HomeMy WebLinkAbout1955_06_06 Planning Board Minutes MINUTES OF A REGULAR MEETING OF THE TOWN OF MAMARONECK PLANNING BOARD, HELD JUNE 6, 1955, AT POLICE HEADQUARTERS, 11 EDGEWOOD AVENUE, TOWN OF MAMARONECK. The Chairman called the meeting to order at 8:30 P. M. PRESENT: Mr. Wullschleger, Chairman Mr. Maggini Mr. Burke Mr. Rigano Mr. Blair Colonel Shea Mr. Schuler ABSENT: None Presence was also noted of Mr. McEvoy, Building Inspector, Mr. Brush, Town Councilman, and Mrs . Barnes, Secretary to the Board . On motion duly made and seconded, the minutes of the meeting of May 2nd, were approved as presented . The Secretary read the notice of the meeting, which was as follows: PLEASE TAKE NOTICE that A. Poccia & Sons, Inc . , by Alfred J. Poccia, President, residing at 129 Elliot Avenue, Mamaroneck, N. Y. , has filed an application for consideration and approval of plans for the subdivision of land of A. Poccia & Sons. , Inc . , which is in Block 314 Parcel 1 on the Tax Assessment Map of the Town of Mamaroneck. TAKE FURTHER NOTICE that the Town of Mamaroneck Planning Board, pursuant to Sections 276 and 277 of the Town Law, and in accordance with the Rules and Regulations adopted by it and approved by the Town Board, will hold a public hearing on Monday, June 6, 1955, at 8:30 P. M. , in the room assigned to this Board at Police Headquarters, 11 Edgewood Avenue, Town of Mamaroneck, at which it will consider the proposed Plat or Subdivision Plan as shown on Subdivision of Property Belonging to A. Poccia and Sons, Inc . , in the Town of Mamaroneck, Westchester County, N. Y. , made by Thomas J. McEvoy, N. Y. S . 21387, and dated November 30, 1954, County Block 3960, Sheet No. 36. TAKE FURTHER NOTICE that all persons present will be given an opportunity to be heard . BY ORDER OF THE TOWN OF MAMARONECK PLANNING BOARD, A. E. WULLSCHLEGER, Chairman Dated: June 1, 1955 The Secretary presented the affidavit of notice of publication of the above notice. Mr. Alfred Poccia appeared and was questioned by the Board members . -22- There was no opposition to this application. After some discussion, the Chairman declared this hearing closed . Mr. Winton L. Miller, 125 Weaver Street then appeared and said he wished to bring to the Board certain information concerning Block 410 Parcel 321 which, he said, "is a piece of 'A' property which is being used in a commercial way. My purpose in being here is to make sure that this Planning Board is aware of this situation because I and a number of other property owners are protesting the driveway and so that the Supervisor cannot say this is a matter for the Planning Board, I am bringing it to your attention tonight. It is 'A' property and a driveway has been put in." Mr. Miller went on to say that he is desirous of having this matter put before the Boards in the Town which would be concerned. He concluded by saying, "it would seem to me that the Zoning Board would be interested in the illegal use of land . We are all citizens of Larchmont, interested in maintaining homes ." The Board now went into executive session and considered the application of A. Poccia & Sons, Inc . , and after discussion, it was decided to waive the Board's requirement of curbing but that Mr. Poccia must conform with the requirement calling for 26-foot pavement (his map showed 24-foot pavement) On motion duly made and seconded, it was unanimously RESOLVED that the map or plat entitled "Subdivision of Property Belonging to A. Poccia and Sons, Inc . , in the Town of Mamaroneck, Westchester County, N. Y. , made by Thomas J. McEvoy, N. Y. S . 21387, and dated November 30, 1954, Councy Block 3960, Sheet No. 36" is hereby approved pursuant to Section 276 of the Town Law, provided that the streets be paved to a width of twenty-six (26) feet. FURTHER RESOLVED that the waiving of the curbing in this instance is not to be considered as a precedent. The Board next took up the matter of the approval of its "Requirements for the Approval of Subdivision Plats in the Town of Mamaroneck" and on motion by Colonel Shea, seconded by Mr. Burke, it was unanimously RESOLVED that this Board hereby approves the "Re- quirements for the Approval of Subdivision Plats in the Town of Mamaroneck, Westchester County, New York" , prepared by this Board and published in the form of a Notice of Public Hearing for the meeting of March 7, 1955; and IT IS HEREBY DETERMINED AND STATED that the Town of Mamaroneck Planning Board 's "Requirements, etc ." shall constitute the requirements for the approval of sub- division plats in the Town of Mamaroneck, in all future proceedings had before it, subject to approval by the Town Board. -23- FURTHER RESOLVED that the Town of Mamaroneck Planning Board 's REQUIREMENTS FOR THE APPROVAL OF SUBDIVISION PLATS IN THE TOWN OF MAMARONECK, WESTCHESTER COUNTY, 1 NEW YORK, be and they hereby are referred to the Town Board for its approval in accordance with Section 272 of the Town Law. The Secretary was instructed to have proofs made by the Printer and after approval by the Town Board they will printed in final form.
