 276 of the Town Law after notice published in the Daily Times on Wednesday, Oct. 1, 1958; and WHEREAS, this Board has examined the subdivision map or plat together with other details submitted in accordance with the final layout and has determined that same are satisfactory subject to the conditions hereinafter recited, NOW, THEREFORE, BE IT RESOLVED that the application of Glen Rock Estates for final approval of subdivision known as "Subdivision of Lots 6 & 7, Section II, Glen Rock Estates in the Town of Mamaroneck, West- chester County, N.Y.," made by T. Mr. Gleicher explained these in detail and Mr. Friedlander said that he found them satisfactory. Upon ascertaining that no other persons wished to address the Board, on motion duly made and seconded, it was unanimously RESOLVED that the Public Hearing on Glen Rock Estates Section II, Lots 8 & 9 be and it hereby is closed. McEvoy, New York State License #21387 and dated Sept. 12, 1958, in accordance with the provisions of the Town Law and the specifications for stree improvements contained in the "Requirement for the Approval of Subdivision Plats in the Town of Mamaroneck, West- chester County, New York," adopted by this Board on Oct. 19,1955, together with a final layout showing streets, drains, easements, pavements, curbs and water together with construction drawings prepared in accordance with the provisions of Section 6of said "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester (County, N.Y.," all of which have been approved by the Town Engineer; and WHEREAS, a public hearing was duly held on Oct. 6, 1958, pur- suant to the provisions of Section 276 of the Town Law after notice published in the Daily Times on Wednesday, Oct. 1, 1958; and WHEREAS, this Board has examined the subdivision map or plat together with other details submitted in accordance•with the final layout and has determined that same are satisfactory subject to the conditions hereinafter recited, NOW, THEREFORE, BE IT RESOLVED that the application of Glen Rock Estates for final approval of subdivision known as "Subdivision of Lots 8 & 9, Section II, Glen Rock Estates in the Town of Mamaroneck, West- chester County, N.Y.,"made by T. PROPOSED REVISED ZONING ORDINANCE Mr. Joseph Mirabella, 930 East 212th Street, Bronx appeared and asked if the Board had given any consideration to changing the zoning of Blossom Terrace thereby making it possible to build a two family house on 8100 square feet of property. Mr. Maggini repleid that the Board's thinking at this point was to require more equare feet for the erection of two family houses rather than less. The Board advised Mr. Mirabella to make application to the Zoning Board of the Town of Mamaroneck if he wished a variance.
