HomeMy WebLinkAbout1955_05_02 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD, HELD MAY 2, 1955, AT POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. The Chairman called the meeting to order at 8:30 P. M. PRESENT: Mr. Wullschleger, Chairman Colonel Shea Mr. Rigano Mr. Maggini Mr. Schuler Mr. Burke Mr. Blair ABSENT: None Presence was also noted of Mr. McEvoy, Building Inspector, Mr. Brush, Councilman, Mr. O'Brien, Superintendent of Highways, and Mrs . Barnes, Secretary to the Board . On motion duly made and seconded, the minutes of the meetings of April 4th and April 18th were approved as presented. The Secretary read the notice of the meeting, which was as follows : PLEASE TAKE NOTICE that GB & EM Realty Corp. , 21 East 40th Street, New York 16, N. Y. , has filed an application for consideration and approval of Plans for the Subdivision of Land known as Subdivision #3 Murdock Woods, which is in Block 304 Parcel 58 on the Tax Assessment Map of the Town of Mamaroneck. TAKE FURTHER NOTICE that the Town of Mamaroneck Planning Board, pursuant to Sections 276 and 277 of the Town Law and in accordance with the Rules and Regulations adopted by it and approved by the Town Board, will hold a public hearing on Monday, May 2, 1955, at 8:30 P. M. , in the room assigned to this Board at Police Headquarters, 11 Edgewood Avenue, Town of Mamaroneck, at which it will consider the proposed Plat or Subdivision Plan as shown on Section 3, Sub- division Map of Murdock Woods in the Town of Mamaroneck, Westchester County, New York, developed by GB & EM Realty Corp. , 21 East 40th Street, New York City, made by S . Spinelli, L. S . , N. Y. S . License No. 230431, dated April, 1955, submitted together with maps or plans showing sewer and drain profiles Section 3 Murdock Woods, made by Carl J. Suhr, P. E. and L. S . License No. 10,317, and also road profile, Section 3, Murdock Woods, made by Sal Spinelli. TAKE FURTHER NOTICE that all persons present will be given an opportunity to be heard . Mr. Irwin Oster appeared and presented the original tracing of the subdivision map for approval by the Board . There was no opposition to this application and after some discussion, the Chairman declared the hearing closed. -18- Colonel Shea then moved that this meeting be recessed in order that Mr. Wanshel, who represents a group of builders in the Town, might be heard on the subject of the adoption of the Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, New York. At the end of this conference Mr. Wanshel thanked the Board for hearing him and complimented the members on the splendid job done on the Require- ments, etc. , and the Board in turn, complimented Mr. Wanshel on his presentation. Mr. Frank X. O'Donnell, 100 Palmer Avenue, then asked to be heard by the Board . He said that in July, 1953, the Larchmont Civic Associa- tions had submitted a proposition to the Town Board, asking that the Town amend its Zoning Ordinance, bringing it into conformity with the two Villages with respect to apartment houses in the unincorporated Town, i .e. limit them to 2 or 2 1/2 stories, garden type. He was given to understand by the Town Board that this would be on the agenda of the Planning Board, and he would be glad to submit copies of the petition, which is a request or recommendation that when the subject of multiple dwellings is reached, (in this Board 's planning) that they be limited to 2 or 2 1/2 stories. Mr. O'Donnell left copies of this petition with the Secretary. The Board next considered a map which was presented by Mr. Irving Roosin, of the Post Road Building Corp. Mr. Roosin said he had pre- sented the map for filing at the office of the County Clerk, and had been informed that he would need the approval of the Planning Board. After discussion, from which it appeared that the map shows a number of lots fronting on Hommocks Road, an existing street or highway, by reason of which the approval of the Planning Board is not necessary, Mr. Wullschleger was authorized to sign the map as Chairman of the Planning Board, stating that the Planning Board of the Town of Mamaroneck has no jurisdiction over the matter. The map was known as "Resubdivision of Lots 2, 3, 4, 5, and 6, as shown on Subdivision Map of Hommocks Estates, Village and Town of Mamaroneck, Westchester County, N. Y. , and filed June 22, 1950, as Map No. 7112, dated February 23, 1955, and made by Sal Spinelli, L. S . 23043" . The Secretary presented a letter dated May 2nd, from the Town Clerk, acknowledging this Board 's letter of April 19th, and asking for further information as to the cost of the survey, study and report, recommended to be made by Eggers & Higgins on the matter of a new Town Hall. The Secretary was instructed to reply to this letter stating that the Planning Board does not feel that this particular enterprise falls within the purview of this Board . The Board now ended the recess and considered the application of GB & EM Realty Corp. , and after discussion, it was decided to approve the map subject to the following conditions: -19- (1) That the pavement to be laid, shall be 26 feet in width; (2) That curbs be installed along the roadways included in the area to be subdivided ; (3) That the pavement be installed in accordance with paving standards currently prevailing in the Town of Mamaroneck. On motion duly made and seconded, it was unanimously RESOLVED that the map or plat entitled "Plat or Subdivision Plan as shown on Section 3, Subdivision Map of Murdock Woods in the Town of Mamaroneck, Westchester County, New York, developed by GB & EM Realty Corp. , 21 East 40th Street, New York City, made by S . Spinelli, L. S. , N. Y. S . License No. 230431, dated April, 1955" is hereby approved pursuant to Section 276 of the Town Law, provided: (1) That sanitary sewer and storm drains shall be installed in accordance with the plans and specifications submitted by the applicant; (2) That the streets be paved to a width of 26 feet; (3) That curbs be installed along the streets or roadways shown on the map; and (4) That the pavement shall be in accordance with standard specifications and procedure acceptable to the appropriate Town Departments.
