OF THE TOWN OF MAMARONECK, HELD MAY 5, 1958, AT
POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF
MAMARONECK.
CALL TO ORDER
The Chairman called the meeting to order at 8:30 p. m.
PRESENT: Mr. Fred L. Maggini, Chairman
Mr. John O'Conor
Mr. Joseph Rigano
Mr. G. Norman Blair
ABSENT: Mr. Henry E. Mullick
ALSO PRESENT: Mr. Maurice Friedlander, Town Engineer and
Building Inspector
Councilman Peter F. Kane
APPROVAL OF MINUTES
The minutes of the meeting of April 7, 1958, were approved
as presented.
PUBLIC HEARING--MURDOCK WOODS SECTION 4
The secretary presented the affidavit of publication of the
notice of public hearing as published in the Daily Times
on April 30, 1958.
The Chairman declared the hearing open and inquired
whether any person present wished to be heard.

The following persons addressed the Board:
Mr. Irwin Oster, representing Split Tree Realty Corp. , appeared
and explained in detail the map and construction drawings which
had been submitted with the application.
Mr. Friedlander advised that the plans and drawings met with
his approval and that he estimated the costs of the required
improvements to be $11, 090. 00.
Upon ascertaining that no other persons wished to address the Board,
on motion duly made and seconded, it was unanimously
RESOLVED that the Public Hearing on Murdock Woods, Section
4, be and it hereby is closed.
After further discussion and consultation with the Engineer, on
motion by Mr. O'Conor, seconded by Mr. Rigano, the following
resolution was unanimously adopted:
WHEREAS, Split Tree Realty Corporation has heretofore filed
with this Board a map or subdivision plat entitled "Subdivision
Map of Section 4, Murdock Woods", in the Town of Mamaroneck,
Westchester County, New York, made by Sal Spinelli, Land
Surveyor, N Y State License #23043 and dated March 31, 1958,
in accordance with the provisions of the Town Law and the spec-
ifications for street improvements contained in the "Require-
ments for the Approval of Subdivision Plats in the Town of
Mamaroneck, Westchester County, N Y" adopted by this Board
on October 19, 1955, together with a final layout showing san-
itary sewers, streets, drains, easements, pavements, curbs,
and water together with construction drawings prepared in
accordance with the provisions of Section 6 of said "Requirements
for the Approval of Subdivision Plats in the Town of Mamaroneck,
Westchester County, N Y", all of which have been approved by
the Town Engineer; and
WHEREAS, a public hearing was duly held on May 5, 1958, pur-
suant to the provisions of Section 276 of the Town Law after
notice published in the Daily Times on April 30, 1958; and
WHEREAS, this Board has examined the subdivision map or plat,
together with other details submitted in accordance with the
final layout and has determined that same are satisfactory subject
to the conditions hereinafter recited:

NOW, THEREFORE, BE IT
RESOLVED that the subdivision map or plat entitled, "Sub
division Map of Section 4, Murdock Woods" Town of
Mamaroneck, Westchester County, New York, made by
Sal Spinelli, Land Surveyor, New York State License #23043
and dated March 31, 1958, together with the specifications submitted
and approved by the Town Engineer, are hereby approved pur-
suant to the provisions of Section 276 of the Town Law to the
end that the subdivision map or plat may be filed in the County
Clerk's Office, subject, however, to the following conditions:
(1) That no building permit shall be issued for the con-
struction of houses on any lots of said subdivision
unless or until Split Tree Realty Corporation has
furnished a bond in the sum of $11, 090. 00 for the
completion of such improvements, such bond to
run for a term of three years provided, however,
that the term of such bond may be extended by the
Planning Board, or, at any time during the term
of the performance bond may be modified to an
appropriate amount so that the new face balue of
such completion bond will cover the cost in full of
the improvements required, but taking into account
the improvements already installed, such modifi-
cation or reduction to be made after due public notice
and public hearing, as required under Section 277 of
the Town Law, such bond to be approved by the Town
Board as to the surety.
(2) That Split Tree Realty Corporation shall deliver to
the Town Attorney deeds and/or releases for the
the lands lying in the bed of all streets and highways
and easements as shown on such subdivision map or
plat.
FURTHER RESOLVED that deeds, releases, or grants of street
rights and easements are received solely for the purpose of com-
pliance with Section 277 of the Town Law and Section 3 of the
"Requirements for the Approval of Subdivision Plats in the Town
of Mamaroneck, Westchester County, N Y, " and that the filing
of same shall not constitute the dedication of any streets, highways,
or easements until after the approval by the Town Board, nor
constitute a waiver of the payment of the necessary title charges
and recording fees.

COMMUNICATIONS --TOWN ATTORNEY
The secretary read the following letter dated May 5, 1958,
from the Town Attorney:
I regret not being able to attend your meeting tonight
but the Supervisor has asked me to be present at a meeting
in his office this evening.
I had intended to be at the meeting in connection with
the application of Soundview Woods, Inc. for a third sup-
plemental map. I understand, however, from Mrs. Dammann
that this matter will not come up for a final hearing until a
later meeting.
In the meantime I want to call your attention to the fact
that the second supplemental map and in fact no map should
be filed until after the bond which you require-in this case
$21, 405. 00- has been filed with you and approved by the
Town Board as required by Section 277 of the Town Law.
Until this is done and the deeds for the streets on this map
have been furnished, you should not sign the approval on the
map.
When the final and last supplemental map of Soundview
Woods, Inc. is approved, your resolution should in some
fashion consolidate all of these various applications and I
would like to have the privilege of advising you concerning the
form of resolution to be then adopted.
PLANNING CONSULTANT--MR FRED CLARK
The Board discussed at some length the Revised Proposed
Zoning Ordinance particularly floor area rquirements. Mr. Kane
suggested that when a Public Hearing was arranged , every effort
be made to acquaint the public with the amount of time and thought
that had gone into this Proposed Zoning Ordinance.
Mr. Maggini, Chairman, thought that it might be wise to meet
with the Neighborhood Associations and bus iness groups and
point out to them how their suggestions and criticisms had been

® incorporated, as far as possible and practicable, into the revised
Ordinance. No definite decision was reached as to this matter.
AD JOURNMENT
There being no further business to come before the meeting
it was adjourned at 10:00 p. m. to reconvene June 2, 1958.
