MINUTES OF THE SPECIAL MEETING OF THE
TOWN BOARD OF THE TOWN OF MAMARONECK,
HELD ON THE 22ND DAY OF MAY 1984 IN THE
SUPERVISOR'S OFFICE OF THE TOWN CENTER,
MAMARONECK, NEW YORK
The meeting was called to order at 8:10 A.M. by Supervisor
Battalia.
Present were the following:
Supervisor Dolores A. Battalia
Councilman Lee H. Bloom
Councilman Thomas R. Amlicke
Councilwoman Caroline Silverstone
Councilman Lawrence E. Lerman
Also present:
Stephen V. Altieri, Town Administrator
Steven M. Silverberg, Town Counsel
James Staudt, Counsel to Sanitation Commission
The Board discussed the negotiations relative to Westchester
County Solid Waste Plan, more specifically, the question of
environmental review requirements.
Jim Staudt presented an outline of his discussions with the
County on the environmental question. Basically, the County has
taken the position that they are lead agency in the matter of the
regional transfer stations. If the Town or any other agency cared
to appeal that decision, it is possible within the SEQA Rules and
Regulations.
The Board discussed the next step if the Town wanted the project
classified as a Type I action. If this step is taken, the Town
would become lead agency because it is the County's position to
not classify this matter as Type I.
Steven Silverberg, Town Attorney, explained to the Board the
reasons for his position that an Environmental Impact Study was
required. Councilman Amlicke was of the opinion that the County
was probably correct in their conclusion that an E.I.S. was not
required, but still felt that the Town should require one.
Councilman Bloom agreed with Counsel Silverberg's analysis that
an E.I.S. was required; however, he was not certain that the
Town should assume lead agency status. Supervisor Battalia
expressed the opinion that an E.I.S. was required and that the
Town should seek lead agency status.
The Board then discussed other matters relative to the negotiations
with the County:
a) One-year renewal
b) Property situation
c) Need for easment

d) Accepting private carter, gardeners, Thruway
Authority, etc.
e) Number of trucks from the Village of Mamaroneck
f) Use of compactor during weeks when newspaper
and garbage are picked up on Wednesdays
g) Value of tractors and sale of tractors
The Board's general consensus is that we should allow for the
additional one-year option.
On the question of Environmental Review, the consensus of the
Board is that the Town would assume lead agency status, require
a draft E.I.S. and have the County bear the cost of the E.I.S.
There being no further business, on motion by Councilman Bloom,
seconded by Councilman Lerman, the meeting was adjourned.
