CALL TO ORDER The Chairman called the meeting to order at 8:30 p. m. PRESENT: Mr. Fred L. Maggini, Chairman Mr. G. Norman Blair Mr. Henry E. Mullick Mr. John F. O'Conor Mr. Joseph Rigano ABSENT: None Also Present: Town Engineer Friedlander APPROVAL OF MINUTES On motion by Mr. Mullick, seconded by Mr. Rigano, the minutes of the meetings of August 6, 1956, and September 4, 1956, were approved as presented. RE SUBDIVISION MAP OF SAXON PARK ESTATES Following discussion, on motion by Mr. Mullick, seconded by Mr. Rigano, the following resolution was unanimously adopted: WHEREAS, T. J. D. Const. Corp. has heretofore filed with this Board a map or subdivision plat entitled "Map of Saxon Park Estates in the Town of Mamaroneck, Westchester County, N. Y. , made by Thomas J. McEvoy, N. Y. S. 21387, and dated December 30, 1955, County Block 3964, Sheet 45", in accordance with the provisions of the Town Law, and the specifications for street improvements -75- 1 contained in the "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, West- chester County, New York", adopted by this Board on October 15, 1955, together with a final layout showing streets, drains, easements, pavements, curbs, and water, together with construction draw- ings prepared in accordance with the provisions of Section 6 of said "Requirements " all of which have been approved by the Town Engineer; and WHEREAS, a public hearing was duly held pursuant to the provisions of Section 276 of the Town Law after notice published in the Daily Times on July 31, 1956; and WHEREAS, this Board has examined the subdivision map or plat, together with other details submitted in accordance with the final layout has determined that same are satisfactory subject to the conditions here- inafter recited, NOW, THEREFORE, BE IT RESOLVED, that the subdivision map or plat entitled "Saxon Park Estates in the Town of Mamaroneck, Westchester County, N. Y. , made by Thomas J. McEvoy, N. Y. S. 21387, and dated December 10, 1955, County Block 3964, Sheet 45", together with the specifi- cations submitted and approved by the Town Engineer are hereby approved pursuant to the provisions of Section 276 of the Town Law to the end that the sub- division map or plat may be filed in the County Clerk's office, subject, however, to the following conditions: 1. That no building permit shall be issued for the construction of houses on Lots 1, 2, 3, 4, 19, 20, 21, 22, 23, 24, 25, 26, 30, 31, 32, 33, until Saxon Drive and Marbourne Drive, as shown on Sec- tion I of said map are improved in accordance -76- with the construction drawings filed with this application, and the specifications for street improvements contained in the "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, New York", or, in the alternative, that T. J.D. Const. Corp. shall furnish a bond in The sum of $34, 000. for the completion of such improvements, such bond to run for a term of from one to three years, provided, however, that the term of such bond may be extended by the Planning Board, or, at any time during the term of the performance bond may be modified to an appropriate amount so that the new face of such completion bond will cover the costs in full of the improvements already installed, such modification or reduction to be made after due public notice and public hearing as required under Section 277 of the Town Law, and upon further condition that T. J. D. Const. Corp. shall construct and install a connecting street between the portion of Saxon Drive and Marbourne Drive, as shown on Section I of said map, and rough grade the same to a width of twenty-six feet, as shown on the sketch map filed with this resolution. 2. That no building permit shall be issued upon any other lots shown on said map unless and until the remaining portions of all the streets shown on the map hereby approved are completed in accordance with the construction drawings filed with this ap- plication and the specifications for street improve- ments contained in said "Requirements ", or, in the alternative, and additional completion bond to be furnished in such amount as this Board may fix after notice and public hearing. -77- 3. That T. J. D. Const. Corp. shall deliver to the Town Attorney deeds and/or releases for the land lying in the bed of all streets and highways as shown on such subdivision map or plat, and that T. J. D. Const. Corp. shall deliver to the Town Attorney a grant or deed of an easement through Lots 2 and 3 on said map as shown on the construction drawings. FURTHER RESOLVED, that deeds, releases, or grants are received solely for the purpose of compliance with Section 277 of the Town Law, and Section 3 of the "Re- quirements " and that the filing of same shall not constitute the dedication of any streets, high- ways, or easements, until after the approvalby the Town Board, nor waive the payment of the necessary title charges and recording fees. RE PROPOSED STUDY OF ZONING, TOWN OF MAMARONECK The Chairman pointed out that at a special meeting of the Planning Board held on September 12, 1956, to review the proposals submitted by George M. Raymond, and Frederick P. Clark, Planning Consultants, the members of the Board had voted to retain the services of Mr. Clark to study and make recommendations con- cerning the possible revision of the Zoning Ordinance of the Town. Following discussion, the Chairman was directed to contact Mr. Clark and obtain from him a definite proposal as to scope and price. The Board further discussed method of payment, the amount to be ex- pended during the balance of the current year, and the amount to be allocated in the 1957 budget in order to complete this work. On motion duly made and seconded, it was unanimously decided to send the following letter: -78- 1 October 2, 1956 Honorable George D. Burchell Supervisor Town of Mamaroneck, N. Y. Dear Supervisor: At a meeting of the Planning Board held October 1, 1956, it was the decision of this Board to proceed with retaining the services of Frederick P. Clark of Rye, N. Y. , as the Board's consultant, for the study of the Zoning require- ments of the Town, in accordance with resolution passed by the Town Board on July 11, 1956. We will advise the Town Board at a later date regarding all the details. Respectfully yours, Fred L. Maggini FLM:C Chairman BUDGET On motion duly made and seconded, the following budget for the year 1957 was unanimously approved: Secretary $ 300. 00 Supplies & Other Expenses 200. 00 Consultants' Services, etc. 7, 500. 00 $ 8, 000. 00 -79- RE JOINT MEETING OF CHAIRMEN PLANNING BOARDS, LARCHMONT AND MAMARONECK The Chairman advised the members of the Board that he had met with Mr. C. A. Latimer, Chairman of the Planning Board of the Village of Mamaroneck, and Mr. William Eipel, Chairman of the Planning Board of the Village of Larchmont. He said that both Chair- men had expressed their willingness to work with this Board at any time on matters of mutual interest.
